MINUTES OF SECOND MEETING 2019-2020 BOARD OF LICENSURE

FOR PROFESSIONAL ENGINEERS AND LAND SURVEYORS Montgomery, Alabama

January 14, 2020

The Alabama Board of Licensure for Professional Engineers and Land Surveyors was established by legislative action in 1935. Its charter is to protect the public by helping to safeguard life, health, and property, and to promote the public welfare by providing for the licensing and regulation of persons in the practices of engineering and land surveying. This purpose is achieved through the establishment of minimum qualifications for entry into the professions of engineering and land surveying, through the adoption of rules defining and delineating unlawful or unethical conduct, and through swift and effective discipline for those individuals or entities who violate the applicable laws or rules. Board meeting notices are posted on the Open Meetings area of the website of the Secretary of State, and the Board’s website under Dates and Deadlines. Chair Whorton called the second meeting of the 2019-2020 Board to order at 8:20 A.M., Tuesday January 14, 2020, at the Board Office in Montgomery, Alabama. He noted that there was a quorum of Members present and the meeting began with the pledge of allegiance and a prayer. The following Members and Staff were in attendance. 20-026. IT WAS MOVED by Mr. Johnson and seconded by Ms. Walton to adopt the agenda as proposed. MOTION CARRIED 9-0.

Minutes of the first meeting of the 2019-2020 Board held on November 6, 2019, were reviewed.

20-027. IT WAS MOVED by Mr. Vaughn and seconded by Mr. Barter that the minutes of the first meeting of the 2019-2020 Board held November 6, 2019, be approved. MOTION CARRIED 9-0.

The Board reviewed pending Action items assigned to sub-committees. During this review, the Board approved a draft letter to be sent to GIS Departments throughout the State. The Board’s Remote Supervision sub-committee agreed to meet during lunch to have additional discussion. APPLICATIONS – Mr. Nathan G. Johnson, Advisor The Board previously authorized the Executive Director to approve applications for licensure, intern certification, and examinations if the application is in order and all requirements have been met. Applications of those applying for Professional Engineer licensure by comity since November 6, 2019, as provided by Section 34-11-4(1)(b) of the Licensure Law, were considered. Applications of those applying for Professional Engineer licensure by examination since November 6, 2019, as provided by Section 34-11-4(1)a and b, of the Licensure Law having previously passed the FE Examination in Alabama or in another jurisdiction, were considered. Applications of those applying for Engineer Intern certification since November 6, 2019, as provided by Section 34-11-4(2) of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure since November 6, 2019, as provided by Section 34-11-4(3)a and b of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure since the November 6, 2019, having previously passed the Fundamentals of Land Surveying Examination and the Principles and Practice of Land Surveying Examination in Alabama or in another jurisdiction were considered and were approved to take the Alabama Land Surveying Standards, History, and Law Examination.

20-028. IT WAS MOVED by Ms. Walton and seconded by Ms. Adams-Morales that the Board ratify the approval of licenses issued since the November 6, 2019, meeting and the list of those be included in the minutes on Attachment #1. MOTION CARRIED 9-0.

20-029. IT WAS MOVED by Ms. Walton and seconded by Mr. Johnson that the Board ratify

the approval of Intern Certifications issued since the November 6, 2019, Board Meeting and that the list of those be included in the minutes on Attachment #2. MOTION CARRIED 9-0.

20-030. IT WAS MOVED by Ms. Walton and seconded by Ms. Adams-Morales that the Board

ratify the approval of exam applicants approved since the November 6, 2019, Board Meeting and approve for examination the applicants listed on Attachment #3. MOTION CARRIED 8-0 with Mr. Johnson abstaining from the vote.

20-031. IT WAS MOVED by Ms. Walton and seconded by Ms. Adams-Morales to deny for

licensure the application of Jason Robert Williams, Chris Arlandson, Rainer Arceo Feria, Jarrell Blake Whitman, and deny for certification the application of Campbell Doss Cook. MOTION CARRIED 9-0.

20-032. IT WAS MOVED by Ms. Walton and seconded by Ms. Adams-Morales to close the

inactive applications listed and include them on Attachment #4. MOTION CARRIED 9-0.

20-033. IT WAS MOVED by Ms. Walton and seconded by Mr. Averrett to deny for examination the application of Marshall Tye Bailey. MOTION CARRIED 8-0 with Mr. Johnson abstaining.

The Board reviewed a letter from Mr. Clay Richardson requesting it to provide an opinion as to if the procedures he proposed would meet the licensure requirements. The Board determined to advise Mr. Richardson that it could not provide an opinion on possible scenarios for becoming licensed, that he would need to submit an application for its review and determination. Mr. Lee William Howard along with his supervisor Gabe Jackson met with the board to discuss the experience outlined on his professional engineer licensure application. After discussing his work experience the Board made the following motion.

