"The Fundamental Principles and Detailed Basic Principles"(Adopted by the National Convention)

Chapter (I)

State Fundamental Principles

(1) In connection with the State, it is laid down that -(a) Myanmar Naing-Ngan is a sovereign, independent nation;(b) the State shall be known as Pyidangs !hamada Myanmar Naing-Ngan "aw;(#) !he State is a nation wherein varios national ra#es make their homes together$(d) sovereign power o% the State is derived %rom the #iti&ens and is in %or#e in thewhole #ontry;(e) the territorial bondary o% the State is as it is on the day this State Constittion#omes into %or#e$

() In connection with the aims and o!ecti#es o$ the State, it is laid down that - theState is #onsistentlyaimed at -

(a) non-disintegration o% the 'nion,(b) non-disintegration o% national solidarity,(#) perpetation o% sovereignty,(d) %lorishing o% a dis#ipline-%lorishing genine mltiparty demo#ra#y(e) %rther brgeoning o% the noblest and worthiest o% worldly vales namely sti#e,liberty and eality in the State,(%) %or the !atmadaw to be able to parti#ipate in the national politi#al leadership roleo% the State$

(%) In connection with multipart& democrac&, it is stipulated that -- the State pra#tises dis#ipline-%lorishing genine mltiparty demo#ra#y$

(') In connection with State structure, it is laid down that -(a) the 'nion is #onstitted by Pyidangs ('nion) systems;(b) the e*isting seven divisions are designated seven regions and the e*isting sevenstates are designated seven states$ !hose seven regions and seven states are o% ealstats and athority;(#) the names o% those seven regions and seven states are retained as they are atpresent;(d) i% it is desired to #hange the name o% a region or a state, it shall be done so with

ena#tment o% law a%ter as#ertaining the wishes o% #iti&ens residing in the region orstate #on#erned;(e) in regions or states, sel%- administered areas are to be pres#ribed %or national ra#eswho reside together in #ommnities on the same #ommon stret#hes o% land inappropriate si&es o% poplation, other than national ra#es who have already gotregions or states;

() In connection with separation and distri!ution o$ so#erein State power, it is laiddown that -

(a) the three bran#hes o% State power, namely legislative power, e*e#tive power anddi#ial power are separated as m#h as possible and e*ert re#ipro#al #ontrol, #he#kand balan#e among themselves;

(b) the three bran#hes o% State power, so separated are distribted amongPyidangs ('nion), regions, states and sel%- administered areas$

(*) In connection with leislature, it is laid down that -(a) the legislative power o% the State is distribted among Pyidangs +lttaw,egion +lttaws and State +lttaws$ legislative power stiplated by the StateConstittion shall be distribted to sel%- administered areas;(b) Pyidangs +lttaw #onsists o% two +lttawsone +lttaw ele#ted on the basis o%township as well as on the basis o% poplation and the other one with eal nmbero% representatives ele#ted %rom regions and states;(#) there will be a egion +lttaw in ea#h o% the seven regions and a State +lttaw inea#h o% the seven states;

(d) Pyidangs +lttaw, egion +lttaws and State +lttaws in#lde !atmadawservi#emen +lttaw representatives nominated as s#h by the "e%en#e Servi#esCommander-in-Chie% in nmbers stiplated by the State Constittion;(e) %or national ra#es with appropriate si&es o% poplation, national ra#erepresentatives are to be permitted to parti#ipate in legislatres o% regions, states orsel%-administered areas #on#erned$

(+) In connection with eecuti#e !ranch, it is laid down that -(a) the head o% e*e#tive o% the State is the President o% the State;(b) the e*e#tive power o% the State is distribted among the administrative organso% Pyidangs, regions and states; sel%- administrative power shall be distribted to

sel%-administered areas as stiplated by the State Constittion;(#) Pyidangs, regions, states, sel%-administered areas and distri#t e*e#tive organsin#lde !atmadaw servi#emen nominated by "e%orm Servi#es Commander-in-Chie%to ndertake responsibilities o% the de%en#e, se#rity, border administration et#$(d) %or national ra#es o% whi#h representatives are so permitted to parti#ipate inlegislatres o% regions, states or sel%-administered areas in a##ord with aboveparagraph (.) sb-paragraph (e), representatives are to be permitted to parti#ipate,mainly to ndertake their national ra#e a%%airs, in administration o% respe#tive region,state or sel%administered area/

