HUMAN rights groups in Davao City and Vice Mayor Rodrigo Duterte have issued a strong demand for the dismantlement of all military detach-ments and patrol bases in civilian communities after the September 7 incident in Barangay Fatima Paquibato.

On September 1, a unit of the New People’s Army’s (NPA) Medardo Arce Command tossed a grenade at a military detachment.

2 high school students killed, 3 others wounded in shootingCOTABATO City––Au-thorities are hot on the trail of two gunmen who fired upon a group of high school students along Sausa St. here on Wednesday afternoon, killing two and wounding three others.

Sr. Supt. Marlo Martinez, city police deputy direc-tor, identified those killed as Saddam Ampatuan, 17, of Barangay Poblacion 4; and Mark Bandali, 15, of Barangay Bagua 2, both of this city.

Ampatuan died on the spot while Bandali expired several hours after at a local hospital where they brought following the incident.

The names of those wounded were withheld considering they are minors and are vital witnesses to the incident, Martinez said.

Initial investigation revealed that the victims were walking toward their school, the Roxas National High School, situated along Sausa St. around 4:45 p.m.

Tuna stakeholders to tackle measures to conserve ‘tuna’ in the Pacific region

GENERAL SANTOS CITY-- City officials are set to meet with tuna industry players here to discuss measures that would keep the indus-try afloat amid the possible implementation of more fishing restrictions in the high Pacific seas in the coming months.

City Mayor Darlene Antonino-Custodio said they would look into vi-able alternatives that would help counter the impact of

additional conservation measures being planned by the Western and Central Pacific Fisheries Commis-sion (WCPFC) for Pacific tuna fishing grounds.

“(These issues) will be discussed together with the (tuna) sector,” she told reporters.

WCPFC members, co-operating non-members and participatingterritories is scheduled to gather in Manila on Dec. 3 to 7 for

its 9th regular session.The WCPFC was estab-

lished by the Convention for the Conservation and Management of Highly Mi-gratory Fish Stocks in the Western and Central Pacific Ocean, of which the Philip-pines was a signatory, that came into force in 2004.

Prof. Glenn Hurr y, WCPFC executive direc-tor, said the meeting would mainly focus on the adop-tion of new regulatory mea-sures that would further strengthen their ongoing conservation initiatives in the high Pacific seas.

The commission closed down to tuna fishing in late 2009 the four pockets of the Western and Central Pacific Ocean due to con-cerns over the declining tuna fish stocks in the area.

The WCPFC imposed the fishing ban on all of its 25-member countries and 10 other observer-states as a result of scientific studies and the emergence of statis-tics that showed the drastic decline of tuna fishstocks, especially bigeye and yel-lowfin tuna.

But it decided last March to reopen the Pacific Ocean’s Pocket 1 starting Oct. 1 exclusively to Filipino fish-ermen.

TROPICAL STORM “KAREN” intensified into a typhoon while still hovering over the East Philippine Sea at mid-morning Thursday, the state weather bureau said.

The Philippine Atmospheric, Geophysi-cal and Astronomical Services Administra-tion (PAGASA) defines a typhoon as an intense tropical cyclone with maximum wind speed exceeding 117 kilometers per hour.

Weather forecaster Aldczar Aurelio said that as of 10 a.m. Thursday, typhoon Karen was located at 760 kilometers east of Infanta, Quezon (15.1°N, 129.6°E) with maximum sustained winds of 120 kph near the center and gustiness of up to 150 kph.

Karen continues to move northwest at 13 kph and with its present speed, Aurelio said it is expected to leave the Philippine territory by Saturday evening or Sunday morning on its way to southern Japan.

He also said Karen may not make landfall in any part of the country since it will only pass over the eastern seas of the country.

Aurelio added that no public storm signal was raised and no other weather disturbance was seen near the Philippine territory.

PAGASA said the estimated rainfall amount is from 10 to 20 millimeters per hour (heavy) within the 550-km diameter of the typhoon.

The weather agency said that Karen is expected to enhance the southwest monsoon that will bring rains over Palawan, Panay Islands, Negros provinces, Zamboanga Peninsula, Misamis Occidental, Lanao del Norte, and Autonomous Region in Muslim Mindanao.

Fishing boats and other small seacraft are advised not to venture out into the eastern seaboards of Central and South-ern Luzon, Visayas and Mindanao due to strong winds generated by typhoon Karen.

Karen is forecast to be at 600 km east of Tuguegarao City, Cagayan by Friday morning and 420 km east of Basco, Batanes by Saturday morning.

THE Ecosystems Re-search and Development Service, DENR-10 through the Technology Transfer and Information Division conducted an IEC-Forum on Biosecurity Issues/Concerns and Invasive Alien Spe-cies at Kaatuan, Lantapan, Bukidnon last September 5, 2012.

The forum aimed to dis-seminate information on biosecurity issues/concerns and invasive alien species (IAS) to local communities living within the vicinity of a protected area (PA) like Mt. Kitanglad Range Natural Park and capacitate them on the identification of IAS that may invade and affect biodiversity of the PA.

a very conducive venue. He stressed that biosecurity and invasive alien species are new terms/information that needs to be understood by the local stakeholders so that they would be able to act as a vehicle for the protection of biodiversity

of Mt. Kitanglad. TTID Chief Gina C. Padilla, then, presented the rationale of the forum.

Biosecurity reflects the concern by a lot of countries over the negative effects caused by alien organisms

KIDAPAWAN CITY—City Mayor Rodolfo Gantuangco here on Wednesday put up a P50,000 reward money for the arrest of the killers of the city’s tourism officer who was gunned down last week while on her way to work.

Gantuangco said the money would be taken from his ‘own pockets’.

want to be right!”Our feelings and con-

science are NOT always a good guide to show us what’s right and wrong. Since everyone one of us has the tendency to be self-centered in one way or another, we’ve damaged and confused our conscience. So we often tell ourselves that certain wrong things are right so we won’t feel guilty about doing them.

A person can be very wrong even though he doesn’t feel wrong or guilty.

For example: Adolph Hitler had six million Jews tortured and murdered just

because of their race! But he did not show any guilt for all the evil he did.

Does that mean he was not guilty of all those wrongs, just because he didn’t feel guilty? Of course not!

You and I can tell a small lie, cheat on our taxes, school exams or customs duty, or get away with a little stealing. But that does not mean it’s right, or that we will never be caught and punished. The fact is we’re still guilty of doing those wrong things, even if everybody else is doing it.

So because we cannot

depend on our conscience or feelings every time, we need Jesus Christ to be our guide Who can clearly show us what’s right and wrong every day.

Today, even though you have not felt very guilty, you now understand that you are guilty of living your own way. You know that you’ve done wrong things: wrong thoughts, words, and actions.

Maybe they were even things you thought were not wrong because many other people do them. Yet the good news is Jesus Christ will still forgive you and start changing your life if you let Him.

So why not ask Him to take full control of your life and help you start living His way every day? It’s the way you can finally have real peace in your conscience, and the satisfaction of living the right, successful way.

WITH the series of cases filed against incumbent City Mayor Vicente Emano of Cagayan de Oro, one could feel the frustration of Emano’s political opponents. What makes these cases abominable is the perception that these cases where purposely done in the advent of election season.

One could simply sense the ulterior motive behind these cases. Notwith-standing, the objective here is to dis-credit political opponents at all costs. From the looks of it, Emano’s political nemeses are now unleashing what they have in their propaganda pantheons.

Last Monday, Emano and 12 other members of the City Council headed by Vice Mayor Ian Acenas were respondent with violation of the anti-graft and corrupt practices with the Ombudsman in Manila. The case was in connection with the termination of the Contract of Lease executed by and between the city government and New Wishing Star Trading Corp.

Jacky Ching, President of the New Wishing Star filed the case arguing that the termination of the contract of lease was illegal and arbitrary. It turned out that Jacky Ching was the lessee of the 2nd f loor at Carmen Public Market where another store is operating. The city’s legal department decided to terminate the New Wishing Star’s contract when it discovered that the lessee allegedly inserted some provisions apart from the originally signed contract.

As alleged, one of the violated provisions was the sub-leasing of portion of the 2nd floor at Carmen Public Market to another outfit. It was alleged that the original contract did not allow the subleasing of the leased area other than the New Wishing Star Trading Corp. During initial probe, the city council found out that the lessee was paying to New Wishing Star more than thrice the New Wishing Star pays to the city government. Jacky Ching argued that the outfit is a partner as stipulated in the contract.

At a glance, Jacky Ching might sounds credible. However, with dozen lawmakers, most of them veteran legislators, and lawyers, the city council is not a body of fools to issue a termination order without conducting a fair and just investigation/review of the contract. If the Word is God, and we put the Word in our minds and hearts, and in our words and ac-tions every second of our lives, then God is surely with us, too. Of course, this applies only to those who believe in God, and in Jesus Christ, His Son, our God and Savior.

ADMINISTRATIVE ORDER 29 ON WEST SEA ILL-ADVISED: Whoever prompted President Aquino to sign Administrative Or-der No. 29 to rename the South China Sea as West Philippine Sea should be fired. First, naming the South China Sea as West Philippine Sea is highly provocative to China, with which our country is at great odds nowadays pre-cisely because of its claim over the same territory. This could only trigger a shooting war, which we will surely lose.

Then, signing an order stating our claim over that part of the sea at this point

is even an admission that, all along, before Aquino came up with Administra-tive Order No. 29, South China Sea was indeed named South China Sea---that is, that area was and is really called South China Sea. This speaks volumes about the legality of China’s claims---and the futility of our own claims---over it.

Third, this could make us the laughing stock of the whole world, considering that simply giving a tag to a place does not even mean anything, especially because there are so many other claimants to that place. Lastly, our neighboring countries could even be angered or at least dismayed by the administrative order because that would mean unilaterally repudiating their own claims.

a. The budget of State Universities and Colleges as a share of GDP has been drastically declining from 0.41% of GDP in 1991 to 0.29%at present. There were just 81 SUCs in 1991 but they got a bigger share as compared to the 110 SUCs today.

BUTUAN City––The city government has commemorated the first year an-niversary of the “Clean Ground, Zero Waste” (CGZW) movement, Tuesday.

CGZW was launched in 2011, with simultaneous cleanup activity in all the barangays of this city.

Mayor Ferdinand Amante Jr. said solid waste management is one of the most important advocacy in the local government units even as he asked for the people’s continued cooperation by making waste segregation part of

their daily routine. For his part, Vice Mayor Lawrence

Fortun said “discipline among us is what we really need to make this movement realistic, and through proper segregation of wastes, we are able to help our environment, as well as our city government to reduce its expenses in garbage collection.

He chairs the committee on en-vironment and natural resources of the city council, which has made significant efforts, including the endorsement of the watershed code and the creation of the Taguibo Wa-

tershed Council. During the occasion, Mayor Aman-

te awarded plaques of “Clean Seal” to 34 recipient-barangays in Butuan City, including Barangay Pagatpatan, which is among the top three cleanest barangays of the Philippines for its consistent implementation of proper solid waste management.

malicious, and oppres-sive prosecution and to pro-tect him from an open and public accusation of crime, from the trouble, expense and anxiety of a public trial, and also to protect the state from useless and expensive trials…”

Chief Inspector Nor-man Ala of CIDT-AND filed the case against Her-nandez after an April 1, 2012 raid on a house at CS Compound, Bacolod Street, Upper Doongan here on the strength of a search warrant issued by Butuan City Regional Trial Court Branch 2 Judge Emmanuel Escatron. The raiding team recovered eight firearms and hundreds of ammunition.

The case caught much attention as it involved the husband of Agusan del Sur’s most powerful tribal chieftain. Hernandez of the Kankaney tribe of Mountain Province, is married to the late Datu Tagleong’s daugh-ter, Bae Merlyn Tagleong Coguit, who replaced her father as leader of more than 3,000 Manobos.

In his petition for re-view, Ala asked whether the Butuan City Prosectutor’s Office was authorized and clothed by law, existing jurisprudence and the Rules of Criminal Procedure to “unilaterally and directly” attack and nullify “pronto” and disregard a “validly is-sued search warrant issued by a competent magistrate, under the aegis of ‘presump-tion of regularity of official duty’” when the main and sole function of preliminary investigation is merely to determine whether there is probable cause to indict Hernandez based on the evidence adduced.

