Marshals needed - Sunday 14th

September 2014.

The Llanferres Playing Field Association hasagain agreed to marshal the event, with the help

of our local community.

In 2013 we raised £2000 for the playing field.

As in previous years, there will be a marshals meeting onFriday 12th, at 7.30pm,

& post event BBQ / free drink at The Druid.

Now firmly established as one of theUnited Kingdom’s top historic events,Saturday the 6th of September sees thefourth running of Clwyd Vale MotorClub’s ‘Vale of Clwyd Classic’. Theevent is based at The Druid Inn atLlanferres, with technical and safetyinspections taking place on Friday the5th of September at LoggerheadsGarage between 17:45 and 20:45. Theevent is part of a nationwidechampionship aimed solely at vehiclesregistered prior to 1983, with many ofthe vehicles competing from the1950’s or even earlier!

The event brings in many competitorsfrom all over the UK and Eire, with themajority of crews staying in the localityduring the event, thus it provides agreat boost to the local economy. Thefirst car starts from The Druid Inn atLlanferres at 08:26 on Saturday and

the competitors will then head into thefirst driving test at LoggerheadsCountry Park, where Denbighshire

County Council have madespectators more than welcome. Theevent will then wind its way around thelanes of Flintshire and Denbighshire,taking in many more driving andmanoeuvrability tests along the way.The route is a closely guarded secret,as some parts take place on privateland through the kind permission oflandowners. It is also guarded as thestandard of the crews over the last fewyears has risen, many competitors areso skilful they only drop a few secondspenalties over the whole event, soeverything is done to provide themwith a challenge.

The course designer, or ‘Clerk of TheCourse’ is local man Guy Woodcock,Guy is well known for putting on wellreceived and tricky events, not justhere in Wales, but all over the UK andEurope too. Guy said, “It’s great tobring so many well-known andrespected competitors on the HRCRChampionship here to Llanferres, theresponse we have had since this eventstarted has been nothing short ofamazing. We plan to use sections atthe beginning and the end of theevent close to Llanferres. The first partwill head out around Eryrys andGraigfechan and will end up near toGwernaffield. The final section comesover Bwlch Penbarras and finishesclose to the village, but it may surprisea lot of the competitors so I amkeeping quiet about that one!”

Seventy or so cars are scheduled tomake the start from The Druid onSaturday the 6th September, the routewill take some eight and a bit hours tocomplete with the first finishing car and

crew scheduled to be back around16:45 at The Druid.

Leading the cars away will be lastyear’s winners Ireland’s Ronnie Griffinand England’s Anthony Preston in anMGB GT from 1966. They will befollowed by Championship LeaderSteve Entwistle partnered by secondplaced navigator Bob Hargreaves intheir distinctive ‘Orange Box’ Mini.Chasing them hard will be JohnRuddock who lies as second placeddriver in the Championship. John hasIlkley’s Andy Pullan, who at 19 is settingthe rallying world alight with hismaturity and skills to currently lead thenavigators Championship.

Local crews that could spoil the partyare Howard Warren/Iain Tullie in a 1965Porsche 911, Peter Welch/RichBestwick in a Triumph Dolomite Sprint,Ken Jones/Charles Hughes in a MGBand Keith Davis/John Youd in anotherMGB. With some of the elitecontenders taking part, it will be afantastic battle from the start.

Cyngor y Cymuned - Llanferres July From the minutes of the meeting

held on 10th July 2014:- Present:Cllr. David Jones (Chair), Cllr. JohnAlmond, Cllr Yvonne Foden McCorry,Cllr Rob Jones, Cllr. Margaret Davies,Cllrr David Twomey, the Clerk MrsGwyneth Dillon and County CouncillorMartyn Holland.

1. Apologies: Cllr. Jac Armstrong.2. Declarations of Interest: Cllr Margaret

Davies declared an interest in PlanningApplication No 21/2014/0361 andsigned the register. Because therewere members of the public presentwho had an interest in matters to bediscussed later, the Chairman asked ifCouncillors would agree to the order ofthe Agenda being altered so that Itemswere taken in the order of 1, 2, 4, 5,3, 16, then 6 onwards. This was agreedby all Councillors present.

