DETAILED E-TENDER NOTICE No. 02 /2017 From the competent and capable Civil Engineer (Degree Holder) having experience of more than 15

years in Civil Engineering field, and non government organization having experience of more than 10

years in the field of various housing development schemes for slum dwellers and who’s/their name/s

Terms and Conditions:

1) The Interested bidders may download and collect the blank tender form available on

http://maharashtra.etenders.in website by online method.

2) For the payment of cost of blank tender form and E.M.D., Bidder should make online payment in

the A/c. of Chief Officer, Municipal Council. This original Computer Generated Money Receipts

should be submitted with other documents in envelop 1 online without this tender will not

accepted

3) The offer shall be remain valid for 60 days from the date fixed for opening of the tender. The

Chief Officer may request the bidder for extension of offer validity period & the Chief Officer

may/may not get the extended validity from the bidder. In case if no any letter received in writing

from the bidder, it will presumed that the bidder is not willing to extend validity period.

4) The Tender should submit by two (2) envelop system i.e. each for Technical & Commercial bid.

5) The Tender Holder has to use DIGITAL SIGNATURE KEY for submission.

6) The published Tender Notice in News Papers and/ or Website etc. is also a part of Terms &

Conditions of the Tender.

7) The Chief Officer, Municipal Council reserves the right to accept or reject any or all Tenders

without assigning any reason there to.

8) Priority will be given to the bidder belongs to Maharashtra State as to obtained the better & timely

services throughout the implementation period and he/they may be called for negotiation in their

rates.

9) J.V. Partnership shall not accept.

10) The bidder must have selected by minimum 5 Municipal Councils of Maharashtra state for

Preparation of Detail Project Report (DPR) under IHSDP Scheme & minimum 2 Municipal Council

(identified by GOM) for PMAY scheme and as a evidence he/they should have the work order of

minimum 5 Municipal Councils for the IHSDP & 2 Municipal Council for PMAY DPR preparation

work in his own name.

11) The bidders’ must have successfully completed in his/their own name the work of Preparation of

DPR for minimum three Municipal Council in Maharashtra State under Integrated Housing & Slum

Development Programme and the same shall have approved by Central Government.

Satisfactory work completion certificate issued by competent authorities should be submitted in

envelope 1

12) The bidder must have experience of practical construction work of minimum 50 DUs in one or

more slums under any Housing scheme in Maharashtra state and the work order should obtained

directly from the issuing authority in his own name, and not from any Private Agency.

13) All the work orders, Certificates etc. should be in the name of bidder obtained directly from the

issuing authority and not by any Private Agency & not of Sublette work order. The work obtained

from private agency/ies, as a Sublette work shall not be considered for eligibility criteria. Their

Commercial offer i.e. envelop 2 shall not be open.

14) The tenderer’s name must be in the list of experienced consultants. (Which is prepared by Mhada

and attached with Letter no. Ja.kra.Mu.A-2/Ka.A.2/451-13/1173.)

15) Tenderer must give presentation to Municipal Council regarding Online website prepared by them

for other Municipal Council for PMAY online survey work with all output data generation & reports

from the website. (Presentation will be required on Tender opening day or as informed by

Municipal Council)

16) All the documents as an evidence of the condition mentioned in the tender form shall be

submitted only online, which are to be enclosed in Envelope 1.

TENDER FORM 1. Introduction Partur Dist. Jalna Municipal Council of Maharashtra State total population is 35883 as per census 2011.

About HFA Mission under PMAY

“Housing for All’ is the mission of Prime Minister Awas Yojana and it is mentioned in the Guidelines of GoI

that all the family should have their own house and definition of family is also described therein as below.

A beneficiary family will comprise husband, wife and unmarried children. The beneficiary family should not

own a pucca house (an all weather dwelling unit) either in his/her name or in the name of any member of

his/her family in any part of India. Simultaneously, it is very clear in the GoI Guidelines that no a single

family should get the benefit of house under any subsidized Scheme for more than one time, while no a

single family should escape from obtaining benefit under this Scheme even though he is eligible.