() In connection with the udiciar& It is laid down that -

(a) the di#ial power o% the State is distribted among Spreme Cort o% the 'nion(Spreme Cort), egion !aya +lttaw (egion +igh Cort), State !aya +lttaw(State +igh Cort) and law #orts o% di%%erent levels in#lding law #orts o% sel%-administered areas/(b) in the Pyidangs is #onstitted one Spreme Cort o% the 'nion$ SpremeCort o% the 'nion is the spreme law #ort o% the State;(#) Spreme Cort o% the 'nion has powers to isse writs;(d) a egion !aya +lttaw is #onstitted in ea#h o% the regions and a State !aya+lttaw is #onstitted in ea#h o% the states;

(e) the %ollowing are stiplated as di#ial prin#iples-- independent administration o% sti#e in a##ord with law;- administration o% sti#e in pbli# e*#ept where restri#ted by law;- giving o% right o% de%en#e and right o% appeal by law in #ases$

(.) In connection with the Tatmadaw, it is laid down that -(a) the !atmadaw is strong, modern and mst be the sole e*isting !atmadaw;(b) the !atmadaw has the right to independently administer all a%%airs #on#erning the%or#es;(#) the "e%en#e Servi#es Commander-in-Chie% is the Spreme Commander o% allarmed %or#es;(d) the !atmadaw has the right to administer %or parti#ipation o% the entire people inState se#rity and de%en#e;(e) the !atmadaw is mainly responsible %or sa%egarding non-disintegration o% the'nion, non-disintegration o% national solidarity and perpetation o% sovereignty;(%) the !atmadaw is mainly responsible %or sa%egarding the State Constittion$

(1/) In connection with citi0ens and citi0ens $undamental rihts and responsi!ilities,it is laid down that -

(a) every #iti&en shall enoy rights o% eality, rights o% liberty and rights o% sti#e et#$as pres#ribed in the State Constittion;(b) there shall be no right to hold a #iti&en in detention %or more than 01 horswithot the permission o% a law #ort;(#) pbli# pea#e and tranillity and prevalen#e o% law and order is the responsibilityo% every #iti&en;(d) ne#essary law shall be ena#ted to make #iti&ens %reedoms, rights, bene%its,responsibilities and restri#tions e%%e#tive, %irm and #omplete$

(11) In connection with the national races, it is laid down that -(a) the State shall help develop langage, literatre, %ine arts and #ltre o% thenational ra#es;(b) the State shall help promote solidarity, mtal amity, and respe#t and mtal helpamong the national ra#es;(#) the State shall help promote so#io-e#onomi# development in#lding ed#ation,health, e#onomy, transport and #ommni#ations o% less developed national ra#es$

(1) In connection with the peasantr&, it is laid down that -(a) the Stale shall ena#t ne#essary law to prote#t the rights o% the peasantry/(b) the State shall help the peasantry get eitable vale %or their agri#ltral

prod#e$

(1%) In connection with wor2ers, it is laid down that -- the Slate shall ena#t ne#essary laws to prote#t the rights o% workers$

(1') In connection with Intellectuals and intellientsia, it is laid down that - the stale shall help promote the interests o% the intelle#tals and intelligentsia$

(1) In connection with the State ser#ice personnel, it is laid down that -(a) Stale servi#e personnel shall be %ree %rom party politi#s;(b) the State shall ena#t ne#essary laws %ar State servi#e personnel to have dese#rity in servi#e and s%%i#ien#y o% %ood$ #lothing and shelter, tot married womenin servi#e to get maternity bene%its, and %or wel%are to ease livelihood o% persons who

have retired %rom servi#e$

(1*) In connection with national culture, it is laid down that -- the State shall help %or development, #onsolidation and preservation o% national#ltre$

(1+) In connection with education and health, it is laid down that -(a) !he State shall earnestly strive to improve ed#ation and health o% the people;(b) the State shall ena#t ne#essary law to enable the national people to parti#ipate inmatters o% ed#ation and health o% the people;(#) the State shall implement %ree #omplsory primary ed#ation system,(d) the State shall implement a modern ed#ation system that will promote all-

arond #orre#t thoghts and good morals and #ontribte towards bilding o% thenation$

(1) In connection with ariculture, it is laid down that -- the State shall provide inpts s#h as te#hnology investments, ma#hinery, rawmaterials et#$ as m#h as it #an %or #hangeover %rom manal to me#hani&eagri#ltre$

