Definitions

"THE ACT" means the Environment Protection Act 1993.

"THE AUTHORITY" means the Environment Protection Authority established under Division 1 of Part 3 of the Act.

"THE PREMISES" means, at the time of issue of this authorisation, the whole of the land comprised in Titles Register - Certificate of Title, Crown Lease and Crown Record:

"AUTHORISATION FEE PAYMENT DATE" means the anniversary of the grant or renewal of this authorisation.

"ASBESTOS" The fibrous form of mineral silicates belonging to the serpentine and amphibole groups of rock-forming minerals, including actinolite, amosite (brown asbestos), anthophyllite, chrysotile (white asbestos), crocidolite (blue asbestos), tremolite, or any mixture containing one or more of the mineral silicates belonging to the serpentine and amphibole groups.

Asbestos-containing material is any, material, object, product or debris that contains asbestos.

Friable asbestos means (a) non-bonded asbestos fabric, or (b) asbestos-containing material that:

(i) is in the form of a powder, or (ii) can be crumbled, pulverised or reduced to powder by hand pressure when dry.

Non-friable asbestos means asbestos-containing material in which the asbestos fibres are bonded by cement, vinyl, resin or other similar material, eg asbestos cement.

Asbestos Waste means waste asbestos-containing material (ACM) including all removed ACM, as well as disposable items used during asbestos removal work, such as plastic sheeting and disposable coveralls, respirators and cleaning rags.

Advice on the requirements for handling and transport of this waste can be found in EPA Guideline, Wastes containing asbestos: removal, transport and disposal (2005).

"ASSESSMENT OF SITE CONTAMINATION NEPM" means the National Environment Protection (Assessment of Site Contamination) Measure 1999.

"COMMERCIAL AND INDUSTRIAL WASTE (GENERAL)" means the solid component of the waste stream arising from commercial, industrial, government, public or domestic premises (not collected as Municipal Solid Waste), but does not contain Listed Waste, Hazardous Waste or Radioactive Waste.

"COMPOST" means pasteurised material resulting from the controlled microbiological transformation of compostable organic waste under aerobic and thermophilic conditions for at least six weeks.

"COMPOSTABLE ORGANIC WASTE" The biodegradable component of the waste stream that is of biological origin but does not contain any Listed Waste, Radioactive Waste or Hazardous Waste. Notes: These organic materials may be processed through composting works to formulate valuable recycled organic products. Suitability of compostable organic waste as a feedstock is dependent on the location, site design, processes and potential to cause environmental harm.

"COMPOSTING" The controlled process whereby compostable organic wastes are pasteurised and microbiologically transformed under aerobic and thermophilic conditions for a period not less than six weeks, including the pasteurisation phase.

"CONSTRUCTION AND DEMOLITION WASTE (INERT)" means the solid inert component of the waste stream arising from the construction, demolition or refurbishment of buildings or infrastructure but does not contain Municipal Solid Waste, Commercial and Industrial Waste (General), Listed Waste, Hazardous Waste or Radioactive Waste. NOTES. C&D waste (Inert) should be such that the entire composition of the C&D materials is Inert Waste with no contamination by foreign material. As such it is acknowledged that, with the aim of no contamination, there may be some negligible components of foreign material contained in the waste (as a guide, 0 to 5% maximum by volume per load). C&D waste (Inert) includes bricks, concrete, tiles and ceramics, steel and inert soils. Foreign material includes green waste, plastics, electrical wiring, timber, paper, insulation, tins, packaging and other waste associated with construction or demolition of a building or other infrastructure. Foreign material must not be Municipal Solid Waste, Liquid, Listed, Hazardous or Radioactive Waste.

"CONSTRUCTION AND DEMOLITION WASTE (MIXED)" means the solid component of the waste stream arising from the construction, demolition or refurbishment of buildings or infrastructure which contains some foreign material (as set out below), but does not contain Municipal Solid Waste, Commercial and Industrial Waste (General), Listed Waste, Hazardous Waste or Radioactive Waste. NOTES. C&D Waste is considered C&D (Mixed) waste if it contains significant foreign materials from construction and demolition activities that would render the load of waste no longer inert (as a guide, 5 to 25% maximum by volume per load). Foreign material includes green waste, plastics, electrical wiring, timber, paper, insulation, tins, packaging and other waste associated with construction or demolition of a building or other infrastructure. Foreign material must not be Municipal Solid Waste, Liquid, Listed, Hazardous or Radioactive Waste. Where waste from construction and demolition sites contains predominantly foreign materials or domestic waste, such as waste from household clean ups collected by commercial skip bins, this is Commercial and Industrial Waste (General).

