MUNICIPAL ORDINANCE NO. 10-2014

GRANTING A PERMANENT PARADA IN THE MUNICIPALITY OF GUINOBATANFOR PUJs BOUND TO JOVELLAR, ALBAY & TRICYCLES-FOR-HIRE BOUND TOPARIAAN, CAMALIG, ALBAY.

WHEREAS, in the grant of permanent parada for the applicants, reference shall bemade to the implementing guidelines of the LTFRBs Franchising Authority over Tricycle -For-Hire to Local Government Units Pursuant to Local Government Code of 1991 (R.A. No.: 7160),where the operators of Tricycle fo r Hire may be allowed to operate within more than oneMunicipality provided that the operators shall secure MTOPs from each municipalities having

jurisdiction over the area covered by the Zone.

WHEREAS, the divers/operators of Tricycles-For-Hire of Pariaan, Camalig Albay whousually & regularly park, load and unload right in front of the Public Market alongside with thePUJs bound to Jovellar, Albay, filed an application through the SB Committee Chairman onTransportation for the grant of permanent parada in this Municipality;

WHEREAS, giving due consideration to the application will mean additional income tothe LGU-Guinobatan and an increase to the share of the TKF and PPDAF from the Tricycle fees& charges;

WHEREAS, to fix a permanent parada for the said applicants together with the PUJswill necessarily decongest Mabini Street from heavy traffic and will give delivery trucks ofvarious goods in the Public Market enough parking space in the area;

WHEREAS, to avoid competition with the PUJs bound to Jovellar, Albay in a PublicHearing conducted for the purpose, the parties agreed to limit the zone or route of the Tricycles-For-Hire from parada in Guinobatan, Albay to parada in Pariaan, Camalig, Albay only;

WHEREFORE, in view of the foregoing premises,

BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF GUINOBATAN,ALBAY, THAT:
