Experienced HVAC Technician required for alternative staffing assignment through the Marin City Community Development Corporation (MCCDC). Position is a temporary status. Qualifications Ideal candidate must have:
2 years verifiable experience (more is desirable) in residential HVAC installation; Solid troubleshooting skills; Experience working with homeowners providing a high level of customer service and professionalism; Experience having worked on a team as well as independently; Willingness to learn and adhere to stringent requirements regarding equipment and duct installations;
and A valid California driver’s license, a clear driving record and proof of personal vehicle insurance coverage
are required to be maintained at all times for this position. Functions and Responsibilities The HVAC Technician must possess:
Ability to pull his/her entire body weight up through an attic hatch door; Skills to be able to work in an 18" high crawl space or attic; Tolerance for working under high heat and extreme cold conditions Ability to wear a full-face respirator for several hours a day continuously; Capacity to regularly carry up to 50 pounds of equipment; Unafraid of mice, rats, spiders, bugs, etc., commonly found in HVAC work; Must model environmentally responsible behavior on the job at all times.
Additional criteria Highly desirable:
BPI Certification; Environmental literacy certification such as Roots of Success; OSHA safety certification Own truck or van; and Genuine interest in the industry and be dedicated to greening the environment.

Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc.
Parting may be ‘sweet sorrow’ but it’s also more paperwork for contractors. Nothing ‘ventured’, nothing gained. As a license qualifier departs it can also open up new avenues of individual opportunity. Another contractor faces a dire situation, and last I want your feedback to share… Q: I am in the process of leaving my company. What steps do I need to take to remove myself from their license as I was the Responsible Managing Employee (RME) for the A & B. Being that I took and passed the tests is it possible for me to carry my own license forward into my next venture or do I need to re-test? Please let me know how to go about this. Thank you A: The first step would be to complete and file a Notice of Disassociation to remove yourself from your present license. Since the license belongs to the corporation not you as the RME, you can take these classifications any-where you want; however, you may not take the license number. If “your next venture” is to operate as a Sole owner, you’ll need to apply for a new original license. If you intend on qualifying as a RME on another corpora-tion, you’ll need to file two applications for additional classifications. Either way there is no need to re-test. Q: I have enjoyed reading your Q&A in the ‘California Builder & Engineer’ for many years. About 10 years ago I was forced to bankrupt my Engi-neering Company. I also had an unrelated contracting company. One of the listed creditors was a bank. About the same time as I was making this filing, a company purchased what they thought was a recoverable obliga-tion. They either did not know or did not care if they were violating an automatic stay. Nevertheless, they failed to file a demand under a list of creditors and proceeded to secure a judgment from a Court. I knew nothing about the court action and was not served notice of the hearing. This is by way of background. I am upset at the actions of the Contractors Board since
they will not issue my ‘pocket card’, even though my fees are paid, and I requested ‘inactive’ status. After the Contractors License Board had deposited my renewal check, they sent me a letter saying they could not issue my pocket license, which is required when contracting. Section 7071.17 of the B & P Code regarding judgments states “construction related”. What does a credit card issued to Engineering Company have to do with my con-tractor’s license? Any suggestions on what to do? A: Your license has been renewed Inactive until 2013 but is suspended due to “an outstanding civil judgment”. I do not know why the Board would hold back issuing a pocket card with an “inactive” license. Conversely, with an Inactive license the pocket card is not critical since you cannot do any contracting. I would suggest providing the CSLB with a copy of your BK, which lists the applicable bank creditor? Often this is the only thing the Board looks for. I do not believe it matters that someone else purchased the asset; however, I would consult with a bankruptcy attorney to see if this is an issue. If this doesn’t work you might try making the argument that “a credit card issued to an Engineering Company” is not “construction related” however, it’s up to the CSLB to determine what does and does not fall into this category. CONTRACTOR ALERT: If you have called or emailed the Governor’s Office regarding the CSLB hiring freeze, please contact me with the response you have received. Hardest hit are the Board’s enforcement efforts against the underground economy and the “phone units” ability to respond to everyday calls from contractors and con-sumers.