"DISPOSAL" means the final stage in the management of waste, which includes: (a) treatment of waste prior to disposal; (b) incineration of waste, with or without energy recovery; (c) deposit of waste to land or water; (d) discharge of liquid waste to sewer; (e) permanent, indefinite or long-term storage of waste. NOTE: Long-term storage of waste includes waste stored for a period of time that is not considered temporary by the EPA, whether for a defined period or not, and for which there is no known or foreseeable market for resource recovery.

"DISPOSE" To dispose of waste includes deposit the waste and cause or allow the waste to be disposed of or deposited.

"DOMESTIC WASTE" means the waste produced in the course of a domestic activity.

"E-WASTE" means waste electrical and electronic equipment which is dependent on electric currents or electromagnetic fields in order to function (including all components, subassemblies and consumables which are part of the original equipment at the time of discarding). NOTE. For example e-waste may include: a. Consumer/entertainment electronics (e.g. televisions, DVD players and tuners), b. Devices of office-, information- and communications technology (e.g. computers, telephones and mobile phones), c. Household appliances (e.g. fridges, washing machines and microwaves), d. Lighting devices (e.g. desk lamps), e. Power tools (e.g. power drills) with the exclusion of stationary industrial devices, f. Devices used for sport and leisure including toys (e.g. fitness machines and remote control cars).

"ENVIRONMENTAL CONSULTANT" means a person who, in the opinion of the Authorisation Holder, is a fit and proper person to assess and certify the nature and extent of the contamination of waste having regard to the requirements of this Authorisation.

"ENVIRONMENTAL HARM" means the same as is defined in section 5 of the Environment Protection Act 1993.

"FRIABLE ASBESTOS" means: (a) non-bonded asbestos fabric; or (b) asbestos-containing material that: (i) is in the form of powder; or (ii) can be crumbled, pulverised or reduced to powder by hand pressure when dry.

"GREEN WASTE" means the vegetative portion of the waste stream arising from various sources including waste from domestic and commercial premises and municipal operations.

"HAZARDOUS WASTE" Listed waste having a characteristic described in schedule A list 2 of the National Environment Protection (Movement of controlled waste between States and Territories) Measure. NOTE. Hazardous Waste includes any unwanted or discarded material (excluding radioactive material), which because of its physical, chemical or infectious characteristics can cause significant hazard to human health or the environment when improperly treated, stored, transported, disposed of or otherwise managed.

"INERT WASTE" solid waste that has no active chemical or biological properties. These wastes do not undergo environmentally significant physical, chemical or biological transformation and have negligible potential to cause environmental harm.

"INTERIM COVER" means a compacted layer of at least 0.30 metres of soil for sealing solid waste that has been disposed and to which no additional waste will be added within the proceeding 30 days (refer to Tables 1 and 2 for physical and chemical characteristics, attached to this licence).

"INTERMEDIATE LANDFILL COVER" means intermediate landfill cover as defined in conditions of this authorisation and the Intermediate Landfill Cover & Low Level contaminated Waste attachment to this licence.

"INTERMEDIATE SOIL" means waste consisting of clay, concrete, rock, sand, soil or other mineralogical matter and containing chemical substances in concentrations (calculated in a manner determined by the Authority) that exceeds the Waste Fill criteria, but is less than the concentrations for those substances set out for Intermediate Soil (and does not include other waste including asbestos or bitumen, nor any significant organic matter).

"LANDFILL GAS" means gases arising from the decomposition of wastes deposited or disposed of to landfill, with methane and carbon dioxide being major constituents.

"LEACHATE" means a liquid that has percolated through and/or been generated by decomposition of waste material. It includes water that comes into contact with waste and is potentially contaminated by nutrients, metals, salts and other soluble or suspended components and/or products of decomposition of the waste.

"LIQUID WASTE" means waste classified as liquid waste in accordance with the assessment process set out in the guideline Liquid waste classification test, 2003. NOTE. Liquid waste that is liquid at 20 degrees Celcius regardless of whether or not it is packaged or otherwise contained, and irrespective of whether or not the packaging or container is to be disposed of together with the liquid that it contains.

"LISTED WASTE" means wastes listed in Part B of Schedule 1 of the Environment Protection Act 1993.

"MATERIALS RECOVERY FACILITY" means, a depot for the treatment of waste for resource recovery, other than a composting depot.

"MEDICAL WASTE" means medical wastes listed in Part B of Schedule 1 of the Environment Protection Act 1993.

