Today the Central Bankruptcy court is set to accept the petition for Thai Airways
International Plc (THAI) rehabilitation that is set to be presented to the court today.
The rehabilitation plan of the airline is set to include wiping out the current capital
base by lowering the company’s par value to 0.01 baht from the current price of
10 baht a piece
The move would see that 47% stake of Ministry of Finance (MoF) being
wiped out and the MoF could stand to lose 10.44 billion baht
The Vayupak fund that holds just over 15% will see its holding in the
airline being wiped out by close to 4 billion baht.
Despite these reports shares of THAI were up 13% yesterday to close at
4.90 baht a share.
As part of the move after the wiping out of the capital, the airline will raise capital
and the MoF is set to put in about 30 billion baht as part of the recapitalization
plan.
Also as part of the move to make the airline more efficient, the rehabilitations
plan calls for the airline to have a strategic partner.
The issue of ‘strategic partner’ was also an issue that was looked into in
2001 when the airline had faced problems but 19-years later the airline
remained in similar position.

Meanwhile while THAI continues to seek a strategic partner, Minister of Transport –
Saksayam Chidchob, has come out to say that ‘one fine day’ the airline can return to
being a ‘state owned enterprise’.
A statement that could hinder any possible strategic partner from even looking
into the airline
Prime Minister Prayut Chan-o-cha endorsed the appointment of an 8-member committee
to monitor Thai Airways International Plc (THAI)’s operations, performance and
rehabilitation process.
The 8-member committee or the so-called “super board” which will be led by
Deputy Prime Minister Wissanu Krea-ngam comprises:
Former finance minister Apisak Tantiworawong;
Finance Permanent Secretary Prasong Poonthanet;
Transport Permanent Secretary Chaiwat Thongkhamkoon;
Hayatham Promsorn, Director of the Office of Transport and Traffic
Policy and Planning;
Justice Permanent Secretary Visit Visitsora-ath;
Pakorn Nilapraphan, Secretary-General of the Council of State.
Ruenrudee Suwanmongkol, Secretary-General of the Securities Exchange
Commission;
Praphas Kong-iad, Director of the Office of State Enterprise Policy
Committee.
The House committee on communications, telecommunications and digital economy and
society said it plans to invite Advanced Info Service (AIS), the top mobile operator by
subscriber numbers, the National Broadcasting and Telecommunications Commission
(NBTC) and the Digital Economy and Society (DES) Ministry to explain the incident
involving a major data breach of more than 8.4 million users managed by AIS.
The House committee’s move came following a report of a leaked database
thought to be revealing the internet records of millions of Thais online in real
time, with around 8.4 billion records.
The breach was uncovered on May 7 by security researcher Justin Paine, who
discovered an open ElasticSearch database online which appeared to be
controlled by ADVANCED Wireless Network (AWN), a subsidiary of AIS.
AIS though insisted that a small amount of non-personal, non-critical information
was leaked for a limited period in May during a scheduled test.
Security researcher Justin Paine discovered a cluster of now less than three
servers where databases were left exposed without a password. The database was
actually controlled by AWN. AIS is AWN’s only upstream peer and for all intents
and purposes was completely controlled and used solely by AIS.
Bhumjai Thai Party list MP and deputy chairman of the committee Settapong
Malisuwan did not buy into AIS’s claim and said the committee on
communications, telecommunications and digital economy and society and the
NBTC must take the data breach seriously. Dr Settapong said the NBTC which is
operates independently without being supervised needs to upgrade its cyber
security.
In the latest move, the NBTC is said to issue an official warning letter to the AIS
subsidiary, urging it to strictly ensure cybersecurity and data protection.
The Fiscal Policy Office (FPO) sees a shortfall of more than 200 billion baht in tax
revenue collection from 3 tax-collecting agencies-- the Revenue Department, the Excise
Department and the Customs Department.
The Finance Ministry has set its revenue collection target for the 3 tax-collecting
agencies at 2.87 trillion baht, Director-General of the FPO Lavaron Sangsnit as
Finance Ministry spokesman said. However, the forecast is likely to be met after
the 3 tax agencies amassed a combined 116 billion baht in the first half of this
year, around 200 billion baht lower than expected target.
The Association of Used-Car Dealers will submit a letter to the Excise Tax Department’s
Director-General today (May 27) to oppose the Federation of Thai Industries (FTI)’s
proposal for a 50% excise tax reduction until the end of this year to boost domestic
demand.
