With reference to the above cited subject, by order dated; 16.01.2019, in OA.No.60612018, theHon'ble National Green Tribunal (Principal Bench, New Delhi), directed the State Government toconstitute a State Level Committee under the Chairmanship of Justice Sri. Subhash B Adi,(Former Judge, High Court of Karnataka and Upa Lokayukta, Government of Karnataka)to lookafter the implementation of SWM Rules-2O16 in the state of Karnataka.

Accordingly, the Govemment of Kamataka constituted a Committee vide GO. No. FEE 07 ENG2019, Bangalore, dated: | 3.02.2019.

Thereafter the Committee has convened several meetings & filed visits at several places across

Karnataka to review the implementation of SWM Rules-2O16.

It was noticed that the ULBs including BBMP in Kamataka have not enforced the provisions ofPlastic Ban notification published in Gazette as per ref(l) as well as the Plastic Waste

Management Rules-2016 notified by MoEF & CC, Gol.

The details oforders are as follows.

1. The Government of Kamataka has banned manufacturing & use of Plastic Canybags,

Baners & Buntings, Flex, Flags, plates, water pot,spoons, kling films,Dinning table sheets

& items made up of Thermacoal etc. as per Government Gazette Notification No, FEE

l7 EPC 2012, dated: 11.03.2016.

2. The Government of Karnataka has banned use of Plastic Carrybags, plates, water pot,

spoons, Dining table sheets etc, in Govemment meetings & functions as per Government

Order No. DPAR 83 RSV 2018, dated: 05.09.2018 Government Circular No. DPARl0 SRS 2019, dated: 02.07.2019.

3. The Govemment of Karnataka has banned use of Plastic Carrybags, Baners & Buntings,

Flex, Flags, plates, water pot, spoons, kling films, Dining table sheets & items made up ofThermacoal etc. in temples as well as other religious as per Government Order No. FEE

I 7 EPC 2012(vol-3), dated: 11.07.2017.

4. The PWM Rules-2O16 also emphasise on ban of single use plastic items.

Evenafter, Government orders, it was found that there is no substantial enforcement of provisions

of orders by the enforcing authorities all over the state.

In this connection, I am directed by Hon'bre chairperson of NGT-SLC, Kamataka to inform arlthe. concemed enforcing authorities to strictly i.plement the plastic ban notification in theirjurisdiction (Schools, cofleges, Universities, commercial Estabrishments, Health careEstablishments, Apartments/Houses, street Vending Zones, Shops, Industries, GovemmentQuarters & offices, court euarters & premises, Kalyan Mantaps/choultries, Airports, ULBs etc.)and publish immediately in local newspapers that 3l;tAugust-2019 would be deadline after whichthe manufacturers/distributors/retailers/users ofplastic be-strictly penalized as per the provisions.