20-034. IT WAS MOVED by Mr. Johnson and seconded by Mr. Breighner that the Board approve the professional engineer licensure application of Lee William Howard. MOTION CARRIED 4-3-2 with Mr. Johnson, Mr. Breighner, Mr. Barter, and Ms. Baldwin voting for the motion, Mr. Averrett, Mr. Vaughn and Ms. Walton voting against the motion, and Mr. Whorton and Ms. Adams-Morales abstaining.

CERTIFICATES OF AUTHORIZATION – Ms. Adams-Morales, Advisor The Board authorizes the Executive Director to issue certificates of authorization to applying firms if the application is in order and all requirements have been met. A list of the certificate of authorizations issued since the November 6, 2019, Board Meeting were reviewed.

20-035. IT WAS MOVED by Ms. Adams-Morales and seconded by Mr. Barter that the Board ratify the approval of the Engineering and Land Surveying Certificates of Authorization issued since the November 6, 2019, Board Meeting and the list of those issued be included in the minutes on Attachment #5. MOTION CARRIED 9-0.

The Board recessed for lunch at 11:30 am. The Board reconvened at 12:20 pm. LAW ENFORCEMENT – Ms. Elaine B. Walton, Advisor The Board reviewed the status of the files pending with the Investigators, and the Investigative Committee. The Board was briefed on the 2019-2020 statistics. The Board discussed pending cases presented by the investigative committees to accept, modify, or reject the recommended actions. The cases were discussed in a sanitized format to avoid compromising due process for the Respondent in the event the Board determined another course of action.

20-036. IT WAS MOVED by Mr. Johnson and seconded by Mr. Breighner that the Board

accept the proposed Consent Order and issue a Final Order thereby closing Case 2019-21. MOTION CARRIED 8-0 with Ms. Adams-Morales recused.

20-037. IT WAS MOVED by Mr. Vaughn and seconded by Ms. Adams-Morales that the Board

accept the proposed Consent Order and issue a Final Order thereby closing Case 2019-26. MOTION CARRIED 8-0 with Mr. Barter recused.

20-038. IT WAS MOVED by Mr. Johnson and seconded by Mr. Breighner the Board accept the recommendations of the investigative committee and close Case 2019-27 with no action. MOTION CARRIED 8-0 with Mr. Barter recused.

20-039. IT WAS MOVED by Mr. Barter and seconded by Mr. Breighner that the Board modify

the recommendations of ALJ Jerry Wood to require a $2,500 fine, a six-month license suspension period, payment of $121.13 for the cost of the hearing, and issue a Hearing Order thereby closing Case 2019-09-B. MOTION CARRIED 8-0 with Mr. Johnson recused.

20-040. IT WAS MOVED by Mr. Johnson and seconded by Ms. Walton that the Board accept

the recommendations of the investigative committee and close Case 2019-29 with a letter of caution. MOTION CARRIED 8-0 with Mr. Whorton recused.

20-041. IT WAS MOVED by Mr. Averrett and seconded by Ms. Walton that the Board accept

the recommendations of the investigative committee and close Case 2019-31 with a letter of caution. MOTION CARRIED 7-1 with Mr. Johnson opposed, and Mr. Vaughn recused.

20-042. IT WAS MOVED by Mr. Averrett and seconded by Mr. Barter that the Board accept

the recommendations of the investigative committee and close Case 2020-04 with no action. MOTION CARRIED 8-0 with Mr. Johnson recused.

COMMUNICATIONS AND PUBLICATIONS - Ms. Nanette T. Baldwin, Advisor The Board was briefed on current Outreach activities; and reviewed the Annual Report to be submitted to the Governor. FINANCE – Mr. John E. Averrett, Advisor The monthly financial reports for August and September were briefed. EXECUTIVE DIRECTOR’S REPORT The Board was briefed on (1) travel to the NCEES Zone meeting in April 2020, (2) a letter provided to licensed general contractors advising them of the QBS requirement for professional engineers and surveyors, and the Examiner’s Training scheduled for January 29, 2020. CORRESPONDENCE The Board reviewed a list of individuals asking to be granted the right to use the title "Professional Engineer, Retired" or “Professional Land Surveyor, Retired.”

20-043. IT WAS MOVED by Mr. Averrett and seconded by Ms. Adams-Morales that the Board ratify the approval of the individuals requesting to use the title "Professional Engineer, Retired” or Professional Land Surveyor, Retired”. MOTION CARRIED 9-0.

The Board reviewed correspondence submitted by Mr. Jon Ramirez of the organization, “Hunter Engineering Company” that requested the Board allow the organization’s name to contain the word “Engineering” without having to meet the certificate of authorization requirements.
