LETTER FROM THE EXECUTIVE DIRECTOR

I am very pleased to present the Northern California Innocence Project’s Fiscal Year 2013-2014 Annual Report.

This has been a phenomenal year for NCIP. On the legal front, NCIP handled 755 new requests for assistance and George Souliotes walked free. The NCIP law school clinic was revamped to a two-semester course that deepened the experience for our students. Governor Brown signed two NCIP-supported bills – one to prevent false confessions of juveniles accused of murder by requiring that police departments videotape these interrogations; the other to make it easier for the wrongfully convicted to receive the compensation to which they are entitled. Close to 200 people – the majority from law enforcement – attended NCIP’s Eyewitness Identification Best Practices Symposium, where they heard from district attorneys,

police chiefs, researchers and advocates about how wrongful convictions can be prevented. NCIP completed an extensive strategic planning process that produced a five-year Strategic Plan and one-year Operating Plan. And NCIP took a significant step toward long-term financial sustainability by starting a reserve fund consisting of this year’s $312,867 budget surplus.

We at NCIP are extremely grateful to all those who made our success possible this year: our staff, students, clients, volunteers, donors, partners, advisory board, Dean Lisa Kloppenberg and Santa Clara University School of Law, and Father Michael Engh and Santa Clara University.

Together, we are realizing NCIP’s mission to promote a fair, effective and compassionate criminal justice system and protect the rights of the innocent.

EXONERATING THE INNOCENTExonerating the innocent has always been NCIP’s central goal. Since its founding in 2001, NCIP has secured the freedom of 17 people. In FY 2013-2014, NCIP received 755 new requests for assistance from indigent California inmates and NCIP lawyers and students spent over 27,000 hours on investigation and casework.

On July 3rd, 2013, NCIP client George Souliotes walked free after serving 16 years in prison. NCIP, together with pro bono partner, Orrick, Herrington & Sutcliffe LLP, dedicated ten years to investigating and collecting evidence to discredit the faulty forensic analysis used to convict him of arson and triple murder in a deadly 1997 Modesto fire. The federal district court found compelling evidence of innocence based on the investigation and ordered a retrial. With just weeks to prepare, another pro bono partner, Morrison & Foerster LLP, volunteered to spearhead the defense trial team. Ultimately, the State of California conceded that it could not prove the fire was deliberately set and Souliotes was released from prison after his attorneys successfully negotiated an agreement to secure his immediate freedom.

Souliotes is now living in Southern California near his sister and is happily reunited with his adult children. Formerly a professional ballroom dancer, he still frequently dances for exercise, and is looking forward to doing some construction work with his son over the next year.

ENSURING EXCELLENCE IN CLINICAL EDUCATIONNCIP’s clinical program is one of the top programs in the nation. More than 700 Santa Clara Law students have graduated from NCIP since 2001. NCIP’s clinical students master key lawyering skills while also developing a clear sense of their ethical obligations as future lawyers.

This year the NCIP clinic was revamped so that students take the course for two semesters, instead of just one. This provides a deeper educational experience for students and greater support to clients.

“With the yearlong course at NCIP I felt I had an opportunity to actually accomplish something in the cases I was working on.” said Reed Wagner, NCIP yearlong clinic student. “The nature of habeas is so complex that if I had only been involved for a semester, I would have gotten great skills, but I wouldn't have had the rewarding opportunity of applying them.”

REFORMING CRIMINAL JUSTICE POLICYThe Northern California Innocence Project was instrumental in passing two crucial pieces of California legislation that were signed by Governor Brown in 2013. The first bill, SB 569, sponsored by Sen. Ted Lieu, helps to prevent false confessions by juveniles accused of murder by requiring that police departments videotape these interrogations. The second bill, SB618, sponsored by Sen. Mark Leno, streamlines the process for the wrongfully convicted to receive compensation for their erroneous convictions. NCIP exonerees Maurice Caldwell and Franky Carrillo traveled to Sacramento to testify and urge state representatives to pass these bills.

NCIP also began work on two bills for the following legislative session, sponsoring SB 1058 and SB 980. SB 1058 is designed to help exonerate innocent men and women who were wrongfully convicted based on outdated expert testimony; NCIP exoneree George Souliotes testified at the state capitol to support this bill. SB 980 is designed to improve the process for wrongfully convicted prisoners to obtain DNA testing to prove their innocence.