"MUNICIPAL SOLID WASTE" means the solid component of the waste stream arising from all sources within a defined geographic area.

"MUNICIPAL SOLID WASTE - DOMESTIC SOURCES" The solid component of the waste stream arising from domestic premises that is received directly from the public, it is not received as Municipal Solid Waste - Kerbside bin collection.

"MUNICIPAL SOLID WASTE - HARD WASTE" means the solid component of the waste stream arising from domestic premises which is not suitable for collection using a kerbside bin system, but does not contain Commercial and Industrial Waste (General), Listed Waste, Hazardous Waste, Radioactive Waste or waste that is not deemed suitable for collection by local councils. NOTE: MSW (Hard Waste) is typically collected in campaigns by local councils, which also advise on what wastes are suitable for that collection.

"MUNICIPAL SOLID WASTE - KERBSIDE BIN COLLECTION" means the solid component of the waste stream arising from mainly domestic but also commercial, industrial, government and public premises including waste from council operations, services and facilities that is collected by or on behalf of the council by kerbside collection, but does not contain Commercial and Industrial Waste (General), Listed Waste, Hazardous Waste or Radioactive Waste.

"NON-FRIABLE ASBESTOS" means asbestos-containing material in which the asbestos fibres are bonded by cement, vinyl, resin or other similar material, for example asbestos cement. Advice on the requirements for handling and transport of this waste can found in EPA Guideline 414/05 - Wastes containing asbestos - removal, transport and disposal

"ODOUR" means the characteristics of emissions amounting to its smell, but does not mean or include the measurement of the chemical constituents of the emissions (ie. the toxicity of the emission).

"PUTRESCIBLE WASTE" The component of the waste stream liable to become putrid. For example: organic matter which has the potential to decompose with the formation of malodorous substances; usually refers to vegetative, food and animal products.

"RADIOACTIVE WASTE" Radioactive waste means any radioactive substance in the form of a solid, liquid or gas (or combination thereof) that is left over, surplus or an unwanted by-product from any business or domestic activity, whether of value or not, but excluding the following: (a) Substances to which the regulations under the Radiation Protection and Control Act 1982 do not apply; (b) Substances which have been exempted from regulatory control under provisions of the Radiation Protection and Control Act 1982; and (c) Material containing activities or activity concentrations of radioactive elements below the exemption levels specified in the National Directory for Radiation Protection published by the Australian Radiation Protection and Nuclear Safety Agency.

"RECYCLE/RECYCLING" Set of processes (including biological for converting recovered materials that would otherwise be disposed of as wastes into useful materials and or products. The following definitions apply: Closed loop recycling: recycling process in which the reclaimed output is used as an input to the same product system. Open loop recycling: recycling process in which the reclaimed output is used as an input to another product system.

"RESOURCE RECOVERY" as defined in the Environment Protection (Waste to Resources) Policy 2010, resource recovery in relation to waste means -(a) reusing the waste; or (b) recycling the waste; or (c) recovering energy and other resources from the waste.

"RESOURCE RECOVERY AND TRANSFER FACILITY" means a facility licensed by the EPA for the receipt of waste, recycling of waste material, recovery of resources and transfer of waste.

"SOLID WASTE" Any waste that is not gaseous and is not a Liquid Waste as determined by EPA Guideline, Liquid waste classification test (2003).

"STORMWATER" is as defined in the Environment Protection (Water Quality) Policy 2003 and means rain or melted precipitation that runs off land or structures on land.

"SUITABLY QUALIFIED CONSULTANT" A person who holds relevant qualifications, has demonstrated professional experience and expertise encompassing an appropriate range of competencies and is either a full member or is eligible for full membership of one of the following or equivalent professional organisations: 1. The Institution of Engineers Australia 2. The Association of Consulting Engineers Australia 3. The Australian Contaminated Land Consultants Association Incorporated.

"WASTE" As defined under the Environment Protection Act 1993, Waste means -(a) any discarded, rejected, abandoned, unwanted or surplus matter, whether or not intended for sale or for recycling, reprocessing, recovery or purification by a separate operation from that which produced the matter; or (b) anything declared by regulation (after consultation under section 5A) or by an environment protection policy to be a waste, whether of value or not.

"WASTE CONTAINING ASBESTOS" includes both Waste Containing Friable Asbestos and Waste containing Non-Friable Asbestos.