(1.) In connection with industr&, it is laid down that -- the State shall provide inpts s#h as te#hnology investments, ma#hinery, rawmaterials et#$ as m#h as it #an %or development o% indstries$

(/) In connection with emplo&ment, it is laid down that -- the State shall, as m#h as it #an, help red#e nemployment among the people$

(1) In connection with mothers, children, the old and the in$irm, it is laid down that-

(a) the State shall #are %or mothers and #hildren, orphans, %allen !atmadawservi#emens #hildren, the old an the in%irm, and the disabled;(b) the State shall arrange %or disabled !atmadaw servi#emen to be able to make arespe#table livelihood and get %ree vo#ational training$

() In connection with the &ouths, it is laid down that -- the State shall strive to imbe yoths with strong and dynami# patrioti# spirit,#orre#t way o% thinking and the %ive noble strengths$

(%) In connection with reliion, it is laid down that -(a) every #iti&en is eally entitled to %reedom o% #on-s#ien#e and the right %reely topro%ess and pra#tise religion sbe#t to pbli# order, morality or health and to theother provisions o% the State Constittion$

(') In connection with the econom&, it is laid down that -(a) the State e#onomi# system shall be market e#onomi# system;(b) the State permits all e#onomi# %or#es s#h as the State itsel%, regionalorgani&ations, #ooperative organi&ations, oint-ventre organi&ations and private#on#erns et#$ to take part in e#onomi# a#tivities %or the development o% national

e#onomy;(#) the State shall prevent a#ts that harm pbli# interests throgh monopoli&ation ormaniplation o% pri#es by an individal or grop with intent to eopardi&e %air#ompetition in e#onomi# a#tivities;(d) the State shall strive towards pli%t o% living standard o% the people anddevelopment o% general investments;(e) the State will not nationali&e e#onomi# enterprises;(%) the State will not demoneti&e the #rren#y that is legally pt into #ir#lation$

() In connection with the land, the waters, the atmosphere and natural resources, itis laid down that -

(a) the State is the ltimate owner o% all the land, and natral resor#es above and

below the grond, above and beneath the water and in the atmosphere within itsterritorial bondary;(b) the State shall ena#t ne#essary law to spervise e#onomi# %or#es e*tra#tion andtili&ation o% State owned natral resor#es;(#) the State shall permit #iti&ens right o% private property, right o% inheritan#e, righto% private enterprise, right o% initiative and right o% patent in a##ord with law$

(*) In connection with elections, it is laid down that -(a) ever #iti&en shall have the right to vote and to stand %or ele#tion a##ording to law;(b) voters #on#erned shall have the right, in a##ord wit, provisions o% the StateConstittion, to re#all ele#ted peoples representatives$

(+) In connection with political parties, it is laid down that -- the State shall ena#t ne#essary law %or systemati# %ormation o% politi#al parties %or%lorishing dis#ipline-%lorishing genine mltiparty demo#ra#y$

() In connection with state o$ emerenc&, it is laid down that -(a) when there arises a state o% emergen#y #hara#teri&ed by inability to per%orme*e#tive %n#tions in a##ord with provisions o% the State Constittion in a region ora state or a sel%administered area, the President o% the State is empowered to e*er#isee*e#tive power in that region, state or sel%- administered area and i% ne#essary indoing so, the President o% the State is empowered to e*er#ise legislative powers

#on#erning that region, state or sel%- administered area in a##ord with provisions o%the State Constittion;(b) when there arises or there is s%%i#ient reason to arise a state o% emergen#yendangering li%e and property o% the people in a region, a state or a sel%- administeredarea, the !atmadaw has the right, in a##ord with provisions o% the State Constittion,to prompt that danger and provide prote#tion;(#) when there arises a state o% emergen#y that #old #ase disintegration o% the'nion, disintegration o% national solidarity and loss o% national sovereignty, de totake over o% sovereign State power or attempts there%or by wrong%l %or#ible means

s#h as insrgen#y or violen#e, the "e%en#e Servi#es Commander- in-Chie% has theright to take over and e*er#ise State power in a##ord 2ith provisions o% the StateConstittion$

