• The J.C. Carter Company, Inc. named in the 1990 Order no 10I.lger exists by thatname(ifit exists at all), is not a current owner or operator at the site, and was sold bymanagement asSociated with our client in 1997. ' . '
• Several sep~te and distinct corporate entities used ~e name "J.C. Carter Company" or"J.G. Carter Company, Inc." over more than fiftyyeaxs, most ofwhich were notaffiliated with our ~lient in ~y way;
• Mr. Velozand 9ther shareholders created a new corporate entitY in connection with anasset purchase in 1987, which included the purchase of the underlying real estate;

You had raised the issue ofTCA. While there are three"locationson the Property whereTCA has been detected, there are no locations anywhere on the Property where TCAis greaterthan the Maximum Contaminant Level ("MCL''). Further, purchase orders indicate that the lasttime TCA was purchased at the facility was in January of 1986. Twenty gallons ofTCAwaspurchased at thattime, and would have been consumed by operations prior to the sale of the .busmess iri 1987. See Ex. 3 at 4. Regarding other constituents, while chemicals have beendetected at the Property, all of theseitems are below the McL. As a result, the only chemicals atissue are TCE and PCE, neither ofwhich was used by Veloz Carter.
Since mCarter, Annatron Carter, and VelozCarter conducted similar businesses, youasked what changed such that TCE~d. pCEwere i;J.o longer used at the Property by VelozCarter. As described by the fonner employees, at least four factors led the pre:'Veloz Carterentities to discontinue using TCE and PCE at the Property.
First, the demand for oxygen pumps decreased in t4e late 1970's as the air force andNASA spaceprograms changed course.. Specifically, Titan I came to an end and was replacedby Titan II and III, which did not use oxygen as a propellant. As aresult, there was a diminisheddemand for oxygenp:umps and the business shifted its focus to other shaft seal pumps whichused argon, nitrogen, and hydrazine. TCE and PCE were not used to Clean these other fuelpumps. See ExA at~16;Ex. 5 at ~13, '.

Fourth, thecompanyleamed and appreciated the,safety-risks inyolved if the O:lCygeripumps were not cleaned property.. See Ex'. 4 ~t ~19; Ex;' 5 at 'U16.
As a result, abusiness 9-ebision ~as made to instead sendthe oxygen pumpsoffsite to bel,c1eaned. 80nietllne between 19'78 and 1979,m carter started sendingthe oxygen, PllIl1PS off .."site to he cleaned by Wyte 'cpmpany. See Ex 3 at 2-3.The Delta Report reviewed the use, storage, and disposal practice ofVeloz Carter, reconstructed

from purchase orders dating back to 1985 and hazardous waste manifests, for petroleum andother volatile hydrocarbon and halogenated hydrocarbon compounds. According to Delta, ''TCAwas us.ed once at the facility as a cleaning fluid. TCA has not been used or stored at the facilitysince 1986:' Ex. 3 at 3..Further, Delta found that:
"According to the purchase records maintained by the presentowners, which are available through 1985 only ... TCE and PCEh'ave never been used at the site [during the Veloz Carterownership].. Both the fact that the underground waste oil tank wasremoved before the [then} present owners ofthe company[VelozCarter] controlled the site, and the fact that there is no evidencewhatsoever that TCE arid PCE have ever been used.at the site,indicates that, even if the site were considered a source of theconstituents found in the underlying groundwat~r the currentownerS and operators of the site [Veloz.Carter]arenot theappropriate responsible parties." Ex. 3 at 2. (emphasis added)
, The June 28, 2008 Tetra Tech Con:ective Action Plan, approved by the agency, cites to· Delta'sfiridmg,that TeE and PCEwere not useda.t the Property.since atleast 1985. See CAP at,p. 3.
