CasemeNt wiNdows For top-to-bottom unobstructed views and wide-open ventilation, you can’t beat casement windows. They’re hinged on the side, and the entire sash swings outward to open. Clean lines, smooth operation and easy cleaning make casements a favorite around the country.

awNiNG wiNdows Awning windows are a great choice when you want the fresh air of an open window even if it’s raining. They can be used alone, but are most often stacked, combined in a grouping, or placed underneath a large picture window to provide ventilation.

double huNG wiNdows Perhaps because it’s the most traditional window, the double hung is also the most popular window. It can open from the top or bottom, and features tilt in sashes for easy cleaning.

horizoNtal slidiNG wiNdows For a more unique style and a slightly more contemporary look, try horizontal sliding windows. They’re a good alternative for locations where you don’t want the sash of a casement or awning window sticking out in the way—on your deck or walkway, for example. But that’s merely a practical reason for choosing them. Many people simply prefer the clean lines and smooth, gliding operation of a “slider.”

fixed-lite aNd GeometriC shaPe wiNdows Special window shapes can give your home a unique individuality. It could be a large picture window, transoms stretching from wall to wall above a bank of patio doors, or an arched expanse of glass that seems to light up an entire home. Fixed-lite windows can be used alone, or combined with other windows or patio doors.

bay, bow aNd GardeN wiNdows Bay, bow and garden windows make a room seem larger. With their multi-unit configurations, they create the feeling that the great outdoors is actually part of the room. A bay usually consists of a large fixed window between two casement or double hung units. A bow consists of several casements or double hung units mulled together, creating a smooth arc or bow. The garden window configuration allows added sunlight from nearly any direction.

slidiNG Patio doors Sliding patio doors are a great space-saving option compared to swinging doors. One panel is operable, the other is fixed. They are easily combined with additional doors, sidelites and transoms.

I. AWS’S EXPRESS WARRANTIES.This Limited Warranty covers Astoria, Colony, Excel, and Impact vinyl window and vinyl door products (“New Construction Prod-ucts or NC Products”) of American Weather-Seal Company (“AWS”) which are manufactured on or after the effective date noted hereon, subject to the conditions and restrictions contained below, except for AWS NC Products which may be specifically sold subject to other written limited warranty terms or which are specifically identified as being sold “as is.” This Limited Warranty is available only to the per-son to whom the AWS NC Products were originally sold for purposes other than resale (the “First Purchaser ”) and is not transferable.

A. Lifetime Limited Warranty: Residential Buildings. For any AWS NC Products which are installed in a single family detached dwelling unit (a “Residential Building”), this Limited Warranty cov-ers, as follows:

1. Vinyl Components and Hermetic Seal. AWS warrants that the Vinyl Components of its AWS NC Products, other than factory paint-ed Vinyl Components, will not crack, rot, blister, pit, peel, flake, corrode, or rust for as long as the product is owned by the First Purchaser. In addition, AWS warrants that insulated glass glazed in AWS NC Products shall be free from any material obstructions of vision due to fogging occurring between the interior glass surfaces that result solely from a failure of the hermetic seal for as long as the product is owned by the First Purchaser, unless the failure of the hermetic seal is caused by glass breakage. In the event any AWS NC Product fails to conform to the express warranties described herein during the first twenty (20) years after the date of manufacture, First Purchaser’s sole and exclusive remedy is that AWS will, at AWS’s sole option and discretion, either repair or provide replacement product or part for defective materials or AWS will refund the original pur-chase price or original catalog list price of the defective product or part thereof. After twenty (20) years from the date of manufacture, AWS’s obligations under this warranty shall be limited to granting a credit equal to 30 percent of the then current list price of comparable new AWS replacement materials, to be used toward a purchase by First Purchaser of comparable new AWS replacement materials or whole replacement product.

