ACP’s Legislative Updates Updated 6/6/2016The North Carolina Senate moved its budget very quickly last week releasing it late Tuesday evening and passing its third and final reading after midnight on Friday morning. The Senate spent Wednesday debating the budget in committees before passing it on to the Senate floor for debate on Thursday. The bill passed its second reading by a vote of 33-15 and then passed it final vote at 12:05 am Friday morning—both along party lines. This week, a conference committee will be appointed by the Speaker of the House and Senate pro tempore to negotiate the differences and work toward a final budget.All indications are the House and Senate are ready to move forward toward adjournment by the end of June, which means budget negotiations could move very quickly. The Senate has included legislation that make changes to the sales tax expansion to repairs, maintenance and installations in the budget which puts that issue into conference with the House. This could be one of items that slow down the conference process.

Pharmacy… the Senate budget does the following:There are no changes in pharmacy reimbursement for Medicaid in the Senate budget.

Reduces the Division of Medical Assistance (DMA) base budget for the impact of enrollment, utilization, and pricing based on the Division of Medical Assistance forecasting model and year to date trends in spending and enrollment. The reduction in the Medicaid rebase represents 7.9% decrease from the enacted budget. The revised net appropriation for DMA is $3.6 billion after all changes and is a $310 million reduction.

Includes a requirement that prescribers of controlled substances check Controlled Substance Reporting System (CSRS) for the 12-month history of the patient prior to prescribing a controlled substance. The Senate also included $1.7 million in additional funding to upgrade the CSRS software.

Senate Bill 734 (Naloxone), which was on such a fast track though the Senate, did not see action in the House last week but continues to be working toward passage with its final committee hearing scheduled in the House Judiciary I Committee on Wednesday, June 8. This clarifies NC law to allow the state health director to issue the standing order for the entire state and all pharmacists, rather than each pharmacy having to seek a standing order from an individual physician. It would allow a practitioner acting in good faith and exercising reasonable care to directly, or by standing order, prescribe an opioid antagonist (naloxone hydrochloride) to either a person at risk or experiencing an opiate-related overdose, or to a family member, friend, or other person in a position to assist a person at risk of experiencing an opiate-related overdose. It would also provide immunity from civil and criminal liability for such action.

As stated before in discussion, SB 734 will not have a waiting period and will become law when the governor signs the legislation. The Department of Rural Health and the governor’s office intend to highly publicize the passage of this bill and will get maximum coverage across the state in all forms of media. All pharmacies should be aware that the local media will pick up this story and will be interested in talking to their local pharmacies about the new law. The media will want to see a sample of naloxone in the pharmacy.
