IC 33-34-5-7 provides that a Marion County Small Claims Judge in a low caseload court shall provide five (5) days of assistance to the Judges in the other Marion County Small Claims Courts. A low caseload court is defined in IC 33-34-8-5 as a court with less than four thousand new filings and is limited to two courts. In return for this service IC 33-34-8-3(c) provides that each of the non-low caseload courts shall pay $1.50 of the township docket fee for each new case filed to the township trustee of each low caseload court at the end of each month.

There is little that the Marion County Small Claims Judges can do to allocate cases among the Marion County Small Claims Courts. The legislature has stepped in and implemented a structure where the Judge of the low caseload courts follow the cases rather than allowing for the cases to be reallocated.

Pursuant to Indiana Code 33-34-5-7(a), the Presiding Judge of the MC Small Claims Courts assigns Judge Hockman and Judge Kitley as low caseload court judges each to 10 sessions per month in the following courts:

1. Wayne Township Small Claims Court 2 ½ days or 5 sessions per month. 2. Center Township Small Claims Court 2 ½ days or 5 sessions per month. 3. Lawrence Township Small Claims Court 2 days or 4 sessions per month. 4. Warren Township Small Claims Court 1 day or 2 sessions per month. 5. Perry Township Small Claims Court 1 day or 2 sessions per month. 6. Washington Township Small Claims Court ½ day or 1 session per month. 7. Pike Township Small Claims Court ½ day or 1 session per month.

Upon the request of the high caseload court Judges for coverage, Judge Hockman and Judge Kitley are to work with the Judges to determine the actual schedule.

The Judges of the Marion County Small Claims Courts agree with the certified caseload numbers as provided to the Marion County Circuit Court Judge to determine the low caseload courts for 2017 and 2018. (See Attachment).

Since the Marion Superior and Circuit Court and Marion County Small Claims Courts were created by different statutory authority and operate under different and separate rules of procedure, the Marion

The Marion County Small Claims Court Judges took the same approach for the above reasons and 75% of the Small Claims Judges approved this plan.

Attachment

Indiana Administrative Rule 1(E) Caseload Allocation Plan determines that a small claim case should take 12 minutes from start to finish. Caseload Allocation Plan also accounts for the number of total hours worked in a given year, reduced down for estimated time off. It has been determined by the weighted caseload measurement system that average judicial officer works 77,745 minutes per year.

Published Document Comment Feb 09, 2019 This document outlined the status at the end of

2018 using Net case filing numbers and the Judicial Officer assignments that existed as of 12-31-18

Feb 22, 2019 This document took the judicial officer assignments as of 1-21-19 along with the net case filings in each court in 2018, and provided the utilization numbers.

This document takes the 2018-year end net case filings in each court, uses the existing Magistrate Commissioner Schedule and assignments in all the courts, and uses the equalization of filings in the misdemeanor courts, and the juvenile courts to arrive at the utilization numbers.

At this time, the Judges of Marion County are reviewing their court operations in light of the upcoming move to the Community Justice Campus (CJC). The Community Justice Campus is at this time on schedule to be operational in early 2022.

Due to several procedural issues to be discussed, reviewed and considered, it is the opinion of the author that at this time, only the following be submitted as the official plan for Marion County Courts’ Weighted Caseload Allocation/Capture plan for the years 2020-2021.

All case filing numbers used in this document are using 2018 Year End New Case Filings. For this document and going forward we are using NET Numbers for all Case Filings. So the calculation for NET (Adjusted) Filings is Adjusted (NET) Filings = (New Cases Filed + Cases Venued in + Cases Transferred In + Cases filed as Special Judge from Other Court + Other Special Judge in Court ) – (Cases Venued Out + Cases Transferred Out)

b. Each court would receive about 4,230 cases (projected) that works out to 489,254 minutes.

Other NOTES • Civil D04 – All Civil Courts normally receive 6 sessions of Magistrate time. Civil D04 has 7

sessions of Judicial Officer time allotted as it handles the OV case docket. Due to that, D04 receives an additional 1 session of Magistrate time taking it to a 2.07 Judicial Time instead of 1.67.

• EC and Term Presiding Judges each are getting a 1 session of Judicial Officer Time. The table below shows the utilizations for each of the EC Judges without giving them an extra commissioner session.

