Dear Member Posted to members for your information, especially for those of our members who were unable to join us for the AGM on the 13October, is a record of the President’s address delivered at the AGM and some pics. from the AGM. As we enter the ‘silly season’, too soon once again, we reflect on some of the issues with which your association has dealt with dur- ing the year. Insurance as a service to members has been a major factor and we enclose for your information a brochure on an extension of our in- surance offering to that of Master Builders Insurance which with our colleagues in the other regions we expect this to grow into a real benefit to members. Coupled to this we are in negotiations to set up a staff retrenchment insurance fund for the members of the Western Cape. As soon as the model has been produced we will liaise with members with a view to establishing whether members will support such a scheme. Master Builders Code of Conduct

This is work in progress and has reached the stage where it is very soon to be submitted to our attorneys for assistance with the process for settling complaints and disputes in line with the requirements of the Consumer Protection Act. Small Builders Manual The above is in the process of review by the Directors with amendments and as soon as a few samples are available we will request member companies to sponsor some of the Modules. The format of the new edition is the same as that of the previous edition and sponsorship acknowledgments will be advertised at the start of each module. We trust we will get the necessary support with this to enable 2000 copies to be printed as a first run. CONGRESS 2011 A full report on this years MBSA annual congress is published in the October edition of SA Builder. Should any member not be receiving their copy of SA Builder kindly contact the MBA office. The CETA Members are aware that the CETA is presently under administration. What does this mean ? In short the executive decision making has been taken over by Mr Themba Mhambi, the administrator. The Council and executive and all standing committees have been dissolved pending the appointment of a new Accounting Authority ( formerly the Council). At a roadshow last week, held for stakeholders, Mr Mhambi mentioned the following; His appointment was for 6 months which ended on the 24th Sept. 2011—the Minister has since extended his appointment to the 24th March 2012 He kicked off the meeting with a one hour ‘off the cuff’ presentation on what he found at the CETA when he was appointed administrator. Apprenticeships

Members are reminded that the MBA will contribute the equivalent wages of a general worker to members, compliant with the BIBC benefit purchases, who sign on apprentices for training.

Please contact Adele at the MBA office for details and an application form.

LEADERSHIP COURSE

The in-house Leadership course now in its 4th year will once again be presented at Belmont Square in 2012. The course is for those supervisory staff who have no formal qualifications and leads to an NQF4 certificate.

JBCC 6th Edition. PBA

The amendments to the 5th edition for incorporation into the 6th edition are at a stage which could mean release for printing early in the new year. The JBCC Nominated / Selected Sub contact agreement is also in the process of being revised to coincide with the amendments to the PBA.

* Staff and Board members could not distinguish between the organisation and their own personal needs.. What the CETA undertook for you (stakeholders) depended on ‘who you knew’. * Invoices were settled with some stakeholders on the basis of a ‘backhand’. * Some stakeholders were paying for vehicles for some staff members. * Staff members found to be on the payroll of some stakeholders * Staff appointments over the were found to be highly irregular. * Staff lapses in performance were so bad that the staff performance was the worst to be found in

any of the SETA’s. * In taking over the management he has had to dismantle most of the existing structures within the CETA and start again. * Regional offices saw no difference between themselves and stakeholders * The SETA’s fall under schedule 3 A of the Public Finance Management Act—the CETA administration took scant notice of the requirements contained in the Act. * Corrupt systems work for some and hence some staff members and council members were reluctant to change anything. * 80% of current CETA financed projects had a fraudulent component * A new Board will be appointed before the next financial year * CETA hired 5 Mercedes Benz motorcars to transport 5 CETA officials to a function in Limpopo * A large construction company was financed for an ABET project with the majority of names submitted as learners having matric!! As demonstrated the Administrator has a difficult task going forward but we are committed to sup-porting him in his endeavours to get the CETA functional and running for the benefit of our members who are the majority levy payers into the CETA coffers.

SANS 10400 Development in the building industry is a continuous process ( though I have heard some people refute that) but nevertheless it is so especially considering the passage of time, new materials, design methods, innovative building methods, political influence in policies and other aspects of building and construction that might impact on regulatory requirements. This requires that building regulations and the interpretation thereof cannot remain static and they will require review many times in the future. SANS 10400 consists of many parts under the general title of The application of the National Building Regulations The General Principles and Requirements are Published in Part A: of the SANS 10400 Regulations applicable to the ‗deemed to satisfy‘ requirements. These are general requirements for satisfying the National Building Regulations and requirements deemed to satisfy the following parts of the Regulations Part B: Structural Design; Part C: Dimensions; Part D: Public Safety; Part F: Site Operations; Part G: Excavations; Part H: Foundations; Part J: Floors; Part K: Walls; Part L: Roofs; Part M: Stairways; Part N: Glazing; Part O: Lighting & Ventilation; Part P: Drainage; Part Q: Non water borne means of sanitary disposal; Part R: Stormwater Disposal; Part S: Facilities for persons with disabilities; Part T: Fire Protection; Part V: Space heating; Part W: Fire Installation.

