Disabled parking legislation to be examined by committee. Has legislation aimed at tackling the misuse of disabled parking places been effective? This is one of the ques-tions Local Government & Communities Committee will ask as it launches an investigation into the Disabled Persons’ Parking Places (Scotland) Act 2009.

The Act, was aimed at stopping disabled parking spaces being used by those not entitled to use them. Whilst enforcement action can be taken against non-blue badge holders who park in a disabled persons’ place, some local authorities rely on the goodwill of drivers not to park in what is known as ‘advisory parking places’.

CQC announces fee increases. The CQC has outlined the fees that providers of health and adult social care in England will be charged from April 2017 to recover the costs of their regulation. Amounts that providers will pay depends on the type of health or social care they offer, as well as how close their sector is already to meeting the chargeable cost of their regulation in full. Examples of the changes provid-ers can expect to fees in 2017/18 include:

People with dementia and learning difficulties detained in care without checks due to “failing” law – Law Commission. Thousands of vulnerable people with dementia and learning disabilities are being detained in hospitals and care homes without the appropriate checks, due to a law unfit for purpose. In a new report published today, the Law Commission has offered its recommendations on reform to the Deprivation of Liberty Safeguards – proposing a new system designed to ensure that vulnerable people are no longer denied their rights.

Outstanding Quality of Care. The CQC has found the quality of care provided by Brookside care home in Melksham Wiltshire as outstanding following an inspection in November 2016. The home is run by the Orders of St. Johns Trust.

Inadequate Quality of Care. The CQC has found the quality of care provided by Rosecroft Residential Care Home in Plaistow Lane. Inspectors were called in January 2017 after con-cerns were about the treatment of people living in the home. Those concerns are currently being investigated by the police. Provider is C.N.V. Limited,

Care firms have cancelled contracts with 95 UK councils, saying they cannot deliver services for the amount they are being paid, a BBC Panorama

investigation has found. Some firms said they could not recruit or retain the staff they needed.

Care for older people. Research has shown that older people are less likely to complain about services and less aware of the differ-ent ways they can share their views.

However we also know that older people are the most regular users of health services. Two out of three peo-ple admitted to hospital and 70 per cent of hospital emergency beds are taken by those aged 65 and over. It's vital that the voices of our growing elderly popula-tion are heard.

Care worker imprisoned after the death of service user. A care worker at Springwood Day Centre, has been sentenced after the death of a service user. The Nottingham Crown Court heard how a group of service users from the day centre, had been on a trip to Kings Mill Reservoir. The care worker who at the time was supposed to be providing one to one supervision, lost sight of the service us-er, who drowned when he suffered an epileptic seizure around the time that he fell into the reservoir.

A joint investigation by the HSE and Nottinghamshire Police found that the care worker spent a significant amount of time on her mobile phone instead of giving her full attention to the service user while walking with him around the reservoir.

The care worker pleaded guilty to breaching section 7(a) of the Health and Safety at Work Act 1974 and has been sen-tenced to four months imprisonment With the increase of use of both personal and work mobile phones Has the organisation made sure all staff have instructions that personal phones must not be used whilst at work – written permission must be obtained if they are required (e.g. family member may require urgent contact etc) in which case this must be risk assessed…? Check who is to remove Asbestos.

Two incidents. 1. A demolition contractor has been sentenced after ad-mitting illegally removing asbestos from a building he was working on.

Was found to have ignored an asbestos survey while demolishing the former Oakbank Training Centre in Chadderton, Oldham. The Court also heard he failed to prevent exposure to asbestos to workers & others on site.

David William Briggs of Wellington Street, Bury, plead-ed guilty at Manchester Magistrates’ to breaching Sec-tion 2(1) & Section 3(1) of the Health and Safety at Work etc Act 1974 and Regulations 8 (1) and 16 of the Control of Asbestos Regulations 2012 and was sentenced to 24 weeks imprisonment.

