RIGHT OF ENTRY AND HOLD HARMLESS AGREEMENT (AGREEMENT) FOR VOLUNTARY ACTIVITIES

(GRANTOR) whose mailing address is and the Lake Worth Drainage District (LWDD) a Special Taxing District of the State of Florida, whose mailing address is 13081 Military Trail, Delray Beach, Florida 33484-1105, hereby agree that LWDD, its agents, employees and assigns, are hereby granted the right to enter upon property owned by GRANTOR for the following purposes:

See Exhibit “A” attached hereto and made a part hereof. Such equipment as may be needed to accomplish the above purposes may be brought upon, over and across the property which is described as follows:

LWDD without waiver of Florida Statute §768.28 and GRANTOR, agree to release, hold harmless and indemnify the other party including their agents, employees and assigns from any liability for death, injury or other loss or property damage which may occur during or as a result of this activity. Project Limits

Description of Work

The Lake Worth Drainage District

(District) is planning necessary

rehabilitation work on the east side of

the E-4 Canal adjacent to your property.

This work is necessary to facilitate

effective flood control for public safety

and provide unobstructed access for

emergency flood control response and

routine canal maintenance.

Rehabilitation efforts may include

removal of non-native vegetation,

dredging of the canal channel, and

reshaping or reconstruction of the canal

bank(s). Non-native vegetation located

adjacent to the District’s canal banks

can create obstructions to water flow

during a heavy rainfall event and/or

hinder the District’s ability to properly

maintain the canal, both of which can

cause serious flooding issues for

surrounding properties. An example of

the typical vegetative removal,

mulching and treatment process is

included on the following page.
