1.0 Introduction

1.1 This LDS has been prepared in accordance with the requirements of the Planning andCompulsory Purchase Act 2004. The LDS has two main functions:

1. To identify the current planning policy documents that are being applied inNuneaton and Bedworth.2. To provide a three year project plan that outlines how and when the existing

planning policy documents will be reviewed and replaced.

1.2 Reflecting these functions the document is divided into the following sections:

• Existing Planning PolicySection 2 of the document provides an overview of the existing planning policydocuments and guidance that cover the Borough. This section also includesinformation on the status of the documents during the transition to the LDF

system.

• Documents to be Prepared Under the LDF SystemSection 3 outlines the type and function of the documents that the Council willproduce within the LDF System.

• Supporting StatementSection 4 explains how documents within the LDF interrelate and in turn how theLDF itself integrates with other strategies and plans. The evidence base for thedocuments in the LDF is discussed along with the Sustainability Appraisal workthat will be required. A programme for monitoring and reviewing documents, the

political framework for the approval of documents, the resources available and anassessment of the risks associated with the delivery of the LDS are also identified.

1.3 As is required by the 2004 Act, this LDS will be reviewed on an annual basis. Anyrevisions to the Scheme as a result of the review will be submitted to the Secretary ofState. Copies of the LDS along with any revisions will also be available on theCouncil’s website.

2.0 Existing Planning Policy Documents

2.1 The following gives an overview of the key planning documents that cover Nuneatonand Bedworth to create the current Development Plan for the Borough. The listincludes those documents prepared by other authorities.

• Regional Spatial Strategy (RSS)The West Midlands RSS (previously Regional Planning Guidance) provides aregional context for planning in Nuneaton and Bedworth. Prepared by the WestMidlands Regional Assembly, a three staged review of the document commencedin Autumn 2005. Details of that review are outlined in table 1 below.

cannot be saved or converted into Supplementary Planning Documents (SPDs).However, where the SPG can be linked to a saved policy within the adopted LocalPlan, and has undergone the same adoption process required for a SPD, the SPGcan have status as a material consideration. Appendix A lists the Council’sexisting SPG which have status as a material consideration.

3.0 Local Development Framework

3.1 Listed below are the types of documents the Council will produce under the LDFsystem. Further details about the status, purpose and timetable for the preparation ofthe documents is summarised in appendix B and C and considered in detail inappendix D.

• Statement of Community Involvement (SCI)The SCI (adopted December 2006) sets out how and when the local community,

stakeholders and other interested parties will have the opportunity to becomeinvolved in the preparation of LDDs and in the determination of planningapplications. The statement also sets out how the Council intends to facilitate thisinvolvement above the minimum standards set by the Government in order tomeet the particular needs of the Borough.

• Local Development Documents (LDDs)The LDDs the Council will produce can be divided into two categories;Development Plan Documents (DPDs) and Supplementary Planning Documents(SPDs).

Development Plan Documents (DPDs)DPDs will have the same weight and status as the current adopted Local Plan.Production will involve formal consultation with the community, stakeholders andother interested parties in accordance with the SCI. The documents will also bethe subject of an independent public examination by the Planning Inspectorate.The Council will be required to accept the recommendations made in theInspector’s final report.

Supplementary Planning Documents (SPDs)SPDs provide more detail on particular policies within DPDs. SPDs are notsubject to independent examination and do not form part of the development plan.They are however a material consideration in the determination of planningapplications.

3.2 The Council will produce the following types of DPDs:

• Core StrategyThe Core Strategy will set out the vision, spatial strategy and core policies for theBorough. The Core Strategy is required to have a lifespan of at least 10 years.The Nuneaton and Bedworth Core Strategy will have a lifespan of 14 years,

covering the period from adoption to 2026 to coincide with the revised RSS.