(.) In connection with $orein a$$airs, it is laid down that -

(a) the State pra#tises independent, a#tive and nonaligned %oreign poli#y, aims atworld pea#e and %riendly relations with nations, and pholds the prin#iples o%pea#e%l #o- e*isten#e among nations/(b) the Stale never starts aggression against ant nation;(#) no %or#ing troops are permitted to be deployed within the borders o% the 'nion$

(%/) In connection with punishments, it is laid down that -(a) there is no right %or any penal law to provide %or retrospe#tive e%%e#t;(b) there is no right to pres#ribe pnishments that violate hman dignity$

(%1) In connection with the natural en#ironment, It is laid down that -- the slate shall prote#t the natral environment$

(%) In connection with eneral pro#isions, it is laid down that -- a Constittional !ribnal shall be sat p to interpret provisions o% the StaleConstittion; to s#rtini&e whether or not laws ena#ted by Pyidangs +lttaw,egion +lttaws and State +lttaws and %n#tions o% e*e#tive athorities o%Pyidangs, regions, stated and sel%- administered areas are in #on%ormity with theState Constittion to de#ide on disptes in #onne#tion with the State Constittionbetween Pyidangs and regions, between Pyidangs and states, between regionsand states, among regions and states and between regions or states andselladministered areas and among sel%administered areas themselves to per%orm otherdties pres#ribed in the State Constittion$

Chapter (II)

The State Structure

(1) 8% it is desired to #hange the name o% a region or a state, it shall be done so withena#tment o% law a%ter as#ertaining wishes o% the #iti&ens who have the right to vote and areresiding in the region or state #on#erned$

(9)Desination o$ 3nion territories

(a) Nay Pyi !aw, that is the Capital o% the 'nion, is designated as 'nion territorypla#ed nder dire#t administration o% the President o% the 'nion,(b) i% the need arises to designate areas that have spe#ial sitation in #onne#tion withnational de%en#e se#rity, administration and e#onomy et#$ as 'nion territories theymay be so designated as 'nion territories a%ter ena#ting laws$

(.)Constitutin the 3nion

- :illages are organi&ed into village -tra#t,- wards are organi&ed into town or township,- village-tra#ts and wards or towns are organi&ed into township,

- townships are organi&ed into distri#t,- distri#ts are organi&ed into region or state,- in a sel%-administered &one townships therein are organi&ed into the sel%-administered &one,- in a sel%-administered division townships therein are organi&ed into distri#t and distri#ts areorgani&ed into the sel%-administered division,- i% there be sel%- administered division or sel%administered &one in a region or a state, the selladministered division, sel%- administered &one an$ distri#ts are organi&ed into region or state,- regions, states and 'nion territories are organi&ed as the 'nion$

() No part o% the territory o% the 'nion, namely regions, states and sel%- administered areaset#$ shall ever se#ede %rom the 'nion$

(7) assenting votes o% more than hal% the nmber o% representatives %rom theregion or state involving the bondary #on#erned in the two +lttaws,(#) the leader o% the Pyidangs +lttaw, a%ter obtaining the assenting votes asmentioned above, shall in%orm the President o% the 'nion %or redelineate theterritorial bondary o% the 'nion,(d) 8% any +lttaw or representatives %rom the region state involving the bondary#on#erned in the two +lttaws, %ollowing the methods mentioned above, dissent in#onne#tion with the redelineation o% the territorial bondary o% the 'nion, a#tionshall be taken a%ter obtaining the opinion o% the Pyidangs +lttaw$ 8% three%orthsand pwards o% the tot nmber o% the Pyidangs +lttaw representative assent, theleader o% the Pyidangs +lttaw shall in%orm the President o% the 'nion %or the re-delineation o% the territorial bondary o% the 'nion as ne#essary,

(e) the President o% the 'nion shall take ne#essary measres %or re-delineation o% theterritorial bondary o% the 'nion a%ter obtaining the opinions o% the Pyidangs+lttaw$

