Finding of Fact

Zeta Tau Alpha pleaded not guilty to the charge because their definition of cosponsoring was"planning, funding, advertising, supervising, invitation, or registration of the event." While thecommittee did fmd them responsible for negligence in the events that took place we agreed withthe above definition and do not feel they are responsible for cosponsoring the event.

Rational

Zeta Tau Alpha members did not finance or plan the party. Members and Exec. were unaware ofthe party before the dinner took place and the Homecoming Chair for Zeta Tau Alpha wasunaware of the party. Obviously, if this had been a Zeta Tau Alpha function then theHomecoming Chair and Exec. members would have an active role in the facilitation of the parry.Consequently, Exec. members did not stop members from attending the event and as a result wefelt this showed lack of responsibility.

Recommended Sanctions

These are the recommendations from the Greek Judicial Board to Dr. Gene Zdziarski on Jan. 30,2003.Because ofthe extensivesanctions that the Zeta Tau AlphaNational organization places on theirlocal chapter we felt that it wasn't necessary to further educate the chapter. Since the event tookplace in November, Zeta Tau Alpha at UF has already undergone the following and is stillundergoing educationalrequirements from their national organization.

l) Cancellation of all homecoming events2) Canecellation of all date functions planned and socials planned (were unable to get the

downpayments on several activities which resulted in the loss of thousands of dollars)3) Multiple visits from Regional and National representatives all at the expense ofthe local

chapter4) Multiple mandatoryemergency chapter meetings5) Interviews with 150 of the chapter members in regards to the event6) Educational activities for the chapter such as a member from the University Police

. Departmentandcrisiscounselors7) Required attendanceat "He said, she said" an educational rape awareness forum

Therefore, the board felt in unanimous agreement that Zeta Tau Alpha should be on conductprobation through May 2003 where they would be able to attend all social functions but to becautious of their actions.Likewise, the Board felt that a list of the names of all members whoattended and continue to attend national mandated eventsbe submitted to the Dean of StudentsOffice at the conclusion of the Spring semester.

BackgroWld:On Tuesday,Nov. 12, I was notified by .; and' - that a Gamma 10tamember was allegedly assaulted the night of November 10. GammaIotawas paired withSigmaPhi Epsilon for Homecoming. OnNovember 10 the two groupshad a "kick-off"dinnerat the fraternity house. This was a registered event, alcoholfree. Following thedinner there was a party at a house rented by some 3-4 Sigma Phi Epsilonsand 2 non-fraternitymen. At this time. the university wasproceeding with their investigation intothe assault as well as the evening's events.

Investigation:Conductedby myself, Karen Mills (formerProvince President) andJill Williams (fannerProvince President). The investigationcentered only around the dinnerand party. Wedid not investigate the assault.The three of us interviewed 153members one at a time. Each was askedto fill out aquestionnaireand we then had them elaborateon their answers. Duringthe interviewswe also took the opportunity to do some one on one education about whywe were there.

Results:Chapter membership= 177 Excused = 12 Interviewed= 153 Unaccountedfor = 12

Dinner ar the Sigma Phi Epsilon houseAttended dinner=48 it wasLaborDayweekendandmanywereoutof townMost showedup right before dinner started, hung around in the foyer for a few minutesand then were seated.. When asked if alcohol was present at the dinner,most said alcoholwas probablyavailable upstairs but they did not go upstairs because theyarrived rightbefore dinner started. Three members admittedto going upstairs, twoto consumingalcohol. Alcohol was mix.eddrinks in the rooms upstairs. One membersaid she sawsome of the fraternity men (no women)with beer cans at the dinner table.
