10.1.6 FORWARD CAPITAL WORKS PLAN

The Royalties for Regions is a plan for the whole of Western Australia, with a focus on building communities in regional areas through six policies objectives:

Building capacity in regional communities Retaining benefits in regional communities Improving services to regional communities Attaining Sustainability Expanding opportunity Growing prosperity

The primary objective of the Royalties for Regions Country Local Government Fund (CLGF) is to address the infrastructure backlogs across to country local government sector. The fund provides country local governments sector with additional money for the purpose of infrastructure provision and renewal. Funding is provided to individual country local governments and regional groups of country local governments to promote strategic infrastructure development and asset preservation and renewal. The fund aims to:

Address infrastructure backlog and support capacity building Improve the financial sustainability of country local governments in WA through improved

asset management Provide financial assistance to country local governments which choose to amalgamate

voluntarily Assists groups of country local governments to fund larger scale infrastructure projects

COMMENT Council is required to adopt a Capital Forward Works Plan (CFWP) in order to meet the requirements of forward capital planning and enable Council to access the allocated funds. Council adopted its Capital Forward Works plan at the December 2010 Ordinary meeting and resolved to review the plan annually as part of its budget preparations. Guidelines for the 2011-12 CLGF allocations were released last year. For the first time the guidelines included a date to which submissions had to be submitted to the department. A draft submission has been forward to the department, with staff requesting an extension be granted to allow Council the

opportunity to review the CFWP and endorse the Recreation and Events Centre – stage one as Council’s top priority. STATUTORY ENVIRONMENT Royalties for Regions Act 2009 POLICY IMPLICATIONS Council does not have a policy in relation to this matter. FINANCIAL IMPLICATIONS There are signification financial implications associated with the adoption of this report. The main financials implications are;

2011/12 CLGF Budgeted Income $376,608 and future years funding Recreation and Events Centre – stage one Capital Expenditure 2012/13 Financing Inwards – Community Development Reserve Future Capital Expenditure, as indentified within the plan.

The Plan also indicates a number of funding sources for capital expenditure, these funding sources are not confirmed, and Council’s ability to attract the required funding levels will significantly impact on Council’s financial ability to fund the plan. STRATEGIC IMPLICATIONS Capital works projects are in line with the adopted Plan for the future 2010-2020 as well as Council’s Strategic Plan in many of the Key result areas. 10.2.2 EHO – INFORMATION UPDATE

Applicant: Shire of Corrigin Location: Corrigin Date: 15 February 2012 Reporting Officer: Lauren Bosch, Environmental Health Officer Disclosure of Interest: No interest to disclose File Number: BACKGROUND The following is to update Councillors on any issues that have occurred and work undertaken to date by Shire’s Environmental Health Officer. COMMENT Private Swimming Pools and Spas In November 2011 the Shire commenced swimming pool and spa safety barrier inspections. The inspections are to check whether the barriers are compliant with Australian Standard 1926.1-1993. Only pools within the town sites of the Shire are required to be inspected. Initial inspections were conducted in November and December 2011 and follow-up inspections have been completed. 12 swimming pools and 3 spas are now on the register. Routine compliance inspections are required at a minimum of once every four years. It is likely that there are more spas in town to be registered, and advertising encouraging residents with spa pools to register with the Shire has already be organised. Corrigin Hydrotherapy Pool A representative from the Department of Health inspected the new hydrotherapy pool on 31 January. There are some items to address before the pool can be opened. They are currently underway. Once the water chemistry has been corrected, water samples can be taken, which will indicate whether the water quality is satisfactory for use. Food Premises Assessments Routine assessments of food businesses within Corrigin have been completed over January and early February, with some follow-ups already performed. If there are any contentious issues which require regulatory action, such as issuing Prohibition Orders (premises closure), Council shall be made aware of them as they arise. These situations are unlikely and will only occur if absolutely necessary. Routine assessments will continue on a 3-4 monthly basis, however premises that need to be checked more regularly will be followed up on at random to ensure continuous compliance. Public Building Assessments Initial assessments of public buildings within the Shire have commenced this month and a register and assessment record is being created. It resembles the food premises register, however once initial assessments and follow-ups have occurred, routine assessments are only required annually.