2. Enviro-Safe Limited fined for failing to meet the standards required when removing asbestos.

The Court heard how the company failed to protect their employees from the spread of asbestos fibres dur-ing the removal work at separate projects and exposed them to the risk of developing a form of cancer related to asbestos (Carcinogen).

Fined £16,000 and costs of £7731.13

London council fined after school injury. Islington Borough Council has been sentenced after admitting a role in an incident where a boy was left with serious hand injuries. Crown Court heard that a twelve year old schoolboy was in a design and technology class making animal shapes out of plywood. The class used hand saws and some were using a belt sanding machine. The court heard the schoolboy was using the machine for the first time, along with fellow pupils. They were shown how to use it by a fellow pupil and none knew the purpose of the metal guard for the sanding belt which was in a raised position.

Fined £200,000 and full costs of £19,865.

Care home fined after boy drowned in a disused quarry. A Kettering based care home company has been fined after a 16-year-old boy drowned at a disused quarry. The two boys went into the water at the pits despite the no swimming signs. One became trapped in weed on the bottom of the pit and drowned. His body was recovered later.

An investigation by the HSE in July 2013 found the two residential support workers who accompanied the boys had very little experience and did not attempt to prevent the children entering the water.

No risk assessment was carried out prior to the trip and Castle Homes’ procedures were ineffective in ensuring the safety of the children while on trips outside of the home.

Castle Homes Ltd, Kettering, was fined £80,000 and costs of £20,000.

Prosecution against Liverpool care home. A care provider that failed in its duty to provide safe care and treatment CQC brought the prosecution against the owners of Mossley Manor Care Home in Liverpool, following 14 offences including failing to provide safe care and treat-ment resulting in residents being exposed to significant risk of avoidable harm, failure to notify CQC of the deaths of ten residents, and failure to notify us of three serious incidents. The providers were fined £60,000 for failing to provide safe care and treatment and £20,800 for the 13 offenc-es of failing to notify us of deaths and serious incidents. They were also ordered to pay the prosecution costs of £1509.72 and a £120 victim surcharge.

High Court order sets out terms of HSE’s new FFI appeals process. The HSE has been forced to dramatically overhaul its procedure for appealing against Fee for Intervention bills, agreeing for the first time to disclose its evidence and reasoning to dutyholders, and to appoint a new ad-judication panel of independent experts .

Mental Capacity and Deprivation of Liberty This project is complete. The final report and draft Bill were published on 13 March 2017. We are awaiting a response from the Government. The project was a review of the Mental Capacity Act and the Deprivation of Liberty Safeguards (DoLS).

Care Home Security & Access Assessments - Reducing the Risk of Falls & of Residents Leaving the Site. The article refers to security arrangements to put in to place re: access to stairs etc in older peoples care homes (following the recent court case). The residents of Care Homes are often frail and elderly and may suffer from neurological impairments such as dementia, resulting in them being unable to recognise the risk of harm associated with falling down stairs or ac-cessing unsafe and unfamiliar external areas.

Case 351 - Council would not supply gar-deners with sun screen in case they were allergic. Issue A council would not supply their gardeners with sun screen during hot weather as it was a health and safety issue as someone may be allergic.

Panel opinion The council is not obliged to provide sun screen to out-door workers, but there is nothing under health and safe-ty law to prevent it doing so. HSE encourages employers to provide advice on sun protection for those who work outside for most of the day including using sun screen to prevent long term health damage

Care Home open day 16th June 2017

Congratulations are in order.

We have been informed that David Coleman (CMIOSH) (MIFSM) who is a Safety Consultant for Arden Health and Safety, Leamington Spa has just completed his first year as a Skills for Care Registered Provider (the only health and safety company in the UK to hold this status)

He has also recently been awarded the Skills for Care Approved Programme status for a Health & Safety for Care Managers course he has developed. There is only one other Skills for Care Approved Programme in the UK which covers the Care Certificate.

David is a member of NASHiCS and we send him our congratulations on the achievements.