According to Ala’s peti-tion for review, Prosecutor Go “has acted as lawyer and avid advocate” for Hernan-dez by “summarily dismiss-ing” the case without the benefit of a hearing in gross violation of due process.

Ala said Hernandez had not instituted either a mo-tion to quash search warrant in the proper court or filed criminal or administrative proceedings against the raiding team.

He said that in dismiss-ing the complaint, the pros-ecutor’s office adopted “as gospel truth” Hernandez’s allegation that the house subject of the search warrant was the office of Datu Tagle-ong Security Agency rather than giving more premium and weight to the affidavit of Doongan Punong Ba-rangay Eddie Baltazar and two barangay councilmen who testified that “no such security agency operates” in their barangay based on their personal knowledge of their locality where they govern.

Ala also took issue with the prosecutor’s office for its “neglect” to consider in the resolutions the omis-sion of securing a barangay clearance before operating a security agency, the belated submission to SEC CDO of its registration, the failure to get a Butuan City business permit before operating an agency aside from the baran-gay officials’ affidavit who testified the non-existence of the security agency in their area of responsibility.

Ala said the resolutions “completely” disregarded the evidence which showed “tampered serial number” of seized M-16 rifles that should have been litigated to give chance to Hernandez to defend himself. “It was a wholesale declaration of illegality, the proceeding as well as the outcome sans a judicial proceeding in gross violation of the due process rights of complainant,” he said.

He said that since the search warrant clothed the CIDT-ADN with author-ity to search and any evi-dence confiscated should be deemed admissible un-less the warrant itself was recalled or withdrawn by the issuing judge through the filing of a motion by Hernandez in the issuing court. “It did not happen here, yet Hernandez was given a favorable resolution on a silver platter without exerting much effort to cause the nullification of a validly presumed search warrant,” Ala said.

Ala, through his counsel John Gil Unay, Sr., said in the petition that in preliminary investigation, the investi-gating prosecutor “merely

determines whether there is a probable cause or suf-ficient ground to engender a well-founded belief that a crime has been commit-ted and that respondent is probably guilty thereof, and should be held for trial.”

He added, citing a Su-preme Court decision on Tan v. Ballena, “Certainly, it does not involve the de-termination of whether or not there is evidence beyond reasonable doubt pointing to the guilt of the person.

Only a prima facie evi-dence is required or that which is, on its face, good and sufficient to establish a given fact, or the group or chain of facts constituting the party’s claim or defense, and which is not rebutted or contradicted will remain sufficient, therefore matters of evidence, such as who are the conspirators are more appropriately presented and heard during the trial.”

NPA self-criticizes on Paquibato

Last September 7, the Medardo Arce Command of the NPA released a state-ment to the media and the Filipino public to apologize for the casualties of the Paquibato incident. Com-mand spokesman Rigoberto Sanchez said the NPA will take concrete measures to indemnify the victims “con-sistent with the principles of revolutionary justice and the policies governing the NPA and the revolutionary movement.”

Sanchez said the NPA’s 1st Pulang Bagani Company made a wrong decision in initiating a tactical offensive against the AFP detachment located in a civilian popula-tion. The unit was said to

be targeting the military detachment and destroy the structure, but the plan backfired.

“ T h e N PA e r r e d i n c o n s i d e r i n g t h e circumstances,combat in-telligence and all pertinent operational information in instigating the action. In the face of this gross mistake in judgement, the MAC-SMROC-NPA is cur-rently initiating an internal investigation and is ready to take appropriate courses of action, to include among others, disciplinary action on the responsible unit,” Sanchez said.

In reactions to demands of certain quarters that the NPA surrender the mem-bers of the unit involved in the Paquibato incident, the NPA said it is not subject or subsumed within the legal and constitutional system and processes of the GPH, and that it has its own system of correct-ing the errors its members commit against civilians and non-combatants.

FIFA: My Game is Fair Play; this is what Laos forgot in their friendly match against our national football team – the Azkals. This was the last of three friendly matches in the Azkals’ Asian tour in preparation for the Suzuki Cup 2012 – and the nationals wanted to go home with a bang. And so they did.