INTENTION OF THE ABOVE:

To enable [a] designers to design buildings that comply with the National Building Regulations and [b] contractors to construct buildings that comply and their subsystems using conventional materials and construction techniques in accordance with practices deemed to satisfy such Regulations and; [c] local authorities to establish compliance with the Regulations in a uniform and consistent manner. PART A deals with Administration: which includes inter alia the following which is of specific relevance to the Contractor as per the following A5 Application Forms and Materials, Scales and sizes of Plans A6 Site Plans A7 Layout Drawings A11 Pointing out of Boundary Beacons A12 Street levels A13 Building Materials and Tests A14 Construction A16 Qualifications of a Building Control Officer ( SC + 3yrs Tertiary education) A18 Control of Plumbers and Plumbing Work A19 Appointment of persons ( by Client) Responsible for Design, Inspection and Assessment Duties. ( Competent Person) A22 Notice of Intention to Commence Erection or Demolition of a Building, Notices of Inspection A24 Temporary Buildings A25 General Enforcement

B4 NHBRC The revision of SANS 10400 has been deemed desirable to incorporate the requirements of the Home Building Manual which in turn prescribes, inter alia, quantified performance criteria that augment functional regulations etc. Ie : If SANS 10400 is adhered to compliance with both the NBR‘s and the technical requirements of the NHBRC will be ensured. B10 Minor Building Work It is a requirement that the Local authority be advised of the intention to undertake minor work to enable them to set conditions where it is considered necessary to invoke some of the NBR‘s if deemed necessary. The discretion to decide whether proposed work should be classified as minor work is left to the building control officer. It is recommended that contractors source a copy of the SANS 10400 regulations, copies of which are available from The SABS office in Rosebank.

Johannesburg: Proudly South African announced the winners of their 5th Annual HomeGrown Awards competition, sponsored

by PetroSA, at a glitzy gala dinner on Thursday 29 September 2011.

The Homegrown Awards showcases homegrown, Proudly South African companies and organisations that are contributing to

the growth of the South African economy by creating employment opportunities and also enhancing the reputation of South

African products and services.

Member companies were able to submit entries in two categories only, with the highlight of the evening being the category,

‗Best Proudly SA company over the past 10 years‘ award, which was awarded to none other than Longspan Gutters. This cate-

gory criterion focused on how the company promoted the Proudly SA brand and campaign in its activities and marketing. The

impact of the business operations on the environment. Improvement of the company‘s‘ products, services and operations. Their

international quality management systems and how they have contributed to job creation and retention through their own opera-

tion as well as supporting local companies.

The event was well attended by more than 450 delegates, including special guests such as Cllr Parks Tau – Executive Mayor of

Less talk, more action needed on corruption – Minister

Government and the private sector must rise above strategising and planning and start to soil their hands in the fight against corruption, Public Service and Administration Minister Richard Baloyi said on Friday at the third Business Unity South Africa (Busa) anticorruption forum in Sandton.

―I intend to amend the Public Service Act in an effort to deal swiftly and decisively with any public official

suspected of corruption. I want to do away with the practice of suspending such officials with full pay,‖ he

assured delegates.

Baloyi intends to implement a strategy of taking swift action with minimal financial implications – firing corrupt officials. Source : Engineering News ____________________________________________________________________________________

Good news for economic development in the Western Cape

SA may designate Saldanha IDZ by September 2012 A feasibility study into the creation of South Africa’s fifth industrial development zone (IDZ), at Saldanha Bay, in the Western Cape, estimates that the development could yield between 4 240 and 8 930 direct jobs over a 25-year period and add between R11.2-billion and R31.6-billion in yearly revenues to the regional economy. ———————————————————————————————————————————-

Minister of Human Settlements, Tokyo Sexwale, in his address issued his strongest warning to home builders yet - build shoddy houses and you'll never build in this country again. "If houses are built, it should be a quality product and affordable. Consumer protection and satisfaction is of utmost importance." MBSA is planning to engage with the Minister on precisely this aspect

of the Forum, in the New Year, in order to continue the success achieved in February by bringing together industry role players to discuss matters of
