Spin Zoneby Jon Freeman Post Mother’s Day, Keith Urban is still in charge of

the CountryBreakout™ Chart with “Kiss A Girl.” Dierks

Bentley, Sugarland, Montgomery Gentry and Lady

Antebellum are trailing slightly but still showing signs of

growth. Eli Young Band hangs in there at No. 6, followed

by Toby Keith’s “Lost You Anyway” moving up to No. 7

from No. 9. Team Sony rounds out the Top 10 with positive

gains on Brad Paisley’s “Then,” Kenny Chesney’s “Out

Last Night,” and Alan Jackson’s “Sissy’s Song.”

“Sounds Like Life To Me,” Darryl Worley’s second

release for Stroudavarious Records, is now at No. 17 after

a big push. Another group crashing the Top 20 party from

outside the major label complex is Emblem Records’

Gloriana, whose “Wild At Heart” is heating up at No. 20

and aided by their inclusion in Taylor Swift’s high-profile

Fearless Tour.

Surveying the top 40, there are a number of acts

bolstered by small and mid-size labels. Mark Chesnutt’s

“She Never Got Me Over You” is making strong headway,

moving to No. 26 in only 8 weeks. Katie Armiger’s

most recent single “Trail of Lies” is just behind at No. 27.

Charley Rivers is still showing some positive traction on

“Lovin’ In The Country," as are the Bellamy Brothers

and "Lord Help Me...” Finally, both Daryle Singletary’s

“Love You With The Lights On” and Tracy Lawrence’s

“Up To Him” pick up triple digit spin gains and propel to

No. 34 and No. 37, respectively.

Luke Bryan"Do I"Capitol Records Nashville

Bryan’s “Do I” still has significant

momentum, as it shoots to No. 49 in

its second week on the chart. Bryan’s

upcoming sophomore album Doin’ My

Thing is scheduled for an October 6

release. Recently Eventful.com and

Bryan announced that country fans across

the nation will have the chance to bring Luke Bryan’s album release

show to their city and, thanks to Eventful Demand, only the fans will

know the destination. Bryan will set his sights on whichever city

rallies and delivers the most Demands by the end of the competition.

In Your Own WordsJonathan YudkinProfessional Musician

Nashville, TN

Buy None, Get One FreeA response to the Mike Masnick

Leadership Music Digital Summit

Keynote

During the recent Leadership

Music Digital Summit I attended the

keynote address from Mike Masnick, a

technology blogger. Masnick promotes

a number of compelling new ideas for

marketing, but combines them with a

dangerous trend, the essential removal

of music from the "music" business. He even goes so far

as to suggest the end of copyright protection for music in

order to better "connect with fans." I believe these Copy-

left ideas—free music and the end of copyrights and

licensing—could lead to the devaluation of music creation

and production. As a local musician I found the address

disturbing and felt that Masnick should have tried harder

to achieve his goals without demonizing many of Nashville's

most important elements. Intellectual property rights are

how creative professionals get compensated for their

creations. It gives value to the artistic, cultural and

industrial contributions made by these individuals. The

value of these creations has been protected by the

constitution for over 200 years.

The Copyleft agenda wants to influence how we obtain

and consume music in favor of an easily controllable

music business. They would redefine the value placed on

these works. Some, like Masnick, believe intellectual

property should only be used as a gimmick to entice the

purchase of other product. Music to them is no more than

an advertisement. Its "buy none—get one free." These

captains of cyberspace treat music theft and piracy as

acceptable and unavoidable and would rather ignore

what it truly is. The "return to business" means to stop

wasting time with copyright and licensing issues and

spend that time selling more product. This leaves the

artistic creation at the center of attraction, but outside

the circle of revenue.

Hasty decisions are being made, perhaps out of fear

for the uncertain future. One popular band is giving away

their entire catalog with the purchase of a concert ticket.

Great, what's left to give away next year? Where will the

incentive be to create art that will just end up as the

plastic giveaway prize?

"Free music isn't necessarily the death of music sales," says Masnick. Of course it is when you are no longer selling the music. And remember, in most cases all you have to do to access this free music is provide your e-mail address to a marketing firm. This valuable personal information is the true and invisible currency of the

internet. So much for free. The musicians I work with want

to connect with fans who love and

appreciate the music they create, not

people who are drawn to the gimmick

of the month like bugs to a lantern.

Connecting with fans should focus on

the quality of the music, not the toy in

the cereal box.

We must not give up the fight

against piracy and theft. We cannot

adopt an "if you can't lick em, join em"

attitude just because we haven't yet been

able to stop people from stealing music.

Public awareness and understanding is

our greatest weapon. Authorities

cannot easily prosecute violators so we

have to deal with this on a societal level.

We have nothing to lose by pursuing the fight against

music theft and piracy, and nothing to gain if we don't.

"Do not go gentle into that good night" wrote Dylan

Thomas.

Week-At-A-Glanceby Jon Freeman Pray for good weather this week, because the

Grammy Block Party is on Tuesday (5/12)! The outdoor

gathering takes place at Owen Bradley Park and scheduled

performers include Jason Aldean, Melinda Doolittle,

Eli Young Band, the Gabe Dixon Band, Brandon

Heath with special guest Jason Ingram, and Sam &

Ruby.

In a slightly more weather-sheltered environment on

Wednesday (5/13), SOLID’s annual Crawfish Boil will

provide revelers with a bounty of freshwater

deliciousness. The fun starts at 5pm in the old UMG

Parking Garage. (60 Music Sq. W.)

Didn’t get your share of punishment in the Country

Music Marathon two weeks ago? The Music Row Road

Race to benefit St. Jude on Saturday (5/16) is a 5k run

offering one more, albeit considerably shorter, chance to

pound some pavement.

Singles hitting radio this week include Megan

Mullins’ “Long Past Gone,” Holly Williams’ “Mama,”

Shawna Russell’s “Fire In The Desert,” Zona Jones’

“Bluer Than Blue” and Cledus T. Judd’s “Garth Must Be

Busy” with assistance from Brooks & Dunn.
