Explain why the proposal cannot comply with the provisionsof the Zoning By-law, Fence By-law or Sign By-law:

The existing historic home c 1818 is positioned 2.48 m from thefront lot line. All additions are dictated by this fact (Relief points2,3,4,5). In consultationwith the MunicipalHeritageCommittee, a sensitive design and proposal was agreed uponwhereby all new addition structures were moved to the rearground ?oor to respect and highlight the historic structure. Thisdesign resulted in an increased footprint and a correspondingincrease in lot coverage of 2.2% over allowable coverage by thezoning by-law.

The application satis?es the four criteria of a minor variance:1. The variance of lot coverage from 33.0% to 35.2% is

minor in nature2. The increase in lot coverage is desirable as the expanded

rear footprint preserves the prominence and architectureof the historic structure. As mentioned, this plan wasarrived at following lengthy discussionsand approvalwith the Municipal Heritage Committee.

3. The application meets the intent and purpose of theOfficial Plan by preservingand restoringa historicresidential dwelling. It is in keeping with Provincial

policy guidelines.4. The applicationmeets the intent and purpose of the

zoningby-law. This residenceabuts the commercialzonewhich is undergoingintensi?cation.This plan provides abuffer for this property from the commercialdevelopment to the east. The design, materials andmassing of the proposed building is sympathetic to theneighbouringhouses and architecture.The propertyimmediatelyneighbouringto the south is also owned bythe applicant and the designs of each complimenttheother.
