PROPOSALS FOR THE FUTURE ELECTORAL ARRANGEMENTS TOR THE COUNTY OF ESSEX

1. The last Order under Section 51 of the Local Government Act 1972 in

relation to electoral arrangements for districts in the county of Essex was made

on 2k January 1978. As required by Section 63 and Schedule 9 of the Act we have

now reviewed the electoral arrangements for that county, using the procedures

we had set out in our Report No. 6.

2. We informed the Essex Countv Council in a consultation letter dated

15 May 1979 that we proposed to conduct the review, and sent copies of the letter

to all local authorities and parish meetings in the county, to the MPs representing

the constituencies concerned, to the headquarters of the main political parties

and to the editors both of local newspapers circulating in the county and of the

local government press. Notices in the local precs announced the start of the

review and invited comments from members of the public and from interested bodies*

3« On 2^ January 19 0 the County Council submitted to us a draft scheme in

which they suggested 99 electoral divisions for the county, each returning

1 member in accordance with Section 6(2)(a) of the Act.

*f. We considered this scheme together with the views expressed by local

interests. On 10 June 19&> we issued draft proposals which we sent to all those

who had received our consultation letter, or commented on the County Council's

draft scheme. Notices were inserted in the local press announcing that the draft

proposals had been issued and could be inspected at the County Council's offices*

5. We incorporated the County Council's draft scheme in our draft proposals

subject to certain modifications which we adopted either to produce a more even

standard of representation or to take account of comments we had received on

the scheme. A reduction by one in the number of divisions in Chelmsford Boroughhnd the effect of reducing the total size of the Council from 99 to 98.

6. The modifications we made were as follows:

(a) Braintree., District

We replaced k of the 7 electoral divisions proposed by the County

Council with alternative divisions suggested by Braintree District Council*

(b) Chelmeford Borough

We reduced' by one the number of divisions in the Borough, by incorporating

part of the Danbury and Boreham division in the Springfield division and the

remainder in the Woodham Ferrers division (which we renamed 'Woodham Ferrers

and Danbury ' ) . We took the view that the Borough would be over-represented

with the allocation of 10 councillors resulting from the County Council's

draft scheme, though we were aware that the arrangement of 9 divisions that we

included in our draft proposals might not be the moat appropriate to achieve

our objective. We therefore said we would be prepared to consider alternative

schemes providing for 9 divisions in the Borough.

(c) Colchester Borough

We replaced 3 of the 9 electoral divisions proposed by the County Council

with 3 alternative divisions suggested by Essex County Labour Party; Of the

County Council's proposed divisions that we accepted we renamed the Clingoe

division 'Wivenhoe St Andrew', as suggested by Wivenhoe Town Council, and the

Old Heath division 'Colne1, as suggested by East Donyland Parish Council.

(d) Epping Forest District

We replaced *t of the 8 electoral divisions proposed by the County Council

with alternative divisions suggested by Epping Forest District Council and

Ongar Parish Council, and 2 with alternative divisions suggested. by Essex

County Labour Party and Epping Forest Constituency Labour Party.

(e) Maldon District

We replaced 2 of the 3 electoral divisions proposed by the County Council

with alternative divisions suggested by the Dengie Hundred Group of Parishes.

Uttlesford District

We replaced 3 of the 4 electoral divisions proposed by the County Council

with alternative divisions suggested by the Saffron Walden Constituency

Conservative Association.

7. We received comments in response to our draft proposals from the Essex County

Council, 7 district councils, 2k parish councils, 2 town councils, 2 county

councillors, 13 district councillors, 14 political associations and 25 individuals

or groups of individuals. A list of those who wrote to us is given at Appendix 1

to this report.