This Municipal Council is intending to implement the mission named “Housing for All” under PMAY for

municipal council. According to that, it is required to prepare the DPR & Plan of Action.

DPR is to be prepare for all the eligible beneficiary families of the town in phase wise manner, to avoid

delay in submission & sanction the project. By this phase wise method, the DPR(s) can submit as early as

possible to the concerned department DPR shall be prepared in phase wise as suitable.

Hence Municipal Council invites offers for the appointment of Consultant through E-tenders from

technically competent and capable Civil Engineer (Degree Holder) having experience of more than 15

years in engineering field and/or Non Govt. Organization Regd. with Charity Commissioner office having

experience of more than 10 years in the field of slum housing Project for Preparation of DPR under

various Housing Schemes and also bidder must having their names in the list of experienced Consultants

(prepared by Mhada with letter no. Ja.kra.Mu.A-2/Ka.A.2/451-13/1173).

2. Scope of Work:

Working Area : Municipal Area with its adjoining slums etc. (If any)

A) TO EXECUTE THE WORK OF PHYSICAL/ONELINE SOCIO-ECENOMIC SURVEY AND DATA

COLLECTION

To execute the work of Physical/online Socio-economic surveys & data collection survey of all the

proposed beneficiaries’ family from whole city/town by collecting required documents given by

beneficiaries, through Manual as well as online process.

B) PREPARATION OF DETAILED PROJECT REPORT (DPR)

Under mentioned activities are required to be done for preparation of DPR

Based on data collected, the consultant shall have to prepare detailed project report in Phase wise

manner of all the beneficiaries as per the PMAY Guideline, and as per GoM Resolution No. Pra-AA-yo

2015-Pro.ka.110-Gru.Nir.Dho.2-(Cell)Dt.9/12/2015, in various suitable phases, which will include the

following works.

• The consultant will prepare detailed project report strictly as per the requirement and as per the

guidance and instructions in writing or oral given by M.C. for obtaining approval and will include all

the required items, which are necessary to be included in the said project report.

• Details of Housing unit and infrastructure facilities and social amenities if permissible will be shown

in detail in the said project report as well as on the drawings, as required.

• The consultant will have to prepare all necessary documents in reference to Housing For All (HFA)

Mission and also prepare the drawing, key plan, DP plan by demarking all the required components

on the same which are necessary for submission with the DPR, in the prescribed format, if any.

• To prepare the DPR only as per the instructions of M.C. and with making necessary corrections. (if

required).

• Each DPR should be complete in all respects with all reports, drawings, certificates, statements and

document necessary for obtaining the approval from the Government.

• The consultant will have to prepare detailed estimates of various type of Dwelling units as well as

basic and social amenities including Garden, Schools building etc. if required along with detailed

plans of proposed facilities.

• The DPR shall be computer typed and printed and drawing should be of Auto-Cad style. DPR in as

required copies shall submitted to the council for scrutiny and only after detail scrutiny and only

after complete satisfaction, the same shall be signed and forwarded by the Municipal Council, and

till the satisfaction, the consultant is bound to rectify the same as per instructions of Chief Officer of

the M.C.

C) Preparation of POA

i. Survey of Beneficiaries

• To Execute Socio-Economic Survey as per requirements for approval and for the speedy process

Municipal Council Partur Dist. Jalna has decided that consultant shall prepare necessary

website and software for the same and invite online application with all necessary documents

and start minimum 50 centers or also engaged café centers / satu kandra’s in all areas of

Partur Dist. Jalna City for this online Survey work also physical survey in all the slums of the

city.

• It is responsibility of Consultant to collect hard copy of application form & all necessary

documents from beneficiaries and verify the same before inserting his/her name in DPR.

• To propagate the Scheme along with its mission and encourage needy people to take the benefit

of the Scheme & aware them about to deposit their share within time & to make the payment of

Municipal Taxes now & even in future also.

• To collect all required documents from proposed beneficiaries.

