Introduction:

National Glass Centre is part of the University of Sunderland and a visitor

centre, production house and contemporary gallery attracting 280K visitors

per year. Additionally it is home to around 130 students studying glass and

ceramics at BA, MA and PhD levels who enjoy access to a huge range of ‘world

class’ production facilities.

National Glass Centre is committed supporting professional glass and

ceramic artists in the production of their work through the provision of

affordable access to our specialist facilities. This can be extremely useful to

artists early in their careers when they may not have an established studio, theequipment they require, or for more established artists wishing to undertake

projects that require access to larger equipment.

It is regretted that our facilities are not available for those with limited

inexperience. Hirers are expected to be proficient in the use of all materialsand equipment they intend to use.

Prior to hire artists are expected to supply an electronic copy of a valid Public

Liability Insurance with a minimum cover of £2M. If more than one person is

working then a policy/s that covers both parties must be provided. Manyartists subscribe to AN (Artists Newsletter) magazine which currently provides

a suitable policy with an annual subscription (www.a-n.co.uk). There are of

course many alternative insurers.

HIRE PROCEDURE:

Contact Studio to confirm availability of equipment and dates.

Receive a unique booking reference number for the enquiry.

Confirm intention to hire on the agreed date.

Supply Studio with a copy of a suitable Public Liability Insurance policy –this must be provided before hire commences.

New Customers will be e mailed a ‘New Customer Form’. This enablesus to invoice for activities post hire as opposed to requiring full

payment on the day of hire.

Return ‘New Customer Form’ – this only needs doing once.

USE FACILITIES

Discounted offers: if available must be confirmed a minimum of 10 daysprior to the hire.

Once accounts are set up invoices will be issued after hire of hot shops,some kilns and for larger amounts. 30days credit.

Hire of other facilities i.e. cold shops must usually be paid in full on theday. Cards accepted.

National Glass Centre facility hire does not include consumables or technical

support unless agreed in advance. Please let us know is you would like advice

on sourcing materials or equipment.

CANCELLATION:

Please note that cancellations must to be made in writing/e-mail.

In order to benefit from the discounted hot shop offer, bookings must beconfirmed a minimum of 10 days in advance. Cancelations with more than 7days notice will attract a 50% refund.

Hire of hot shop facilities for teaching private classes must be discussed withthe Head of Commissioning & the Studio prior to booking as separate Health& Safety, induction and insurance issues may have to be reviewed.

Conditions of hire - summaryTo be read in conjunction with University of Sunderland terms and conditions (below)

Hot Glass Studio

All hirers and assistants must be inducted into the hot shop and sign the appropriateInduction Forms before working in the Hot Shop.

Hirers must provide a suitable public liability insurance policy for themselves and anyassistants.

A hire session may be terminated, without refund, if any team member believes thathirers, or assistants, are unable for whatever reason to work safely in the hot shop.

Blowing times are strictly 10am until 4.30pm, with a 30 minute lunch break. The Studiowill be available from 9am to set up.

Hot Shop ‘special offer’ is subject to availability and confirmation of booking a minimumof 10 days prior to hire date.

Hot shop cancellation – 50% refund with 7 or more days notice. Hirers are limited to a maximum of 3 discounted hire days in any one calendar month.

There after the Standard Commercial rate applies. Hot shop ‘special offer’ includes 15kg of glass per day. Additional glass is charged at

£3.50+vat per kg. This offer may be terminated without notice. Hot shop ‘Standard Commercial rate’ includes 30kg of glass per day. Additional glass is

charged at £3.50+vat per kg. Additional glass charges will be added to the bill and invoiced accordingly. The Glass Centre does not supply colour, enamels, frits, etc. However we are happy to

provide details of suppliers that may be suitable. Some tools are available but it is advised that hirers’ bring their own if possible. Special requirements, i.e. extended lehr use, top-loader hire, large propane torch or large

glory holes must be requested in advance. Additional fees apply. Only Studio team members may light, adjust or extinguish glory holes. Problems and faults should be reported to a Studio Team member straight away. Mobile phones may not be used in the Hot Shop. Food may not be consumed in the Hot Shop. Work areas and benches must be properly cleared and tidied at the end of each hire

session, tools and pipes put away, and a programme for annealing agreed with a Studioteam member. If any cleaning is left to a Studio Team member a £10.00+vat surchargewill be invoiced.

The Studio accepts no responsibility for goods damaged by events beyond its control, i.e.power failure, mechanical failure, etc...

Other facilities & workshops

Hirers must be formally inducted into each piece of equipment they intend to use beforecommencing work.