8. Essex County Council accepted our draft proposals for 9 of the 1** districts

(Basildon, Brentwood, Castle Point, Earlow, Rochford, Southend-on-Sea, Tendring,

Thurrock and Uttlesford). In the Braintree district they accepted our proposals

except that in relation to our Booking and Braintree West divisions they forwarded

alternative suggestions made by one of the local members for the area, County

Councillor 0 R M Sebag-Montefiore. They indicated that they wished to express

no preference as between these suggestions and our own draft proposals, which were

supported by County Councillor Gilthorpe, the other local member for the area*

In the other 4 districts (Chelmsford, Colchester, Epping Forest and Maldon) they

urged ua to retain their draft scheme. . :

other9« The/comments we received can be summarised district by district as follows:-

(a) Basildon District

Basildon, Billericay and Wickford Conservative Association and the Laindon

Branch of that Association put forward an alternative which they thought would

better reflect local ties and have better boundaries than our proposed Basildon

e?rouch, Basildon Fryerns, Basildon Gloucester Park, Basildon Laindon and

Basildon Westley Heights electoral divisions. Essex County Labour Party

supported our draft proposals.

(b) Braintree District

Braintree District Council, Essex County Labour Party and County Councillor

Gilthorpe wrote in support of our draft proposals. County Councillor

Sebag-Montefiore thought that rural and urban areas should not be linked as

in our Bocking division and put forward alternative suggestions for this and

the adjoining Braintree West division.

One private individual put forward an alternative arrangement for the

Braintree East, Witham Southern and Withara Northern electoral divisions

which he considered would provide better linkages between villages and towns.

(c) Brentwood District

Brentwood and Ongar Constituency Labour Party and Essex County Labour Party

objected to our draft proposals for the Brentwood South and Brentwood Central

electoral divisions and preferred to retain the existing divisions on the grounds

that they followed the natural boundary of a railway line. One district councillor

and 13 private individuals made similar objections.

(d) Castle Point District

Essex County Labour Party repeated their earlier arguments for alternative

divisions which would link rather than separate the Benfleet and Canvey Island areas.

(e) Chelmsford Borough

The Essex County Council objected to the reduction in the number of divisions for

the Borough and urged us to revert to their draft scheme for 10 divisions.

Chelmsford Borough Council also opposed our draft proposals and supported the County

Council's draft scheme subject to one minor amendment. Great Waltham Parish Council,

Danbury Parish Council and Boreham Parish Council all preferred the County Council's

draft scheme to our draft proposals. Broomfield Parish Council repeated their

arguments for the retention of the existing division in which they were located*

Woortham Ferrers Parish Council asked that East Hanningfeld Parish be transferred

from the Stock to the Woodhara Ferrers and Danbury electoral division. The Chelmsford

Liberal Association considered that the view that the Borough would be over-

represented with 10 councillors was fully justified and responded to the invitation

we attached to our draft proposals by putting forward an alternative scheme of

9 divisions for the Borough. The Essex County Labour Party also agreed that the

Borough would be properly represented with nine members,

(f) Colchester Borough

The Essex County Council asked us to look again at the Constable, Drury and

Park divisions in their draft scheme which we had modified and to revert to

their original name, Old Heath, for our Colne division, on the grounds that it

was more appropriate for reasons of geography. Colchester Borough Council

agreed with our draft proposals except that they too preferred the name Old

Heath for our Colne division. The New Town Ward of the Colchester Constituency

Labour Party, six borough councillors and one county councillor likewise

opposed our renaming of Old Heath division. Essex County Labour Party agreed

our draft proposals but preferred the names of Old Heath to Colne, and St

Andrews and Wivenhoe to Wivenhoe St Andrew* East Donyland Parish Council and

Wivenhoe Town Council supported the proposed renaming of the Old Heath and

Clingoe electoral divisions. One private individual suggested that the Drury

and Maypole electoral divisions be renamed. The Colchester Division Conservative

Association supported our draft proposals because they avoided the three-way

splitting of the Lexden ward which was a feature of the County Council's draft

scheme. • .