II. Preparation of Slum Redevelopment/Rehabilitation Pl ans.

• To analyze the socio economic data to create city level socio economic reports to facilitate slum

level dialogues for developing slum/rehabilitation plans for relocation and/or by developing

various types of Schemes in the same area to utilize the saved land to settle other

beneficiaries. As well as to provide other social amenities like PHC, Garden, School, Market

etc., and/or to use the saved land for other commercial purpose. The funds so earned to utilize

for benefit of construction of more houses under the Scheme.

• Activities for dissemination of information and dialogues with different stakeholders or slums

redevelopment / rehabilitation plans in each zone.

• Preparation of Kachha House free city plans with slum level socio economic plans, project level

details etc. in association with NGOs, if required.

• Preparation of Time-bound programme schedule of implementation of all Phases, starting scio-

economic Survey, preparation of DPR, preparation of POA by considering the time for

sanction, prepare the time schedule to work after approval i.e. preparation of tender document,

allotment of work, execution of work till completion of Project.

3. Eligibility Criteria of the tenderer.

3.1

i. The bidder must have selected by minimum 5 Municipal Council of Maharashtra state for

Preparation of Detail Project Report (DPR) under IHSDP Scheme & minimum 2 Municipal Council

for Preparation of Detail Project Report under PMAY scheme means he/they should have

awarded the work order of minimum 5 Municipal Council for the IHSDP work & minimum 2

Municipal Council for PMAY work in his own name.

ii. The bidders’ must have successfully completed in his/their own name, the work of Preparation of

DPR, for minimum three Municipal Council in Maharashtra State, under Integrated Housing &

Slum Development Programme and the same shall also have approved by Central Government.

envelope 1

iii. The bidder must have experience of practical construction work of minimum 50 DUs in one or

more slums under any Central Govt. sponsored housing scheme in Maharashtra state and the

work order should be obtained directly from Competent Authority in his own name, and not from

any Private Agency.

iv. All the work orders, Certificates etc. should be in the name of bidder obtained directly from

Competent authority. The same should not obtained from any Private Agency & not of Subletted

work order. The work obtained from private agency/ies, as a subletted work shall not considered

for eligibility criteria. Their Commercial offer i.e. envelop 2 shall not be opened.

v. The bidder’s name must be in the list of experienced consultants. (Which was prepared by Mhada

and attached with Letter no. Ja.kra.Mu.A-2/Ka.A.2/451-13/1173.)

3.2 The bidder shall have sufficient work force and resources to carry out such works and the bidder

should be able to hire the other experts as and when required.

In addition to the above, the bidder has to submit and upload the following documents /

Information online and hard copies to be enclose in Envelop 1.

a) If the bidder, is Non Government Origination (NGO) they have to submit xerox copy of

registration certificate from charity commissioner. In case of Degree Holder Civil Engineer,

the Xerox copy of degree.

b) If the offer of NGO is accepted, along with other papers, they have also to submit the

certified copy of the Board resolution mentioning that the board has authorized the signing

authority to sign all the necessary documents, to submit the tender with the digital signature

and have rights to deal with Municipal Council, for the said tender process in future also

before signing the agreement.

c) Copy of work order in the name of bidder from 5 Municipal Council of Maharashtra state for

Preparation of Detail Project Report (DPR) under IHSDP Scheme & minimum 2 Municipal

Council for Preparation of Detail Project Report under PMAY scheme.

d) Evidence of completion of at least three DPR under IHSDP of three Municipal Council/Corp.

till its approval from GoI.

e) Other necessary documents like Copy of PAN Card, IT Return etc., which are available with

the bidder.

Note: Even though the bidder may satisfy the above requirements, he would be liable to

Disqualification, if he has:-

i. Made misleading or false representation or deliberately suppressed the information in the

forms, statements and enclosures.

4. General conditions:

4.1 The preparation of DPR will have to complete phase wise within six months for each phase & next

phase will be completed in another six months from the date of obtaining final sanction of previous

DPR, similar each Phase-wise Eighteen months time will be allowed for PMC work also. This shall

reckon from the 15th day of written order of commencing the work/from the date of obtaining a letter

of final sanction to M.C. and shall be inclusive of monsoon period.