Hire of the cold workshop is available in 1 hour increments between the hours of 9amand 5pm, or a full day rate is available – payable in advance at reception.

Half and full day rates are available for other facilities. These are payable in advance atreception.

Cold shop hirers must be inducted into the use of the cold shop prior to use. The ‘basicinduction programme’ covers the flatbed grinder, linishers, sandblaster & polishing lathe.The ‘basic induction’ fee is £10.00+vat.

Inductions must be pre-booked. Induction forms must be signed off before the use of anyequipment.

Hirers may only use equipment they have been inducted on. If Studio staff are not completely satisfied that a hirer/assistants or participants are able

to work in a safe and competent manner they may immediately terminate any hiresession without refund.

NGC accepts no liability for misuse of any equipment or damage to work howsoevercaused.

Hirers will be liable for the repair or replacement cost of damage to equipment. Use of specialist equipment may be negotiated separately. Hire may be arranged through NGC Reception or the Glass Studio. It is advised that

hirers confirm that their preferred time is suitable. Upon arrival hirers must let a StudioTeam member know they have arrived and when they intend to finish.

Hire charges that are not to be invoiced must be paid in full at NGC Reception at the endof each working day or an administration fee £10.00+vat will be charged.

All equipment must be cleaned after use. If a Team Member has to clean up after a hirera £10.00+vat fee will be charged.

Any problems or faults should be reported to a Studio Team member immediately. When using the facilities use the correct PPE (Personal Protective Equipment) and tie

long hair back. If unsure ask a member of the Studio Team for advice. We provide aselection of ear defenders, face masks/safety glasses, aprons and boots. We do notsupply dust masks or respirators.

Aprons, ear protectors and safety glasses are provided & should be cleaned andreturned at the end of the session.

Food must not be consumed in the studios at any time. The NGC accepts no responsibility for the safety of tools, equipment, materials or work

left on the premises. Terms and conditions may change without notice.

UNIVERSITY OF SUNDERLAND TERMS AND CONDITIONS OF FACILITY HIRE

General1 Applications for hire should be made in writing on the appropriate forms, and shall specify the purpose for which the premises are required. Provisional bookings may be made by telephone in

the first instance, but must be confirmed in writing within 10 working days or the booking will automatically be cancelled.2 The hirer will use the facilities, and any equipment included, only for the purpose agreed, and only for the period of hire agreed.3 The hirer must ensure compliance with the University’s Code of Conduct for the Protection of Freedom of Speech (made under the Education (no. 2) Act 1986) and other University policies, regulations

or procedures, copies of which are available upon request for inspection at the University’s offices.4 Any failure to comply with these terms and conditions, or any use outside of the agreed purpose may result in an immediate termination of hire and vacation of premises.5 The hirer will retain the facilities in their exclusive control at all times, and is not permitted to assign the hire to any third party during the period of hire.6 The hirer shall leave the facilities, and any equipment, furniture, fixtures, fittings or other articles included in the facilities, in as clean and good order and condition as the same were in at the date of

hire. Where any cleaning is required post hire, the hirer will be charged at an appropriate rate to be determined by the University.7 The hirer shall pay the University for any and all loss or damage to the facilities or part of the facilities and/or any equipment, furniture, fixtures, fittings or other articles included in the facilities,

howsoever caused during the period of hire. The amount of any such loss or damage shall be determined by the University and shall be recovered from the hirer as liquidated damages.8 The hirer shall be responsible for ensuring sufficient personnel are available in order to comply with and perform the obligations imposed under the hire by these terms and conditions.9 No food, intoxicating or non-intoxicating liquors, or other refreshments shall be sold or consumed within the facilities at any time, without the prior consent of the University. Where such consent is

given, additional charges may be made.10 Smoking is NOT permitted on University premises.11 The hirer shall be responsible for maintaining good order and discipline within and in the vicinity of the facilities during the hiring.12 The University reserves the right of entry at all times to the facilities and to require the hirer to refuse admission to, or remove from the facilities, any disorderly person(s) or any article or substancewhich is considered a possible source of damage or danger.13 The facilities are hired as they stand. No furniture or equipment shall either be moved into or removed from the facilities without the prior consent of the University, nor shall the furniture, equipment or

other articles in the facilities be moved or stacked one upon another. If such consent is given, an additional charge may be made for extra work involved in the removal of any furniture or equipment intoor from the facilities.14 The hirer (or an authorised representative of the hirer) is required to liaise with the University’s Facilities staff within the 24 hour period prior to the commencement of the period of hire to ensure

there are no changes to the conditions of hire since the booking was made.15 The hirer shall not close block or obstruct any corridor, internal or external entrance or exit to the facilities. Windows must not be blocked up and neither the hirer nor any other person shall drive any