(g) Epping Forest District

The Essex County Council preferred their own draft scheme for- the two

Loughton divisions, and for the Cbigwell and Ongar divisions. They s&w no

good reasons for the changes we had made, and in the latter case drew attention

to the imblance in the electorates that would result;.from our"draft"propoaale»

Epping Forest District Council also objected to ourdraftproposals for the two Lough ton

electoral divisions but supported the inclusion of the Parish of Lambourne

in the Ongar division. One district councillor and 2 private individuals

supported our draft proposals as they affected the Loughton divisions. Epping

Forest Conservative Association supported our draft proposals except in the

case of the Loughton divisions where they preferred the County Council's draft

scheme. Essex County Labour Party and Epping Forest Constituency Labour Party

welcomed our draft proposals for the Loughton divisions but were concerned

about the siae of the Waltham Abbey division. They suggested an alternative

involving the transfer of the High Beach ward to the North Weald and Nazeing

division. Two private individuals also made the same objection about the

Waltham Abbey division. Ongar Parish Council put forward again their earlier

suggestion for the transfer of the Sheering ward to the North Weald and Nazeing

division to reduce the area of the Ongar division.

(h) Harlow District

Essex County Labour Party and Harlow District Labour Party accepted our

draft proposals.

(i) Haldon District

The Essex County Council objected to our draft proposals on the grounds

that they divided the town of Haldon, and sought a return to their draft scheme.

Essex County Labour Party, Longford and Ulting Pariah Council, the Charter

Trustees of the Town of Maldon, Maldon Branch Labour Party, Heybridge Liberal

Association, 3 private individuals and one district councillor also opposed our

draft proposals. On the other hand Maldon District Council, 12 Parish Councils

and Maldon and Rochford Conservative Association supported our draft proposals.

One district councillor also supported our draft proposals but suggested that our

proposed Tollesbury division be named 'Thurstable1.

(j) Rochford District

Essex County Labour Party and Ashingdon Parish Council accepted our draft

proposals,

(k) Southend-on-£ea Borough

Essex County Labour Party accepted our draft proposals. Three district

councillors, on behalf of 216 residents, Leigh Ratepayers' Association, Southend

West Liberal and Radical Association and 3 private individuals objected to our

draft proposals because part of the Leigh ward would be included in the Chalkwell

division. We also received a late request from County Councillor David Cotgrove.,

on behalf of a number of borough councillors and other individuals.that the name

of the Shoebury division be changed to Shoeburyness; this requsst was subsequently

supported by Mr Teddy Taylor MP.

(l) Tendrinft District

Essex County Labour Party accepted our draft proposals. One private

individual suggested that in the case of the Tendring Rural East and Tendring

Rural West electoral divisions the description 'Rural' was superfluous.

(m) Thurrock District

Essex County Labour Party and Thurrock Constituency Labour Party urged an

amendment to our draft proposals as they affected the Grays Thurrock and Tilbury

electoral divisions, which they thought would produce better boundaries. The

Thurrock District Council also wrote to us in support of this amendment. A private

individual suggested an amendment to the boundary between the Grays Thurrock division

and the Orsett and Stifford division.

(n) Uttlesford District

Uttlesford District Council and Wimbuah Pariah Council accepted our draft

proposals.

10. When we camo to reassess our draft proposals we took account of all the comments

we had received and came to the following conclusions: -

(a) Basildon District .

We could see no justification for adopting the alteration suggested by the

Conservative Association to our draft proposals which were otherwise acceptable

locally.

(b) Braintree District

There was no support for the arguments put forward by Councillor Sebag-

Montefiore in favour of changing our draft proposals for the Booking division, and

his alternative did not offer any numerical advantage. We therefore preferred our

draft proposals.

(c) Brentwood District

The arguments in favour of retaining the existing Brentwood South and Brentwood

Central di visions had been brought out in comments on the County Council's draft

scheme. The comments on our draft proposals had not produced any significant new

evidence and we saw no reason to modify our draft proposals.

Castle Point District

The arguments for linking Benfleet and Canvey Island areas had similarly been

deployed earlier and no fresh evidence had emerged to cause us to change our view

that the draft proposals were preferable for geographical reasons and in order to

retain compatibility with District wards.