• Site Allocations DPDThe Site Allocations DPD will identify non-strategic development sites inaccordance with the principles, vision and objectives outlined in the Core Strategy.The requirement to prepare the Allocations DPD will be dependent on what optionis taken forward in the Core Strategy i.e. whether or not development is scatteredacross the Borough.

• Gypsy and Traveller Site Allocations DPDThe Gypsy and Traveller Site Allocations DPD will identify a sufficient number ofadditional pitches on sites within the borough to meet the needs of Gypsies andTravellers. Sites identified will need to adhere to criteria outlined in the CoreStrategy.

• Proposals MapThe Proposals Map will illustrate the main proposals, designations and area basedpolicies of the Core Strategy. Inset maps may be used where further detail is

required.

3.3 The Council will also produce:

• Supplementary Planning Documents (SPD)SPDs will be produced to support policies and/ or proposals in DPDs and will havestatus as a material consideration in the decision making process. Preparation willinvolve consultation with the community, stakeholders and other interested partiesin accordance with the SCI, although the document will not be subject to anindependent public examination.

In 2007 the Council adopted a Supplementary Planning Document on AffordableHousing to support policy H3 of the adopted Local Plan. Details of this documentare summarised at Appendix B.

• Annual Monitoring Report (AMR)Under the requirements of the Planning & Compulsory Purchase Act 2004 theCouncil must prepare an AMR which reviews progress in delivering the LDS andprovides an assessment of the extent to which policies in the Local Plan and thepolicies that replace it are being achieved. The AMR will be published by theCouncil and submitted to the Secretary of State on or before 31st December eachyear.

4.0 Supporting Statement

4.1 Integration Between Documents in the LDF 

4.1.1 The relationship between the documents that make up the Development Plan forNuneaton and Bedworth is outlined in Appendix E. As is illustrated in the diagramthere is a clear chain of conformity. DPDs should be in general conformity with the

RSS and national guidance and in turn any SPDs should be in conformity with DPDs.All documents within the LDF will need to be produced in accordance with the SCI.The production and content of the LDDs will be monitored through the AMR.

4.2 Integration with other strategies/ Plans

4.2.1 The 2004 Act introduced the concept of Spatial Planning. Central to this concept isthe integration of policies for the development and use of land with other policies andprogrammes that influence places and the way they function. The LDF will thereforeplay a key role in delivering the spatial elements of other strategies and plansproduced by the Council and partner organisations. Examples of these strategiesinclude those identified in fig. 1.

4.2.2 The link between the LDF and the Sustainable Community Strategy is particularlyimportant. The policies in the LDF will function as a key delivery mechanism in takingforward the vision and key spatial objectives of the Sustainable Community Strategy.This will help to ensure that the challenges facing the Borough are addressed in a co-ordinated way.

4.3 Evidence Base

4.3.1 Documents that make up the LDF must be based on up to date robust evidence forthem to be considered sound1. In preparing LDDs there is therefore a need to

undertake technical research studies and other background work. This work will beundertaken by the Council as well as external consultants on behalf of the Councilwhere information of a specialist nature is required or where the time needed toundertake the work is not available in house. All background/ technical documentswill be made available alongside the LDDs to which they relate. Currently identifiedtechnical studies that are required include:

4.4 Sustainability Appraisal / Strategic Environmental Assessment (SA / SEA)

4.4.1 All DPDs will be subject to a SA/ SEA, produced in accordance with nationalguidance. The purpose of the appraisals is to assess the likely environmental,economic and social implications of the policies/ proposals proposed in thedocuments. Work on preparing the appraisals will involve external groups andorganisations as well as the Council. The work will be undertaken in four main stagesand in the case of DPDs will lead to the outputs identified in table 2.

Scoping ReportSets out the scope and level of detail of the SA and willbe prepared at the evidence gathering stage.

Initial SAPublished at Issues and Options stage, the purpose ofthe document will be to aid the development of the

Preferred Options.First Draft of Final SA Published at Preferred Options stage

Published at Submission Stage and submitted to theSecretary of State, the report will help demonstratesoundness of the document and provide justification forthe policies/ proposals in the DPD.

and final SA (not submitted to the Secretary of State) published alongside the adoptedversion of the SPD.