"WASTE FILL" As defined in the Environment Protection Regulations 2009 Waste Fill means: waste consisting of clay, concrete, rock, sand, soil or other inert mineralogical matter in pieces not exceeding 100 millimetres in length and containing chemical substances in concentrations (calculated in a manner determined by the EPA) less than the concentrations for those substances set out in Regulation 3 - Interpretation, but does not include waste consisting of or containing asbestos or bitumen. NOTE. The Waste Fill chemical criteria are specified in Regulation 3 - Interpretation, contained within the Environment Protection Regulations 2009 - http://www.legislation.sa.gov.au

"EIP" means Environment Improvement Programme.

"AHD" means Australian Height Datum

"AS" means Australian Standard.

"BTEX" means Benzene, Toluene, Ethylbenzene, Xylenes.

"DA" means Development Application.

"HDPE" means High Density Polyethylene.

"NATA" means National Association of Testing Authorities.

"NEPM" means National Environment Protection Measure.

"PAH" means Polycyclic Aromatic Hydrocarbons.

"PCA" means potentially contaminating activities, as detailed in Regulation 50 of the Environment Protection Regulatior

"PCB" means Polychlorinated Biphenyls.

"RPD" means Relative Percentage Difference.

"STEDS" means Septic Tank Effluent Disposal Scheme.

"WTF" means Waste Tracking Form.

Explanatory Notes (NB. - Explanatory Notes do not constitute a part of this Authorisation)

1. THIS LICENCE IS VARIED DURING THE TERM OF THE LICENCE, PURSUANT TO VARIATION BY CONSENT LETTER DATED 1 AUGUST 2013, AND LICENSEE'S INDICATED CONSENT GIVEN ON 1 AUGUST 2013.

2. This licence does not permit any activity in breach of any other approval by any other authority. For example, this licence does not permit any activity on the Premises which is not authorised under the Development Act 1993. It is the responsibility of the Licensee to ensure that any action or activity referred to in this licence is permitted by, and is carried out in compliance with, statutory requirements.

3. This licence is subject to the Act.

4. PUBLIC REGISTER INFORMATION. The Environment Protection Authority maintains a Public Register that is available to the public. Information maintained includes issued Environmental Authorisations (Licences, Exemptions & Works Approvals), Emergency Authorisations and various submitted Applications. Should the conditions of an Environmental Authorisation require that the Holder submit a report or other information to the Authority, then that submitted information is made available on the Public Register subject to commercial confidentiality. Endorsed Public Register information may be available on the EPA website.

5. Conditions of this licence can be varied by the EPA in accordance with section 45 of the Act.

6. This licence can be suspended, cancelled or surrendered during the term of the licence in accordance with sections 55 and 56 of the Act.

7. The Licensee must report to the EPA (on EPA emergency phone number 1800 100 833) all incidents causing or threatening serious or material environmental harm, upon becoming aware of the incident, in accordance with section 83 of the Act. Note - In the event that the primary emergency phone number is out of order, phone the secondary number (08) 8204 2004.

8. The Licensee must be aware of, and comply with: 1. the requirements of the Environment Protection Policies which operate pursuant to the Act; and 2. the requirements of any National Environment Protection Measure which operates as an Environment Protection Policy under the Act. NB: These requirements govern permissible procedures and protocols, emission or concentration levels, as well as operation and/or maintenance standards of plant and equipment.

9. The EPA undertakes to provide written advice within 14 days of receipt of all information required for assessment.

10. WASTE DEPOT LEVIES AND RETURNS (1) Waste depot levies are payable under Part 6 of the Environment Protection Regulations 2009 - Clauses 69 to 75. Penalty fees apply for non-payment of the levies. (2) Obligations to lodge waste returns apply unless you are entitled to be exempted under Regulation 75. (3) Non-lodgment of returns is an offence.

CONDITIONS OF LICENCE

The Licensee is authorised to conduct the prescribed activities as described in this licence on the Premises nominated, subject to the following conditions:

Waste Management Condition(s)

1. (67-11) PERMITTED WASTES - RECEIPT AND/OR DISPOSAL

The Licensee must:

1. ONLY RECEIVE and/or DISPOSE of waste materials at the Premises that are identified on the 'Schedule - Permitted Wastes' attachment to this licence; and

2. submit written application to the EPA to amend waste materials listed on the 'Schedule'.

NOTES.

A. The EPA may during the term of this licence impose or vary the conditions of this authorisation upon approval of an application made in accordance with this condition.

B. Written application to the EPA should be submitted on the EPA 'Change to Process Emissions or Waste' application form, which is available on the EPA website at -http://www.epa.sa.gov.au/xstd_files/Licensing/Form/06_process_cha nge.pdf.

C. The Licensee is advised to ensure that any change to waste materials has received prior approval from the relevant planning/development authority (if applicable).