The Association voiced concerns over the impact of the proposed tax cut on
prices of 2nd
hand cars after the second-hand car market has already been
dampened by the COVID-19 crisis.
The Association said brand new cars will see their prices drop by several of 10
thousand baht if the FTI proposal is materialised.
Shares on Thailand’s stock exchange closed 15.11 points higher or 1.14% at 1,336.09
points, with a trading value of 73.954 billion baht following the global stock markets
which were buoyed by positive sentiment of a coronavirus vaccine produced by
Novavax.
The Stock Exchange of Thailand (SET) index climbed to its highest close since
early March, in line with most Southeast Asian stock markets closed higher as
further moves to ease the coronavirus lockdowns and hopes of more stimulus
from China boosted sentiment, while the Philippines ended lower even though it
pared steep early losses.
The Thai bourse also had buying pressure from tourism and hotel stocks on the
anticipation of phase 3 easing and tourism stimulus plans, expected in July, to
support domestic tourism.
Deputy Transport Minister Thaworn Senneam has put the brakes on a plan to transfer
four airports under the supervision of the Department of Airports (DOA) to the Airports
of Thailand (AOT) Plc to manage, citing the need to identify whether the law allows the
airport handover to avoid legal complications.
Mr Thaworn cautioned that the handover of the 4 airports which are state assets
to the AOT, a listed company, may violate the law.
Mr Thaworn said he instructed the DOA to hire a consultancy firm to study the
issue.

Prime Minister and Defence Minister Prayut Chan-o-cha said he is ready to lead 16
cabinet ministers to attend the House’s debate on executive decrees for 1.97 billion baht
loans and the budget transfer bill starting today (May 27). Meanwhile, the opposition
Pheu Thai Party plans to submit an amendment proposal to 3 executive decrees on
borrowing.
Gen Prayut is confident that he could convince the Opposition to support the loan
decrees to fund all state projects to fight the impacts of COVID-19. The Prime
Minister said all projects financed by the 1.9-trillion-baht loans will be vetted by a
scrutiny committee assigned to look into the loan transparency. He will allow the
public to take part in the scrutiny process of all projects designed to alleviate
hardship facing the public as a result of COVID-19.
Pongthep Thepkanchana, a member of the Pheu Thai strategic committee, said his
party prepares to submit an amendment proposal to 3 executive loan decrees if the
decrees receive approval from the parliament. The party believes that the move
can create confidence among the public that the bills will be less prone to
corruption, as Pheu Thai’s amendment proposal will allow parliamentary scrutiny
of the loans.
Sanguan Pongmanee, a former Pheu Thai MP for Lamphun, called on Gen Prayut
not to appoint army personnel to sit on a scrutiny panel assigned to look into the
loan transparency. The Pheu Thai Party MP said the public already lacked trust in
the management of state enterprises where army officials have been allowed to
serve as state enterprises’ board members.
Pheu Thai candidate has pulled out of a by-election in Constituency 4 of Lampang
province scheduled for June 20, despite having a greater chance of beating the Phalang
Pracharath Party (PPRP).
Pheu Thai Director Anusak Lek-uthai said he was notified by Phinit
Chantarasurin about his decision not to run in the by-election. Mr Phinit’s slow
decision has caused Pheu Thai to find a replacement because the candidate
registration was closed on May 26.
Mr Phinit cited that his grief over the death of his son Pheu Thai MP Ittirat
Chantarasurin. Mr Phinit’s withdrawal will pave the way for PPRP candidate
Wattana Sithiwang who came in 2nd
with 30,368 votes last year.
Another report said Mr Phinit decided not to run because he said there was no
benefit. He appears to be leaning more towards the PPRP, especially after Deputy
Agriculture Minister Thammanat Prompao asked Deputy PM Prawit Wongsuwan
to let Mr Phinit apply for the post of chief executive of provincial administrative
organisations.
In return, Mr Phinit was asked to withdraw from the by-election and clear the
path for Mr Wattana to become a representative of Lampang. Mr will have to
decide whether he takes up the chief executive’s job as a member of Pheu Thai or
of the PPRP.
There are reports that another factor that prompted Mr Phinit to withdraw from
the Lampang race is the internal conflict in Pheu Thai which reared its head at the
end of last year when the party lost in the Khon Kaen by-election. The party’s
loss in its long-standing stronghold was blamed on Pheu Thai chief strategist
Sudarat Keyuraphan.
