    quent amendment as registered by the Clerk of thePrivy Council under the Statutory Instruments Act,the original regulation or amendment prevails to theextent of the inconsistency.

    MARINE PERSONNEL REGULATIONS RGLEMENT SUR LE PERSONNEL MARITIME

    INTERPRETATION DFINITIONS ET INTERPRTATION

    1. (1) The following definitions apply in these Regu-lations.Act means the Canada Shipping Act, 2001. (Loi)

    Administration means

    (a) in respect of a Canadian vessel, the Minister; and(b) in respect of a foreign vessel, the administrationof the state whose flag the vessel is entitled to fly.(Administration)

    air cushion vessel or ACV means a vessel designedso that the whole or a significant part of its weight canbe supported, whether at rest or in motion, by a continu-ously generated cushion of air dependent for its effec-tiveness on the proximity of the vessel to the surfaceover which it operates.     applicant means a person who applies to obtain, renewor replace a certificate or an endorsement issued underPart 1 or 2. (candidat)

    approved cadet training program means a training pro-gram in either navigation or marine engineering, depend-ing on the certificate or position sought, listed in the De-partment of Transport Standard TP 10655, Approved

    approved training course means a course that has beenapproved in accordance with section 114. (cours de for-mation approuv)

    approved training program means a training programapproved in accordance with section 114, given by a rec-ognized institution and forming an integral part of the re-quirements for obtaining a certificate or an endorsementthat, in cases provided for in these Regulations, may be

    ARPA means an approved training course in simulat-ed electronic navigation (SEN) entitled Automatic RadarPlotting Aids. (APRA)

    assistant engineer means a person, other than a rating,who is in training to become an engineer. (officier mca-nicien adjoint)

    ment; or(c) a Restricted Proficiency in Survival Craft andRescue Boats Other Than Fast Rescue Boats certifi-cate that is valid for the vessel on which the person isemployed. (personne brevete)

    chief engineer means the engineer officer responsiblefor the mechanical propulsion and the operation and

    SIM means an examination on simulated electronic

    navigation administered by an examiner. (SIM)SOLAS means the International Convention for theSafety of Life at Sea of 1974, and the Protocol of 1988relating to the Convention. (SOLAS)

    stationary MOU means an MOU that is not underway,that is not maintaining position by means of thrusters ordynamic positioning or that does not keep the propulsionunit in standby mode. (UML stationnaire)

    STCW Code means the Seafarers Training, Certifica-tion and Watchkeeping Code adopted under the STCW

    (3) The successful completion of a course that wastaken for the purpose of obtaining a certificate of compe-tency or an endorsement remains valid for life once thatcertificate or endorsement has been obtained, except inthe case of the following courses:

    (a) a course referred to in subsection (1);(b) a first aid course;(c) a course with respect to tankers; and(d) a course with respect to passenger-carrying ves-sels.

    104.

    Except in the cases set out in section 105, theholder of a Master, a Mate or an Engineer certificate thatwas issued before the day on which this section comesinto force, that has not been renewed under these Regu-lations and that is set out in column 1 of Schedule 1 tothis Part may obtain, in order to continue to have a cer-tificate that is valid for use at sea and at the latest on thedate of the expiry of the certificate, on application, anexchange of that certificate for one of the correspondingcertificates set out in column 3 having, where applicable,the endorsement and limitation set out in column 4 of

    that item, and for that purpose the holder shall meet therequirements set out in column 2 of that item or para-graph, if any, and the requirements of section 106 or107, as the case may be.

    in respect of which renewal of the certificate issought, in accordance with the vessels gross ton-nage, and

    (ii) in the case of any other certificate, a written ex-amination on navigation safety and an oral exami-nation on general seamanship; or

    (c)provide the examiner with training testimonialsindicating that they have successfully completed,within the 5 years before the application date for re-newal, the following courses at the level applicable to

    the certificate sought:(i) ship management, and(ii) refresher training course in marine emergencyduties.

    (2) An applicant who chooses to meet the require-ments of paragraph (1)(a) shall acquire the followingservice:

    (a) subject to subsection (3), at least 12 months of seaservice on board one or more vessels as a master or

    mate in charge of the deck watch or on board one ormore MOUs as an offshore installation manager, abarge supervisor or a ballast control operator acquiredwithin the 5 years before the application date for re-newal of the certificate;

    (b) subject to subsection (3), at least 3 months of seaservice on board one or more vessels as a master, mateor supernumerary mate performing watchkeeping du-ties, or on board one or more MOUs as an offshore in-stallation manager, a barge supervisor or a ballast con-trol operator acquired within the 12 months

    immediately before the application date for renewal ofthe certificate;

    (c) at least 24 months of service, within the 5 yearsbefore the application date for renewal of the certifi-cate, performing duties in any of the following ma-rine-related positions:

    (iii) a marine surveyor or marine inspector per-forming duties relating to the survey or inspectionof vessels or vessels equipment or cargoes,

    (iv) a harbour master, dock master, berth master,deputy harbour master, deputy dock master ordeputy berth master,

    (v) a watchkeeper or supervisor of port operations,vessel traffic services or a search and rescue centre,(vi) a hydrographic surveyor,(vii) an instructor or training officer in nauticalsubjects, employed at a recognized institution or byan authorized representative,

    (viii) an examiner of masters and mates,(ix) a casualty investigator engaged in investigat-ing marine casualties,

    (x)a person engaged in marine emergency re-sponse planning or vessels operations, or

    (xi) an officer or representative of a trade union, asdefined in the Canada Labour Code, whose dutiesinclude

    (A) involvement in marine casualty investiga-tions,

    (B) liaising with or providing assistance to gov-ernment bodies such as the Department of Trans-port and the Transportation Safety Board of

    Canada, and(C)participating in the development of policywith respect to the training of ships officers; or

    (d) an equivalent prorated combination of the require-ments set out in paragraphs (a) to (c).

    (a) acquire the service set out in subsection (3);(b)provide the examiner with a training testimonialindicating that they have successfully completed,within the 5 years before the application date for re-newal, a refresher training course in marine emergen-cy duties at the level applicable to the certificatesought, pass within that same period a written or oralexamination on general engineering knowledge and atany time, have successfully completed a course inpropulsive plant simulation at the level applicable tothe certificate sought; or

    (c)provide the examiner with a training testimonialindicating that they have successfully completed,within the 5 years before the application date for re-newal, a refresher training course in marine emergen-cy duties at the level applicable to the certificatesought, have successfully completed at any time acourse in propulsive plant simulation at the level ap-plicable to the certificate sought and, in addition, havesuccessfully c