2. (67-783) WASTE DISPOSAL

The Licensee must:

1. Only dispose of waste from which recyclables have been recovered:

1.1 within Stages 1,2, 3A and 3B with material that meets Waste Fill or Construction and Demolition Waste (Inert) in accordance with development consent 963/0071/84; and

1.2 within Stages 3 and 4 for all other approved waste streams.

2. Only dispose of drums that have been emptied, triple-rinsed and crushed or perforated prior to arrival.

3. Only stockpile Waste Fill, Construction and Demolition Waste (Inert) and recyclable materials awaiting transport from the premises; and

4. Ensure that a suitable cover material is stockpiled and available in sufficient volumes to meet daily cover requirements for the next working day.

3. (67-709) COMPOSTING PROHIBITED

The Licensee must not compost any waste at the Premises.

4. (67-762) ASBESTOS MANAGEMENT

The Licensee must:

1. only receive:

1.1. non-friable asbestos that has been wrapped and sealed in plastic of no less than 200 micron thick; or

1.2. friable asbestos that has been received in plastic-lined bins;

2. only dispose of asbestos in an area solely designated for the disposal of that waste; and:

2.1 display a sign at the designated area stating that it is a friable or non-friable asbestos disposal area; and

2.2 ensure that the designated area is not readily accessible to the general public;

3. take all reasonable and practicable measures to prevent the generation of asbestos dust;

4. ensure that containers and packages of waste containing asbestos are not dropped or roughly handled;

5. not remove asbestos from the container or package in which it is received at the Premises;

6. not cause or permit direct contact of compaction and/or earthmoving equipment with waste containing asbestos or with its packaging;

7. not use asbestos waste as road making material;

8. not remove or expose any asbestos that has previously been disposed of at the Premises;

9. on or before the close of each days operations; cover:

9.1 any friable asbestos disposed at the premises with no less than one metre of waste fill; and

9.2 any non friable asbestos disposed at the premises with no less than

10. not dispose of:

10.1 friable asbestos within two metres of any final surface level at the Premises; or

10.2 non friable asbestos within one metre of any final surface level at the Premises.

5. (315-414) SITE OPERATION

The Licensee must:

1. operate the Resource Recovery and Waste Transfer Facility in accordance with the following document:

1.1 Development Authorisation 313/0016/07 dated January 2007;

2. operate the Landfill in accordance with the following documents:

2.1 Landfill Environment Management Plan (LEMP), Ref 20020448RA1F, dated May 2008, prepared for Transpacific Waste Management by Tonkin Consulting; and

2.2 Nuriootpa Solid Waste Landfill Depot Closure and Post Closure Plan, Ref 20060236RA1B, dated August 2006, prepared for Transpacific Waste Management by Tonkin Consulting; and

3. not implement any amendments to the documents in this condition unless they have been approved in writing by the Authority.

6. (67-687) FIRE PREVENTION PROTOCOL

The Licensee must:

1. not cause or permit any waste to be burned within the Premises;

2. take immediate action to extinguish any fires at the Premises, or where appropriate, notify emergency services;

3. notify the EPA no greater than two hours after becoming aware of a fire at the Premises; and

4. provide a written incident report to the EPA within 72 hours after becoming aware of a fire at the Premises setting out:

4.1 the date of the fire;

4.2 the approximate time of the fire;

4.4 the area of the Premises where the fire occurred; and

4.5 any circumstances that will be taken to prevent a recurrence of a similar fire at the Premises.

7. (67-784) COVER

The Licensee must:

1. on or before the close of each days' operations, cover all waste disposed at the Premises with no less than 150 millimetres of daily cover.

2. ensure that no less than 300 millimetres of interim cover is applied to all areas at the Premises in which waste has been disposed and in which no additional waste will be disposed within the following 30 days.

3. only apply interim cover and daily cover that meets waste fill chemical criteria to stages 1, 2, 3A and 3B of the landfill.

4. only apply interim cover and daily cover that meets Waste Fill or Intermediate Landfill Cover criteria to stage 3 of the landfill and all future lined cells as approved by the Authority.

8. (67-1256) RECEIPT OF WASTE FILL AND INTERMEDIATE SOIL

The Licensee must only receive Waste Fill or Intermediate Soil at the Premises:

1. if it complies with the relevant definitions and chemical criteria for Waste Fill or Intermediate Soil as defined in the attachment(s) to this Licence; and

2. provided it is received in accordance with conditions 67-1257, 67-1258, or 67-1259 of this licence.

