Gambling Act 2005 – Gambling Policy Review

The council is currently consulting on its Gambling Policy. The Gambling Act 2005 requires the council to prepare and publish a statement of the principles that it proposes to apply in

exercising its functions under the Act. The statement of principles, or Gambling Policy, lasts for three years.

The council’s current policy was published in January 2010 and the council has initiated a

review of this policy prior to publishing a revised statement in January 2013.

The review is open to public consultation until 14th September 2012, and the council would welcome any views in relation to the policy review. The consultation paper and reply details

Licensing Sub-Committee – Thursday 23rd August 2012

Rapha Racing, 85 Brewer Street, W1 (West End Ward / West End Stress Area) – Cycling clothing shop with an ancillary café facility in a new development on the corner of Air Street and Brewer Street. The applicant wished to sell alcohol in the café between 10:00 hours and 20:00 hours Monday to Saturday and 10:00 hours and 18:00 hours on Sunday. The Sub-Committee granted the application, attaching a condition to the licence that the use of the café area would be ancillary to that of the retail premises which would prevent the premises being turned into a bar. Alcohol would be ancillary to food and consumed whilst seated (although the premises could not be considered as a restaurant on the basis that the food offering was not a substantial meal and not all of the wording of the full restaurant model condition had been agreed as alcohol was not being served by waiter/waitress) and would be restricted to beers and wines. New China, 48 Gerrard Street, W1 (St James’s Ward / West End Stress Area) – Chinese restaurant which operates on the basement, ground and first floors. The licensable activities applied for were the sale of alcohol on the premises and the provision of late night refreshment at the premises until midnight Monday to Wednesday and 01:00 hours Thursday to Saturday. The Sub-Committee granted the application, taking into account that the applicant had agreed the restaurant model condition. Members were also advised by Environmental Health that whilst there had been problems in the past with karaoke taking place on the ground and first floors, there had been no recent examples of noise emanating from the premises. Both Environmental Health and the Police’s key concerns had been addressed by their conditions being agreed by the Applicant. The Applicant’s Representative commented that karaoke would only take place for private parties in the basement area which was appropriately licensed and that the relevant karaoke equipment had now been removed on the ground and first floors. Staff had received appropriate training to prevent the licensing objectives being undermined. Cote, 17-19 Maddox Street, W1 (West End Ward / West End Stress Area) – The premises are to operate as a French bistro with licensable activities on the ground floor and within the dining room located in the basement. The licensable activities applied for were the sale of alcohol on the premises until 23:30 hours Monday to Thursday, midnight Friday to Saturday and 22:30 hours Sunday and the provision of late night refreshment at the premises until 23:30 hours Monday to Thursday and midnight on Fridays and Saturdays. The Sub-Committee granted the application, taking into account that the applicant had agreed restaurant conditions and the licensable hours were within the Council’s core hours policy. There was no regulated entertainment and doors and windows would be closed after 21:00 hours. Dalla Terra, 25 Slingsby Place, WC2 (St James’s Ward / West End Stress Area) – Specialist wine shop and café operating on the ground floor. The application was to vary the licence to include the external area within the licensed area and add the conditions to

the licence that there would be no more than 4 tables and 16 chairs outside, the sale and supply of alcohol for consumption outside would cease at 21:00 hours and alcohol in the outside area would only be consumed by patrons seated at a table. The Sub-Committee in granting the application took into account that there were existing restaurant conditions on the licence and Environmental Health’s specific concerns had been addressed. Members considered that the licensing objectives would be upheld and that local residents would not be inconvenienced by the proposed licensable activities in the outside area.
