3. Eligibility criteria for participating e-tenderer: a. The bidders shall have satisfactorily completed as a primary agency during the last 5 years from the date of

issue of this notice at least one work of similar nature under the authority of State/Central Govt. undertaking, statutory bodies constituted under the statue of the Central/State govt. and having a magnitude of 50 (Fifty)% of the amount put to tender. The completion certificate and detail communicational address of the Client must be indicated in the credential certificate. (Non-Statutory Documents).

4. PAN Card, up to date P. Tax deposit challan, GST Registration Certificate, IT return document, Rate Analysis (if needed), Only the highest valued Credential certificate, filled up Annexure A & B has to be accompanied with the technical bid document. (Non-Statutory Documents).

5. Registered partnership deed in case of partnership firm has to be submitted. The company shall submit the article of Association and Memorandum. Where an individual person holds a digital certificate in his own name duly issued to him against the company or the firm which he happens to be a director or partner, such individual person shall, when uploading any tender for on behalf of company or firm, invariably upload a copy of registered power of attorney showing clear authorization in his favour, by the rest of the director of such company or the partners of such firm to upload such tender. (Non-Statutory Documents).

6. Joint venture will not be allowed.

7. The tenderer shall establish field testing laboratories equipped with requisite instrument and technical staff according to the requirements to the staffs to be executed.

8. Payment will be made as and when fund will be available from the concerned source. No claim whatsoever for delay payment, if any will be entertained. Total 3 (three) nos bill (including final bill) will be paid for this work. Contractors are requested to quote their rate accordingly.

9. No arbitration is allowed in this contract.

10. 10 (ten) % value [2% Earnest Money and 8% Security deposit from bill] of the work will be retained as security deposit which will be released after as per tender notice from successful completion of the project. Agencies have to arrange land for direction of Plant & Machineries, storing of Materials labour shed, Lab rotary etc. water and electricity at their own cost and responsibility.

11. If the agency fails to start the work within 15 days of receiving work order or found any negligence in implementation the scheme, a curtailment of 3% may be done from their bill without any clarification.

12. No materials will be issued from the department.

13. Constructional labour welfare cess at @1% of the bill value will be deducted from every bill.

14. Contractors shall have to comply with the provisions of A) The contract labour (regulation Abolition) Act. 1971 B) Apprentice Act 1961 & C) Minimum wages Act, 1948 of the notification thereof or any laws relating there to and the rules made and order issued there under from time to time.

15. The schedule of rates is as given in BOQ.

16. During scrutiny if it comes to notice of the tender inviting authority that the credential or any other paper found incorrect/fabricated, that bidder would not be allowed to participate in the tender and that application will be rejected without any prejudice.

17. The authority reserves the right to cancel the NIT due to unavoidable circumstances and for that no claim will be entertained.

18. Bids shall remain valid for a period not less than 120 (one hundred twenty) days from the last date of submission of Financial bid. If the bidder withdraws the bid during the validity period of bid, the earnest money as deposited will be forfeited forthwith without assigning any reason thereof.

19. Before submission of tender, the tenderer shall have to acquaint by actual visit to the site as regards to the prevailing conditions and tenderer submitting tender shall be deemed to have done so. He must acquaint himself with local conditions of labour, material, transport, electricity, water, Panchayet regulations etc.

20. The contractors responsibility to keep the road open to all kind of traffic during the execution of work. No claim what-so-ever will be entertained for idle labour, establishment cost of hire & labour charges of tools & plants etc. at any circumstances.

21. Rate analysis should be submitted by the Agency, if the quoted rate is 15% less than the estimated value.

22. The contractor shall pay of charges & fees legally payable for act out of their works & hold the employer free of such cost.

23. Contractor has to execute the work on strict supervision of the beneficiary Committee & Mejia Panchayet Samity Engineers/ Authorities.

24. Decision of Authority will be final & binding on contractor in case of any dispute.

25. Contractor has to arrange at his own cost, to display sign board at the site before starting the job indicating the following:

a. Name of Contractor- b. Name & Nature of Contract- c. Name of Mejia Panchayet Samity Engineers Supervising the job. d. Estimated amount. e. From which fund the work is being executed. f. Time of completion.

26. All tools, plants & machineries including vibrator, road roller etc. required to execute the contract, has to be arranged by contractor at his own cost.

27. The works are time bound project & time of completion of work should be strictly followed.

28. All agencies are requested to remain present during the Financial Bid opening with all relevant documents in original.

29. Sample Format of Affidavit to be followed as Annexure A. It should be submitted with filled up and signed with by the agency.

30. Bank Solvency certificate for evidence of access to or availability of credit facilities bank certificate. Format of Annexure B may be followed for that.