(=)4e-delineation o$ the territorial !oundaries o$ a reion or a state

(a) 8% there arises #ase to re-delineate the bondary o% a region or a state, %irst o% allthe wishes o% persons with voting rights residing in the township involved in$ the re-delineation o% the bondary shall be sogh,(b) re-delineation o% the territorial bondary shall not be e%%e#ted at all withotspporting vote o% more than hal% the total nmber o% eligible voters residing in the

township involved in the redelineation o% the bondary$(#) 8t more than hall the total nmber o% eligible voters in the township #on#ernedvote m spport at the re-delineation o% the bondary, the wishes o% the involvedregion or stale +lttaw representatives stall be soght$(d) the President o% the 'nion$ with the or the Pyidangs +lttaw shall redelineatethe territorial bondary o% a region or a stale$ abet getting the spporting vole o%three-%orths and pwards o% the total nmber o% involved region or state +lttawrepresentatives,(e) the de#ision o% the Pyidangs +lttaw shall be soght it an invoked region orstale +lttaw passes a de#ision against re-delineation o% the bondary$(%) the President o% the 'nion shall re-delineate the bondary o% the region or state

as ne#essary i% it spported by three-%orths and pwards o% the total nmber o%representatives in the Pyidangs +lttaw$

(3>) 4e-delineation o$ the !oundar&, orani0ation and chane o$ name o$ a #illae,#illae-tract, ward, town, township and district in a reion, state, all-administereddi#ision or sel$administered 0one

- 8% o##asion arises to hake #hanges in the bondary, organisation or name o% a village,village-tra#t, ward, town, township or distri#t in a region$ state, sel%-administered division or

sel%administered &one, the region or slate e*e#tive athority #on#erned shall sbmitre#ommendations to the President o% the 'nion and the President o% the 'nion shall thena#t a##ordingly$

(33)Chane o$ name o$ a sel$-administered di#ision or sel$-administered 0one

- 8% it is desired to #hange the name o% a sel%administered division or sel%-administered &one,the same method shall be applied with the #ase o% a #hange o% the name o% the region orstate$

(30)In connection with prescri!in o$ sel$administered di#ision or sel$-administered0one in accord with these !asic principles, the $ollowin detailed !asic principles arelaid down5

Chapter (III)

The Head of State

(3) !he +ead o% State is the President o% the 'nion,

(0) !he President o% the 'nion represents the nation,

(7) !he President o% the 'nion o##pies a position o% the highest honor in the whole o% the'nion o% Myanmar,

(1)6uali$ications o$ the President and 7ice-Presidents -

(a) !he President o% the 'nion shall be loyal to the 'nion and the #iti&enry,

(b) !he President o% the 'nion mst be a #iti&en o% Myanmar who was, and both o%whose parents were, born in the territory nder the risdi#tion o% the State,belonging to the nationality o% Myanmar,(#) !he ele#ted President o% the 'nion shall be a person who has %lly attained theage o% 19$

(d) !he President o% the 'nion shall be well a#ainted with a%%airs o% State s#h aspoliti#al, administrative, e#onomi# and military a%%airs,(e) !he President o% the 'nion shall be a person who has been residing #ontinoslyin the #ontry %or at least 0> years p to the time o% the ele#tion,(%) !he President o% the 'nion himsel%, parents, spose, #hildren and their sposesshall not owe allegian#e to a %oreign power, shall not be sbe#t o% a %oreign power or#iti&en o% a %oreign #ontry$ !hey shall not be persons entitled to the rights andprivileges o% a sbe#t or #iti&en o% a %oreign #ontry,(g) !he President o% the 'nion shall possess spe#i%i# ali%i#ations reired o% thePresident in addition to ali%i#ations reired to stand %or ele#tion to the +lttaw$(h) !he :i#e-Presidents shall possess ali%i#ations reired o% the President$

(9)8lection o$ the President and 7ice-Presidents -

(a) !he president o% the 'nion shall be ele#ted by the presidential ele#toral #ollege$(b) !he presidential ele#toral #ollege shall be organi&es with three grops o% thePyidangs +lttaw representatives as %ollows /

(3) Brop %ormed with ele#ted +lttaw represents live in the +lttaw witheal nmbers o% representatives ele#ted %rom regions and states$(0) Brop %ormed with ele#ted +lttaw represents ?ives in the +lttawele#ted on the basis o% poplation and tawnship$(7) Brop %ormed with !atmadaw member +lttaw representativesnominated as s#h by the Commander- in- Chie% o% the "e%en#e Servi#es %or

the said two +lttaws$(#) a#h grop shall ele#t a :i#e-President %rom among +lttaw representatives or%rom among persons who $ are not +lttaw representatives,(d) A body #omprising trio leaders and depty leaders o% the Pyidangs +lttawand the two +lttaws o% the Pyidangs +lttaw shall s#rtini&e whether r not the:i#e-Presidents possess the ali%i#ation pres#ribed %or the President,(e) !he presidential ele#toral #ollege made p o% all the Pyidangs +lttawrepresentatives shall ele#t by vote one o% the three :i#e-Presidents who arepresidential #andidates, as the President o% the 'nion;(%) ?aw shall be ena#ted as reired %or presidential ele#tion$

