McCulloch v. Maryland
Facts The second national bank was formed in 1816 as the successor of the first Bank of
the United States. Majority of the people believed the bank harmed state economies and
local businesses, giving the national government more power over the people. So,
February 11, 1818, the Maryland state assembly issued the “stamp tax” which made all
the banks pay for the special stamped paper.
James McCulloch, a cashier for the Baltimore branch of the United States Bank,
was sued for violating this Act. McCulloch admitted he was not complying with the
Maryland law. McCulloch lost in the Baltimore County Court and that court’s decision
was affirmed by the Maryland Court of Appeals. The case was then taken by writ of error
to the United States Supreme Court.
