7. Corrigendum (Rule 216)

The committee responsible had forwarded the following corrigendum (P7_TA-PROV(2011)0004(COR01)) to a text adopted by Parliament.

Corrigendum to the European Parliament position adopted at second reading on 18 January 2011 for adoption of a regulation of the European Parliament and of the Council laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC P7_TA-PROV(2011)0004 - (10753/3/2010 – C7-0267/2010 – 2008/0098(COD))

Pursuant to Rule 216(4) of the Rules of Procedure, this corrigendum would be deemed approved unless, not later than 48 hours after its announcement, a request was made by a political group or at least 40 Members that it be put to the vote.

The corrigendum was available on the Séance en direct site.

8. Interpretation of the Rules of Procedure

The President notified Parliament that, pursuant to Rule 211(3), the Committee on Constitutional Affairs, to which the matter of the application of Rules 56 and 50 had been referred, had provided the following interpretation of those rules:

1) Interpretation of Rule 56

Following a referral back to committee under Rule 56(3), the committee responsible, prior to adopting its decision on the procedure, must allow a committee associated under Rule 50 to make its choice as to which amendments are its exclusive competence, including the choice of the amendments that are to be resubmitted to Parliament.

The time limit set in the second subparagraph of paragraph 3 applied to the submission, orally or in writing, of the report by the committee responsible. It did not affect Parliament’s decision as to when consideration of the procedure in question should recommence.

2) Interpretation of Rule 50

The decision by the Conference of Presidents to apply the associated committee procedure applied at all stages of the procedure in question.

The committee responsible could exercise the entitlements arising from its status as ‘lead committee’. In exercising those entitlements it had to respect the prerogatives of the associated committee, including the requirement to cooperate fairly with regard to timing and the right of the associated committee to decide on the amendments to be submitted to Parliament in fields that were its exclusive competence.

In the event of the committee responsible not recognising the prerogatives of the associated committee, the decisions taken by the former would remain valid, but the latter could directly submit amendments to Parliament, within the bounds of its exclusive competence.

If this interpretation was not contested by a political group or by at least 40 Members (Rule 211(4)) before the opening of the sitting the following day, 16 February 2011, it would be deemed to have been adopted. Otherwise, the matter would be put to the vote in Parliament.

‘The Commission shall submit, by March 2012, a report to the European Parliament and the Council on the appropri­ateness of a mechanism for compensating farmers whose foodstuffs have been contaminated above the maximum permitted levels and that cannot be placed on the market. That mechanism should be based on the polluter-pays principle. The report shall, if appropriate, be accompanied by a legislative proposal setting up such mechanism.’