3. Now item 4: Meeting open to thepublic for ten minutes: Mr GrahamHarvey asked i) Whether the Councilconsidered that the coming by-election to elect one Councillor (at acost of approximately £2,000)represented good value for money.The general opinion of Councillors wasthat it did not, as the position couldhave been filled by co-option at nocost to the community. ii) Whetherthere was disquiet in the community atthis expenditure. It was explainedthat some members of the public hadexpressed such concerns. iii) Werethere plans in place to avoid this wastein the future? The Chairman explainedthat should another vacancy occur theCouncil had a legal obligation toadvertise it and, therefore, werepowerless to stop the same situationarising again. iv) Could not theCouncil function with the remainingeight members? The Chairmanexplained that there was a legalobligation to fill the position. v) Will

Councillors give an undertaking toremain in office for the remainder ofthe term to avoid a repetition of thesituation? The Chairman responded bysaying that he understood that all thepresent Councillors intended to remainin office, but circumstances mightarise to make that impossible.

Mr Barton said that he considered thatthe expense of Community Councilelections should be paid by theNational Government. To the replythat it would still be public money thatwas spent he replied that"Governments have a bottomlesspurse" (much to the consternation ofour County Councillor who refutedsuch an assertion).

4. Now item 5: County Councillorsreport: County Councillor MartynHolland reported that he had attendeda Finance Meeting and that theexpected cut in the County Council'sbudget of £6 million for the nextfinancial year had been increased (bythe National Assembly) to £9 millionwith another £6 million for thefollowing year. He thought this unfairas the Welsh Government had not hadits allocation cut by Centralgovernment, although it had notreceived any increase to keep up withinflation. The Budget had to be set byChristmas so the cuts have to bedecided by then. It was difficult to seehow present services could all beretained. He was still hoping that Peny Waen would be re-surfaced this yearbut there was a question whetherfinance was available but other roadsalready declared for re-surfacing willbe done. The County Council wastrialling 20mph speed limits nearschools to see if they were beneficial.The new bus timetable is nowavailable. He would enquire whether

5. Now item 3: Casual Vacancy on theCommunity Council: Two persons hadsubmitted their names as Candidatesto fill this vacancy :- Mr Robert Bartonand Mr Adrian Walls. The election willtake place on 31st July 2014.

6. Now item 16: Planning matters:21/2014/0360 Cllr. Margaret Daviesleft the room. Proposal: Change of useof part of existing agricultural buildingand rear yard area to sawmill businessuse, erection of a dry wood storagebuilding and retention of staff carparking (partly retrospective)AMENDED. Location: Bryn FfynnonSawmills, Llanferres. The CommunityCouncil resolved to reiterate itsremarks of the June meeting - 'Due toconsiderable amount of technicaldetail and the concerns expressedfrom neighbours with regard toemissions and the noise element, amore technical assessment would needto be carried out. It was proposed notto object to the siting of the plant, butto express serious concerns regardingthe biomass and operationaleffectiveness of the boilers and tocarry out a detailed assessment of theimpact on the local environment onthe operational use' and to take theexisting car park into consideration.21/2014/0591 Proposal: Installationof a single BT telecommunicationcabinet painted green. Location:Pavement north of Star Croft, RuthinRoad, Llanferres. Resolved to raise noobjection.CERTIFICATES OF DECISION21/2014/0433 Proposal: amendmentsto Plot 2 of previously approvedapplication 21/2007/0344 for erectionof dwelling Location: Plot 2 GlebeLand, Llanferres. 7. Minutes of the Meeting held on 12thJune 2014: The minutes of theMeeting held on Thursday 12th Junewere signed as a true record.

8. Matters Arising: No matters raised.9. Reports from other meetings:

Several Councillors had attended a'Member Code Training' meeting, forthe three Community Councils in theward, held in Llanarmon. TheChairman, in his role as a member ofthe Standards Committee, hadattended a training session for presentor prospective Chairs and Vice Chairs.