2. Glass and Operating Hardware. AWS warrants that its glass shall be free from any material obstructions of vision due to glass de-lamination, and AWS warrants that its Operating Hardware (consist-ing of sash locks, roto operators, balances, and lock sets) shall be free from defects in materials or workmanship for as long as the product is owned by the First Purchaser. In the event any AWS NC Products fail to conform to the express warranties described herein during the first ten (10) years after the date of manufacture, First Purchaser’s sole and exclusive remedy is that AWS will, at AWS’s sole option and discretion, either repair or provide replacement product or part for defective materials or refund the original purchase price or original catalog list price of the defective product or part thereof. After ten (10) years from the date of manufacture, AWS’s obligations under this warranty shall be limited to granting a credit equal to 30 percent of the then current list price of comparable new AWS replacement materials, to be used toward a purchase by First Purchaser of compa-rable new AWS replacement materials or whole replacement product.

B. Ten (10) Year Limited Warranty: Commercial Buildings. For any NC Products which are installed in a structure which is other than a Residential Building (a “Commercial Building”), AWS war-rants, for a period of ten (10) years from the date of manufacture and only while installed in the structure of first installation, that its Vinyl Components, other than factory painted Vinyl Components, will not crack, rot, blister, pit, peel, flake, corrode, or rust, that the insulated glass shall be free from any material obstructions of vision due to delamination or fogging occurring between the interior glass surfaces that result sole from a failure of the hermetic seal, unless the failure of the hermetic seal is caused by glass breakage, and that its Operat-ing Hardware shall be free from defects in materials or workmanship.

C. Five (5) Year Limited Warranty: Painted Vinyl Components. AWS warrants that its factory painted Vinyl Components will not crack, rot, blister, pit, peel, flake, corrode, or rust for a period of five (5) years from the date of manufacture of the NC Product.

D. Two (2) Year Limited Warranty: Other Parts and Accessories. AWS warrants that its metal, wood, nylon, and vinyl accessory parts, storms, and any other NC Products part not otherwise specifically referred to elsewhere, herein, shall be free from defects in materials or workmanship for a period of two (2) years from the original date of manufacture of the NC Product. II. LIMITATIONS AND DETAILS OF AWS’S EXPRESS WARRANTIES.

A. AWS windows and doors are manufactured to certain specifica-tions and ratings (including air and water infiltration and structural performance). The performance of installed windows and doors can and will change over time due to environmental conditions, installa-tion technique, maintenance, normal wear and tear and other factors beyond AWS’s control. The initial ratings and specifications are furnished solely to assist the purchaser in comparing products at the time of purchase and are not meant to warrant or guarantee specific field performance at those ratings or specifications over the life of the product.

B. AWS will not be liable for, and none of the above warranties apply to or cover problems, costs or losses caused by, arising from, or related to, any of the following:

1. Improper installation, including failure to follow manufacturer’s guidelines and/or failure to install in conformance with accepted construction practices or applicable building codes;2. Improper or inadequate flashing, or other defects in construction;3. Any size units having any dimensions greater than those listed in AWS’s standard catalog;4. Installation of products in applications or environmental condi-tions above certified performance levels or exceeding design stan-dards;5. Any AWS products installed in any face barrier system or exterior insulation finish system using synthetic stuccos, unless the Purchaser proves that there is an effectively engineered system for the control and drainage of water or moisture vapor;6. Installation other than vertically (slope glazing);5. 8. Obstructions of air flow to products, including draperies or storm panels;9. Scratches, imperfections or blemishes that do not impair the integrity of the unit, or were not caused by AWS, or which are not discernable within the central viewing area at a distance greater than 6 feet or outside the central viewing area at distance greater than 12 feet, when viewed at 90 degrees under normal daylight conditions;10. After market tints, films or coatings applied to glass surfaces;11. Door warpage of less than _” as measured across the diagonals;12. Weathering or wood discoloration;13. Painting or staining of vinyl parts or weather-strip;14. Variance in color, grain or texture, and normal wear or discolor-ation of interior or exterior finishes;15. Discoloration or weathering of hardware finishes;16. Loss of functionality of hardware (except for seacoast hardware) in highly corrosive environments, including but not limited to loca-tions within two miles of salt water and any home located in the state of Hawaii;17. Power washing, or any abuse, misuse, or alteration of any prod-uct;18. Exposure to chemicals, chemical fumes or other corrosive sub-stance or corrosive environments;19. Stress cracks or other problems due to stress or strain due to building movement or settlement;20. Glass breakage;21. Screens (NOTE: Screens are intended solely as protection from insects and are not intended to provide safety protection or to pre-vent falling through an open window.)22. Any air or water infiltration/damage on non-factory mulled or non-AWS setup units;23. Any non-AWS product or component unless specifically identi-fied herein;24. Damage that occurs during delivery by someone other than AWS;25. Damage as a result of normal wear and tear;26. Natural causes and/or natural disasters, including tornadoes, hurricanes, typhoons or hurricane or typhoon conditions;27. Acts of God, war or civil unrest.

