DOELSTELLING MINISTERIE VAN JUSTITIE
• Terugbrengen van recidive van justitiabele.
• Percentage ex-gedetineerde dat binnen 2 jaar opnieuw wordt vervolgd (periode 1996-
2003) lag tussen 54%-59% (Wartna et al., 2006).
• Ernstige recidive (staf van 4 jaar of meer) ligt tussen 41% - 46%.
• 20% van geregistreerde criminaliteit zijn veelplegers (Tollenaar et al., 2006).
• Recidive van ex -TBS gestelde tussen 1999-2003 kwam 19% binnen twee jaar
opnieuw in aanraking met justitie (straf van 4 jaar of meer)

BELEIDSCONTEXT: BEHANDELING
• Doel; evidence based diagnostiek, risicotaxatie en gedragsinterventies/ behandeling.
• Neurobiologische kennis een plaats geven binnen onderzoek, beleid en praktijk.
• Huidige justitiële interventies ten aanzien van bijvoorbeeld antisociaal gedrag
gebaseerd op sociaal wetenschappelijk uitgangspunten (De Kogel et al., 2006).
• Voornamelijk medisch – psychiatrisch aanpak voor forensisch psychiatrische
patiënten die lijden aan ernstige psychische stoornissen.
• Geen genetisch, neurobiologisch, neuropsychologische factoren voor
verklaringsmodel van crimineel gedrag.
• Neurobiologisch – neuropsychologische onderzoek laat zien dat er variatie is tussen
individuen in onder meer gevoeligheid voor straf en beloning (Blair et al., 2001).

LITERATUUR HERSENLETSEL – FORENSISCH
• De huidige ontwikkelingen op het gebied van diagnostiek bieden steeds meer
mogelijkheden om hersenletsel te diagnosticeren. Aandacht voor een juiste
diagnostiek met betrekking tot hersenletsel lijkt wenselijk (o.a Alberto C & Souza de
2003, Egger et al. 2010)
• In Nederland geen forensische-psychiatrische settings die zich specifiek richten op
'neuro- patiënten' met ernstige gedragsproblemen met en zonder strafrechtelijke
maatregel.
• London (geopend in 2015) heeft in samenwerking met Justitie & Universiteit & GGZ
een specialistische ‘Forensische- Neuropsychiatrisch- Centrum’ opgezet.
• Een intensive samenwerking tussen GGZ en forensische settings en neuro-
psychiatische centrum / rehabilitatie is nodig om tegemoet te komen aan de complexe
zorgbehoeften van mensen met hersenletsel (Conor et al. 2009)

PREVALENCE OF TRAUMATIC BRAIN INJURY (TBI)
• A study on prevalence of Traumatic Brain Injury (TBI) in 69 randomly selected
inmates, 60% of the sample reported TBI over their lifetime and 36% reported TBI in
the prior year.
• Lumsden et al 1998 Study of 100 consecutive admissions to Broadmoor high security
hospital concluded that 31% had a history of [known] traumatic head injury with loss of
consciousness.
• Sarapata et al 1998 Study of nonviolent convicted offenders in US concluded that
people with TBI were significantly at greater risk of committing crimes. It also found
that 50% of nonviolent convicted offenders reported history of TBI.
• Langevin et al 2006 Canadian study of 476 sexual offenders concluded that almost
half had sustained traumatic brain injuries.
• People affected by ABI have a higher likelihood of entering the criminal justice system
(24% - 32%) (McKinley et al, 2008; McGuire et al, 1998)