2018 Initial Review Case Filing Numbers

• As part of the end of year review, on Feb 8, 2019, and on Feb 15, 2019 I received from the IOJA the 2018 official numbers based on our 4 quarters of new case filings. All net adjusted numbers are documented and certified numbers from the Indiana Office of Judicial Administration.

FOR IMMEDIATE IMPLEMENTATION

At this time, this is recommended for immediate implementation to give relief across all Criminal Division Courts.

1. Search warrants (MC – Miscellaneous Criminal) case types have 17 minutes allocated to each case filings. In 2018, there were 7118 Search warrants filed and all of those minutes were distributed only to the Major Felony Courts. The 7118 cases accounted for 1.6 Judicial Officer time that should be attributed to the Initial Hearing Court (IHC) judicial officers. As the session times for the IHC Judicial Officers is distributed across all the Criminal Division courts, we will be distributing all the MC Search Warrant type case numbers going forward to all courts in the Criminal Division from sometime in June 2019.

So at this time, the 1.6 Judicial Officer time should be equally distributed across all Criminal Division Courts and not just limited to Major Felony courts. The MC cases for search warrants will also be randomly distributed across all Criminal Division Courts, with each court getting credit for 339 MC Search Warrant case. Doing this step will ensure the following numbers (using 2018 Net Numbers).

Distributing Search Warrant MC Cases across all Criminal Division Courts

This table shows for each court the original MC cases that were filed per court. The column NEW outlines the new MC case numbers after distributing the search warrant cases across all the criminal division courts. Doing this also changes the Minutes for each of the courts, and the new minutes are also shown here along with the differences in utilization.

1. There would be NO change in Judicial Officer Sessions allocations regarding this.

2. The ONLY change proposed in the plan is

that the Odyssey Case Management System would be changed, and ALL Criminal Division Courts would now be in the rotation to be allocated the MC (Miscellaneous Criminal) cases with sub-type of “SEARCH WARRANT”. This would then allocate the appropriate minutes for each of the courts.

2. Ordinance Violations (OV) Court Docket – Judicial Officer Needs

The Current Judicial Officer schedule for the Magistrate OV Docket that handles Ordinance Violations cases is as shown below –

For 2018, there were 4392 OV cases filed that are allocated 2 minutes for each case for a total of 8784 minutes. Due to that, we should allocate Judicial Officers to handle the cases appropriately.

PROPOSED: The OV Docket will have the following Judicial Officer assignments  

  

The suggested NEW assignment for the OV docket is 3 Sessions with a 4th one available – the Judicial Officer for the 4th session is actually assigned to IHC, but available for the OV docket and will be working on the Search Warrant Queue, PC findings and IHC queue and the OV queues during the THURSDAY AM session. In the event there is a shortage of judicial officer in both the OV and the IHC docket on THURSDAY AM, the judicial officer will look to fill the IHC Docket first with a pro tem appointment to the OV docket. The recommendation would be to tell the OV docket practitioners to ONLY schedule Court sessions for MONDAY AM, TUESDAY AM and WEDNESDAY AM. We should allow for a maximum of 60 days’ transition time for this to occur.

3. Initial Hearing Court Docket – Judicial Officer Needs

The Initial Hearing Court docket needs to have at least 2 Judicial Officers assigned to each session as the Judges have to conduct the initial hearings on the bench for all lower felony courts while also handling search warrant requests for the whole county, along with PC determination and all initial queue activity for all lower felony level courts.

Currently, there is a gap of 6 sessions that is handled by just 1 Judicial Officer as shown below -

The utilization for D04 after removing 5 sessions of Judicial Officer time and assigning to the IHC docket rises to 0.9 from the existing 0.78. Please see charts to the right for details.

Notes for Proposed IHC Schedule:

a) Mag. Jim Snyder has MONDAY off – this allows him to be assigned for the Weekend Day Shift coverage

b) The Judicial Officers assigned to IHC will operate in both IHC and will also be watching the Search warrant queue, IHC docket queue for PC findings, urgent queues and any OV paperwork queue.

c) The reason to have 2 JOs simultaneously assigned is to allow for any emergency situation as well to handle vacation/time offs etc. It is recommended that while approving leave requests BOTH judicial officers assigned to a day not have the same time off.

d) The only session that does not have 2 Judicial officer assignment is FRIDAY AM session and this can be reviewed in the near future to fill.

4. Title IVD Court Docket – Judicial Officer Needs – NO CHANGE

The Title IVD docket benefits greatly by having the continuity of the same judicial officer. Currently the docket is handled by Magistrate Marci Ferree for 4 sessions.