BUILDING A CUTTING-EDGE TRAINING INSTITUTENCIP has established itself as an expert on eyewitness identification, one of the leading causes of wrongful convictions. On May 21, 2014, NCIP hosted a highly successful Eyewitness Identification Best Practices Symposium, in partnership with the International Institute of Criminal Justice Leadership at the University of San Francisco (USF). Nearly 200 people attended the symposium, two-thirds of whom were prosecutors or law

enforcement. The audience also included criminal defense attorneys, civil rights attorneys, forensic scientists and others. The symposium, sponsored by a Flom Incubator Grant from the Skadden Fellowship Foundation, featured Santa Clara District Attorney Jeff Rosen, San Francisco District Attorney George Gascon, and Alameda District Attorney Nancy O’Malley; San Francisco Police Chief Greg Suhr, Los Gatos Police Chief Scott Seaman, and El Cerrito Police Chief Sylvia Moir; criminal justice reform and victims advocate Jennifer Thompson; and Dr. Jennifer Dysart, one of the leading researchers on eyewitness identification. 84% of attendees graded the symposium as outstanding or very good and 97% of respondents stated that they were very likely or likely to attend future NCIP symposia. The symposium led some jurisdictions to immediately make changes to their existing procedures. NCIP also presented on eyewitness identification best practices to the Alameda County Chiefs of Police and Sheriff ’s Association at their annual conference.

ENSURING ORGANIZATIONAL EFFECTIVENESS AND SUSTAINABILITYThe Northern California Innocence Project completed a comprehensive strategic planning process and published the resulting five-year Strategic Plan in January 2014. As part of the process, NCIP staff identified 25 stakeholders to provide valuable input about NCIP through one-on-one interviews. The resulting Strategic Plan outlines key findings from the stakeholder interviews, sets out NCIP’s new mission and vision, and provides organizational goals, strategies and objectives that will guide NCIP’s work for the next five years. The Strategic Plan can be found on NCIP’s website at www.ncip.scu.edu. To implement the Strategic Plan, NCIP also completed a one-year Operations Plan, which is reviewed and revised quarterly to ensure accountability.

Seeking to further increase organizational effectiveness and sustainability, NCIP developed a new organizational structure. The organizational restructuring was completed in April of 2014, with the creation of three new positions: Operations Director, Communications Director and Assistant Legal Director.

Strategic Plan 2014–2019

Key Findings

The first phase of Northern California Innocence Project’s strategic planning process –which spanned May through November 2013 — was an assessment of the organization’s external environment and internal operations . A detailed PowerPoint presentation was developed based on this assessment . The key findings from the assessment are summarized below .

MethodologyA team from Hernandez & Associates began the assessment by reviewing a wide range of current and historical organizational documents, such as advisory board meeting minutes, drafts of strategic planning documents produced in prior years, results from an online survey of stakeholders conducted several years earlier by a consulting group, financial documents, internal memos, and funding proposals produced within the last few years . These documents helped to illuminate many of the opportunities and challenges facing the organization and offered some preliminary insights about strategies NCIP’s leadership hoped to pursue .

The team also developed several iterations of an organizational logic model to document the relationship between NCIP’s mission and the resources and strategies employed to achieve the organization’s desired impact . This proved particularly useful in teasing out some of the underlying assumptions associated with teaching an innocence clinic and processing wrongful conviction cases .

To gather in-depth information from internal and external stakeholders, NCIP’s Executive Director and staff identified a broad spectrum of individuals who they thought could provide valuable input about NCIP through one-on-one interviews . Targeted interviewees included NCIP advisory board members, Santa Clara University administrators, criminal justice reform advocates, directors of other innocence projects within the national network, local law enforcement, and faculty from other universities with expertise in clinical education . Extensive input was also gathered from staff through two staff retreats and numerous workgroup sessions to delve into the priority issue areas that were identified at the first retreat .

JUSTICE FOR ALL AWARDS GALANearly 400 supporters came out to honor exonerees and award recipients at the Northern California Innocence Project’s seventh annual Justice for All awards dinner, held on Thursday, March 27, 2014 at the Hotel Sofitel in Redwood City. The 2014 award recipients included:

James Brosnahan, a Morrison Foerster partner and legend of the trial bar, who stepped in with his team, just weeks before trial to represent Mr. Souliotes and won the key legal arguments that secured his immediate release.

Denise Foderaro, whose leadership and unwavering determination to exonerate the wrongfully convicted and make policy changes to prevent future wrongful convictions inspires others to act on behalf of the wrongfully convicted.

Police Chief Scott Seaman, a tireless advocate for improving the methods law enforcement agencies statewide use to collect and preserve eyewitness identification evidence.

George Souliotes, NCIP client who was freed after 16 years of incarceration for an arson and triple murder he did not commit.

The annual gala, which was hosted by MC Hammer, showcased the inspiring stories of NCIP’s amazing exonerees, tireless advocates, and the many who continue to work for critically needed policy reforms.