4.2 No addition alteration in the form of tender and the schedule of tender and no additions or alteration

in the scope of work will permitted to bidder. The rates are to be quoted as per the unit mentioned.

4.3 The bidder shall particularly note that the units mentioned in the Schedule of commercial offer, are

to be followed.

4.4 The Income Tax as per norms in force from time to time or at the rate as intimated by the

competent Income Tax authority shall be deducted from bill amount whether measured bill, or from

advanced payment. No any other taxes shall be deduct at source & shall be the responsibility of the

bidder to pay directly if required, while service tax whichever applicable at the time of making

payment shall be paid separately, on the bill amount, by the municipal council.

4.5 The project is for whole the city/town area including authorized and unauthorized slums,

households along with the roadside & on reserved sites specified by the Council for the relocation

of the beneficiaries. Simultaneously, the slums, whether developed or under developing stage in

nearby areas of Municipal Council shall also be include. The DPR & POA should be prepared by

adopting any single component or combination of one or more components of Resolution of GoM

dt. 9/12/2015 as the scheme is for “Housing for All” and not a single eligible family should remain

un-benefitted from the Scheme.

5. Tender Procedure:

5.1 Towards the payment of downloading the Tender form, the Bidder should make Online payment in

the A/c. of Chief Officer, Municipal Council as men tioned in the tender and Generated Money

Receipt shall be enclosed in Envelop No. 1

5.2. The Earnest Money deposit shall be paid online payment in the A/c. of Chief Officer, Munici pal

Council as mentioned in the tender and Money Receip t Generated should be enclosed in

Envelop No. 1

5.3 Submission of Tender:

Manner of submission of offer: The bid to submit by the bidder shall comprise of two separate

envelopes.

Envelope No. 1 : Technical bid

Envelope No. 2 : Commercial bid.

Envelope No. 1: The Technical bid shall contain, along with all submittals, including the technical

details complete with all information and documents/related certificates etc. requested throughout

the biding document, mainly the documents regarding eligibility criteria must be enclosed without

which the bidders Envelope-2 shall not be opened.

Envelope No. 2: The Commercial bid shall be as per Annexure – 'I' and is to be uploaded.

Contents of Envelope No.1 : (To be submitted in har d copies & are also to be uploaded)

a. Details of legal status of the Bidder i.e. copy of registration certificate in case of NGO and in

case of Civil Engineer, the Certificate of Degree as a Civil Engineer.

b. In case of Civil Engineer, Details of businesses is being carried out by Bidder

c. Details of previous experiences required under eligibility criteria. (Certificates/work orders

received in bidders’ own name directly from Competent Authority) as already mentioned in the

tender documents. Work orders and/or certificates obtained from Pvt.A gency/ies will not

be considered for eligibility criteria.

d. Photocopies of Certificates or work orders for which bidders have experience in bidders’ own

name (not subleted) of DPR preparation work till its final approval for minimum three original

DPR Municipal Councils of Maharashtra State and work order of at least five M.C.as bidder is

selected by five M.C. of Maharashtra State for work for Preparation of DPR under IHSDP.

e. Certificate or copy of work orders received under any housing scheme for construction of

atleast 50 D/Us.

f. Other information about the bidder. (if any)

g. copy of, Online Generated Money Receipt of Payment made towards cost of blank tender from

& EMD paid should be submitted in envelope 1.

h. The envelop 1 will not be accepted if submitted either earlier or later from date & time, mention

in the tender notice and even though if submitted shall be rejected.

i. The tenderer has to submit copy in envelope 1 letter of experienced consultants prepared by

Mhada along with its list, duly highlighted or underlined his/their name on the said list, without

which the envelope 2 shall not be opened.

Contents of Envelope No. 2 : Commercial Envelope 2 is to be up loaded after quo ting the

rates as in the unit mentioned there in.