Hold on to your hats and “plug your ears,” that sound you will soon be hearing on TV and the radio is not “dueling banjos;” rather, it will be the loud noise of dueling campaign ads urging you to vote for a specific tax proposal and/or an ad disparaging the other likely proposals that will be coming your way! Indeed, California’s taxpayers are going to be dealing with myriad tax reform proposals over the next year due to California’s continuing budget woes! And let me say this before discussing any of them, the chances that even one will ultimately be approved will be problematical at best since the more choices voters have will more than likely just add to their confusion and thus a likely “NO” response to all of them.
Now on to the proposals, THUS FAR!
Over the weekend, the Sacramento Bee revealed the proposals from the Think Long Committee funded by billionaire Nicolas Berggruen. The centerpiece of this proposal is a tax on services. The proposal also carries plans to cut income and corporation tax rates, drop the sales tax on goods a half-cent and raise business taxes on out-of-state firms, among other proposals.
The sales tax cut goes against the plan being tested by the California Teachers Association, which would raise the sales tax along with income taxes on certain high-end taxpayers.
Then there are other tax plans in the works primarily aimed at funding education. To this end, civil rights attorney and investor, Molly Munger, has a proposal to increase income taxes. A coalition of some business and education groups including the Bay Area Council, Children Now and the California School Administrators Association are reportedly behind a strategy that would include broad-based tax increases along with plans to make it easier to raise parcel property taxes on the local level. Also already filed with the Attorney General’s office
is an initiative to create an oil severance tax to fund both K-12 and higher education.
It doesn’t take a degree in political science to realize that if all these tax measures appear on the ballot they would be self-defeating, scaring the taxpayers to pull the NO lever and be done with it.
Of course, “DA MAN” in bringing these disparate plans together is the governor who also wants a tax plan on the ballot. In fact, he’s working “behind the scenes trying to entice business interests to “lay low” on his forthcoming plan. In return for Brown staying away from business-specific taxes, he would instead advocate for broad based taxes like the sales tax and an income tax increase on upper income earners. And, unlike the education interests who would be satisfied with directing all new revenue to schools, Governor Brown would also propose that some of the money go to fund his government realignment plans.
The bottom line? Based on the outcome of the budget negotiations from earlier this year, Brown is going to have to perform a miracle to “pull off” his plan! In the meantime, I expect that even more tax proposal may come forth! From what I’ve seen and heard, the governor will likely have until late January to somehow get all of the various proposals (and their respective interests) to unite under one proposal (and somehow neutralize the Howard Jarvis anti-tax folks) or likely face an insurmountable hurdle when Judgment Day arrives next November. Tax Proposals Are “In The Air”

Names are tricky things. Easily forgotten, difficult to pronounce; they roll off the tongue and often just fall to the floor. There are any number of ways to remember a name- repeat it twice so the hearer recalls it; write it on the back of your hand; associate it with some-thing in the area at the time. Usually not something to be concerned about though; unless, that is, you’re a contractor and the other side doesn’t want to pay you. Then you may be in for a bit of a problem, especially now that attorneys are looking very closely at licensing as a defense to payments that are due and owing.
Recall that if you are not properly licensed for the entire time you are performing work, you do not have the right to be paid. Worse still, if you are not licensed for the entire time you are performing the work, you not only don’t get paid, you will need to re-pay all of the money that was paid to you. The icing-on-the-cake though is that you get to pay the other side’s attorney fees, just for good measure.
Licensing has taken on new importance and not having a proper license is now attracting a lot of attention from at-torneys. Some of the more “creative” attorneys are look-ing very closely at everything related to your license as a way to defend against your claim for payment. Sometimes this is justified (i.e. - when you are not licensed) but in some instances, it is taken to an extreme. Well- inten-tioned judges sometimes get it wrong too and legitimate claims are thrown out of court. That is what happened in David E Ball v Steadfast BLK where the trial court ruled that because Ball did not conduct business as the correct dba, he could not bring his claims into court. The Court of Appeals reversed the decision, so there is a happy ending, but there is a lesson to be learned.
In the Ball case, plaintiff was a sole proprietor doing business as Clark Heating & Air Conditioning. Ball was
properly licensed as the sole proprietor for the business; he just conducted business under a dba name. He did some work for Steadfast and at the end of the project there was a dispute over payment. Ball recorded a Mechanics Lien, sued to foreclose on it, and included other claims against Steadfast. Steadfast challenged the Mechanic Lien claim by filing a demurrer (a pleading that basically says that ‘even if everything you say is true, you can’t state any cause of action against me’). The demurrer argued that Ball was not properly licensed.
Why? Because Ball apparently had his dba’s mixed up. Instead of doing business as Clark’s Heating & Air Condi-tioning, he signed the contract as Clark’s Air Conditioning & Heating. According to Steadfast, there was no such en-tity and therefore Ball was conducting business as an unli-censed contractor. The trial court agreed and sustained the demurrer and also found that because Ball was unlicensed, none of his claims survived and he was out of court.
The Court of Appeals reversed in a thoughtful and ap-propriate decision. First, they found that Ball was a sole proprietor and regardless of whether it was Clark Heating & Air Conditioning or Clark Air Conditioning & Heating, he was a sole proprietor. Therefore for any dba he oper-ated under, it was still Ball himself as the contractor, and he was properly licensed. It did not matter for purposes of the law regarding payments to unlicensed contractors that he had reversed the dba name. The court reasoned that the only way Ball could operate was as a sole proprietor, he was always properly licensed as a sole proprietor, and therefore his claims survived.
According to the court, this was at best a case for disci-plinary action by the CSLB. The name mix up was not the type of problem that the Legislature and courts are trying to discourage by passing laws and handing down decisions