C. Your AWS product may contain inert gas, intended to improve the thermal performance of the product. However, the best manu-facturing techniques cannot guarantee that the initial fill rate of inert gas will be maintained during the product’s lifetime and AWS makes no such guarantee. If the product is fitted with a capillary tube, it must be treated as if it is entirely air filled. AWS does not guarantee the presence of inert gas or any thermal performance related to inert gas.

D. This warranty is effective as of December 1, 2007. This war-ranty gives you specific legal rights and you may also have other rights that may vary by state or country.

III. WARRANTY RESOLUTION.Except as otherwise provided, in the event the product fails to conform to the express warranties described above within the stated time period, First Purchaser’s sole and exclusive remedy is that AWS will, at AWS’s sole option and discretion, either repair or provide replacement product or part for defective materials or refund the original purchase price or original catalog list price of the defective product or part thereof. Current design may be substituted for the original. If the remedy selected is replacement of defective products or parts thereof, AWS will pay for the freight to deliver thereplacement materials to the place where the defective products or parts thereof were first delivered from AWS’s factory. Any freight or delivery charges beyond that destination will be First Purchaser’s

responsibility. In no event shall AWS be responsible to pay for any handling labor, removal, disassembly, assembly, refinishing, or instal-lation costs. Provision of replacement parts does not extend the warranted time period for any product.

IV. NO INCIDENTAL OR CONSEQUENTIAL DAMAGES.

IN NO EVENT SHALL AWS BE LIABLE FOR ANY DIRECT, IN-DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAM-AGES OR LOSSES. IN NO EVENT SHALL THE AMOUNT DUE HEREUNDER BE IN EXCESS OF THE DEFECTIVE UNIT’S PURCHASE PRICE, WHETHER THE CLAIM IS FOR BREACH OF WARRANTY OR NEGLIGENCE OR OTHERWISE. SOME STATES DO NOT ALLOW FOR THE EXCLUSION OR LIMITA-TIONS OF INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES OR LOSSES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

V. NO IMPLIED WARRANTIES.

TO THE MAXIMUM EXTENT ALLOWED BY THE LAW, THE EXPRESS WARRANTIES SET FORTH HEREIN ARE IN LIEU OF ALL OTHER IMPLIED WARRANTIES OF ANY KIND (EXCEPT THE IMPLIED WARRANTY OF TITLE), INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANT-ABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, AND ALL SUCH IMPLIED WARRANTIES ARE HEREBY DIS-CLAIMED AND EXCLUDED BY AWS. THE DURATION AND TERMS OF ANY IMPLIED WARRANTY THAT IS NOT EFFEC-TIVELY DISCLAIMED BY THIS PARAGRAPH SHALL BE THE SAME AS THE DURATION AND TERMS OF AWS’S EXPRESS WARRANTIES DISCUSSED ABOVE. HOWEVER, SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

VI. RESPONSIBILITIES OF FIRST PURCHASER.

Any First Purchaser seeking remedies under this limited warranty must notify AWS, in writing, within 30 days after discovering a possible non-conformity or possible defect in any NC Products, and before beginning any permanent repair. This written notice should describe the possible non-conformity and must include the date the NC Products were installed. In addition, immediately upon discov-ering any possible non-conformity or defect in any NC Products, the First Purchaser must make any temporary repairs or take such other actions as may be necessary to prevent additional loss or damage. In addition, any First Purchaser seeking remedies under this limited warranty must allow an AWS agent, if so requested by AWS, to enter any property on which the NC Products are installed, to inspect any such possible non-conformity or possible defect. The failure of First Purchaser to provide written notice or access to property as described above may, at AWS’s sole discretion, void and/or waive any responsibilities AWS may have to First Purchaser under this limited warranty.