COUNTRY; PREVALENCE TBI
• USA:
• Grafman, et al (Vietnam head study, 1996) Patients with injuries to the area involved in decision
making (frontal ventromedial system) were consistently reported to show greater aggression and
violence
• Blake, Pincus and Buckner (1995) assessed thirty-one individuals awaiting trial or sentencing for
murder, and found evidence of frontal dysfunction in 20 of them (64.5%)
• Finland
• Timonen, M., et al (2002) concluded based cohort study in Finland involving more than 12,000.
Subjects that had TBI during childhood or adolescence was found to be associated with a fourfold
increased risk.
• Sweden
• Fazel, S., et al. (2009, 2011) conclude that TBI was a moderate risk factor for violence. A total of
22,914 casus, 8.8% with TBI committed violent crime, compared with 3% in the population
controls. Crimes: convictions for homicide, assault, robbery, arson, sexual offenses, and illegal
threats or intimidation).
• Australia
• Kenny (2007) found that 85 participants of 242 young offenders in Australia had a history of TBI.
Young offenders with a history of TBI were 2.37 times more likely to have committed a serious
violent crime. TBI with LOC this ratio increased to 2.82.

WAT ZIJN EXECUTIEVE FUNCTIES?
• Executieve functiestoornissen zijn het gevolg van complexe context – brein –
interacties (stress, misbruik, drank & drugs..) in het kader van doelgericht
gedrag
• Term dysexecutief syndroom (DES) geïntroduceerd door Baddeley (1986).
• Executieve functies zijn hogere orde systemen, cognitieve functies die
verantwoordelijk voor de bewust gecontroleerde algemene besturing van
cognitieve processen (en gedrag) (Goldberg 2001).
• Betreft een set processen en vaardigheden; probleemoplossend, planning en
organisatie, zelfmonitoren, initiatiefname, foutcorrectie (en gedragsregulatie)
(Evans, 2003).
• Er wordt aangenomen dat die tot stand komen in functionele circuits waarin
diverse hersengebieden een rol spelen en dat die prefrontaal gecoördineerd
worden (Cummings & Trimble, 2002).

• Vaak aangeduid als “CEO van de hersenen”, of “dirigent van het orkest”.

complexiteit van het concept te begrijpen, ze suggereren een centrale controle

– ventormedial prefrontal cortex stores an accumulated reward history, based on
positive and negative reinforcement, which estimates the outcome and value of

• Wat is het?
• Het gestructureerd toepassen van psychotherapeutische interventies bij patiënten
met een hersenaandoeningen hun naasten, gericht op vermindering of hanteerbaar
maken van emotionele en gedragsmatige stoornissen en problemen voorkomend
uit hersenaandoening.
• Primaire en secundaire symptomen
• Gedrag (agressie, apathie) direct het gevolg van NAH of als reactie op
verlieservaring.
• Wanneer niet?
• Patiënt zonder ziekte inzicht, afasie, amnesie, executieve denkstoornissen,
apathie is neuropsychotherapie niet haalbaar. Enige niveau van inzicht,
abstraheren en reflecteren en leren in nodig.

• Cognitieve cyclus;
• verandering op het niveau van attitude is wat psychotherapie beoogt, dat vraagt dat
je de gehele cognitieve cyclus kan doorlopen, waarbij doelen worden gesteld,
uitgevoerd en afhankelijk van het resultaat worden bijgesteld. Patiënten met
executieve functiestoornissen zullen niet voldoen aan al deze voorwaarde

ALVORENS JE BEGINT MET BEHANDELEN;
• Prevalentie cijfers traumatisch hersenletsel variëren van 25% tot 78% van mensen opgenomen in
een gevangenis (ARC, 2010).
• Diagnostiek naar de cognitieve vermogens bij positieve anamnese is van groot belang!
• Delinquenten met hersenletsel hebben significant vaker te maken met; ernstige depressie,
verslavingsproblematiek, agressie reguleringsproblemen en suïcidale gedachten en/of pogingen
(Traumatic Brain Injury in prison and jails; an unrecognized problem). Dat kan een primair gevolg
zijn of secundair.
• Hersen-gedrag analyse noodzakelijk!
• Uit verschillende onderzoeken blijkt dat de groep delinquenten met hersenletsel en ernstige
gedragsproblemen veel problemen ondervinden bij hun participatie in rehabilitatie programma’s
(Slaughter et al. 2003). Dit vraag om een andere geïntegreerde aanpak.
• Betrek systeem- revalidatie en of neuro-psychiatrische instellingen bij de behandeling.
