I hope this finds you well and in good spirits, as we are now nearly three quarters through 2011. It has been a bumpy ride, but all of you with whom I have had the pleasure to meet and speak with have been optimistic and hopeful for

the future, and I concur.The NCHBA Executive Committee, staff and standing

committees have been busy working to complete the goals and objectives of the Strategic Plan adopted at the 2010 fall planning retreat. Many of these have been accomplished and some are ongoing for the next few years. Details and progress reports will be posted on the NCHBA web site and discussed in NCHBA Monday Briefing. I want to thank all those members and staff that work tirelessly to make this possible. A few of the most significant items that you can benefit from now are:

1. A new user-friendly NCHBA web site with a private Members Only section (your password was included in the 21st Century Builder Expo and Conference announcement Email [email protected] or request the password.).

2. NCBI discounted courses that can be held at your local HBA or in your region this year only.

3. Membership retention through the NAHB Touch Program. NCHBA provides financial assistance to associations of 300 members or less (based on NAHB membership numbers as of 12-31-10) to participate in this program. If your local HBA has not yet signed up for this beneficial program, please encourage your Board and EO to do so immediately. Contact NCHBA Director of Membership Services, Kathryn Atkinson, for full details on the Touch Program and available financial assistance.

4. Our top ten legislative victories that save you tens of thousands of dollars for every home you build

(see the top ten legislative victories in NCHBA Monday Briefing).

Another NCHBA member benefit is the upcoming 21st Century Building Expo and Conference in Charlotte from September 14-16. If you haven’t yet registered, please do so now. A few highlights of the 21CBEC include: the STARS Awards Gala honoring the best of the best in every category of our industry; educational classes equal to the quality

found at the International Builders Show, including those needed to achieve Builder and Associate designations; and an Exhibit Hall offering the latest new building systems and materials. Everyone who has attended in the past has received knowledge and found products that have improved their business operation and profitability. Once here, participate in the 3rd Quarter Board of Directors meeting on September 17 to be a part of key decisions being made. Whether you are a large or small company, your view point is important to give NCHBA the knowledge and balance to make decisions that affect our industry, and ultimately the NC economy, in a positive way.

“Member Value” is a term we use to describe a variety of ways. We, as members of NCHBA, benefit from our membership. Though one benefit may hold more importance to you than another, I believe we all can agree that establishing and maintaining a business-friendly environment and stopping or reversing unnecessary or excessive regulation is paramount for our industry. Failure in this arena is not an option. Tens of thousands of dollars per home are at risk on this issue. Our Government Affairs staff, Lisa Martin and Jessi Hayes supported by Mike Carpenter, are the best at what they do and have the respect and trust of our legislators. They need your help to maintain the success they’ve achieved. Contributing to NC BUILD-PAC is your way to help them maintain access to key legislators, aid the re-election efforts of those who support our housing issues, and help elect pro-housing candidates to replace those who don’t. I am asking everyone to donate a minimum of $10. Many have done much, much more. If you have already contributed, thank you, and I ask you to encourage your fellow members to do so. If you have not yet given, I ask you to do so today. It’s as easy as clicking the Donate Now button on the NCHBA web site under the NC BUILD-PAC tab or in the Monday Briefing. Never has so little allowed so much to be done for you and your business. I thank you in advance for your contribution.

Housing starts and sales have rocked along the bottom for most of this year. Many potential home buyers have decided to wait and see if the home prices are really at the bottom before they buy. One way you might persuade them to buy now is to enlighten them about the relationship between interest rate and home price. In 1st Quarter of 2007, the median national home price was $235,257 and the interest rate was 6.55% for a 30-year fixed mortgage. The median household income could only qualify for a $173,454 home. In 1st Quarter of 2011, the national median home price was $187,500 and the interest rate was 4.5%. The median household income could qualify for a $203,000 home. The message is buyers have unprecedented home buying power now with this low interest rate environment. Avoiding even a slight rise in interest rate is more important than waiting to see if home prices decline. Run the math in your area and use this as a buy now tool. Our industry continues to face tough times. For too long, NCHBA members have struggled to hang on to their businesses and make a living building homes and supplying goods and services for those

homes. Thankfully, North Carolina’s home building industry has fared much better than in other parts of the country. Recent economic reports I’ve seen indicate that many economists believe the worst is behind us.

For eight years now, your state home builders association has been hosting the 21st Century Building Expo & Conference (21CBEC). This event is one of the most important benefits we offer our members, and I hope that you will join us September 14-16 at the Charlotte Convention Center. You will have the opportunity to gather with other industry professionals from across the Southeast for education and networking. I have no doubt that you will leave the 21CBEC with ideas and techniques that will position your company so that it is ready to take advantage of an improving market. There are a variety of ways to participate in the 21CBEC, including options for every budget.

EducationalConferenceThe 21CBEC provides the best educational conference experience

in the Southeastern United States with more than 50 courses and seminars being offered over three days. These cutting-edge NCBI, NAHB, and general session courses will be taught by experts who will provide information that will be useful in helping you survive. Many of these instructors have presented these same courses at the International Builders Show and at other events across the nation.

I invite each of you to read through our conference schedule found on page 8. In selecting our conference schedule, our goal was to offer courses and seminars that will allow you to gain critical knowledge about the current marketplace and learn how best to position your company in a way that will significantly increase your prospects for success.

A few highlights of the educational conference include: • Green Building for Building Professionals and Basics of Building will

be offered for those interested in earning your Certified Green Professional designation. More than 500 builders in North Carolina hold this useful and popular designation. These are the only courses required to earn the designation.

