NCPA has continued to educate members of Congress and their staffs about NCPA’s legislative priorities and bills. A list of members who are cosponsoring NCPA’s priority legislation is on pages 4–11. These members of Congress support community pharmacy; please continue to support these members of Congress. S. 1190 and H.R. 793, Ensuring Seniors Access to Local Pharmacies Act: These companion bills would allow independent pharmacies the ability to participate in preferred networks if: one or more of their stores is located in a health professional shortage area, one or more of their stores is located in a medically underserved population, and if they can meet the terms and conditions that are offered to other in-network pharmacies.

S. 1190 was introduced by Sens. Shelley More Capito (R-W.Va.), Sherrod Brown (D-Ohio), Tom Cotton (R-Ark.), and Joe Manchin (D-W.Va.) and currently has 10 cosponsors.

H.R. 793 currently has 79 cosponsors and was introduced by Reps. Morgan Griffith (R-Va.) and Peter Welch (D-Vt.).

NCPA President Bradley Arthur Testifies Before Congress on PBM Issues

Top Priorities

President Bradley J. Arthur, co-owner of Black Rock Pharmacy, Buffalo, N.Y., testifies before Congress on PBM Issues

H.R. 244, MAC Transparency Act: Legislation was introduced by Reps. Doug Collins (R-Ga.) and Dave Loebsack (D-Iowa) that would provide transparency and fairness to community pharmacies regarding their reimbursement for generic drugs. This bill would require pharmacy benefit managers to disclose the rate of reimbursement in the contract and to update that rate at least once every seven days to reflect fluctuations in the market. Currently, H.R. 244 has 33 cosponsors. S. 314 and H.R. 592, Provider Status Bills: These companion bills would recognize pharmacists as providers under the Medicare Part B program. If enacted, pharmacists would be able to perform services for patients consistent with their state’s scope of practice if their pharmacy is located in a medically underserved area, health professional shortage area, or medically underserved population.

S. 314 was introduced by Sens. Chuck Grassley (R-Iowa), Robert Casey (D-Pa.), Mark Kirk (R-Ill.), and Sherrod Brown (D-Ohio), and currently has 39 cosponsors.

H.R. 592 was introduced by Reps. Brent Guthrie (R-Ky.), G.K. Butterfield (D-N.C.), Todd Young (R-Ind.), and Ron Kind (D-Wis.), and currently has 262 cosponsors.

NCPA President Bradley J. Arthur testified before a hearing of the House Judiciary Subcommittee on Regulatory Reform, Commercial and Antitrust Law on Nov. 17, 2015 to provide insights into the relationship between PBMs and independent community pharmacies. Arthur, co-owner of Black Rock Pharmacy and Brighton-Eggert Pharmacy in Buffalo, N.Y, was joined on the panel by Amy Bricker, Vice

President of Retail Contracting & Strategy, Express Scripts; Natalie Pons, Senior Vice President and Assistant General Counsel, CVS Health; as well as attorney and consumer advocate David Balto.

Arthur described to lawmakers how the concentrated PBM marketplace is detrimental to both government payers and community pharmacies. Noting that by the industry's own statistics, the "Big Three" PBMs cover more than 180 million lives and almost 80 percent of the drug insurance market, Arthur said, "These PBMs have the upper hand in both negotiating the contract with the payer as well strongly influencing the actual plan design itself." He also said the combined revenue of the Big Three (ExpressScripts, CVSHealth, and OptumRx) "are staggering"—more than $272 billion in 2014.

Doug Collins (R-Ga.), Bob Goodlatte (R-Va.), Tom Marino (R-Pa.), John Conyers (D-Mich.), Hank Johnson (D-Ga.), and John Ratcliffe (R-Texas).

Independent Pharmacies Highlighted in Congressional Speeches

2016 Elections

In honor of American Pharmacists Month in October, Rep. Doug Collins (R-Ga.) led a Special Order hour on the House floor to give members an opportunity to highlight the important role that community pharmacies play in their communities as health care providers. Along with Rep. Collins, community pharmacy champions Reps. Rod Blum (R-Iowa), Buddy Carter (R-Ga.), Dave Loebsack (D-Iowa), and Austin Scott (R-Ga.) extended their gratitude. We hope other members of Congress were listening and greatly appreciate the work of these members to not only honor pharmacists for their contributions to our local communities, but to empower them going forward.

The 2016 elections are around the corner and critical to shaping our political landscape. Remember to register to vote, vote in the primaries, and vote again in the general election. You can find more information about your state and voting here. If you’ve recently

moved or need to register to vote, you can do so here. Every state has different rules and election dates—make sure to stay on top of your 2016 election information.

Last year was hugely successful for pharmacy visits and roundtables across the country. More than 40 members of Congress participated in “behind the scenes” looks at daily pharmacy operations that illustrate the important role independent phar¬macies play in the community. When visiting a pharmacy, elected officials have a hands-on opportunity to speak with the hosting owner(s), staff, and his or her constituents who visit the pharmacy. Remember, it’s never too late to ask your member to visit your pharmacy!
