2. Introduction

This Business and Technical Overview sets out draft specifications for new CHESS features which includes the enhancements in section 2.1 below. These enhancements will not be introduced into production until Q2 2016 but will be made available in the CHESS test environment from Q4 2015 to enable stakeholders to view and commence their own development.

2.1. Inclusions

Includes the introduction of changes to some of the Clearing House Electronic Sub-System (CHESS) messaging process flows and new messages, together with changes to the relevant ASX Settlement Pty Ltd (ASX Settlement) Operating Rules.

The changes relate to the introduction of a number of mFund related enhancements following the introduction of the mFund Settlement Service in May, 2014:

The introduction of a mFund message suite to facilitate the amendment of a distribution reinvestment (DRP) elections to a Registry.

The introduction of a mFund message suite to facilitate the set-up and amendment of a regular payment plan (RPP) to a Registry. This function will not be activated through CHESS Release 9.

The inclusion of Income Statement selection functionality whereby a mFund accredited Participant may request both a Periodic or Annual Income Statement on behalf of their client. Periodic may be selected as an on-demand request or a standing request. Annual may only be on-demand.

A functional and structural change to the existing mFund Distribution Statement functionality to now offer Periodic Income Statement functionality. Selection of a Periodic Income Statement is via the aforementioned Income Statement Selection function.

The inclusion of an Annual Income Statement message suite within mFund that fully meets ATO Tax Statement specifications. Selection of an Annual Income Statement is via the aforementioned Income Statement Selection function. Refer to Appendix 3: Annual Income Statement Components for details.

3. Scope of Inclusions

The scope of CHESS enhancements are:

Enhancement Benefits Impact

1 Allow a Sponsoring Participant to submit distribution election preferences (to/from cash-DRP) for a client’s mFund holding with the registry. The registry will either accept and process the request or reject it.

Sponsoring Participants will be able to provide a more complete service to their clients.

Mandatory for: mFund ASX Clearing & Settlement Participants (brokers), mFund PISPs, mFund Registries.

2 Allow a Sponsoring Participant to set-up or amend a regular payment plan with the registry. The registry will either accept and process the request or reject it.

Sponsoring Participants will be able to provide a more complete service to their clients.

This function will not be activated through CHESS Release 9.

3 The introduction of new functionality to all a Participant to select either a Periodic Income Statement or an Annual Income Statement from a Registry.

Will enable an accredited mFund Settlement Participant to control this process on behalf of their clients. A Periodic Income Statement may be selected as an on-demand report or as a regular standing report. and an Annual Income Statement may be selected as an on-demand report only.

Enables accredited mFund Settlement Participants to request, on behalf of their client, a fully ATO compliant Annual Income Statement from a Registry.

3.1. Testing

To facilitate stakeholder readiness for the changes, the CHESS Release Test Environment (RTE) will be made available in Q4 2015. The exact date/s and scope of testing will be communicated separately soon.

Mandatory and Conditional Mandatory data changes will require CHESS Accreditation. Accreditation completion times and information will be communicated closer to the time. Users can choose to be Accredited for optional messages.

Impacted parties are required to have their CHESS Interface (‘system’) accredited for the processing of the new and modified messages.

3.2. Implementation Date

The mFund enhancements are expected to be effective in Q2 2016. The date will be confirmed in the near future.

3.3. Parties Impacted by this Change

ASX mFund Participants (brokers), mFund Registries, PISPs and CHESS ISVs.

3.4. Next Steps

Parties impacted by this change should use the information in this document to carry out analysis and assessment of changes required within their systems and processes. Further technical details, for example rejection reasons, will be confirmed prior to the commencement of user acceptance testing.

An RTE schedule with dates will be communicated in the near future.

4. Overview of CHESS Enhancements

4.1. Distribution Election

Impacted Parties ASX Clearing and Settlement Participant, Registry, PISP, CHESS ISV

What is the Proposal?

The proposal is that a sponsoring Participant is able to maintain an investor’s distribution election preferences via a dedicated CHESS message suite.

Functionality to allow a sponsoring Participant to set-up and maintain an investor’s RPP preferences has been developed, but will not be activated through CHESS Release 9.

Description Provides ASX Clearing and Settlement Participants with an ability to elect/amend disribution election preferences with the appropriate Registry.

Where the Holder DRP Preference value is ‘N’ (no) and the investor chooses not to use their Primary Bank Account details, then they may enter specific Bank Account details via this function. Note: Initial entry of DISTRIBUTION preferences will remain within the MT726 Application request message.

As Regular Payment Plan (RPP) functionality is not currently available, the Holder RPP Preference value must only include a space; for any other value CHESS will return an error.

What is the Proposal?

Currently Statement functionality puts the onus on the Registry to provide unsolicited Income Statement details to the Participant for all holders based on an agreement.

The modification to this process would allow the Participant to request a periodic Income Statement (refer 4.10) or an Annual Income Statement (refer 4.11) for a specific HIN.