nails, screws pins or other like articles or instruments into the floor, walls or any part of the facilities or affix any equipment, placard or other articles thereto.16 No parking or unloading shall take place on the facilities or any other part of the University’s premises without the prior consent of the University. The hirer will ensure compliance with any restrictions

imposed in any consent given.17 The hirer shall report any faults, or problems experienced during the period of hire, immediately to the University’s Campus Services staff.18 The hirer shall remove all equipment decorations and other materials introduced into the facilities by or on behalf of the hirer prior to the end of the period of hire.19 If the facilities are not vacated (including the removal of all equipment, decorations and other materials introduced by the hirer) by the end of the agreed period of hire an additional charge may

be imposed.20 If the hirer defaults under conditions 17 and 18 above the University shall be at liberty to move all such items immediately to a covered place and the University shall not be liable for any loss or

damage caused thereby. The hirer shall pay the University the cost of such removal and storage.21 Where any members of the hirer’s party are under the age of 18 or vulnerable adults (or the facilities are hired for a purpose where persons under the age of 18 or vulnerable adults will be present), it is

the responsibility of the hirer to ensure that all members of the hirer’s party are CRB checked and cleared where appropriate and that the hirer complies with the Criminal Justice and Court ServicesAct 2000 and the Safeguarding Vulnerable Groups Act 2006 wherever relevant. Proof of compliance may be requested by the University before the period of hire can commence.

Exclusions and Indemnities22 The University will not, in any circumstances, accept any responsibility or liability for the loss, theft of, or damage to, any goods or property of the hirer or of any other person, left, deposited or

brought onto the premises.23 The hirer shall indemnify the University, it’s officers and servants, against all loss, damage, claims, proceedings, costs, expenses, penalties and demands of any nature whatsoever arising out

of or in any way connected with the hiring, including any personal injury or death.24 The University requires the hirer to effect before the date of hiring a public liability insurance policy (and any other such insurance as may be requested by the University), and to produce a copy

of such insurance policy to the University upon request. Minimum liability cover under each policy to be £5,000,000. (Agreed £2M for Glass Centre hire - Carole McGinn)

Licences/Regulations25 From time to time the University holds Cinematographic, Entertainments, Justices or Magistrates Licences in respect of certain of its facilities (available upon request by the hirer for inspection

at the University’s offices). Where such facilities are hired the hirer must comply at all times with the requirements of the licences and the reasonable requirements of the licensee(s) thereunder.It is the responsibility of the hirer to ascertain whether such licences exist for the facilities hired and if not, to arrange such licences as are necessary for the purpose of the hire prior tocommencement of the period of hire. Proof of such licences must be provided to the University before the period of hire commences, failing which this agreement for hire may be terminatedimmediately by the University.

26 Except where expressly agreed, approval for the use of facilities in which a film exhibition is to be given, whether inflammable or safety film, or any other sort of film is used, or any other type ofprojection, e.g. television, shall not be deemed to authorise any exhibition to which the Cinemas Act and Regulations apply.

27 The Hirer undertakes and is required to obtain all necessary licences for any music or musical compositions which are the subject of copyright or otherwise protected and shall not perform anymusic or musical composition which may be an infringement of any subsisting copyright, and shall indemnify the University in every respect against all actions, claims, demands, damages andcosts which may be occasioned by the failure to observe this condition. Such licences must be available for inspection on the facilities.

Health & Safety28 The hirer must at all times comply with the University’s Health & Safety policies, copies of which are available for inspection upon request at the University’s offices or atwww.sunderland.ac.uk/regulations29 Neither the hirer nor any other person having the use of the facilities shall interfere with the fire health and safety equipment or the gas or electric light fittings or other equipment or fixtures and fittings.30 No equipment requiring attachment to the facilities or connection to the services therein shall be installed except with the express approval of the University and subject to such terms as it may

think fit and under its supervision.31 The hirer will retain the facilities, and any equipment, furniture, fixtures, fitting and other articles included, in their exclusive control at all times during the period agreed and will be responsible

for ensuring that all members of the hirer’s party comply with this obligation. The number in the hirer’s party (or a list of names of members of the hirer’s party where requested by the University)must be supplied pre hire.

32 Where facilities are hired out of normal office hours (Monday to Friday 9.00 am to 5.00 pm), the University may require the hirer to take additional supervision / security measures as the Universitydeems necessary.

