LICENSING SUB-COMMIITTEE – SUMMARY OF DECISIONS

Licensing Sub-Committee: 9 April

Ladbrokes 352-353 Strand, WC2 (St James’s Ward) – Application made under Section 187 of the Gambling Act 2005 to vary the layout of the premises. In particular the applicant proposed to move the counter from the rear of the premises to a more central location and have a lower enclosed screen rather than the full counter screen seen in most gambling premises. This was intended to improve interactivity between staff and customers. The Licensing Authority and Environmental Health had been particularly concerned regarding the original proposals to remove screening altogether but many of their concerns had been addressed with the enclosed screen proposal and the availability of a staff retreat room. They were still of the view that Ladbrokes had not provided an adequate site specific risk assessment although this was disputed by the applicant. The Police opposed the application as they were of the view that the staff being located in a central ‘island’ placed staff at risk of assault. The Sub-Committee granted the application as Members considered that the revised proposals, which addressed many of the Licensing Authority’s and Environmental Health’s concerns, and also the conditions would promote the licensing objectives. Members were also aware that the betting industry was being asked to deal more sensitively with customers and more interactivity between staff and customers would be advantageous. The applicant would be required to meet the requirements of the Health and Safety in Work Act so that the needs of the public and staff were protected. Paddy Power, 195-197 Edgware Road, W2 (Hyde Park Ward) – Application made under Section 159 of the Gambling Act 2005 for a new betting shop. The Applicant’s Representative made the case that his client had taken steps that were reasonably consistent with the licensing objectives as required by the Act and there was a presumption in favour of granting the application. The Licensing Authority and local residents emphasized that Edgware Road was a unique location where there was an increased number who were vulnerable to gambling, including the homeless based in hostels. The Police had maintained their representation on the grounds that the application might lead to increased levels of crime and disorder. The Sub-Committee refused the application as Members considered that the unique location could be taken into account and Edgware Road did have a very high percentage of homeless people as was borne out by the number of hostels. The Sub-Committee did not consider that the Applicant had set out measures to address these vulnerable people from being harmed or exploited by gambling. The Sub-Committee had taken into account evidence included in the paper ‘Rates of Problematic Gambling in a British Homeless Sample: A Preliminary Study’. Participants in the study had been recruited from homeless centres across Westminster in 2012.

Licensing Sub-Committee: 10 April Stephano’s Café La Chandelle, 2-3 Irving Street, WC2 (St James’s Ward / West End Stress Area) – Application for late night refreshment until 00:30 Monday to Saturday and midnight on Sunday and on and off sales of alcohol until midnight Monday to Saturday and 23:30 on Sunday. It was clarified by the Applicant that off-sales were only required for alcohol to be sold at the tables and chairs outside. The Sub-Committee granted the proposed hours for the inside of the premises, particularly taking into account the Applicant had agreed the Council’s model restaurant condition. Members noted that in agreeing the restaurant condition with the Police, the Applicant had accepted that there would be no off-sales, and therefore use of the outside area, after 23:00 hours. Members considered that a terminal hour of 23:00 for the external area and the removal of tables and chairs by 23:30 were appropriate for the operation. 8 Mount Street, W1 (West End / not in stress area) – Application to vary the premises plans, incorporating a change of layout and increase the terminal hour of the sale of alcohol by 30 minutes on Friday to Saturday to 00:30 hours. The Applicant offered restaurant conditions on the ground floor but sought a bar in the basement. The rear garden was withdrawn as part of the licensable area. The Sub-Committee in granting the application noted that the existing licence allowed alcohol to be sold without food and considered that the conditions attached to the licence would ensure that the premises would promote the licensing objectives. Conditions were attached which had been discussed between the Applicant and objectors to the application including that a door supervisor would be on duty at the entrance to the premises from 21:00 until 30 minutes after members of the public had left the premises and that all members of the public would be off the premises 30 minutes after the cessation of licensable activities. 5 applications were submitted by Soho Estates for the Walker’s Court area (West End Ward / West End Stress Area). Evidence was heard in part by the Sub-Committee. The Sub-Committee will re-convene on Thursday 17 April to hear the remainder of the evidence.
