Before doing so, it provides an account as to why the environment has so far been mostly neglected in IHL. In this respect ecofeminism provides a useful theoretical framework. By feminising the environment, ecofeminism provides a narrative of the environment's relative neglect in certain fields (including the regulatory field). This explanation is necessary if we are to understand how we have arrived at this point, and whether a broader change of attitude towards the environment is necessary not only to ensure a regime is ever put into place, but that it is also embraced by States and becomes effective. 363.7/156

Assessing the complex normative pluralism in humanitarian crises : do local norms matter ? / Joris Kocken. - Cambridge : Cambridge University Press, 2015. - p. 228-249. - In: Humanitarian action : global, regional and domestic responses This chapter discusses eight normative regimes that play an important role in the lives of victims of man-made humanitarian crisis. The eight regimes are six different international legal or quasi-legal regimes and two national and local normative regimes. The claim put forward is that the different normative regimes that try to influence the position of victims, compete with each other for dominance but fail to establish a coherent set of rights for the victims. Therefore, the problem is not the lack of enforcement, although a huge problem in itself, it is that there is no clear and coherent set of norms that can be used to improve the situation of these victims. The eight regimes discussed are public international law in general, humanitarian law, human rights law, rule of law projects, legal empowerment projects, sets of rules brought in by the international organisations and western NGOs that intervene in humanitarian crisis, national legal systems and local or customary law systems. 361/621

When these values were further defined and formalised in the 1949 Geneva conventions, they included a commitment to protect civilians, based on the assumption that states behave in a civilised manner, that non-state actors are only marginally relevant, and that states can be trusted to provide security, allowing humanitarians to focus on relief. This normative framework has since lost all relevance. It is argued that the renewal of hostilities that took place in Colombia since the end of peace dialogues in 2002 had a twofold effect: On one hand, it made the ICRC’s choice of prioritising gaining access to victims over denouncing abuses by parties to the conflict even starker. To be sure, it made it more difficult for the organisation to find an area of overlap or intersection between these two goals. On the other hand, given the nature of that choice, it forced the organisation to be more vocal and public about the scope and limits of its activities under these new circumstances. First, the author explains how this change in the dynamics of the Colombian conflict unfolded. Second, how this new situation led to a more difficult scenario for humanitarian action by the ICRC. Third, the role of the ICRC in kidnap cases and in the debate about the nature of the Colombian conflict illustrates how the organisation opted for gaining access over denouncing government and guerrilla abuses, and how it communicated the nature and dimensions of its role. The virtual impossibility of peace negotiations made the hostage situations even more uncertain and this pushed the ICRC to make extra efforts to provide them with basic care, to create conditions for their release,

Secondly, the humanitarian agenda of the OAS in the context of armed conflicts and natural disasters is addressed. The regional institution has assumed dsome humanitarian tasks with regard to armed conflicts and its member states have proclaimed that the OAS should support the prevention of, and humanitarian response to, natural emergencies. However, its past and scheduled humanitarian activities also demonstrate that the authority of the OAS in the field of humanitarian action is subject to some significant limitations. Thirdly, the contributions of the Inter-American human rights system are discussed. Although the American states have not entrusted many humanitarian responsibilities to the OAS, they no longer have the absolute right to refuse humanitarian assistance in times of armed conflict or in the aftermath of a natural disaster. 361/621

Malgré l'image de réussite qui auréole le processus de paix en Irlande du Nord, couronné en 1998 par l'Accord du Vendredi saint, la violence a laissé d’importantes séquelles humanitaires. C’est dans les années 1950 déjà que le Comité international de la Croix-Rouge (CICR) publiait les Commentaires des Conventions de Genève de 1949 et dans les années 1980 qu’il leur adjoignait les Commentaires des Protocoles additionnels de 1977. Depuis, les Conventions et leurs Protocoles n’ont cessé de faire leurs preuves et l’on a acquis une pratique considérable en matière d’application et d’interprétation de ces six traités. Through a comprehensive examination of the IHL defining a legitimate target of attack, Dill reveals a controversy among legal and military professionals about the 'logic' according to which belligerents ought to balance humanitarian and military imperatives: the logics of sufficiency or efficiency. Law prescribes the former, but increased recourse to international law in US air warfare has led to targeting in accordance with the logic of efficiency. The logic of sufficiency is morally less problematic, yet neither logic satisfies contemporary expectations of effective IHL or legitimate warfare. Those expectations demand that hostilities follow a logic of liability, which proves impracticable. Much of the argument revolves around whether such machines would be able to uphold the principle of noncombatant immunity. However, much of the present debate fails to take into consideration the practical realties of contemporary armed conflict, particularly generating military objectives and the adherence to a targeting process. This paper argues that we must look to the targeting process if we are to gain a fuller picture of the consequences of creating or fielding lethal autonomous robots. This paper argues that once we look to how militaries actually create military objectives, and thus identify potential targets, we face an additional problem: the Strategic Robot Problem. The ability to create targeting lists using military doctrine and targeting processes is inherently strategic, and handing this capability over to a machine undermines existing command and control structures and renders the use for humans redundant. The Strategic Robot Problem provides prudential and moral reasons for caution in the race for increased autonomy in war.