(.)Term o$ o$$ice o$ the President or the 7ice- Presidents -

(a) !he term o% o%%i#e o% the president or the :i#e-Presidents is %ive years,(b) A%ter e*piry o% in#mbent term, the President and the :i#e- Presidents shall #arryon in o%%i#e till the time the new President and :i#e-Presidents are dly ele#ted,(#) !he President and the :i#e-Presidents shall not serve more than two terms,(d) An interim period to serve as the President or the :i#e- President shall not be#onted as one term o% o%%i#e,

(e) 8% a va#an#y is %illed %or the presiden#y or :i#e-Presiden#y %or any reason, theterm o% o%%i#e o% the President or the :i#e-President shall be p to the end o% theoriginal term o% o%%i#e$

() !he President or the :i#e-Presidents shall not be representatives o% any +lttaw$

() In ta2in oath o$ o$$ice !& the President and the 7ice-Presidents, the $ollowinpoints are to !e included5

(33)!he President or the :i#e-Presidents shall e*er#ise responsibilities and rights assigned

and vested by the #onstittion and other laws$

(30) !he President and the :i#e-Presidents shall not a##ept any other o%%i#e or position o%emolment$

(1) !he Speaker o% the Pyidangs +lttaw shall #onvene a spe#ial session or an emergen#ysession o% the Pyidangs +lttaw as may be ne#essary$

(9) !he Speaker o% the Pyidangs +lttaw shall #onvene a spe#ial session or an emergen#ysession o% the Pyidangs +lttaw soonest when the President in%orms the Speaker o% thePyidangs +lttaw to #onvene a spe#ial session or an emergen#y session o% the Pyidangs+lttaw$

(.) !he Speaker o% Pyidangs +lttaw shall #onvene a spe#ial session o% the Pyidangs+lttaw when at least one-%orth o% the total nmber o% members o% the Pyidangs+lttaw ask to #onvene the Pyidangs +lttaw$

() (a) !he %irst day session o% the Pyidangs +lttaw shall be valid i% more than hal%the nmber o% members, who have the right to attend the Pyidangs +lttawmeeting, are present$ !he meeting i% invalid, shall be adorned$

(b) !he meetings that are adorned de to invalidity in a##ord with the sb-paragraph (a) as well as the valid meetings that are e*tended will be valid i% at leastone third o% the +lttaw members are present$

(b) 8% a bill initiated in the Pyith +lttaw or the Amyotha +lttaw is approved byboth Pyith +lttaw and Amyotha +lttaw, it shall be presmed that the bill isapproved by the Pyidangs +lttaw$

(37) (a) 2hen the Pyidangs +lttaw ena#ts a law, it may H

(i) entrst the right to isse rles ,reglation and bye-laws #on#erning the lawto the 'nion level organi&ations %ormed a##ording to the Constittion$(ii) athori&e the respe#tive organi&ations or athority to isse noti%i#ations,orders, dire#tives and pro#edres$

(b) !he rles, reglations, noti%i#ations, orders, dire#tives and pro#edres issed withthe right vested by a law shall be in #onsonant with the stiplations #ontained in theConstittion and the law #on#erned$(#) 8% both the Pyith +lttaw and the Amyotha +lttaw de#ide to annl or amendany one the rles, reglations or bye-laws, it shall be presmed that the rles,reglations or bye-laws are annlled or amended by the Pyidangs +lttaw$(d) 8% there is any disagreement between the Pyith +lttaw and the Amyotha+lttaw #on#erning the said rles, reglations or bye-laws, it shall be de#ided by the

Pyidangs +lttaw$(e) 8% a de#ision is made to annl or amend any o% the rles, reglations or bye-lawsa##ording to the paragraph (#) or paragraph (d), the de#ision shall be withotpredi#e, however, to the validity o% any a#tion previosly taken nder the rles,reglations or bye-laws$

(31) !he Pyidangs +lttaw -(a) shall give the de#ision on matters in #onne#tion with rati%ying, #an#elling andwithdrawing %rom international agreements, regional treaties or bilateral agreementssbmitted by the President$(b) may %i* the international, regional or bilateral agreements that do not need

