If your pool is not compliant, you may sign a Form 36 which states “No Pool Safety Certificate”, or you may decide to have the necessary changes made for compliance. If you buy a home with a non-compliant pool, you will have 90 days from date of purchase to get the pool compliant.

The state of Queensland has strict laws and from December 1st, 2010, legislation requires that all swimming pool barriers, on properties sold or leased, must be inspected and a compliance certificate issued by 30th November, 2015.

Providers of short term accommodation and shared swimming pools are required to be inspected once every two years. Non shared pool compliance certificates are valid for two years and shared pool certificates are valid for 12 months.

New laws require four-sided barriers to surround a swimming pool with a minimum height of 48 inches or 1200 mm from ground level and non-climbable zones in a 180º arc measuring 36 inches or 900 mm from the top.

To be compliant, there must not be any objects that are more than 0.5 inches or 10 mm in width and depth in the non-climbable zones. Using a building as one side of the barrier is not allowed.

These laws have been passed to reduce the risk of children drowning in Queensland, but should not by any means allow complacency, as it requires a combination of pool safety and vigilant child supervision to prevent a drowning.

A non-compliant swimming pool could expose you to fines and affect the resale value of your property. A licensed pool safety inspector from TCP Property Services will inspect your pool for compliance and issue the relevant compliance certificate from the Pool Safety Council.
