MUTUAL WAIVER AND RELEASE OF LIABILITY

TO ALL WHOM THESE PRESENTS COME

This agreement releases Mangudlong Paradise Resort from any and all liability, if there be any, relating to the injuries sustained by the daughters of Mr. John Peter Calderon Pastrana, namely Sofie and Carle Pastrana, that the latter may have sustained during the incident that occurred on 13 May 2015, inside the bathroom of room no. 407 of the resort.

Equally, Mangudlong Paradise Resort similarly releases Mr. John Peter Calderon Pastrana from any claim pertaining to the damage sustained by the resort consisting of a shattered/broken shower enclosure amounting to approximately Ten Thousand (Php. 10,000.00) Pesos, more or less.

By executing, attesting and signing hereto, both parties agree to mutually waive any claim or liability, including financial responsibility, that both may have against one another as a result of the above-described incident thereby forfeiting all rights to bring a suit against each other.

Both parties freely, voluntarily and intelligently acknowledge and covenant that this instrument is entered into in good faith and solely for the purpose stated above. Further, both honestly and sincerely believe that this agreement is binding upon both parties, their assigns and successor in interest; and is not contrary to law, morals, good customs, public policy, public order, and public interest nor prejudicial to the rights of third persons.

IN WITNESS WHEREOF, We have hereunto set our hands this _____________ at the City of Cebu, Province of Cebu, Philippines.