Bid Opening and Evaluation Procedure:

5.4.1. Bid Opening Procedure: The bids will opened in presence of the bidder or their representative

those who are willing to remain present.

i. Envelope No.1 shall open first, contents of envelopes will scrutinize as per the requirement of

documents.

ii. Envelope no.2 of only those bidders who have fulfilled the requirements stipulated in the

tender document and those who are eligible as per criteria shall opened by the bid opening

authority.

Evaluation of Bids : The bids of the bidder shall evaluate in two stages i.e. Technical Proposal and

Commercial offer. The Technical Proposal and Commercial offer shall evaluate as per following

Criteria.

i) Past experience of the bidder for Preparation of DPR till its approval from Competent Authority

for minimum three Municipal Council in Maharashtra State in IHSDP works as already

mentioned in tender.

ii) The bidder must have at least five work orders from five municipal council separately, for

preparation of DPR under IHSDP Scheme & minimum two work orders from municipal council

for preparation of DPR under PMAY scheme.

iii) The bidder must have work order/orders for construction of 50 DUs under any government

scheme in Maharashtra.

iv) The Presentation of Online website prepared by bidder for other Municipal Council for PMAY

online survey work with all output data generation & reports from the website

v) The name of the bidder must be in the list of experienced consultants. (which was prepared by

Mhada and attached with its letter no. Ja.kra.Mu.A-2/Ka.A.2/451-13/1173)

B. Commercial Proposal:

a) The successful bidder will selected on the lowest price bid quoted by the qualified bidder, but it

is not binding to the Municipal Council.

b) The commercial bids of only technically qualified bidders will be open for further consideration.

Consideration will give to the total price offered unit wise by the consultant to carry out to the

work as per the scope mentioned. The bidder, who has quoted the lowest price, may be award

the work, subject to negotiation made with the priority-giving bidder/bidders.

c) Any effort from any bidder to influence the process of examination, clarification evaluation, and

comparison of bids and in decision concerning the award of tender may result in rejection of

bid.

d) The rights to negotiate with any of the bidder(s) who are found to be responsive and attractive

is reserved with the Chief Officer Municipal Council.

5.5 Clarification of Bids: To assist in examination, evaluations of bids The Chief Officer of Municipal

Council may ask bidder for further clarification of his bid including break-up of costs etc. Such

request shall be in writing and the response thereto shall be in writing.

5.6 Negotiations: The Chief Officer, Municipal Council may carry out the negotiations with the bidders

for modification of the bid by calling the bidder in his office, in such case, the bidder shall remain

present in the office for negotiations. The bidders’ not present on schedule Date & time, it will

presumed that the bidders is/are not interested in negotiation. The bidder at his discretion may give

his revised bid in writing. The original bid shall then treat as modified and this modified bid shall

treat as the final bid.

5.7 Examination of Bid and Determination of Responsiven ess :

Prior to detail evaluation of bids, The Chief Officer, will determine whether each bid,

a) is accompanied with the cost of tender form & E.M.D. paid Money Receipt?

b) is meets with eligibility and qualifying criteria?

c) is properly signed by the authorized person?

d) is substantially responsive to the requirement of the bidding document?

5.8 Bid liable for rejection:

The bid is likely to be reject, if on opening it is found that,

I. The bidder has not submitted the Envelope 1 containing the copies of all the required

documents (Mainly for Eligibility Criteria) and Xerox copy of computer Generated Money

Receipts for the amount paid towards of cost of Blank tender form & EMD and if not submitted

on the exact day, date & time as prescribed in the tender notice.

II. The bidder has not strictly adhered to the procedure laid down for submission.

III. The bidder has proposed conditions or qualifications, which are inconsistent or contrary to

terms and conditions specified.

IV. The tender submitted by bidder shall be based on the clarification, additional facility Issued (if

any) by the department and this tender shall be non-conditional. Conditional Tenders will

summarily reject.

V. All bidders are caution that the tenders containing any deviation from the contractual terms

and conditions, specifications or other requirements and conditional tenders will be reject.

