The purpose of this Act is to – 

1. Provide for and promote safe railway operations;2. Encourage the collaboration and participation of

interested and affected parties in improving railway safety; 3. Recognise the prime responsibility and accountability of operators

in ensuring the safety of railway operations; 4. Facilitate a modern, flexible and efficient regulatory regime that

ensures the continuing enhancement of safe railway operations; 5. Promote the harmonisation of the railway safety regime of the

Republic with the objectives and requirements of the Southern AfricanDevelopment Community for the operation of railways;  

6. Further the achievement of such purpose by establishing a suitable regulatory institution.

The objectives of the Regulator are to- 

1. Oversee safety in the railway transport industry; 2. Promote the use of railways as mode of transportation through

improved safety performance in the railway transport industry; 3. Develop any regulations that are required in terms of this Act; 4. Monitor and ensure compliance with this Act;  5. Give effect to the objects of this Act.

The Regulator may- 

1. Grant, amend, suspend or revoke safety permits2. Collect and disseminate information relating to

safe railway operations; 3. Conduct investigations into Railway occurrences; 4. Provide education and Public awareness;  5. Issue directives on ie modifications to rolling stock

Design, construction and commissioning life cycle requirements

The operator or prospective operator shall undertake the design, construction and commissioning

phases of the life cycle for engineering and operational systems

in accordance with SANS 3000-1:2005 and

SANS 3000-2-1. SANS 3000-2-2.

Prospective operator: Safety permit for commissioning and testingPrior to the commencement of testing under live

and/or simulated operating conditions, the prospective operator shall be in possession of a Commissioning and Testing Safety Permit.

The application for a Commissioning and Testing Safety Permit shall be made to the Regulator at least 60 days prior to the

first commissioning and testing being undertaken..

Existing Operator: Research and development: testing of technologies

under live operating conditionsPrior to the testing of new or modified technology,

the operator shall provide the RSR with a schedule of the tests, the scope of the tests,

a detailed risk analysis including mitigation of the risks.

Locomotive safety critical items

A comprehensive brake test is done during every shedding intervention

and the brake blocks are checked and replaced if worn .

Train brakes are checked as a system every time before a train departs from a yard where the train was made up.