9. (67-1257) RECEIPT OF WASTE FILL FROM DOMESTIC PREMISES OR LESS THAN 100 TONNES FROM OTHER SOURCES WHERE A POTENTIALLY CONTAMINATING ACTIVITY (PCA) HAS NOT OCCURRED

The Licensee must take all reasonable and practicable measures to ensure that Waste Fill that is sourced from a site where a PCA has not occurred is only received at the Premises, if it is:

1. from a single domestic premises or is less than 100 tonnes from any other single non-PCA source;

2. not obviously discoloured or odorous and does not display any other indication that contamination is likely to be present; and

3. not known nor likely to be contaminated based upon knowledge of the source.

10. (67-1258) RECEIPT OF WASTE FILL OR INTERMEDIATE SOIL FROM SOURCE SITE WHERE A POTENTIALLY CONTAMINATING ACTIVITY (PCA) HAS OCCURRED AND WAS SUBJECTED TO A FULL ASSESSMENT IN ACCORDANCE WITH THE SITE CONTAMINATION NEPM

The Licensee must ensure that Waste Fill or Intermediate Soil that is sourced from a site where a PCA has occurred is only received at the Premises if:

1. it has been produced from a site which has been assessed in accordance with Schedules A and B of the Site Contamination NEPM; and

2. is accompanied by written, signed and dated certification from an experienced site contamination consultant or site contamination auditor, stating that based upon the assessment undertaken in accordance with paragraph 1 and any other sampling or testing of the waste they require, that the waste constitutes Waste Fill or Intermediate Soil.

11. (67-1259) RECEIPT OF WASTE FILL OR INTERMEDIATE SOIL FROM SOURCE SITE THAT WAS NOT SUBJECTED TO A FULL ASSESSMENT IN ACCORDANCE WITH THE SITE CONTAMINATION NEPM AND:

* WHERE A POTENTIALLY CONTAMINATING ACTIVITY (PCA) HAS OCCURRED, OR

* IS MORE THAN 100 TONNES FROM A SINGLE NON-PCA SITE (BUT IS NOT A DOMESTIC PREMISES)

The Licensee must ensure that Waste Fill or Intermediate Soil that is sourced from a site where a PCA has occurred or more than 100 tonnes from single non-PCA source site (not being a domestic premises) IS ONLY RECEIVED AT THE PREMISES, IF:

1. it has been subject to a statistically relevant sampling program in accordance with the procedures and methodologies set out in Schedule B(2) of the Site Contamination NEPM that:

1.1 determines the concentrations for all of the chemical substances in the attachment(s) to this Licence; and

1.2 includes any additional substances which a suitably qualified consultant reasonably expects to be present in that waste, based upon the source of that waste; and

1.3 chemical analysis of those samples has been undertaken in accordance with Schedule B(3) of the Site Contamination NEPM by a laboratory accredited by NATA for all relevant analyses; and

1.4 those chemical analyses are assessed by a suitably qualified consultant in accordance with Schedule B(1) and B(2) of the Site Contamination NEPM; and

2. written, signed and dated certification is received from the suitably qualified consultant stating that:

2.1 based upon the sampling program and the assessment of the chemical analyses conducted in accordance with paragraph 1 of this condition, the waste constitutes Waste Fill or Intermediate Soil; and

2.2 any chemical substances present that are additional to those specified for Waste Fill or Intermediate Soil, will not pose any harm to human health or the environment when that waste is received and deposited at the Premises in accordance with conditions of this licence.

12. (67-789) RECEIPT OF INTERMEDIATE LANDFILL COVER OR WASTE TYRES

The Licensee must, subject to conditions of this licence:

1. not receive any ILC or waste tyres from within South Australia, unless it is accompanied by a WTF and:

1.1. parts A and B of that WTF have been completed;

1.2. the Licensee completes Part C of that WTF regarding that waste.

1.3 retain the yellow copy of WTFs for no less than 12 months; and

1.4 provide the Authority with the white copy of the WTF (with parts A, B and C completed) within seven days of receipt of that waste.

13. (67-1160) MAINTAIN GROUNDWATER SEPARATION DISTANCE

The Licensee must not:

1. remove or expose any waste that has previously been disposed; and

2. dispose of waste within two metres of the standing groundwater level.

14. (67-1311) LEACHATE CONTROL

The Licensee must:

2. ensure all leachate pumped from any cell or stage is transferred into a suitably lined wastewater lagoon; and

3. not re-circulate any leachate within any landfill cell or stage.