However, the Pheu Thai Party Director said he is not concerned by Mr Phinit’s
withdrawal following reports that a candidate from the Seri Ruam Thai Party
applied to contest the Lampang by-election on May 25.
Finance Minister Uttama Savanayana, as the Phalang Pracharat Party leader,
along with Energy Minister Sontirat Sontijirawong, reportedly, called a meeting
with more than 40 MPs yesterday (May 26) to prepare for a debate on 3 executive
decrees backing the government’s 1.9-trillion-baht loan. The meeting was chaired
by PPRP list MP Wirat Rattanaset. However, there was no sign of Deputy Prime
Minister Prawit Wongsuwan, the PPRP chief strategist, at the meeting amid
internal rifts over the PPRP leadership.
Prior to this meeting, Mr Uttama called another meeting on May 25 at the
Finance Ministry but without Mr Wirat and members of the Saam Mitr Group.
Gen. Prayut went on air to talk about the extension of the State of Emergency
During his talk he touched upon issues that he has discussed with businesses and
the problems that they face which he said was more about the lack of revenue for
the people on the ground and that can be handled by the spurring of the economy.
As expected, the government extended the country’s state of emergency to the end of
June despite calls to scrap it as numbers of coronavirus cases in the country are now
dwindling.
After an extension of the emergency decree was announced, a majority of people,
87.6%, said they disagreed with the extension of state of emergency for the 3rd
time for another month, fearing impacts on their freedom and liberty, the Thai
Academic Network for Civil Rights (TANC) said, citing the results of an opinion
poll it conducted on the issue on 2,098 samples during May 24-25. It said most
people viewed that the curfew did not help contain the spread of COVID-19.
At the Office of the Permanent Secretary of the Prime Minister’s Office’s
complaint centre, the Five Regions’ People Network submitted a letter to Prime
Minister Prayut Chan-o-cha to scrap the state of emergency immediately, citing
threats to freedom and rights of the public. The group also petitioned the
Ombudsman asking it to consider the legality of the extension of the emergency
law.
The group said it is ready to ask the Constitutional Court to rule whether the
extension of the emergency law until June 30 violates Section 26 of the
Constitution.
Government spokesperson Narumon Pinyosinwat announced the Cabinet’s
decision to back the Centre for Covid-19 Situation Administration (CCSA)’s
proposal for an extension of the state of emergency for another month until June
30.
“The prime minister would like to say that since the beginning of the
emergency decree’s usage and every extension, we have based this on
public health reasons and not political ones,” Ms Narumon said.
Prime Minister General Prayut Chan o-cha denied a hidden political agenda
behind the extension of the state of emergency while the Opposition claimed the
government has a hidden agenda to restrict political activities in the kingdom.
New reports suggests that curfew will be from midnight until 04:00 hrs.
Members of the Opposition camp has voiced their objection to any extension of
the state of emergency, saying that the emergency law is unnecessary since the
situation has improved with single-digit daily infections. They perceived the law
as being used by the government to curb political activity and freedom of
expression.
Anusorn Iamsa-ard, Pheu Thai Party spokesman said the latest extension is a
consolidation of power, and an unnecessary use of power. He said his party could
ask the Constitutional Court to assess the validity of the stimulus legislation if a
debate in parliament starting today (May 27) fails to bring clarity.
The CARE Group led by Phumtham Wechayachai, an adviser to the leader of Pheu Thai
Party, is reported to hold talks with more than 30 members at a venue in Rama 9 area.
Interestingly, the meeting agreed that it is not the time to set up a new political
party due to unfavourable circumstances.
Next week, the group will launch an online forum via Twitter and Facebook to
publicise its ideas on various aspects. The group is looking to change its names.
Preferred names are ACT, WE Move or Chance for Change.

Thailand has reported three new COVID-19 cases and no fatalities over the last 24 hours,
bringing its tally to 3,045 with the death toll remaining at 57 fatalities.
Centre for Covid-19 Situation Administration (CCSA) spokesman Taweesilp
Wissanuyothin said all 3 new cases were related to overseas exposure. All of
them were Thais who returned from abroad and they are undergoing the 14-day
quarantine at a state facility.
The Unites States has seen its death toll run past 100,000 mark now with
infection at more than 1.7 million.
Globally the total infection has gone as far as 5.7 million and death toll
has reached 352,000 until 09:00 hrs this morning.