10. Maintenance in the Community: Thedownspout on the bus shelter on thewest side of the A494 in Llanferresneeds replacing. A firm standing areais required for the notice board inTafarn-y-Gelyn.

11. Red Telephone Kiosk: Nothing toreport.

12. Risk Assessment: Nothing to report atthe moment.

13. Landscape project - Memorial Stone:A quote had been received for thesupply and erection of a polished slateplaque, engraved with the names ofservicemen who died in the two worldwars. It was agreed that this would bejointly financed by the Village Hall andthe Community Council but thepossibility of grants would beinvestigated. It is intended that arededication of the memorial stonewill take place after the normal churchservice on August 3rd to commemoratethe 100 anniversary of the start ofWorld War One. Volunteers areinvited for a working party to tidyround the Memorial stone on Saturday2nd August at 10am.

14. Field Adjacent to the School: Seatsand Benches have been ordered to besited on the field. An InformationBoard will have to be installed. Thismust be A1 size with art work and mustcontain the names or Logos of all thecontributors to an approved size. Thiswill be arranged by Cadwyn Clwyd.These two items will use up the last ofthe grant money obtained and formscovering 'match funding' have beensubmitted. The Chairman and theClerk will investigate costs for grasscutting as strimming is requiredbetween the trees.

15. Training and Finance: Cllr YvonneFoden-McCorry will attend a trainingsession in Mold on 18th July on'Successful Grant Application'. Therewill be Planning Workshop forCouncillors on 17th July at Caledfryn,Denbigh. It is likely that next year'sPrecept will need to be increasedbecause of the unexpected expense ofthe coming By-election.

17. Maeshafn Playing Field: TheCommunity council were still waitingfor a response from the solicitorsacting for Aberduna Quarry.

19. Other Matters that have beenbrought to Councillors' Attention:The clerk had received complementaryremarks regarding the appearance ofthe two Telephone Kiosks.A large lorry unable to negotiate thebends had blocked Forestry Road forseveral hours. It is believed the driverhad been relying on his 'Sat Nav'. Anotice to warn drivers that the road isnot suitable for heavy vehicles is needed.A complaint was made regarding a car,parked in the road passing the church,which did not have a valid Road FundLicence displayed.The hedge on the wide path fromRectory Lane to the Church BurialGround needs attention - the Churchauthorities will be contacted.

JULY

On July 14th, 17 members and friends enjoyed their visit to Tan-y-Parc atLlanrhaedr the home of Sandra Edwards. Overcast skies did not dampen ourenjoyment of this visit. In her cottage garden many specimen plants werewell in flower, particularly her buddleia bushes in purples and white. Neatborders of shrubs and herbaceous plants denote a well-cared for garden bythis dedicated owner. We also enjoyed our tea, strawberry and cream sconesand cake to round off our visit in such a pleasant area.

AUGUSTOur meeting in August was, as usual, to make the final arrangements for ourAnnual Show, which this year will be our 40th, to be held on Saturday,September 6th in the Village Hall, opening at 2pm.Our work begins on Friday 5th evening when we set up tables and makeeverything ready for the Show. Various tasks were allocated to members forthe day.Entries to be received by 6pm on Wednesday 3rd September.Exhibits must be in place between 8am and 10.30am at which time the judgeswill begin judging. Trophies will be presented at 2.30pm by our CountyCouncillor, Martyn Holland. See centre pages for more details.Also there will be the auction of produce at 4pm with the proceeds to be givento the OAP Welfare fund.

IMPORTANT NOTICE

Due to an oversight, the Village Hall has been double booked for 15th

September for both the Garden Club and the Whist Drive. We at the GardenClub cannot move our meeting as a speaker had been booked for that eveningso we have been forced to cancel the meeting.

We had hoped that the Whist meeting could have been moved to the 8th

September but due to the intransigence of Mr Armstrong this has provedimpossible.

We apologise for the inconvenience caused to the Garden Club members butwe have no other option than to cancel the meeting.