• Two courses for the increasingly popular Certified Aging-in-Place Specialist designation will also be offered: Marketing and Communication Strategies for Aging and Accessibility (CAPS1) and Design/Build Solutions for Aging and Accessibility (CAPS2).

• Our Full Delegate registration for just $85 enables you to take in any of our more than 25 general session seminars. Topics include energy efficiency, marketing strategies, social media, remodeling and more. See page 8 for complete descriptions of all the courses and seminars being offered.

The 21st Century Building Expo & Conference offers three days of seminars and continuing education courses taught by a faculty of

nationally-recognized speakers and instructors. Our top-notch educational conference will help you expand your business, profitability, professionalism and knowledge. There are three types of educational courses taught at the 21CBEC:

North Carolina Builder Institute (NCBI) courses offer builders and associates a specialized curriculum with tracks in project management, business management, leadership, diversification, building and computer technology, design, customer service and marketing. Achieve your Accredited Builder (AB), Accredited Master Builder (AMB), Accredited Associate (AA), Accredited Master Associate (AMA) or Accredited Residential Superintendent (ARS) designation through this program. These designations are recognized by the N.C. Licensing Board for General Contractors and will appear on your license. Visit the NCBI website at www.nchba.com for more details on the program.

Cost: $90 per 4-hour course; $180 per 8-hour course

NAHB Education courses offer building industry professionals educational opportunities that will further their professional growth and the success of their business. Courses that count

Lead Based Paint Renovation, Repair & Painting Program Training8 a.m.–5:30 p.m.

If you perform repair, renovation or painting in homes built before 1978, you may need training on lead-based paint safe work practices now mandated by the N.C. Department of Health and Human Services. Under the Lead-Based Paint Repair, Renovation and Painting (RRP) program rules in North Carolina, beginning January 1, 2010, dust sampling technicians, firms, contractors, property managers and others performing renovation, repair and painting projects for compensation that disturb lead-based paint in homes and child-occupied facilities built before 1978 must be certified and must follow specific work practices to prevent lead contamination. Examples of groups that may need training include, but is not limited to, carpenters, painters, electricians, sheetrock/drywall installers, plumbers, HVAC, window replacement and maintenance workers. This eight-hour course will fulfill the education requirements of the NC RRP program.

This course will start at the beginning with the basic concept of debits and credits and proceed to develop an understanding of how accounting records are structured and how the records flow into financial statements (balance sheet, income statement, cash flow statement, etc.). Establishing a feasible Fall Protection standard has been an ongoing process for OSHA since 1995. The most recent standards were contained in the 1999 Interim Fall Protection Compliance Guidelines for Residential Construction. Since

that time, OSHA has continued to evaluate the feasibility of the original Fall Protection standard (29 CFR Part 1926, Subpart M). Recently, OSHA rescinded the 1999 directive and implemented the fall protection standard as originally intended.

In response to OSHA’s newly established fall protection standard, which went into effect June 16, 2011, the North Carolina Department of Labor (NCDOL) established and implemented Operational Procedure Notice (OPN) 109B. OPN 109B references and follows many of the guidelines set forth in the OSHA Fall Protection standard (29 CFR Part 1926, Subpart M). However, there are some differences in the state standard.

DefinitionofResidentialConstructionWithin OPN 109B, the NCDOL provides a clear definition of

Residential Construction. The end use of the structure must be as a home or dwelling and the structure must be constructed using traditional wood frame construction materials and methods (limited use of steel I-beams to support wood framing does not disqualify a structure from being considered residential construction).

WhatthismeansforyouAccording to OPN 109B, all companies engaged in residential

construction must follow the OSHA fall protection standard which states that workers “engaged in residential construction activities six feet (1.8 m) or more above lower levels shall be protected by guardrail systems, a safety net system, or a personal fall arrest system,” or by alternative fall protection measures allowed under 1926.501(b) for particular types of work. Alternative methods include:• Controlled access zones and control lines• Covers• Positioning devices• Barricades, fences and covers• Equipment guards • Warning line system and safety monitoring system (combination)

WrittensitespecificplansIf the employer can demonstrate that it is not feasible or creates a

greater hazard to use required fall protection systems, they may instead develop and implement a written fall protection plan. The fall protection

plan does not need to be singularly site specific, but must be applicable to the site, structure and design/elevation for which it is being used. The written plan must be prepared by a qualified person and:• Address all issues related to fall protection at that site. • Be applicable to the site where the work is being performed.• Be maintained up to date and on the site.• Be implemented under the supervision of a competent person.• Include documentation of reasons why conventional fall

protection systems are infeasible.• Include a written discussion of the alternative work practices used

to eliminate or reduce the possibility of a fall (slideguards may be used in conjunction with a written plan only and may not be used when complying with the fall protection standard).

• Include documentation of employee training records. • Identify each location where conventional fall protection systems

cannot be used and designate them Controlled Access Zones (CAZ).• Implement a safety monitoring system where no other alternative

measure has been implemented and identify all workers designated to work in the CAZ.

• Be reviewed and updated as appropriate if an accident, or near miss occurs.

inspectionsThe NCDOL is not going to increase the number of inspections

due to these changes and all fines remain the same. To avoid citations and fines, all companies engaged in residential construction must implement the revised standard. However, if your company is inspected, the NCDOL will consider the following prior to issuing a citation and/or fine:

1. History of inspections2. Effort to comply to the standard3. Proper documentation