Description A Participant may request a periodic Income Statement or an Annual Income Statement. Additionally the Participant may select either to have the statement as an on-demand or as a regular standing report (applies to periodic only). Based on this request, the Registry may accept or reject, and where accepted return Income Statement data.

A regular standing statement (periodic only) may be cancelled.

For an Income Statement, only the latest details will be available.

For an Annual Income Statement, only the latest financial year details will be available.

Adjustment of the existing mFund Distribution Statement function allowing the Participant to request a Periodic Income Statement for their client via the Income Statement Selection function.

Description A Participant request for a Periodic Income Statement on behalf of an investor would prompt the Registry to return data.

Periodic Income Statements for periods other than the last completed period will not be available.

The Income Statement Selection function may be used to request an Periodic Income Statement (refer 4.2).

4.4. Annual Income Statement

Impacted Parties mFund accredited ASX Clearing and Settlement Participant, Registry.

What is the Proposal?

The Participant may request an Annual Income Statement on behalf of an investor.

The Annual Income Statement data will be ATO compliant. As the dataset is large, CHESS will provide a linked suite of messages to convey the data from the PISP to the Participant.

Description A Participant request for an Annual Income Statement on behalf of an investor would prompt the Registry to return data via a linked suite of messages.

Data is provided only in annual form; post end of financial year. Participant requests for Annual Income Statement data will always show results as at end of the last completed financial year. Annual Income Statements for years other than the last completed financial year will not be available.

The Income Statement Selection function may be used to request an Annual Income Statement (refer 4.2).

To allow a Participant to request the amendment of an investor’s distribution election preferences.

For mFund securities, the Participant would have indicated an investor’s initial distribution election and bank account details via MT726 Application Request. This function allows this distribution election to be amended.

Where a Holder DRP preference is ‘F’ (Full), no additional details are required.

Where the Holder DRP Preference value is ‘P’ (Partial); DRP Units Participating and the Bank Account details must be populated.

Where a Holder DRP preference is ‘N’ (cash), the Bank Account details must be populated.

As Regular Payment Plan (RPP) functionality is not currently available, Holder RPP Preference value must only include a space; for any other value CHESS will return an error.

The purpose of the income statement selection request is to enable a Participant, on behalf of an investor, to request either an annual or a periodic income statement or cancel an existing periodic request, from a Registry. One of the following statements may be requested, either:

An Annual Income Statement, only the latest End of Year financial details will be available.

The Participant may select an on-demand report or a regular standing report (periodic only). There is a cancellation indicator whereby the Participant may cancel an existing regular standing periodic Income Statement request.

As an existing mFund function (renamed from Distribution Statement), this function allowed a PISP to forward Income Statement details to a Participant by prior arrangement.

Changes will now enable Participants to specifically request Income Statement details by HIN and Fund Code via the new Income Statement Selection function (refer 5.3). The request will be directed to the Registry.

The purpose of this message is for the Registry to forward Annual Income Statement details for a sponsored holder, in response to a Participant request. The details provided align with ‘Part A’ of the ATO Standard Statement data set.

As the ATO Standard Income Statement data set is inclusive of all investors and all financial instruments, some sections may not apply to fund investors. To facilitate movement of data, CHESS will provide a series of messages that mirror the ATO income statement sections. The Total Message Count value in the MT971 will indicate the number of messages transmitted that make up the message set. This value will be used by CHESS to confirm and link the individual Income Statement messages. The Set Transaction Id links the messages.

6.2. Appendix 2: ATO Standard Statement

The 2014 standard statement (SDS) is the format recommended by the ATO, the Financial Services Council (FSC) and the Australian Custodial Services Association (ACSA) for disclosure by managed funds of tax information to resident individuals for completion of the 2014 tax returns, relevant schedules and other requirements.

The 2014 SDS that appears below shows amounts as examples that we will refer to in the guidance

notes that follow it. Here is the ATO link:

Participants are advised to consult the ATO guidance notes in the preparation of an investor’s SDS.

6.2.1. Basic Structure

The basic structure consists of three parts: Part A of the 2014 SDS explains where amounts are shown on the Tax return for individuals (supplementary section) 2014 (NAT 2679). Part B explains the components of a that investors may need to know to work out their net capital gain or capital loss and specifically provides the capital gains tax (CGT) concession amount. It also includes tax-deferred amounts required to adjust the cost base and reduced cost base of their units. For investors with straightforward circumstances the information in parts A and B focusing on specific entries at items 13, 18 and 20 should be sufficient to complete their tax return. Part C allows a reconciliation of the net cash amount distributed to the unit holder and provides information relevant to adjustments to the cost base and reduced cost base. It includes all non-assessable amounts: CGT concession, tax-exempted, tax-free and tax-deferred amounts. The Australian income section of Part C has an alternative presentation that is shown in Attachment 1. It is provided for those funds whose systems are unable to use the preferred presentation in 2014. The preferred presentation has the franked equal to the sum of the franked amount of the dividend plus the franking credit.