There would be no other changes to that docket assignment or judicial officer assignment.

The Marion County Courts (Circuit and Superior Courts) are required by Administrative Rule 1(E) and Indiana Supreme Court Order (49S00-1009-MS-483 and 94S00-1701-MS-5) to submit a Weighted Caseload plan for the planned years 2020-2021 by June 1, 2019.

As part of the plan submission, we are required to review the case filings and variance numbers at the end of 2018 using the submitted Quarterly Case Status Reports (QCSR) for each of the courts in our County. As part of a detailed review of the Administrative Rule 1 (E) the Indiana Office of Judicial Administration (IOJA) also did a comprehensive review of the minutes allocated to each case type. In 2017, judicial minutes available for each year per judge for case related activities has been set to 77,745. The Indiana Supreme Court order states that “courts of record in each county shall, by a local rule, develop and implement a caseload allocation plan for the county that ensures an even distribution of judicial caseloads among the judges of the courts of record in the county”.

The key aspect is that once the caseload plan is created, the order says “(3) County Plans. The judges of the courts of record in each county must approve the county caseload allocation plan by not less than 75% vote. The chief judge or another judge designated by the courts of record in the county shall submit the approved county plan to the IOJA by the deadline established in the schedule.”

NEXT STEPS

1. Review CAPTURE/WCL Plan with all Marion County Circuit and Superior Court Judges on May 8, 2019

2. Get CAPTURE/WCL Plan from the Marion County Small Claims Courts and incorporate as a section in the Marion County CAPTURE plan submission by 5-17-2019.

3. On 5-20-2019 complete CAPTURE/WCL Plan after vote of the General Term, and 4. By May 30, 2019 submit the plan for future court operations in the years 2020-2021 as

required by WCL Plan submission to the Indiana Office of Judicial Administration (IOJA) for consideration by the Indiana Supreme Court.

The chart below maps the case filings in 2018 for each case type and for this year we have begun using NET Numbers taking into account New Case Filings, Cases Venued In, Cases Transferred In, Special Judge for Other Court, Other Special Judge in Court, Venued Out and Transferred out.

So the calculation for Adjusted Filings is

Adjusted Filings = (New Cases Filed + Venued in + Transferred In + Special Judge for Other Court + Other Special Judge in Court ) – (Venued Out + Transferred Out)

The schedule for submitting caseload allocation plans shall follow the schedule for adoption of all local rules under Trial Rule 81 and is as follows:

1. April 15, 2019 – Division of State Court Administration shall publish the WCL report based on the prior year caseload statistics.

2. June 1, 2019 – Courts of record in the counties who are due to file caseload plans that year pursuant to Section 10 of AR 1(E) shall submit their plans to the Division of State Court Administration for publication and shall publish notice for comment pursuant to T.R. 81.

3. July 1, 2019 – Close of comment period. 4. July 2 to July 31, 2019 – Final approval of caseload plans by local courts. 5. August 1, 2019 – Submission of locally approved caseload plans to Division of State Court

Administration for approval pursuant to Administrative Rule 1 (E)(3). 6. October 1, 2019 – Supreme Court action – approval, return with request for revisions, or

rejection. 7. November 1, 2019 – Revised plans due before Supreme Court. 8. November 15, 2019 – Final Supreme Court action on resubmitted plans. 9. January 1, 2020 – effective date of caseload plan.

The Supreme Court order states that “courts of record in each county shall, by a local rule, develop and implement a caseload allocation plan for the county that ensures an even distribution of judicial caseloads among the judges of the courts of record in the county”.

Next Steps. In the next few days, I will be creating the state of the courts using the above case filings with the following changes on it –

1. Equalizing case filings a. in Misdemeanor Courts

i. G19 Court does not exist, and all new case filings are taking place in the remaining court – G07, G08, G10, G12.

b. In Juvenile Courts i. We now have courts D09 and D15 that we will be equalizing the case filings

for the Juvenile Division. 2. Using existing Judicial Officers Assignments in each court to get the next utilization

values. I expect to be able to send that report out to all Judges by 2-28-2019. Other Questions that have been asked Some questions that have been asked in the past are – 1. My workload is way higher than the numbers reported.