15. (67-792) STORMWATER

The licensee must ensure that stormwater does not drain towards or collect within:

1.1 waste receipt areas,

1.2 waste storage areas, or

1.3 areas where waste is currently or has previously been disposed of at the Premises.

2. The Licensee must ensure that stormwater that has come into contact with waste or uncapped waste disposal areas is managed as leachate.

16. (67-791) LITTER

The Licensee must:

1. Take all reasonable and practicable measures to prevent the escape of litter from outside the active disposal area and the Premises, and

2. Collect and dispose of any litter that escapes from the active disposal area and the Premises on or before the close of each day's operations.

17. (67-1027) E-WASTE MANAGEMENT

The Licensee must ensure that e-waste is stored at the Premises in the following manner:

1. on an impermeable surface; and

2. undercover to prevent the entry of stormwater into that material.

Note: The Licensee should store e-waste separately from other waste and take care in its handling to maximise its potential for reuse or recycling.

18. (67-1088) SCRAP METAL STORAGE

The Licensee must ensure that the scrap metal storage area does not contain electrical or electronic waste (E-waste) at the Premises.

19. (67-694) STORAGE OF FUEL, BATTERIES AND OIL

The Licensee must:

store fuel, batteries and oil within a bund in accordance with the EPA Guideline entitled 'Bunding and Spill Management' updated June 2007;

2. store batteries undercover preventing the entry of stormwater into that bund; and

3. store and decant oil under a roofed area preventing the entry of stormwater into that bund.

20. (67-772) SPILL KIT FOR BATTERIES

The Licensee must ensure that:

1. An emergency spill kit and a hazard sign is located at the battery storage area; and

2. An emergency spill kit is provided at the loading/unloading point for batteries (if different from the battery storage area).

21. (67-706) TYRES

The Licensee must:

1. not construct tyre stockpiles exceeding 20 metres long, eight metres wide or four metres high;

2. not locate any tyre stockpiles less than 12 metres from any buildings, structures, or other stockpiles; and

3. only dispose tyres in pieces not exceeding 250 millimetres in length, width or height.

22. (67-693) VEHICLE WASHDOWN

The Licensee must:

1. only wash vehicles at the Premises within a washbay that is bunded in accordance with the EPA guideline entitled "Bunding and Spill Management' updated June 2007; and

2. dispose of any wastewater collected within that bund to:

2.1. sewer;

2.2. a waste depot licensed by the EPA to receive that waste;

2.3. a STEDS; or

2.4. a lined evaporation basin that has been constructed in accordance with the EPA guideline entitled 'Wastewater and evaporation lagoon construction' dated March 2004.

23. (67-699) SIGNAGE

The Licensee must display a sign at the entrance to the Premises clearly stating:

1. the Licensee's name;

2. the Licensee's authorisation number;

3. an emergency contact name and telephone number; and

4. the type of wastes that can be received subject to this authorisation.

24. (67-702) SUPERVISION

The Licensee must supervise the receipt and disposal of waste at the Premises to ensure that it is managed in accordance with the conditions of this authorisation.

25. (67-780) HOURS OF OPERATION

The Licensee must only operate and/or receive waste at the Premises between:

1. 7.00 am to 7.00 pm Monday to Friday; and

2. 8.00 am to 5.00 pm Saturday.

The Licensee must take all reasonable and practicable measures to:

1. Prevent the emission of dust or mud from the Premises, including access and internal roads.

2. Provide all weather access for vehicles at the tipping face; and

3. Minimise dust generation from vehicle movements.

27. (67-697) ODOUR

The Licensee must:

1. take all reasonable and practicable measures to prevent the escape of odour from the Premises; and

2. not remove or expose any wastes that have previously been disposed of at the Premises.

28. (330-153) VERMIN

The Licensee must take all reasonable and practicable measures to prevent the attraction and harbourage of vermin.

29. (67-700) FENCING

The Licensee must maintain a fence around the Premises that is suitable for preventing unauthorised access.

30. (67-703) SECURITY

The Licensee must lock all access gates when the Premises is unattended.

31. (300-20) COMPLAINTS REGISTER

The Licensee must:

maintain a register of complaints received regarding the Licensee's operations that sets out:

1.6 an estimate of the temperature, wind speed, wind direction and rainfall at the time of the events giving rise to the complaint;

1.7 any action taken in response to the complaint and to prevent a recurrence of the events giving rise to the complaint; and

2. retain the register for the duration of this licence.

