Introduction

Human rights situation in Bangladesh has been worsening day by day and this is very alarming

as to a significant stage the rights are being violated by the state itself. Various institutions are

objected to malfunctioning at political will causing further deterioration of institutionalization

contrary to the good governance and a healthy culture. Lax law enforcement panics people.

Concern of the International Organizations

Many national and international Human Rights Organizations showed their concerns as to the

recent human rights status in Bangladesh such as:

1. Human Rights Watch (HRW) opines in its website that, Bangladesh‟s overall human rights

situation worsened in 2012, as the government narrowed political and civil society space,

shielded abusive security forces from accountability, and ignored calls to reform laws and

procedures in flawed war crimes and mutiny trials. The security forces disguised extrajudicial

killings as “crossfire” killings. Opposition members and political activists “disappeared.” Flawed

trials against those accused of war crimes in the 1971 war for independence continued. When

Rohingya refugees fled to Bangladesh from persecution in Burma, the government pushed back

boatloads of refugees, insisting that it had no obligation to provide them sanctuary.3

On March 1, Human Rights Watch also shows its grave concern to the 40 deaths in Bangladesh.

In a statement it said, most deaths appear to have been caused by the security forces using live

ammunition against Jamaat protesters. It urged the government to publicly order the security

forces to follow the United Nations Basic Principles on the Use of Force and Firearms by Law

Enforcement Officials. Human Rights Watch also called for effective investigations into the

deaths of all killed during the demonstrations.

Human Rights Watch has long called for justice for victims of the 1971 atrocities to be provided

through fair trials. However, the trials conducted thus far have been replete with irregularities.

HRW opposes the death penalty in all circumstances as an inherently irreversible, inhumane

punishment.4

2. Amnesty International in its 2012 annual report says, some 30 extrajudicial executions took

place in Bangladesh. State security forces were implicated in torture and other ill-treatment and

at least 10 enforced disappearances. Political violence resulted in the death of at least four men.

Women continued to be subjected to various forms of violence. The government failed to protect

Indigenous communities from attack by Bengali settlers. At least 111 workers died in a factory

fire, some allegedly because officials refused to let them leave the premises. More than 20

Buddhist temples and monasteries, one Hindu temple and scores of Buddhist homes and shops

were set on fire during a communal attack. One person was executed and at least 45 people were

sentenced to death. Nevertheless in January, the Prime Minister stated that no human rights

violations had been committed in the country.5

In a Public Statement6 issued on 22 February 2013, Amnesty International showed its concern

over new amendments to the International Crimes (Tribunals) Act 1973 (ICT Act) made by the

government of Bangladesh that may be used to push for hasty death sentences to be imposed on

individuals convicted by Bangladesh‟s International Crimes Tribunal (ICT). The amendments,

passed by Parliament on 17 February, permit the prosecution to appeal against any decision of

the ICT to impose a lesser sentence.

3. Asian Human Rights Commission, on March 7, 2013 criticized the tribunal to be „shoddy‟

and shows its concern towards the violence arising out of the verdict of the same that is about to

lead the nation to civil war. On its own website, it states: the tribunal has pushed Bangladesh to

extreme violence. Since 28 February, the events have taken a violent turn in which almost 100

persons including women, children and police officers have lost life. Several hundreds more are

injured, and properties destroyed of which no body in the country has any true count.7

4. On March 4, the Secretary General of the Organization of Islamic Cooperation (OIC), Prof.

Ekmeleddin Ihsanoglu, has been following with concern the serious situation in Bangladesh

which claimed dozens of lives and caused the destruction of public and private properties. In

trying to bring about satisfactory solutions to the country‟s political and social issues, the

Secretary General invited all parties to refrain from all acts of violence which go against the

interests of the country, and called for the proper respect of the rule of law by all.8

5. On February 7, 2013 two independent United Nations human rights experts Christof Heyns

and Gabriela Knaul stressed that justice for past crimes in Bangladesh requires fair trials, after

voicing concern at recent sentences, including the death penalty, handed down in cases that did

not ensure due process.9

6. International Commission of Jurists (ICJ) criticized the International Crimes Tribunal

established by Govt. of Bangladesh to bring the accused for crimes against humanity to justice. It

said that, the death sentence handed down by the International Crimes Tribunal against Delwar

Hossain Sayeedi violates international standards of due process and fair trial, and, if carried out,

would violate his right to life.10