Ans: Page 3 (Section AR 1 (E)) of the 1st attachment outlines the key changes that have been made. I believe that these are a lot more lenient than what they have been in the past. Nevertheless, here are some key aspects –

a. I have heard, and been told by many different sources that we are not to use “NET” numbers in calculation of the caseload plan. The concept of “NET CASES” is shown below -

NEW CASE FILINGS – CASES TRANSFERRED OUT + CASES TRANSFERRED IN = NET CASES that a Judge works on that year

The Supreme Court has diligently struck off the work WORKLOAD and replaced it with the word CASELOAD everywhere in the rule. At this time, the only 2 ways that IOJA allows counting of cases is by NEW CASE FILING into a court or NET NUMBERS. We are allowed to choose as a county which method we want to choose. The recommendation at this point is to choose the NET NUMBERS method as it then accounts for all the changes of Judges and each court will then truly get accounted for the caseload that they handle. 2. How are those new case numbers counted? We are required by the Indiana Office of Court Services (“IOCS”) and administrative rules promulgated by the Indiana Supreme Court to gather quarterly statistical data on the work of the courts in our county. The Quarterly Case Status Report (QCSR) is the report developed by IOCS to collect the required information about the volume and the type of business conducted by the courts and the methods by which cases are disposed. All reports are

filed online using the Indiana Courts Online Reports (ICOR) application through the INcite (Indiana Courts Technology Extranet) website: https://mycourts.in.gov . Passwords to access these applications are distributed through the Court Technology. Since 2014, all data for our courts have been compiled directly into the ICOR QCSR system from the Odyssey Case Management System. The QCSR data filed with IOCS is used to compute a weighted caseload measure for each trial court. The weighted caseload measure is an index of the judicial resources or judicial time required to process cases filed in the court. ICOR Online Statistics are also available for every county across the state at http://publicaccess.courts.in.gov/ICOR 3. Why are “Special Judge” cases not counted in this? What about the new cases like DC and DN

case weights – how do you account for them? What about DR and other cases?

Ans: This is the NET NUMBERS question, and we are counting them if we choose the NET NUMBERS accounting method for our weighted caseload calculations. The new DC and DN case weights (which replaced the former DR case type) are all used in the calculations. We also account for every case type that has a minutes value allocated.

4. When do we have to have this voted on by general term and turned in to the Supreme Court?

Ans: This needs to be reviewed with drafts communicated to general term by April 2019, and then finally voted in May 2019 for submission by May 31, 2019. NEXT STEPS

- By 2-28-19 provide update spreadsheet with calculations using existing Judicial officer assignments, and equalizing of case filings based on existing court structure.

Background

Please refer to MEMO 1 - Weighted Caseload Review with 2018 case filings and the new minutes

allocations that was published on Feb 20, 2019 for prior details.

This document takes the 2018-year end net case filings in each court, uses the existing Magistrate

Commissioner Schedule and assignments in all the courts, and also equalizes the filings in the

following courts to arrive at the Utilization numbers.

Equalizing case filings

a. Misdemeanor Courts

i. G19 Court does not

exist, and all new case

filings are taking place

in the remaining court

– G07, G08, G10,

G12.

b. Juvenile Courts

i. We now have courts D09 and D15 that we will be equalizing the case filings

for the Juvenile Division.

ii. Each court would receive about 4230 cases (projected) that works out to

489254 minutes.

This Excel document contains all NET case filings for 2018 in all courts of record in

Marion County and uses the existing Magistrate/Commissioner assignments as of 1-21-

2019 along with equalizing of cases in the Misdemeanor Courts (G07, G08, G10, G12) and

the Juvenile Courts (D09, D15)

The TABS on the bottom of the page provide individual court outlines. Click on your court

tab and print to review the numbers for your court in 2018.

The Summary tab provides a quick view of the utilization across all our courts.

o The Judicial HAVEs (Judicial assignment values indicated) are using the

assignments as of 1-21-2019.

The MSCJO tab provides a quick view accounting of every session assignment by Judicial

Officers for each court to calculate the Judicial Officer HAVEs value for each court.

The D09-D15 tab provides the view of the juvenile court cases from 2018 (net numbers)

for each case type, and allocating exactly half to each of the D09 and D15 courts to come

up with the adjusted Minutes for each court.

The MISDEMEANOR ADJ tab provides the view of the net numbers in the misdemeanor

courts in 2018, and then dividing them up equally for 2019 to arrive at the new projected

NET numbers for 2019.
