    The proclamation announces that theextra session Is for the considerationof financial measures.

    The following statement was dictatedby the Governor, tor publication;

    "In a period of financial) depressionpartly caused by the low market priceof our principal commodity, It Is mostunfortunate that the Territory shouldbe forced to Increase the difficulty ofthe situation by registering all Its wa-rrantsby rjractlcally asking Its servants and creditors to carry It untilNovember next, thus overtaxing thetesources of our bankers and merchants.

    "Ulamo whom you may, the faultrests Anally with the people, and canbe cured only through them. We haveovcrrtached ourselves; the demandsmade on' our general funds from everysection and every class have placed theTerritory (in a plane of expenditurefar In excess of Its income. Our posttlon today Is Intolerable. To continuesimply means financial embarrassmentFor the Executlvo to retrench does notsolve the difficulty, for It simply continues the present wide range of publicservice and only cuts down the eff-iciency of each department, and doesaway with necessary repairs and Improvements.     "Our experiment under the presentform of will certainlyfall unless the people can bo made toiccognlzc the following propositions:That they must, through their Legis-lature, adjust their own affairs; thatwhenever the expenditure of a department is increased, provision must bemade for It; that If a new service Isdemanded of the Government, someether less Important function should bonbnndoned, and the difference In costmade good by a direct charge or byIncreased taxation. And the soonerthe people of this Territory and theirrepresentatives In the Legislaturerecognize this the better.

    "Much can be suld in explanation-ma- nyexcuses can be offered, but the

    real difficulty seems to be that thosewho havo made these demands on thoGovernment in tho. past aro unwillingto pay more taxes or to submit to special charges for special privileges rendered.

    Let us begin now to change thismethod. If a special service Is required, let those who enjoy it pay forit or go without. To my mind, theforegoing Illustrates one'of the fundamental causes of our difficulties, andevery opportunity should be acceptedto adjust such a matter, for delay Isoften procrastination. Temporary retrenchment Is not permanent cure.believe our people feel as I do, thatwhen there Is a difficult or arduous taskto be performed, the only couise Is toface it squarely and tackle It at once,

    Affirming Judgment of the First Cir-cuit Court, Supreme Court rendersunanimous decision In the case of S.Ahml vs. Annie Walter ct al, In part,as follows:

    "The action below was a statutoryaction to quiet the title to a piece ofland at Kaakopua, Honolulu, coveredby R. P. 217, L. C. A. 11070, Issued taKalaau. The plaintiff claimed by deedfrom a Mrs. Howland, who was Kala-au- 's

    devisee. The defendants claimedthrough deeds made by Kalaau to oneMakcma Naone, and by the latter toKaplka, who was Kalaau's wife andwho, after Kalaau's death, married saidNaone. These were tho deeds thaiwere the subjection of the decision InHowland vs. Naone, S Haw. 308.

    Two alleged errors are relied on,namely, that the trial Judge erred (1)In directing the Jury to return a ver-dict for the defendants, and (2) In al-lowing the defendants to ask the plaintiff's witness, Naone, certain questions,which were objected to as not proper

    "Tho question of the propriety of di-recting the verdict resolves Itself iutothe question of the construction of thedeed from Kalaau.

    "The other alleged error relied onis that after the plaintiff's witness, Na-one, bad testified on direct examination as to the relationship of variousparties and as to who were living outhe land, and, onwithout objection, that Kalaau had do.vised the property to Mrs. Howlandand that the witness had married Kalaau's widow and had lived on tholand, ho was allowed to be asked further, on against objec-tion, a number of questions.

    "Great care of course should be ex-ercised in seeing that the cross-exa-ination Is not extended unreasonablyfur and the rule that It should be confined to matters brought out on thedirect examination should be observed,but when, as here, no harm resulted,this Court should not set aside the ver-dict.