VI. Stipulates the validity period less than what is state in the form of tender.

VII. Stipulates any of his own condition

VIII. Does not submit the Envelope 1 on stipulated date & time in the office, as mentioned in the

tender notice.

IX Does not satisfy with evidence that bidders name is included in the list of experienced

consultants, which is prepared by Mhada as mentioned earlier.

The Chief Officer, Municipal Council does not bind himself to accept the lowest tender.

5.9 Acceptance of Tender:

i. The acceptance of tender will communicated to the successful bidder in writing by the Chief

Officer Municipal Council Partur Dist. Jalna

5.10 Award of Contract:

The Municipal Council will award the contract to the selected bidder whose bid has been

determined to be substantially responsive and who has complied with all required documentation

and information.

5.11 Municipal Council reserves the right to accept any bid or reject any or all bids:

Not with standing anything contained in these instructions, the Municipal Council reserves the right

to accept or to reject any or all bids and/or to allow or suspend the bidding process. Municipal

Council can also rejects all the bids at any time prior to award of contract without thereby incurring

any liability of costs to the affected bidders and without any obligation to inform the affected

bidders, the grounds for Municipal Council action. However, if all bids found non-competitive shall

reject.

5.12 Notification of Award and Signing of Agreement:

Prior to expiration of bid validity period or any such extended period, the Municipal Council will

notify the successful bidder by a registered and/or unregistered letter / fax / email / What’s app that

his bid has accepted. This communication may state the fees, which the Municipal Council shall

pay to the Consultant. This notification of award will constitute formal commencement of contract

subject only to the signing of the agreement with Municipal Council by the successful bidder.

5.13 Agreement:

The Successful bidder shall have to sign an agreement with Municipal Council on non-judicial

stamp paper of Rs.500/- for executing the work as per the scope of the work mentioned in this

document. The agreement will incorporate all terms and conditions between the Municipal Council

and successful bidder, & It will signed by the Chief Officer, Municipal Council within 15 days of

notification of award.

5.14 General Conditions of Contracts :

1. The successful bidder has to start the actual technical & social survey work immediate after

obtaining the approval of city/town for HFA mission by State Govt.

2. The bidder has to provide two sets of hard copy of DPR.

3. The bidder has to carry out survey for DPR preparation work for the beneficiaries as

mentioned in the guideline issued by GoI. from GoM and / or Mhada.

4. The bidder has to prepare of Detail Project Report in various phases, so that have to the

Project Report of other beneficiaries of the city should not delayed. DPR will be prepared in

phase wise as suitable.

5.15 Dispute Resolution:

i. Both the parties, hereby, specifically agrees, declares and covenants that if any dispute arises

like interpretation of the tender language, about the quality and quantities of works stipulated

there in, or if any type of dispute arises, both the parties have right to refer any/or all type of

such disputes to the arbitrator. The arbitrator shall be the Technical Officer of State Level

Nodal Agency appointed by Government of Maharashtra not below the rank of Executive

Engineer and the decision of the arbitrator shall be binding to the parties.

5.16 Jurisdiction :

The Courts where the agreement will executed will have the jurisdiction to deal with matters arising

under this work.

6. General Directions to the bidder:

The bidders are requested to read carefully the following directions, terms and conditions of the

tender & sign the form of tender, annexure, specifications and bill of quantities and rates etc. after

making appropriate entries, whenever necessary.

6.1 The following documents will form the part of the tender.

i. e-Tender notice inviting the tenders for the work

ii. Tender form

iii. General conditions of tender.

iv. Special conditions

v. Conditions of contract

vi. Commercial offer documents

6.2 Each tender should have be accompanied with the Computer Generated Money Receipt for the

payment of earnest money deposit, which will be returned to the bidder after the signing of the

agreement with the successful bidder, to those whose tenders are not accepted. The bidder of

whose the tender will be accepted his EMD will adjust towards Security Deposit.

