6. (1) A contract of marine insurance is acontract whereby the insurer undertakes to in-demnify the insured, in the manner and to theextent agreed in the contract, against
(a) losses that are incidental to a marine ad-venture or an adventure analogous to a ma-rine adventure, including losses arising froma land or air peril incidental to such an ad-
venture if they are provided for in the con-tract or by usage of the trade; or (b) losses that are incidental to the building,repair or launch of a ship.

Total loss 67. Subject to this Act and any express pro-vision in the policy, the measure of indemnityin respect of a total loss of the subject-matter insured is

68. Subject to any express provision in themarine policy, the measure of indemnity in re-spect of a partial loss of a ship is
(a) where the ship is repaired, the reasonablecost of the repairs less the customary deduc-tions, but not exceeding the sum insured inrespect of any one casualty;(b) where the ship is partially repaired, theaggregate of the reasonable cost of the re- pairs, as determined under paragraph (a), andthe reasonable depreciation, if any, arisingfrom the unrepaired damage, the aggregatenot exceeding the cost, as determined under paragraph (a), of repairing the whole dam-age; and(c) where the ship is not repaired and is notsold in a damaged state during the risk, thereasonable depreciation arising from the un-repaired damage, but not exceeding the cost,as determined under paragraph (a), of repair-
