ii) Layout plan showing dimension wise area calculation of the project is not uploaded and provided.

iii) Land suitability certificate is given of 98 ha instead of 98.430 ha (92.750 for CA and

5.680 ha for ACA).

iv) Administrative approval of the project by competent authority.

v) Total length of Transmission line is not given.

vi) Length of transmission line in forest area is not given.

vii) Width of ROW.

viii) DSS/ Google earth shows that the total polygon area of CA sites i.e (i) Nadla PF, Berwala beat, (ii). R 70, C-1 Nada beat and (iii) R 70 C 3 Chouki Beat is 192 ha. of it approx 72.74 ha space is available for plantation out of the target plantation of 98.430 ha. In CA scheme, SG has not prepared ACA scheme of 23,906 plants as per para 2.4 (ix) of rule and guidelines of FC ( rule 2.4(ix) is at p-290/c). As 23,906 no. of trees/plants already existing on NFL against ACA. In scheme it is also mentioned that out of 23,906 plants which is already in existing, 14,665 are saplings of girth 10-30 cm and 9,241 are trees/poles of grith more than 30 cm. As 14,665 saplings are less that 10-30 cm , they prepared ACA scheme for 4 years maintenance to 10 years maintenance.

iii) DGPS map pdf and CA site is not matching with each other. In DGPS map total CA sites are Nineteen were as KML uploaded on portal is Eighteen. The Missing KML on online portal is CA site Kaulana Distributary RD 60-120 L/R which needs to be uploaded for DSS analysis.

iv) In Serial No. 14 under column 13(i) of part II online, three KML features are uploaded under one KML i.e., Kulwana 1, Kulwana 2, Kulwana 3, but in DGPS map Kulwana 3 geo-coordinates is missing. Revised DGPS map be uploaded.

v) DSS/google earth shows that out of 22.360 ha as provided by the UA/SG of 14 CA sites as shown below only 19.340 ha area/space is available for CA plantation. Additional 3.020 ha is required for target plantation for CA and accordingly DGPS map, KML file, SOI toposeet of the site be provided and uploaded.

vi) Composition of 14,665 plants, which are already exiting in the NFL, to know the major species name and its contribution in the total.

Sir,I am directed to refer to online proposal forwarded by the Nodal Officer (FCA), Government of

Haryana on the above mentioned subject seeking prior approval of the Central Government for diversion of39.57 ha of forest land for non-forestry purpose in accordance with section-2 of the Forest (Conservation) Act,1980.

2. After careful examination of the above mentioned proposal of the State Government, the followinginformation/clarifications are still required to be submitted:

i) CA scheme of Dadhi Bana in Charkhidadri is not uploaded properly. Revised CA be uploaded undercolumn 13 (ii) part II.

ii) Land site suitability and CA scheme of Abondoned land of irrigation department at village Kheri,Kanlna in Mahendergarh forest division is given of 2500 plants whereas in column 13 (i) s.no 4 it isshown as 8.6 ha. Revised CA scheme, site suitability certificate of 8.6 ha be provided.

Proposal for constructing flyover over the diverted land in respect of “Diversion of 13.41 ha of forest land in favour of Project Director, PIU, Chandigarh for constructon of 4 laning Zirakpur-Parwanoo road from km. 42.00 to 57.400, NH 22 n State of Haryana/HP Border, under Forest Division Morni-Pinjore and District Panchkula Haryana. 1. This is a proposal seeking permission for construction of flyover over the already

diverted forest land in respect of diversion of 13.41 ha of forest land in favour of Project Director, PIU, Chandigarh.

2. The proposal was accorded approval (S-II) on 30.08.2007 by NRO, Chandigarh with the condition that “7. वन भिूम का प्रयोग प्रस ् ताव म दशार्ये उ देश ् य के अलावा अन ् य िकसी उ देश ् य के िलये नही ंिकया जायेगा”

3. The State Government on 12.06.2020 has submitted that this flyover (new construction) was not a part of the diversion proposal and has reported violation of condition no. 7 of Stage-II approval.

4. The User Agency (NHAI) on 01.06.2020 has submitted that construction of Half VUP for Amravati Enclave at Ch. 53.550 on Zirakpur-Parwanoo Section of NH-22 (new NH-05) is sequel to the persistent public demand/VIP references and smooth traffic movement. They also affirmed that no additional forest land is required for this project as also no tree will be felled in this process.

5. The proposed construction by NHAI is a case of ‘change of lay-out plan’ of the road without obtaining prior approval of the competent authority.

6. The proposal is placed before the Hon’ble REC for consideration. ‐‐‐

iv) DFO, Rupnagar shall provide legal status of three patches falls on the proposed site

of total 1.09 ha (0.38 ha, 0.31 ha and 0.40 ha) and if found forest, shall prepare Additional CA scheme of 1.09 ha x 2 = 2.18 ha of 3 three patches

5. The observations of REC was informed to State Government vide this office letter dated 11.03.2020 and 05.06.2020.

6. The State Government reply on 03.06.2020 and 26.06.2020 which are compiled as below:

State Govt. informed that Inspection has been done by the DFO Rupnagar of these 3 patches and the Legal status of these sites are Non-forest land.

7. DSS analysis is as under below:

CA sites Analysis:

(1) Naurangpur Jhandian Forest is in Rupnagar range. The total area of KML is approx. 126 ha. out of it approx. 65 ha. vacant space available according to the Google Earth Image dated 04/06/2019 due to undulating topography with ridges.

(2) Khatana Forest is located at Nurpurbedi range. The total area of KML is approx. 26.9 ha. out of it approx. 12 ha vacant space available according to the Google Earth Image dated plantation activity is visible. Need to verify about it from the SG/UA. Total CA vacant land available is approx.:77 ha ACA sites Analysis: Garbagha Forest is in Nurpurbedi range and total area of polygon/KML is approx. 18.2 ha out of it approx. 06 ha vacant space available according to the Google Earth image dated 04/06/2019. Total ACA vacant land available is approx.:06 ha

8. As the legal status of three patches on the proposed site of total 1.09 ha (0.38 ha, 0.31 ha and 0.40 ha) has turned out to be Non-Forest, it shall not attract the CA /ACA. 9. The proposal is placed before REC for discussion and decision.