6.3 The bidder shall make the payment of the cost of tender form & E.M.D. as mentioned in the tender

notice, directly online basis in the A/c of Chief Officer, Municipal Council. This original Money

Receipt should be submitted particularly & punctually on the date & time mentioned in the detail

Tender notice of Municipal Council and scanned copy of Computer Generated Money Receipt

should be attached with the online bidding documents.

6.4 Bidders are advice to visit the site sufficiently in advance before submission of tender. The bidder

shall be deemed of all the relevant documents, sites etc. whether he inspects them or not. All

expenses for visits to the sites, by the bidder in connection to the different stage of work shall be

borne by the Consultant.

6.5 The bidder shall quote rate according to scope of work as mentioned therein exclusive of Service

Tax, along with keeping the knowledge that if in future the Inflation Index increases, fees to be paid

to the PMC shall also be paid by increasing the amount in the same ratio by calculating the

previous year Index.

6.6 The bidders are request to know units of various items carefully before quoting the rates.

6.7 The successful bidder shall be required to execute the tender agreement within thirty days from the

receipt of intimation to execute the same. Failing which it will deemed that the bidder is not

interested to carry out the work & his/their EMD will be forfeited in whole without any further notice

and the second lowest bidder shall be called for negotiation.

6.8 All tenders will remain valid for a period of 120 days from the opening date of the tender.

6.9 The Chief Officer, Municipal Council or his duly authorized assistant will open tenders in the

presence of any intending bidders who may be present at the time. In the event of at tender being

accepted the bidders shall thereupon, for the purpose of identification, sign copies to the

specification and other documents. In the event of a tender, being rejected for opening of Envelope

2, the Chief Officer, Municipal Council shall refund the amount of the earnest money deposited to

the bidder, on the giving a receipt for the return of the money or their payment will directly refunded

online & deposited in their account.

6.10 The payment of running bill shall made for the work done on monthly basis. Payment even if it may/

may not be mention in the agreement will be made for the Phase wise work separately, considering

each Phase as a separate work or as decided by Municipal Council.

6.11 Chief Officer shall have the right of rejection all or any of the tender.

7. General Terms and Conditions:

7.1 If any information furnished by any applicant found incorrect at a later stage, he shall debarred from

tendering / taking up of work in Municipal Council and Municipal Council reserves the right to verify

the particulars furnished by the applicant independently.

7.2 In case, the offer is withdraw before validity period, the earnest money so deposited shall forfeit. In

case if the bidder can prove his inability not to execute the agreement being non possibility for

executing the work for any reasonable reason like sudden financial crises, any critical illness of

executive member or his/their relative, or death of any person directly involving in the work, the

chief Officer may refund the E.M.D.

7.3 The bidder shall follow the conditions of tender strictly.

7.4 The acceptance of tender shall rest with the Municipal Council, who does not bind itself to accept

the lowest tender and reserves the right to reject any or all the tenders received without assigning

any reason thereof. Incomplete tender or tenders not fulfilling the prescribed conditions are liable to

rejected.

7.5 Even if one time tender is called for whole town, and even one agreement is also executed, the

work is to be carried out in Phase wise manner & for payment & other purpose each phase will be

treated on separate work, and unless it not given in writing the agreement will be continue for other

phases also.

7.6 Canvassing whether directly or indirectly in connection with tenders is strictly prohibited and the

tenders submitted by the bidders / firms who resort to canvassing will be liable for rejection.

7.7 On acceptance of tender, the name of the accredited representative(s) of the bidders / firm who

would be responsible for taking instructions from concerned Engineer of Municipal Council or its

authorized representative shall be intimated by the bidders / agency within 30 (Thirty) days of the

issue date of letter / fax or Letter of Intent / award by Municipal Council.

7.8 The bidder shall not permit to tender for works, if their near relative is working in the Management /

Executive Cadre in this Municipal Council. The bidder / firm shall also intimate the names of

persons who are working with him in any capacity or are subsequently employed by him and how

are near relatives to any of the officers in Municipal Council. Any breach of this condition by the

bidder would render him liable to the withdrawal of the work awarded to him a forfeiture of Earnest

Money and Security Deposit.