Recapping the three friendlies, the Philippines kicked off the tour with a pit against Cambodia which is ranked #188 in the FIFA Men’s ranking.

We saw a brilliant display of teamwork and aggressive attacking chances – they were not just descent attacking attempts, they were brilliant. However, the lack of finishing touches and the bad condition of the Cambodian pitch made it difficult for the Azkals’ stalwarts Phil and Chiefy to covert attacks into goals – pour in some rain and the match remained at nil-nil at full time.

Then in the second half – all hell broke loose as Misagh Bahadoran got a cheap shot to the chin and ironically receiving a red card and sent off the pitch, something fishy eh?!, and this was after a scuffle in midfield that lead to Etheridge

Laos TV didn’t show it, safely panning the cameras away from the pitch into the audience – we don’t see this very often. Only 7 Laosians left on the pitch and 10 Azkals. We would have loved to

those red cards raised up.Then the second penalty kick,

courtesy of Etheridge’s mistimed tackle inside the box – what really looked like the Laosian just fell on the pitch on his own.

The Azkals fought back, earning a long throw from the left flank – using the deadly weapon – Jason Sabio into the foot of Gier who did not blink firing away into the back of the net capping his first international goal for the Philippines. Laos wins the “unfriendly” match 2 – 1.

FIFA issued a statement that the International Friendly between host team Laos and the Azkals is INVALID, as not all referees of the match were FIFA recognized, and this will not affect the team rankings. Hats off to FIFA!

Now the women’s counterpart of the Azkals – the Malditas. The ladies led by captain Marielle Benitez, look to make an impact in the AFF Women’s Championship 2012. Several Fil-Foreigners will also boost the Malditas, as Heather Diosano Cooke (USA) will lead the attack. Her experience in the US soccer leagues will certainly add to the “girl power” of the Malditas.

The matches of the AFF Women’s Championship kick off Thursday, September 13 at Thong Nhat stadium in Vietnam as the Malditas face Myanmar. Hope to see our Malditas in action – via live TV or internet live streaming. Either way, this is something to look forward to.

To cap this off, I think the national football squads are now moving forward and look to inspire the younger generations into trying out football. Raise the red, blue, white and yellow!

Circles Productions Inc. in partnership with Pine Grove Mountain Lodge,

Par a s at D i g i t a l , Spr i nt Mult ispor t , Forest Park Dahilayan, Bukidnon, The North Face, Municipality of Libona, Unifrutti, and City of Cagayan de Oro initiated CDO-Dahilayan Ultra Marathon 80k trail on September 8.

Around 125 runners from Davao, Iligan City, Zamboanga, Cagayan de Oro, and Manila participated the event.

According to Ms. Gean Cesar, event coordinator of Dahilayan Adventure Park, this marathon is on its second year. “We want to promote the sport itself, healthy living and of course this place’s tourism”, she added.

Runners started at the City Hall, this city at around 12 midnight of September 7 up to Dahilayan Bukidnon. The trail is quiet difficult since it is uphill plus the changing weather and temperature. “Naglisud gyud ko kay bugnaw

kayo unya pasaka pa gyud labi na ang dapit sa Camp Phillips”, Bryan Quiamco, champion 80k solo said.

Three categories were competed: 57K solo, 80K solo and 80K relay. In the male division 57K solo; Rodel Quilab, Junjun Mahinay, Jay Eric Ludrigito, and Slanislao Raagas got the champion, 1st, 2nd, and 3rd places resp ec t ive ly ; 80K s o lo, champion Bryan Quimco, 1st placer Jonathan Pico, 2nd placer Jullius Badelles, and 3rd placer Zenchen Lagapa; 80k relay, 1st Team Petronas, 2nd Team Happy Finish, 3rd Team Titans, Davao.

“We are so happy because there are many runners who joined, actually more than what we expect and congratulations to them because they made it up to here”, Elipidio Paras, CEO Dahilayan Adventures Park said.

Last year’s Ultra Marathon is still CDO-Dahilayan but a 55K trail and they started at Rodelsa Circle.