33 The hirer will be required to visit the premises pre hire for a Health and Safety induction.34 In accordance with the provisions of the Children and Young Persons Act 1963, in cases where children may be present the hirer must ensure that there are a sufficient number of adult attendants,

properly instructed as to their duties to prevent more children or other persons being admitted to the building or any part thereof than the building or part can properly accommodate, and to controlthe movement of the children and other persons admitted while entering and leaving the building or any part thereof, and to take all reasonable precautions for the safety of the children.

Fees35 Payment in respect of the use of University premises shall be in accordance with the tariff of charges as amended from time to time. The University reserves the right to amend charges after a

booking has been accepted, subject to a minimum of one month's notice, provided no increase will be made where full payment has already been made.36 Unless otherwise agreed by the University, all charges are due within 30 days of the date of the University’s invoice to the hirer. The University reserves the right to require full or part payment

at the time of booking (or within a specified time in advance of the period of hire) and any failure to comply will result in immediate termination of the booking.37 Charges payable for the hire of the facilities are inclusive of all payments for University staff; no additional services from University staff are to be asked by the hirer or any other person using the

University facilities except by prior arrangement.

Special Requirements38 Film: Where the University does not hold a Cinema Licence and the cinema is hired for the purposes of screening a film, it is the responsibility of the hirer to obtain a Cinema Licence (when charging

admission). Proof of Cinema Licence is required prior to the commencement of the period of hire. Where the hirer is not charging admission, the hirer must also ensure that they have rights clearanceto screen the film from the relevant rights holders and have paid the appropriate fees. Proof of rights clearance is required prior to commencement of hire.

39 Theatre: Where the University does not hold a Theatre Licence and the theatre is hired for the purposes of a theatrical performance, it is the responsibility of the hirer to obtain a TheatreLicence (when charging admission). Proof of Theatre Licence is required prior to the commencement of hire.

40 Entertainment: Where the hirer does not fall under conditions 38 and 39 above, but is for the purpose of a performance singing, dancing or playing music, it is the responsibility of the hirer toobtain an Entertainments Licence (when charging admission) where this is not already held by the University. Proof of Entertainments Licence is required prior to the commencement of hire.

41 Performance Rights Society: The Performance Rights Society (PRS) collects and distributes royalties of behalf of the writers and publishers of music. The University holds a PRS licence andis responsible for ensuring that appropriate royalties are paid for music used on its premises and that no infringement of copyright occurs:

(a) Where the hirer uses music in the facilities in a performance or rehearsal during the period of hire, whether it is performed live or played by recorded means and whether admission is charged orotherwise, royalty charges must be paid. These will be paid by the University to the PRS on behalf of the hirer and invoiced to the hirer in addition to the hire charges.

(b) The hirer is responsible for providing details to the University of any music used during the period of hire, including the type of music, dates and times, participant numbers, and any attendancecharges. The hirer agrees to fully and effectively indemnify the University for any loss, damage, claims, proceedings, costs, expenses, penalties and demands of any nature whatsoever arising againstthe University as a result of the hirer failing (whether or not within the hirer’s knowledge) to provide full details under this clause.

(c) All details required under (b) above must be submitted to the University prior to the commencement of hire and then re-confirmed or amended as the case may be by the hirer at the end of the period ofhire.

(d) Please note, in some instances of use of music or musical compositions, prior permission must also be sought from the publisher or copyright owner direct. Determining whether this is required andobtaining any such permission is the responsibility of the hirer prior to the commencement of hire and the indemnity under (b) above applies also as a result of such failure under this clause.

(e) For performances of dramatical and musical works (operas, musical plays, pantomimes and revues on so far as they consist of words and music written expressly for them) and ballet, prior permissionmust be sought from the publisher or rights (copyright or otherwise) owner direct. Obtaining such permission is the responsibility of the hirer and royalties are to be paid direct by the hirer to thepublisher or rights owner as the case may be. The University does not accept any responsibility for failure of the hirer to obtain such permission or pay any such royalties and the hirer agrees to fullyand effectively indemnify the University for any loss, damage, claims, proceedings, costs, expenses, penalties and demands of any nature whatsoever arising against the University as a result of suchfailure (whether within the hirer’s knowledge or not).

Cancellations42 In the event of a booking being cancelled by the Hirer, a cancellation fee will be made as follows:

Less than 7 days prior to the event - 50%43 The University reserves the right to cancel a hiring or terminate a periodic booking at any time subject (except in the case of emergency or an event beyond its control including any form of industrial

action) to one calendar month's notice in writing. In the event of the hiring being cancelled in pursuance of this provision, the hiring fee paid shall be returned, and the Hirer shall have no furtherclaim whatsoever against the University in respect of the hiring or on account of the cancellation thereof.