7.9 The time limit of Phase wise work, as stipulated in the tender, shall reckon from the day of obtaining

sanction letter of the previous DPR by M.C. while for 1st DPR it will be reckon from the letter

received by M.C. as the name of the city is included in approved list of GoM.

7.10 The tender award, execution and completion of work shall be governed by tender documents,

consisting of Letter of Intent / Work Order, agreement, Scope of work, General Conditions of tender

etc. The bidder shall deemed to have gone through the various conditions and clauses of the

tender or any other condition, within the opinion of bidder will affect his price / rates before quoting

their rates. No claim whatsoever against the foregoing shall be entertained.

7.11 In case, the conditions mentioned above violated at any time before opening of tenders, the tender

shall summarily rejected and Municipal Council shall without prejudice to any other right or remedy

is at liberty to forfeit the full Earnest Money absolutely.

7.12 In case, the date of opening of tenders happens to be a holiday, the tenders would receive and

opened on the next working day at the same time, if possible.

7.13 If the bidder fails to complete the said work within the stipulated period or extended time limit, will

be fined at the rate of Rs. 100/- (Rupees One hundred only) per day. The amount deducted only for

the delayed period. The penalty amount shall not be exceed to Rs. 50,000/- (Rs. Fifty Thousand

only) in any circumstances.

8. FACILITIES TO BE PROVIDED BY CHIEF OFFICER TO C ONSULTANT:

Chief Officer M. C. Partur Dist. Jalna shall provide all the available data in soft copies/ hard copies/

of existing city plan, slum boundaries, ward / prabhag / block boundaries, land ownership details,

SECC data etc. at free of cost to consultant and M.C. Partur Dist. Jalna will also bear all the

expenses towards statutory approvals (Technical sanction, demand, certification, valuation etc.) as

per actual.

Chief Officer M. C. Partur Dist. Jalna will provide all the support and access to other departments/

agencies for data collection and co-ordination. The assignment will be contracted by the J. M. C.

Partur Dist. Jalna, Management of assignment and all logistical, financial and methodological

arrangements will be done by M. C. Partur Dist. Jalna and will ensure the support of municipal

officials wherever necessary.

Municipal Council will:

Designate a City Planner/ Engineer as Nodal Officer solely responsible for management and coordination

of this Assignment,

a) Constitute a Stakeholders Group and conduct workshops and meeting with them

b) Provide the consultant the list of identified slum with gazette notification and plan making

actual boundaries of the slum and Beneficiaries in the Requisite Formats and other Slum

related data,

c) Carry out the collection of additional information of Beneficiary if required and provide the

same to consultant.

d) Provide the consultant with necessary authorization to procure information from lined

departments and carry out topographic surveys if required.

e) Forward the Reports and proposals to State/ Central Government, or any other

Government department, required time to time, if any, for approval and sanction, under

Pradhan Mantri Awas Yojana and Atal Mission for Rejuvenation and Urban

Transformation or any state or centre funded scheme mentioned in this or taken in hand

through this document.

f) Partur Dist. Jalna Municipal Council will provide minimum 1000 sq ft space in the Council

Building for PMAY office with required furniture free of cost. All other required equipment

/ stationery / computers / laptop / printer / scanners will be purchased / arranged by

Consultant.

Project Management Consultancy (PMC) Work (as below) i. e part of B Part A:- Under PMC work, after receipt of approval from the Govt., the bidder has to prepare the revised Estimates of all the sanctioned components (if required), also to prepare revised drawings, design etc. for purpose of Technical sanction as well as for ractical execution of work. To obtain the technical sanction for all the estimates by visiting & discussion with the competent authority. Engineer, by fixing the date for Joint Inspection, prepare computer typed bill & to submit the same to M.C. for final checking, necessary corrections & payment to the contractor.

(ii) To supervise the construction work of Dwelling Units (if constructed individual or in cluster or in any other type,) prepare their stage wise payment sheet on the basis of estimated amount & to submit into recommendation for payment.