Pyidangs +lttaws approval and delegate the President to rati%y, denon#e andwithdraw %rom them$

(39) (a) Matters that reires de#ision o% the Pyidangs +lttaw, agreement andapproval shold be implemented as %ollows/

(i) 8% the Pyidangs +lttaw is in session, the matter shall be de#ided at thatsession$(ii) 8% the Pyidangs +lttaw is not in session, the dis#ssion and de#isionson the matter shall be made at the nearest Pyidangs +lttaw session$(iii) A spe#ial session or an emergen#y session shall be #onvened to dis#ssand de#ide the matters whi#h need prompt a#tion %or pbli# interest$

(b) 2hen the President a%ter issing an order having the %or#e o% law sbmits it tothe Pyidangs +lttaw %or approval, the Pyidangs +lttaw shall/(i) pass a resoltion to approve it or not$(ii) %i* the %rther period to whi#h the said order shall #ontine to be in %or#ei% the Pyidangs +lttaw approves the order$(iii) !he order having the %or#e o% law shall #ease to have e%%e#t %rom the dateon whi#h it is disapproved by the Pyidangs +lttaw$

(3.) (a) % the matters in#lded in the 'nion ?egislative ?ist, the 'nion levelorgani&ations %ormed nder the Constittion, shall have the right to sbmit bills onmatters nder their management, to the Pyidangs +lttaw in a##ord with thepres#ribed pro#edres$(b) 5ills on national plans, annal bdgets and ta*ation, whi#h are to be sbmitted

e*#lsively by the 'nion government shall be presented to the Pyidangs +lttawin a##ord with the pres#ribed provisions %or de#ision$

(3) *#ept the bills that are pres#ribed by the Constittion to be initiated e*#lsively at thePyidangs +lttaw, the bills initiated by the 'nion level organi&ations %ormed nder theConstittion, at the Pyidangs +lttaw shall be dis#ssed initially at the Pyith +lttaw orthe Amyotha +lttaw a##ording to the pres#ribed provisions$

(3) (a) 2ithin 31 days a%ter the date the President re#eives the bills sent to him by thePyidangs +lttaw a%ter approving them and the bills in like manner as i% thePyidangs +lttaw have approved them, he shall sign the bills and shall promlgatethem into law$

(b) !he President shall send a bill ba#k to the Pyidangs +lttaw together with his#omments within the %i*ed time to sign and promlgate it into a law$(#) Althogh the President does not send a bill ba#k to the Pyidangs +lttawtogether with his #omments within the %i*ed time, i% the bill is not signed by thePresident within 31 days a%ter the date o% presentation, the same shall be be#ome alaw in like manner as i% he had signed it on the last o% the said 31 days$

(03) (a) 8% the President sends ba#k the bill to the Pyidangs +lttaw together with his#omments within the %i*ed time, the Pyidangs +lttaw a%ter stdying thePresidents #omments, #an a##ept his #omments or #an de#ide to amend the bill, orshall make a de#ision to approve the bill in its original state i% it does not agree the

Presidents #omments$(b) !he President shall sign the bill and ena#t it into a law on the last o% the saidseven days i% the bill so amended a##ording to his #omments or his #omments arenot a##epted and the bill approved in its original state is sent ba#k to him with thePyidangs +lttaws de#ision$(#) 8% the bill sent ba#k to the President by the Pyidangs +lttaw is not signed bythe President within the %i*ed time, the same shall be be#ome a law in like manner asi% he has signed it on the last date o% the said time limit$

Duties o$ the P&idaunsu ;luttaw Spea2er

(01) !he Pyidangs +lttaw Speaker shall -(a) spervise the Pyidangs +lttaw sessions;(b) invite the President, i% the President in%orms him o% his desire to address thePyidangs +lttaw;(#) have the power to invite organi&ations and persons representing any 'nion levelorgani&ations %ormed nder the Constittion to attend and give #lari%i#ations on one

o% the matters o% the on going dis#ssions o% the Pyidangs +lttaw session i%ne#essary;(d) implement his other dties and %n#tions designated by the Constittion or anylaw$

(09) !he 'nion level organi&ations %ormed nder the Constittion shall sbmit their generalsitation, ne#essary to be presented to the Pyidangs +lttaw, with the permission o% theSpeaker$

