    Sir,am directed to seate that the Commisslon has announced the schedule for holding

    General Elections to Lok Sabha and to the Legislative Assemblies of the States of AndhraPradesh, Orlssa an d SkkImIncluding certain b yesle ctlons to the Legislative Assembliesof some States Press Note No. ECI/PN/10/2014, dated Sb March 2014 available atCommission s web-site -.ed.gov.In].2. With this announcement. the provisions of the Model Code of Conduct for the guidanceof the Political Parties and Candidates have come Into forcewit nd will bein force Ull the completion of the General Elections Thls may be brought to the notice of theCentral State Covernments, all Ministries/Departments and all other omces of the ,UnionGovernment and the State Government of the State.3 Your particular attention is drawn to the provlsions of Model Code of Conduct for theguidance of Political Parties and Candidates and various Instructions issued by theCommission, whlch, inter-alia, state that the party In power whether a t the Centre or in theState or States concerned, shall ensure that no cause is given for any complaint that it has usedi t s official position for the purposes of its election campaign and in particular:-

    i) a) The Ministers shall not combine their officlal visit with electioneering work andshall not also make use of official machinery or personnel during the electioneeringwork;@ Government trans port including ofRcial a ir -c r a b , vehicles, machinery andpersonnel shall not be used for hrthe ran ce of the interest of the party in power;

    ii) Public places such s ma idans etc, for holding election meetings, an d use of helipads forair-flights in conn ection with elec ttom shall not be monop olised by itself. Other parties andcandidates shall be allowed the use of such places and bcillties on the same terms andconditions on which they ar e used by the party in power;ill] Rest houses, dak bungalows o r other Government accommo dation w here elections have

    been announced or are taldng place can be given to the political functionaries who areprovided securl ty y th e State In cale or above or equivalent by various State Governmentsor the Central Government under provisions of their laws, on equitable basis. This shall besubject to condition that such accommodation is not already allotted or occupied by electtonrelated officials or Observers. Such polltical functionaries shall not carry out any politicalactivity while staying in the Government Guest Houses/Rest Houses or other Governmentaccommodation et c;Iv) Issue of advertisement at the cost of public exchequer in the newspapers and other

    medla and t he mis use of official mass media d uring th e election perlod for partisan coverage ofpolitical news and publlclty regard lng achievements with a view to fu rthering th e prospects ofthe party in pow er shall be scrupulously avoided;v) Ministers and oth er authorlties shall not s a n d o n grants/payments ou t of discretionary

    funds from th e time elections ar e announced by the Commission andvi) From the t im e elections are announced by Comm isslon. Ministers and other authorities

    shall not -a) announce any financial gran ts in any form or prom ises thereof; orb) except civil ser van ts) lay found ation stones etc. of projects o r sche m es of any kind; orc) make any pro m ise of constru ction of roads, provision of d rinkin g wate r facilities etc.: ordl make any ad-hoc appointments in Government, Public Undertakings etc. which may

    have t he eflect of Influencing the voter s in favour of th e party in power.4. As will be ob served from Para 3{Clause 1V above, no ad ver tise me nk shall be issued Inelectronlc an d prin t m edia highlighting the achievem ents of the GO- a t th e cost of publicexchequer. If any advertise men t has already been released for telecast/broadcast o rpublication in the p rlnt media, it must be ensured tha t the telecastfiroadcast of such ads on

    electronic media is stopped forthwith and that no such ad Is published in any newspapers,magazines,etc, i.e. in prlnt media. h m oday Itself and It should be Immediately withdrawn.5 The instruction of the Commission contained in Its letter No.437/6/2009-CCBE dated5 6 March, 2009 is available on the Commlsslon s web-site http://ecl.nicin/ under the headingElection Laws and ECI Instructions for your Information and necessary action.

    The Commlsslon directs that there shall be a total ban on the transfer of alloRlcers/officials connected with the conduct o the election These include but are notrestricted to:

    I) The Chlef Electoral Officer and Addltional/Jolnt/Deputy Chlef Electoral Otlicers:It) Dlvlsional Commissioners;ill The Dlstrlct Election Offtcers, Returning ORicen, Assistant Returnlng Officers and

    other Revenue Otlicers connected with the Conduct of Election;1 Otlicers of the Police Department connected with the management of election Hke

    range IG s and DIGS Senior Superlntendents of PolIce and Superintendents of Police,Sub-Divisional Police Officers like Deputy Superintendents of Police and otherPollce oficers who are deputed to the Commission under sealon 28A of theRepresentation of the People Act. 1951;

    v The transfer orderr issued in respectof the above categories of offlcers prior to thedate of announcement but not implemented tlll date should not be given effect towithout obtainlng spedfic permlsslon from the Commission in this regard;

    vi] This ban shall be effective till the completion of the election. The Commissionfurther directs that the State Governments should refrain horn making transfers ofsenior officers who have a role in the management of election In the State;

    vi9 In those caseswhere transfer of an officer Isnece- on account of adminisrntiveexigencies, the concerned State Government may with full justiflation approach theCommission for prior clearance..

    am directed to refer to the Commission s Press Note No. ECI/PN/10/2014,dated 5 h March, 20 14 (Press Note available at Comm~ss~on s eb-sitewww.ed.gov.ln) as per which the Commission has announced the enforcement of theModel Code of Conduct for the guidance of the Political Parties and Candidates,consequent on the announcement of General Electlon to Lok Sabha and to theLeglslatlve Assemblies of the States of Andhra Pradesh, Odisha and Sikklm Includingcertain bye-elections.2 The Commission has considered the release of funds under the Member ofParliament Local Area Development Schemes and has decided that-

    a) No fresh release of funds under the Member of Parllament (including RajyaSabha members) Local Area Development fund shall be made in any part ofthe country where election is in progress. Slmllarly no fresh release offunds under the MLAs / MLCs Local Area Development Fund shall be made,if any such scheme Is in operation, till the completion of election process.

    b No work shall star t in respect of which work orders have been issued beforethe issue of this letter the work has actually not started in the field.These works can start only after the completion of election process.However, if a work has actually started, that can continue.

    c) There shall be no bar to the release of payments for completed work(s)subject t the full s a t l ~ f a ~ o nf the concerned ofilcials.