Soon to be new Rectory Lane residents

Charlotte, Scott, 2yr old Luca and recently born (June) Lois will be moving onto Plot 1(Adjacent to the cemetery). Charlotte, originally from Pantymwyn and Scott, originallyfrom Connah's Quay, have been away from the area for over 20 years and are lookingforward to moving back nearer their friends and family, setting up their new family homeand integrating into the village, being able to ride their mtb bikes out of the front door!!and in Scott's case, only having to walk about 50 steps to the pub!

Dave and Jayne, along with a small dog called Pearl, who will be moving onto plot 2 (theNorthern plot) have two children at university. Dave has been based in Wrexham for thepast few years and Jayne works at Kimberley Clark in Flint. Jayne’s family (the Robert’s)were originally from Gresford and both are looking forward to moving to the village,joining in with local life and being part of the community.

Although having never met prior, Dave & Scott were introduced during the land purchaseprocess and have since been working together on their build and timing plans.

The builds are due to commence on/around the 24th June. During the 1st week of thebuild, there will be quite a lot of earth to move so Rectory Lane will be quite busy - theyapologise in advance and will endeavour to keep disruption to a minimum!

Both are targeting Jan 2015 as a completion date.In the meantime, if anybody in the village would like to know more information or haveany concerns during the build then please drop us a line on:

Summer has been andgone judging by thedrop in temperaturesand the heavy rainoutside as I write thisarticle for the Newsand Views.

My mother is over visiting the family fromFlorida and she was happy to leave the 90degree heat at home for what was a verywarm start here in early August. Sadly sheis now asking for the central heating to beput on as she claims her blood is a lotthinner these days!!

The county should have completed thecutting of all grass verges in the area by theend of July and the road maintenanceteams should now have cleared all thegullies and drains. If this has not happenedin your area please let me know.

As your county councillor can Icongratulate Adrian Walls on his recentsuccess in the by election for the vacancyon the Llanferres Community Council. I lookforward to working with him and the rest ofthe council for the remainder of the term ofthis council.

A number of residents have raised concernswith me about the parking of vehicles inturning areas in the village of Llanferres.Sadly most families by necessity, need atleast two cars these days to get to and fromwork and if your children have still notflown the nest there may be even more carsparked on your drive. I know that it isdifficult to park all cars these days on yourown property but please bear in mind thatturning areas are for just that purpose and

so please help all concerned by keepingthem clear.

A number of people have contacted meabout the recent by election for thecommunity council and expressed concernsabout the costs involved. It may help if Iclarify what the procedures are for avacancy on either a community or countycouncil.

By elections can be called when a vacancyarises due to the resignation of a councillornormally due to ill health or the fact thatthey are moving away, sadly due to thedeath of a councillor, after a councillor failsto attend the requisite number of meetingsor when a councillor is barred from officefor such things as misconduct. For acouncillor to be barred from office it wouldnormally involve a judgement by the LocalGovernment Ombudsman.

Once a vacancy has been notified to thecounties returning officer the councils clerkadvertises a casual vacancy. To call anelection the returning officer must receiveten or more requests from registeredelectors, either as individual letters or in theform of a petition. If the designatednumber of requests are not received by theclosing date the matter is passed back tothe relevant council to co opt a localresident to fill the position. Normally theywould ask for interested parties to declarethat they would like to be considered and ifmore than one party does this then thecouncil would select a candidate by eitherinterview, CV or local knowledge. If theywere not happy with any of the candidatesthey can go back and try again. Once a cooption is agreed it must be publishedlocally.

If an election is called a new deadline is setfor the close of nominations and as long astwo or more candidates file their papers bythat date an election is called and acampaign can begin. If there is only onecandidate at the close of nominations thatcandidate is automatically elected.

Sadly democracy does not come cheaplyand the more electors there are in a wardthe higher the cost. Costs include theposting of polling cards and postal voteforms, stationery and printing, the hiring ofpolling stations, the salaries of the pollingclerks and the office costs of the returningofficer at county hall.

All costs have to be met by the council whohave declared the vacancy.

I hope this helps to explain how the processworks and how the costs are incurred.