that prevent unlicensed contractor from being paid and require disgorging of all payments received. The licensing law is intended to provide the public with minimal assur-ance that those offering construction services have the requisite skill and understand the law and the business of construction. Ball met those requirements by being prop-erly licensed as a sole proprietor.
The Ball court distinguished the situation where a cor-poration is the contracting party and the qualifier for the corporation leaves and is not replaced. Referring to the case of Opp v St Paul Fire & Marine, where the qualifier for the corporation left but the president of the company had his own license, the court pointed out that the corpora-tion is a separate entity from the president of the company. In order for the corporation to be licensed, it had to have a qualifier. It did not, and the fact that the president had a li-cense did not mean that the corporation was licensed. The corporation and president were separate entities and each needed to be properly licensed if they were to conduct any contracting business.
In Ball, there was no separate entity- Ball was a sole pro-prietor. Therefore he could do business as a fictitious busi-ness and still be properly licensed. Not so if the contractor is a corporation (or any other business form); in that case, a separate company license is required.Moral of the story- make sure you have a license and make sure you know the name of the dba you are doing business as- it may avoid lawsuits and it probably helps just as a practical matter.

Demolition Safety PlanningBefore the start of any demolition project, care-ful preparations must be made to ensure the safety of workers on the job and of other indi-viduals within the vicinity of the demolition site. Planning for a demolition project is as impor-tant as actually doing the work; and according to Cal-OSHA, a competent person experienced in all phases of the demolition should conduct the demolition planning. Planning should involve the entire demolition operation including meth-ods to be used to bring the structure down, nec-essary equipment to do the job, and measures to be taken to perform the job safely.
Prior to the start of demolition, an engineering survey must be completed to assess the condition of the framing, floors, and walls to prevent a possible premature collapse of the structure. The demolition contractor is responsible for plan-ning the wreckage of the structure, the equipment to do the work, informing worker of hazards and safety requirements, and public safety. Planning should include necessary safety equipment such as specific respirators, hearing protection, safety nets, lifelines, fall protection, warning signs, eye and face protection, and any other hazard protection device needed for the job.
The engineering survey should determine if there are any chemicals, gases, explosives or flammable materials previ-ously used or stored at the work site, which may still pres-ent a hazard. Examples include asbestos containing insu-lation or lead-based paint used in the initial construction. Service and utility companies should be notified in advance of the demolition. Then before demolition begins, electric, gas, sewer, water, steam, and overhead lines etc. must be located and shut off, capped or controlled. If it’s neces-sary to maintain some of the services, temporary relocation should be performed and all workers notified of the new
locations to avoid accidents.
If blasting is planned, a complete written blasting survey must be made by a qualified person. The survey should include the transportation, storage, and inventory of explo-sives as well as any fire precautions to be taken. A post-inspection of the area should be conducted after the blast to insure that no hazards remain. Enough time should be allowed for dust, smoke, and fumes to leave the blasted area before allowing re-entry into the site.
Emergency preparation is a crucial element of the de-molition planning process. Workers should know how to respond to possible emergency situations and evacua-tion routes should be devised, explained, and posted. Local medical or emergency responding facilities should be named and posted in a readily accessible location with phone numbers and addresses. First aid and CPR equip-ment with the names of on-site certified individuals should also be available on-site.
The demolition area should be clearly marked as such to ensure that only authorized personnel are allowed within restricted areas of the site. All site workers or authorized personnel should be dressed in appropriate personal pro-tective wear and be informed of safety practices and emer-gency procedures.

Si se planea el uso de explosivos, es obligatorio que una persona calificada haga un estudio completo por escrito de la demolición con explosivos. El estudio debe incluir el transporte, almacenaje e inventario de los explosivos, al
igual que cualquier precaución a tomar contra los incen-dios. Se deberá hacer una inspección final después de ter-minada la demolición para asegurar que no quede ningún peligro. On June 3, 2009, the Board of Education of the West Contra Costa Unified School District approved Reso-lution 90-0809. The resolution places the District under the Uniform Public Construction Cost Accounting Act. Under Section 22036/of the act, the District is inviting all licensed contractors to submit the name of their firm to the District for inclusion on its list of qualified bidders for the following calendar year (2012).