4.5 Monitoring and Review

4.5.1 The process of monitoring and review is an important part of the post 2004 planningsystem. Central to this is an AMR which will be published in December each year, asidentified in paragraph 3.3. The AMR will;

• Identify how well the Council is performing against the targets/ milestones it setitself for document production in the LDS.

• Examine whether policies in its DPDs are being delivered through the use of Core,Local and Contextual indicators.

• Advise on the need to review the LDS and amend/ revise policies contained inLDDs thus informing the future work programme of the Planning Policy Team.

4.5.2 The AMR will form the basis of an annual revision of the LDS, although more frequentrevisions may be carried out as necessary.

4.6 Political Framework

4.6.1 Before submission to the Secretary of State and Regional Planning Body forconsideration, or formal adoption by the Council (in the case of SPDs), eachdocument in the LDF will require political approval. The level of approval will bedetermined by the status of the document and the stage it has reached in the

preparation process. Listed below in table 3 are the levels of approval different typesof document will require at different stages of their preparation.

4.7 Resources

4.7.1 The work associated with the production of the LDF, its monitoring and review willprimarily be undertaken by the Planning Policy team with contributions from otherservices within the Council as and when required. Input from the Council’s otherservices will be particularly valuable at the evidence gathering stage of policydevelopment to help ensure that the Council’s other Plans/ Strategies are integrated

into the LDF. In preparing documents specialist services provided by consultants willalso be utilised as identified in paragraph 4.3.1.

4.7.2 The cost of producing the LDF is currently being met through the existing Servicebudget, supplemented with money from the Housing & Planning Delivery Grant(HPDG).

4.7.3 Both staffing and budgetary resources will need to be monitored to ensure that thereis adequate provision to enable the delivery of the LDS.

4.8 Risk Assessment

4.8.1 This LDS has been drafted on the basis of what is considered deliverable.Nevertheless there are a number of risks which could jeopardise the Council’s abilityto deliver the documents that make up the LDF within the timeframe identified. The

Council has however attempted to minimise the risks by putting in place mitigationmeasures. The risks, their rating (in terms of likelihood and impact) and the mitigationmeasures that have been put in place to moderate and manage the risks aresummarised in table 4.

AAP  Area Action Plan Planning framework for development in a particulararea within the Borough.

AMR  Annual Monitoring Report Annual report that assesses the implementation of

the LDS and the effectiveness of the LDF policies.

CS  Core Strategy Document containing the long-term vision, spatialstrategy and core policies for the Borough.

DPD  Development PlanDocument

Spatial planning documents that have developmentplan status and have been subject to formalconsultation and independent examination.

LDD  Local DevelopmentDocument

Name given to the SCI and the DPDs and SPDsthat set out planning policy guidance for theBorough and make up the LDF.

LDF  Local DevelopmentFramework

A folder containing LDDs, the LDS and AMR for theBorough that will replace the adopted Local Plan.

LDS  Local DevelopmentScheme

The work programme for the preparation of the LDF.

LP  Local Plan The adopted development plan for Nuneaton andBedworth Borough that will be replaced by the LDF.

RPG  Regional PlanningGuidance

The strategic plan for the West Midlands region thathas been replaced by the RSS.

RSS  Regional Spatial Strategy Sets out the region’s policies in relation to thedevelopment and use of land for a 15-20 year timeperiod. SCI  Statement of CommunityInvolvement

Sets out how the local community, stakeholders andother interested parties will be involved in thepreparation of LDDs.

SPD  Supplementary PlanningDocument

Documents produced by the Council to providepolicy guidance that supplements policies andproposals in DPDs. SPDs are not subject toindependent examination and do not haveDevelopment Plan status. Public consultation onSPDs will be carried out as specified in the SCI.