As Budgets get tighter I am pleased toconfirm that I have managed to get anumber of roads in the ward included inthe resurfacing budget for this year and Ihave chased a number that should havebeen completed last year!! Majorresurfacing works will begin in Septemberin Eryrys from the county boundary to thevillage centre, in Graianrhyd past the MaesY Droell Quarry to the junction with theB5430, in Llandegla village and on theA5104 from Rhydtalog to Llandegla.

Work will be done on the back road fromLlanferres to Moel Famau but I fear thatdue to a change in policy across the countytowards minor roads in rural areas this maybe not the full resurfacing that we hadhopped for. I am still on the case and I willlet you know more in due course.

Llanferres Park has once again beenawarded the The Green Flag CommunityAward® in 2014.

Himalayan Balsam is an insidious, invasive,foreign and fast growing menace to agri-cultural land, river banks and the country-side in general. If left unchecked it can, inonly a few years, take over vast areas ofland, smothering all other plants, makingthe land unproductive and liable to soilerosion when the winter rains arrive. It is anational problem. It is a huge problem inthe Conway Valley, I have seen it inGloucestershire, Oxfordshire, Merseysideand recently I observed large swathes onthe side of the M6 near Preston. On tele-

vision it is often observed growing on thelikes of canal banks and in wetland centresyet the managers of these places seem tobe doing nothing to control it. Here inLlanferres a voluntary group was set upabout six years ago to tackle the problemwhich was bad on the Cacwyn Brook and

the River Alyn ( the group is now part ofthe River Alyn Himalayan Balsam ActionProject). Weekend working parties wereorganised to hand pull the Himalayan Bal-sam plants and, where infestation was verybad, to strim them down. The group wasvery successful and the control was excel-lent and it looked as though the problemhad been almost eliminated. However,complacency is not an option because itonly takes one or two plants to be allowedto flower and the problem quickly returns.They can be missed if growing in a nettle

patch or a pile of brush-wood and, out of sight,they can throw theirseeds up to 7 metres inevery direction and eachplant can produce up to800 seeds. Unfortunate-ly this has happened injust one or two places.Some people say thatbees love them and thisis undoubtedly true but,when the bees are feast-ing on the easily accessi-ble pollen and nectar,they are not pollinatingour native wild speciesor our food crops.The original group setup to control HimalayanBalsam in our area hasunfortunately reduced in

numbers and some of us are getting a bit‘long in the tooth’ so can I ask any memberof the public or any landowner to destroyany plants they see, so all the original workwill not be in vain.

A Local SwindleFrom time immemorial men known as“Adventurers” have sought to maketheir fortune by mining minerals.Many of these adventurers are bestdescribed as being “colourful”. Thisarticle is about one such person.

In about 1850 a private companystarted mining for lead ore on NercwysMountain close to the borders ofLlanarmon yn Ial and Llanferres. Theleader of this enterprise was oneSamuel Merryweather from Wigtown,Cumbria who had a controllinginterest of 33/64ths. He hadpreviously been a traveller to awholesale grocer in Liverpool and wasnow best described as a miningspeculator as he also had mininginterests in Cumbria.

Starting up a new mine can be anexpensive undertaking and the

company soon ran out of resources.So they decided to form a new publiccompany with a nominal capital of£30,000 to be raised from the issue ofsix thousand £5 shares. The intentionwas for the new company to buy themine for £7,000 (£4,000 in cash and£3,000 in fully paid up shares of thenew company). Henry Whitworth andCompany of Manchester was toprovide the mine management. Theprospectus claimed that “largequantities of ore” had already beenraised from the mine. However, thelaunch of the company did not go welland only part of the purchase pricewas raised.

The chairman of the new companysmelt a rat and engaged a miningengineer to examine the mineworkings. He reported that the minewas worthless and would require at

least £10,000 of investment to be productive. Some of the shareholders decidedthat a fraud had been perpetrated and filed a suit in the Court of Chancery inthe name of the company against Samuel Merryweather and his supporters.This suit was dismissed as it had been improperly filed as no resolution hadbeen passed by the shareholders authorising the suit. {In legal jargon therelevant company law at that time was “the rule in Foss v. Harbottle”. This statesthat any action in which a wrong is alleged to have been done to a company, theproper claimant is the company itself.}

Immediately, David Atwool, one of the shareholders, filed a suit in the Court ofChancery against the company, Samuel Merryweather and his supporters.Several years passed before this was heard but in the meantime he successfullypetitioned for the company to be declared bankrupt thus freezing the companyassets.