(e) Chelmsford Borough

We were not convinced by the reasons put forward by the Essex County Council

for reverting to 10 divisions rather than 9 for the Borough. On the Council's own

forecasts of electorates for 198 the precise entitlement for the Borough on the

basis of a 98 member Council was 9-31 .(or 9-^1 on the basis of a 99 member Council),

and in accordance with the practice normally followed by the Commission the

appropriate allocation was the nearest whole number, ie 9«

The alternative scheme for 9 divisions submitted, in response to our invitation,

by the Chelmsford Liberal Association was numerically superior to our draft

proposals but it had not been publicly advertised. We therefore thought it

appropriate to ask the Essex County Council and the Chelrasford Borough Councils for

their comments on it before reaching conclusions: copies of our letter were sent to

the political parties. In response both Councils expressed reservations about the

Liberal scheme and reiterated their strong preference for a 10 member scheme.

Having considered the matter further in the lir;ht of these comments we decided to

adhere to our draft proposals.

(f) Colchester Borough .

As requested by the County Council we carefully reconsidered our proposals for the

Borough but concluded that the balance of local opinion appeared to be in favour of

the" substance of our draft proposals and therefore decided against reverting to the

County Council's draft scheme. However we saw the force of the arguments in favour

of changing the name of our Colne division back to Old Heath, and accepted this

suggested alteration.

(g) Spping Forest District

We found there were sound arguments either way in relation to the two Loughton

divisions and the Chigwell and Ongar divisions. In both cases it was a question of theprecise weight to be given to numerical considerations and to local feeling about

community of interest. On balance we thought it appropriate to revert to the

County Council's draft scheme in both instances. We were faced with a similar

situation in relation to the Labour Party's suggestion for the transfer of High

Beach ward from the Waltham Abbey division to the North Weald and Nazeing division.

In this instance we thought it appropriate to give greater weight to the numerical

considerations and to accept the suggested .transfer which gave a distinctly more

even standard of representation.

(h) Maldon District

In weighing up the arguments for and against our draft proposals for two

divisions in the Maldon District on vhich thars "was disagreement Me had in mind that

we had made the modification to the County Council's draft scheme in the light of a

considerable volume of objection to that scheme and of support for the alternative

we had adopted, in which we also saw advantages in terms of geography. After careful

consideration we came to the conclusion that although there was a clear difference

of opinion locally and there were strong arguments for both points of view, on balance

it would be in the interests of effective and convenient local government to adhere

to our draft proposals*

(i) Southend-on-Sea Borough

Our draft proposals for the Chalkwell and Leigh divisions were identical to

the County Council's scheme* The objections to them therefore came at a very

late stage in the review* The effect of making the suggested transfer of an

area to Leigh division would be to produce a numerically inferior result. We did

not think this was something that we could accept. In relation to the late

suggestion for a change of name in the Shoebury division, we noted that the County

and Borough Councils had already indicated opposition to this, in the interests of

maintaining consistency between ward and divisional names* We did not therefore

think we should accept the suggestion*

(j) Tendring District

We decided against the suggestion for a change in the names of the Tendring

Rural East and fiural West divisions which had otherwise proved acceptable locally,

(k) Thurrock District

The suggestions for minor changes in the boundaries of two pairs of divisions

in the Thurrock District were again ones that related to part of the draft scheme

which we had adopted in our draft proposals, and that had not been brought out at

the earlier stage. Though the Thurrook District Council supported the amendments

suggested by the Labour Parties the County Council did not; we were not convinced

by the case for adopting them*

11. Subject to the change in name of one division in Colchester Borough (para 10(f))

and the changes to several divisions in Epping Forest District described in

para 10(g) we decided to confirm our draft proposals as our final proposals for

the County.

12. .Details of these final proposals are set out in Schedules 1 and 2 to this

report and on the attached map. Schedule 1 gives the names of the electoral

divisions. A detailed description of the boundaries of the proposed electoral

divisions, as defined on the map, is set out in Schedule 2.

PUBLICATION

13- In accordance with Section 60(5)(b) of the Local Government Act 1972, a copy

of this report and a copy of the map are being sent to Essex County Council and

will be available for inspection at the Council's main offices. Copies of

this report (without map) are being sent to those who received the consultation

letter and to those who made comment.

Those parts of the Basildon District Wards of Burstead, Laindon, Wickford

North and Wickford South commencing at a point where the western boundary

of Wickford South Ward joins the northern boundary of the district, thence