A representative from the Department of Health was present at the Corrigin District Club and Corrigin Hotel inspections to provide input and advice on public buildings of that age. Lodging House Registration Under the Health Act 1911, a lodging house means:

“any building or structure, permanent or otherwise, and any part thereof, in which provision is made for lodging or boarding more than 6 persons, exclusive of the family of the keeper thereof, for hire or reward”

However it does not include a liquor licensed premises. A person who keeps a lodging house is obliged to register the lodging house with the local government. Local Government is required to keep a register of lodging houses within their jurisdiction, and assess them for compliance with Lodging House part of their Health Local Laws. To date the Shire has not enforced this legislation and the Health Local Laws which apply to lodging houses. Inspections of some accommodation for health and hygiene purposes may have occurred in the past, however there is no record of a register on file. A letter with a copy of the Health Local Laws and registration forms will be sent to businesses which may house more than 6 people, workers accommodation for example CBH and shearers quarters, motels, resorts, caravan parks, hostels, farm stays and B&B’s. Health inspections at the hotel will continue even though it is not required to be registered as a lodging house, as it has a liquor license. Discussions with Liquor Licensing indicate that they would prefer that health inspections by the Shire take place and if there are serious health issues found, they should be reported to and dealt with by the Department of Racing, Gaming and Liquor. Asbestos Competency Course The EHO will be attending an asbestos materials competency course in Merredin on 28/29 February 2012. It is a 1.5 day course which is nationally accredited and will help in addressing issues associated with the identification and control of asbestos materials within the Shire. Leave The EHO will be taking leave from 6 – 20 March 2012. STATUTORY ENVIRONMENT

13 CHIEF EXECUTIVE OFFICERS REPORT

The Shire has employed Pippa Boyland 5 days per week. Pippa will work 2 days per week in the Shire office at the front counter and 3 days per week in the Resource Centre. Amanda Crombie has also been employed 3 days per week at the front counter of the shire office. The Executive Support Officer position has been advertised to fill a vacancy to cover parental leave and applications close on Friday 24 February. Tanya has taken on the Debtors & Creditors role and also Rates while Karen Wilkinson is on parental leave. The CEO has appointed contractors in to run the pool for the remainder of the season due to the unavailability of the Pool Manager to continue his duties. Boyd Street has been re-sealed, Knight Court has been sealed and they will both be kerbed shortly. The Works Crew are also making good ground on Lomos South Road. The construction of the house on Lawton Way is progressing well. The cabinets have been installed in the bathroom and the plumber has installed toilets. Tiles have been laid. The kitchen cabinets are being constructed and should be installed soon. Then there is painting, carpets and the garage roller door. The Building Supervisor believes the project is well on budget with a good amount remaining for landscaping lawns, fencing etc. The CEO met with WA Country Builders who are going to list house and land packages on their website. They are also have put advertising signage on the Granite Rise subdivision.

14 PRESIDENTS REPORT

The President thanked to staff and Councillors who attended the Australia Day BBQ. Approximately 185 people attended the event. The recent Integrated Planning & Reporting Workshops was attended by 6 Councillors. The President advised that she attended the recent Local Health Advisory Group meeting.

Cr Bolt advised that he was unable to attend the Central Agcare meeting as it was was planned for the same time as the Council meeting.

16.1.1 LOCAL GOVERNMENT REFORM AGENDA

Applicant: Councils for Democracy Location: Perth Metropolitan Area Date: 21 February 2012 Reporting Member: Cr Lynette Baker, President Disclosure of Interest: No interest to disclose File Number: GOV 0019 BACKGROUND Council has received a request for support for the retention of the self-determination clauses of the Local Government Act 1995 from the Councils for Democracy, a group comprising the local governments of the Town of Claremont, Town of Cottesloe, Town of Mosman Park and the Shire of Peppermint grove. The group seeks to lobby the State Parliament to retain the clauses in the Local Government Act 1995 which provide for electors to demand a poll on a recommendation to amalgamate local governments. The Councils for Democracy have provided the following submission for Council consideration:

We write to you to seek your Council’s support to join with your fellow councils to preserve the right of your constituents to decide for themselves whether or not your Council should be amalgamated with another council if that is ever proposed.

That right to self-determination is embodied in clauses 8, 9 and 10(2) of Schedule 2.1 of the Local Government Act 1995 (WA). These “Poll Provisions” (called the “Dadour amendment” after the politician who introduced them) enshrine the right for 250 electors or 10% of electors in a local government district (whichever is the lesser) to require a poll on any proposed merger of their council, whereby they can veto the merger so long as at least 50% of electors participate in the poll and more than 50% of those who do participate elect to vote against the proposed merger.

This is fair in requiring proponents for change to use persuasion rather than force.

The Poll Provisions embody your constituents’ democratic right to self-determination. Every democracy should be entitled to determine its own future.

The State Government of Western Australia intends to reduce the number of Local Governments, initially through its Metropolitan Local Government Review, but without any assurance that the Poll Provisions will not later be repealed, diluted or circumvented so as to forcibly implement any proposed reduction in council numbers.

The Western Australian Local Government Association (WALGA) in its submission to the Metropolitan Local Government Review shied away from any mention of the Poll Provisions and may not defend their continued preservation.

To better ensure that the State Government and WALGA recognise that the Poll Provisions are sacrosanct and must not be repealed, diluted or circumvented for any reason whatsoever, we request that you move your Council to formally resolve as follows:

Each of the below signatories to this letter will be putting this proposal to their respective councils when it next convenes, and we would hope that you do likewise.