From the proceedings of the new case we learn that Merryweather knew that themine was worthless but he was determined to get £4,000 for his share of theoriginal company. He therefore colluded with Henry Whitworth, who had noprevious interest in the mine, and sought his help in the sale. It was arrangedbetween them that Merryweather would receive £4,000 of the £7,000 andWhitworth the remaining £3,000.Merryweather and Whitworthconcealed these facts from the otherdirectors and induced them to buy themine. In other words a straightforward fraud. But how could this beremedied? As Merryweather,Whitworth and their supporters helda controlling interest in the companythey were able to prevent an actionbeing brought under the rule in Fossev. Harbottle. Vice Chancellor Wooddecided that an exception had to bemade to this rule in order to protectminority interests. This importantexception is now known as “fraudsagainst a minority” and is still quotedin legal actions today. The Court alsoruled that the sale of the originalcompany was to be set aside, all thepurchase money was to be refundedand Merryweather and Whitworthwere to pay all the legal costs. Thiswas the last that we heard of SamuelMerryweather in this area. But Iunderstand that he continued to sailclose to the wind in his activitieselsewhere in England.

At this time of year we often seeHarvestmen scuttling about and it iseasy to misidentify them as spiders or'Daddy-long-legs(Crane flies) but theyare neither. They are not insects (asCrane flies are) but are of the Classarachnida(along with spiders) butbelong to the Order Opiliones. Theyare totally harmless and arebeneficial to humans. While spidershave their abdomen separated fromthe thorax by a waist, theharvestmen's body is undivided.They have four pairs of very long legsof which the 2nd pair are the longestand act as 'feelers', rather likeantennae do, and enable the animalto find its way about. They only havetwo eyes compared with spiderswhich have six to eight. They cannotbite people, do not produce venomlike spiders, do not produce silk, donot hunt but scavenge and feed onparticles of food, not sucking juices asspiders do. They reproduce by layingeggs, from which hatch tinyharvestmen that gradually grow toadulthood, they do not have a larvalor pupal stage. They are known asHarvestmen because most species, ofwhich there are over twenty inBritain, come to maturity in latesummer or early autumn, at time ofharvesting.When some volunteers from theHimalayan Balsam group weresearching along the River Alyn forspecimens of the insidious weed (seeseparate article, page 30) they heardthe sound of chicks calling from a holein the river bank and I was askedcould I explain. I said it would beeither be a Kingfisher or a Sandmartin nest but I would investigate.Following the given instructions I

found the site and I could hear thesound of nestlings therein. Havingsecreted myself nearby, I waited andsoon afterwards a parent arrived toenter the nest and within half aminute re-emerged and sure enoughit was a Sand martin. I have seenthem near the river over the yearsand suspected breeding but this wasthe first time I have been able topositively confirm it. The nest wasunusual on several counts i) it was asingle nest and Sand martins usuallynest in colonies, ii) it was in a claybank which one would have thoughtwould be too hard for Sand martinswhich prefer sandy banks, iii) thehole did not go straight in but, afteronly a few centimetres, it turned by90 degrees, probably because thebirds had encountered a stone. Thesenest burrows can sometimes be asmuch as a metre in length.The Sand martin is the smallest ofour Hirundines, which comprise theSwallows and Martins, but not Swiftswhich belong to a separate group.They can be separated from the morefamiliar House martins in beingbrown in colour, have a brown bandacross the chest but do not have thedistinctive white rump. They are oneof the earliest spring migrants, oftenarriving in Britain by mid-March.They overwinter in the Sahel a semi-arid area just south of the SaharaDesert where they sometimes suffersevere losses in particularly dry yearsand this affects the numbers comingto Britain. Once here, they usuallyhave two broods of chicks and the onein this hole will be the second brood.They leave for Africa round mid-September.
