AN ORDINANCE AMENDING SECTION 135 OF ORDINANCE NO. 2916, SERIES OF 2004,
OTHERWISE KNOWN AS "AN ORDINANCE ADOPTING A TRAFFIC MANAGEMENT CODE
OF PASAY CITY" SUBJECT TO ALL APPLICABLE LAWS, RULES AND REGULATIONS ON
THE MATTER

WHEREAS, In a letter dated July 5, 2018 addressed to Honorable Vice Mayor Noel L. Del Rosario, Mr. Arturo 0. Fortaleza, Officer-In-Charge of the Pasay Ci.� 1):affic & Parking Management Office, requested for the amendment of Section 135 of Pasay City Ordinance No. 2916, Series of 2004 on the prescribed towing fees enforced within the City considering that the said ordinance was passed back in 2004; hence, making Pasay City having the lowest price in terms of towing fees in Metro Manila. This is to augment the limited resources of the office in performing their functions in view of the fact that the office only has one (1) government-owned tow truck;
WHEREAS, this is why they have to tap the assistance and partner with private towing companies, particularly SMG with Four (4) additional tow trucks, so that they can cater the needs of the growing population of motorists in the City;
WHEREAS, with the increase of towing fee, the share of the City shall also be increased and the additional income can be used in other projects for the benefits of the people of Pasay City;
WHEREAS, A representative from the City Legal Office was also invited for their comments. Atty. Glen Villarin commented that since the ordinaru:.� i.s mainly for the purposes of regulation, the towing fees must be commensurate with the expenses of the City Government in rendering the service. He has the opinion that the increase is not commensurate to which some members of the Sanggunian agreed and rather proposed an increase of only 50% of the current towing fees rate;
NOW THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED, BY THE SANGGUNIANG PANLUNGSOD OF PASAY, IN SESSION ASSEMBLED, BY VIRTUE OF THE POWERS VESTED IN IT BYLAW, THAT:
Section 1. Section 135 of Ordinance No. 2916, Series of 2004 is hereby amended and to be read as follows:
"Section 135. Towing Fees.