(0.) (a) Sbe#t to the provisions #ontained in the Constittion, and the provisionspres#ribed in the Pyidangs +lttaw law, members o% the Pyidangs +lttaw shall

have %reedom o% spee#h and voting at the Pyidangs +lttaw and the Pyidangs+lttaw Joint Committee$ Con#erning the dis#ssions and %n#tions o% thePyidangs +lttaw and the Joint Committee, a Pyidangs +lttaw member shallbe absoltely privileged, e*#ept nder the laws o% the Pyidangs +lttaw$(b) Sbe#t to the provisions #ontained in the Constittion, and the provisionspres#ribed in the Pyidangs +lttaw law, members o% organi&ations or personsrepresenting any one o% the 'nion level organi&ations invited to attend thePyidangs +lttaw have the %reedom o% spee#h$ No a#tion shall be taken againsts#h persons %or their spee#hes, e*#ept nder the laws o% the Pyidangs +lttaw$(#) +owever, i% the persons mentioned in the above paragraph (a) and paragraph (b)#ommit physi#al assalts, they shall be liable to pnishment a##ording to the e*isting

(0) 8% there arises a need to arrest a Pyidangs +lttaw member attending a Pyidangs+lttaw session or a person attending the Pyidangs +lttaw session at the invitation o%the Speaker o% the Pyidangs +lttaw, the reliable eviden#e shall be sbmitted to theSpeaker o% the Pyidangs +lttaw$ +e shall not be arrested withot the prior permission o%the Pyidangs +lttaw Speaker$

o% the egion or State +lttaw a%ter the Constittion #omes into %or#e$(b) !he Speaker o% the egion or State +lttaw who #ontines to per%orm his dtiesin a##ord with the provisions o% the Constittion shall #onvene the %irst reglarsession %or the ne*t terms o% egion or State +lttaw$

7$ (a) Members o% the egion or State +lttaw shall take oaths be%ore the #hairman o%the egion or State +lttaw at the %irst reglar session o% the egion or State+lttaw$(b) Members o% the egion or State +lttaw who have not taken oaths, shall take

oaths be%ore the Speaker o% the +lttaw at the session o% the egion or State+lttaw they %irst attend$

1$ !he Speaker o% the egion or State +lttaw shall #onvene the reglar session o% theegion or State +lttaw at least on#e a year$ !he interval between two reglar sessions shallnot e*#eed 30 months$

9$ !he %ollowing matters are #arried ot at the session o% the egion or State +lttaw$(a) e#ording the address delivered by the 'nion President;(b) eading ot and re#ording messages sent by the President and other messagespermitted by the Speaker;

(#) e#ording the address delivered by the egion or State Chie% Minister;(d) Sbmitting, dis#ssing and making de#ision on a bill;(e) "is#ssing and de#iding the matters the egion or State +lttaw shall implementin a##ord with the provisions o% the Constittion and any o% the e*isting laws;(%) "is#ssing, de#iding and re#ording the reports presented to the egion or State+lttaw;(g) Sbmitting proposals, holding dis#ssions and making de#isions;(h) aising estions and making replies;(i) 8mplementing matters permitted by the Speaker o% egion or State +lttaw;

.$ (a) !he Speaker o% the egion or State +lttaw #on#erned may #onvene spe#ial

session or emergen#y session o% egion or State +lttaws i% ne#essary$(b) !he Speaker o% the egion or State +lttaw shall #onvene a spe#ial or emergen#ysession o% the +lttaw as soon as possible when the egion or State Chie% Ministerin%orms to do so$(#) !he Speaker o% the egion or State +lttaw shall #onvene a spe#ial session o% the+lttaw as soon as possible i% at least one-%orth o% the egion or State +lttawmembers so reisition$

$ (a) A session o% the egion or State +lttaw is valid i% more than hal% the nmber o%members who have the right to attend the session o% the egion or State +lttaw arepresent on the %irst day o% the session$ !he session i% invalid shall be adorned$(b) !he sessions that are held nder sb-paragraph (a) de to invalidity o% thesessions and the sessions that are e*tended de to validity o% the sessions are valid i%

3$ 8n #onne#tion with %ormation o% the Pyidangs ('nion) government,(a) !he *e#tive +ead o% State is the President o% the State;(b) (3) the e*e#tive power o% the State is distribted among the Pyidangs,

regions and states;(0) sel%-administrative power is distribted to sel%administered areas asstiplated by the State Constittion$
