The 9.5% Rule Possibly the most confusing aspect of the Obamacare employer mandate (for employers of 50 or more) is the requirement that employees cannot be required to pay more than 9.5% of their W-2 income for their own coverage, however, they may be charged for the full cost of dependant coverage. First, the rule is based on actual wages and thus may vary every pay period. Second, it is not connected to the cost of coverage so employer practices like “we pay 75% of employee cost” are not likely compliant. Third, the employee must be able to obtain medical coverage for no more than the 9.5% contribution limit. The practical solution to employer compliance, with minimum employee confusion, is to require a uniform dollar employee contribution from employees wishing coverage for themselves. Setting that contribution at no more than $22.80 per week (9.5% x 30 x $8) guarantees compliance. It is also important that a low cost plan (along with other options) be available to the employee so the employee contribution (along with the employer portion) will buy that plan for the employee. If the employee wishes a more expensive plan, the employer may charge that employee 100% of the excess cost over the low cost plan. The problem is that it really isn’t “printing.” It involves the computer controlled deposition of metal or plastic to produce a three dimensional object. With current technology, it’s a slow process best suited to the production of prototypes for R&D use. The natural buyers are therefore R&D types not marketers—the people we know and love. It’s also a natural in-house application and the cost of the devices makes this possible. If that happens, the hopeful 3D printer is now competing with the customers which is not good positioning.

We heard a major firm explain that its plan was to deliver was to deliver print to Fortune 1000 firms at minimum cost. That story would be music to the ears

of the CFO, but what about the CMO? In most uses of print, its cost is a small, sometimes tiny, fraction of the total product cost, but it can and should play a key role in gaining the prospect’s attention and motivating the buying decision—that’s the value story. When you’re talking to a “C” level executive, it should be the CMO, not the CFO because selling value is the key to keeping print in the game at decent pricing levels.

Celebrate Christmas With Charles Dickens

Your transportation back in time will cause the Museum’s galleries to be transformed into Fezziwig’s Warehouse with special presentations, tours, carolers, music, and

Travel Time Payment

Under California state law, if an employer requires an “hourly” employee to attend an out-of-town business meeting, training session, or any other event, the employer

has an obligation to pay for the employee’s time in getting to and from the location of that event. Time spent driving, or as a passenger on an airplane, train, bus, taxi cab or car, or other mode of transport, in traveling to and from this out-of-town event, and time spent waiting to purchase a ticket, check baggage, or get on board, is, under such

circumstances compensable “hours worked.” On the other hand, time spent taking a break from travel in order to eat a meal, sleep, or engage in purely personal pursuits not connected with traveling or making necessary travel connections (such as, for example, spending an extra day in a city before the start or following the conclusion of a conference in order to sightsee), is not compensable. If the employee’s travel from his home to the airport is the same or substantially the same as the distance (and time) between his home and usual place of reporting for work, the travel time would not begin until the employee reached the airport. The employee must be paid for all hours spent between the time he arrives at the airport and the time he arrives at his hotel. No further “travel” hours are incurred after the employee reaches his hotel and is then free to choose the place where he will go. The employer may establish a different pay scale for travel time (not less than minimum wage) as opposed to the regular work time rate. The employee must be informed of the different pay rate for travel before the travel beings. For purposes of determining the regular rate of pay for overtime work under the circumstances where a different rate is applied to travel time, the State of California adopts the “weighted average” method. Call Doug Moore at Ext. 218 (email: [email protected]), if you would like a “Travel Time” policy.

Do You Have EPL?

Every business has insurance coverage for fire and usually some coverage for general liability so that they’re covered if a visitor falls down in the plant. However,

in the real world, these events practically never occur. What does occur with distressing frequency are suits from ex-employees alleging wrongful termination and current employees alleging sexual harassment. These are fueled by a barrage of advertising from law firms holding out the promise of big settlements at the employer’s expense. Many of these are lawyer driven shake-downs which an employer is helpless against unless they can fund an expensive defense. That’s where Employee Relations Liability (EPL) coverage comes in. If you have it, you won’t be the deer in the lawyer’s headlights. Call Joanne Cadenas at Ext. 256 (email: [email protected]) to get it before the lawyer’s demand letter lands on your desk.