32. (67-785) CONSTRUCTION OF LINER AND LEACHATE COLLECTION SYSTEM

The licensee must not dispose of waste into the Stage 3 area (excluding Stages 3A and 3B, as indicated in Figure 2.3 of the document entitled 'Nuriootpa Solid Waste Landfill Depot - Additional Information Requested by EPA' dated March 2002 prepared by Tonkin Consulting) unless:

1. a liner and leachate collection system has been constructed in accordance with:

1.1. the development approvals numbered (DA 313/0308/01 and DA 313/0574/99) granted on 5 April 2002; and

1.2 associated design specifications have been approved in writing by the Authority.

33. (67-1159) DESIGN AND CONSTRUCTION OF NEW STAGES/CELLS

The Licensee must:

1. No less than three months prior to construction of any new landfill stage or cell, submit a design specification for that stage or cell to the Authority for assessment.

2. Receive written approval from the Authority of that design specification prior to commencement or construction of any new landfill stage or cell.

3. Construct any new landfill stages or cells:

3.2. under the supervision of a Geotechnical Inspection and Testing Authority (GITA) in accordance with the requirements of level 1 supervision, described in Australian Standard 3798-2007, and

3.3. so that the underside of the base liner including any sump is no less than two metres above the maximum level of the underlying groundwater level at all times.

4. Prior to the disposal of any waste into the new cell or stage submit an 'As Constructed Report* to the Authority that demonstrates and includes certification from a GITA that the construction has been undertaken in accordance with paragraph 3 of this condition.

5. Must not receive any waste into the cell or stage unless written approval has been received from the Authority.

Closure & Post-closure Management Condition(s)

34. (67-786) CAPPING AND CLOSURE

The Licensee must:

1. close and manage the site after closure in accordance with the Nurioopta Solid Waste Landfill Depot Closure and Post Closure Plan, Ref 20060236RA1B, dated August 2006, prepared for Transpacific Waste Management by Tonkin Consulting; and

2. not exceed a maximum final height of 289 mAHD following completion of capping and rehabilitation works.

Monitoring & Reporting Condition(s)

35. (315-86) REVISE LANDFILL ENVIRONMENT MANAGEMENT PLAN (LEMP) 30-JAN-2012

The Licensee must:

1. prepare a revised and updated LEMP; and

2. submit the revised and updated LEMP to the Authority for assessment by the date indicated in the compliance date column.

36. (67-787) LANDFILL GAS MANAGEMENT AND MONITORING 31-AUG-2010

The Licensee must:

1. Take all reasonable and practical measures to prevent the emission of landfill gas from the Premises.

2. Ensure that the installation, testing and monitoring of landfill gas monitoring bores is undertaken by suitably experienced and competent landfill gas personnel.

3. Undertake monitoring of all landfill gas monitoring bores at the Premises on a quarterly basis;

4. Ensure that the landfill gas monitoring readings taken record:

4.1. methane concentration;

4.2. carbon dioxide concentration;

4.3. oxygen concentration;

4.4. landfill gas temperature and pressure; and

4.5. atmospheric temperature and pressure.

5. Provide all landfill gas monitoring results to the Authority within 14 days of receipt by the Licensee.

6. If maximum concentrations of landfill gas by volume in air exceed 1 % methane and/or 1.5% carbon dioxide at landfill gas monitoring locations:

6.1 immediately implement remedial measures and notify the Authority within 48 hours; and

6.2 undertake gas monitoring at a minimum of one monthly intervals until these exceedances are no longer recorded.

7. Submit a Landfill Gas Management and Monitoring Plan (the Plan) to the Authority for assessment and approval on or before the date indicated in the Compliance Date column that:

7.1 sets out measures that will be taken to ensure there are no exceedances of the maximum landfill gas concentrations as specified in paragraph six of this condition; and

7.2 includes interpretation of results and trends.

8. If the Plan is not approved by the Authority, resubmit a revised version of the Plan, addressing any issues raised by the Authority within 28 days of being so advised by the Authority; and

8.1 implement and comply with the Plan once it has been approved in writing by the Authority.

9. Ensure that bore logs are prepared for all bores, including all landfill gas test bores constructed within the landfill cells.

10. Ensure that all test bores constructed within the landfill cells are assessed for depth of waste within the landfill cell.

11. Submit a report of all bore logs to the Authority within 30 days of the installation of the gas extraction bores.

12. Where any other matter is not specifically provided for in this licence, operate the waste depot in accordance with 'Remove All Rubbish Co

37. (305-648) GROUNDWATER MONITORING

The Licensee must:

1. ensure that groundwater samples are collected from the locations marked GW1, GW2, GW3, GW4 and N3 as shown in figure 1 in the Golder Associates document entitled 'Groundwater and Surfacewater Monitoring July 2010 - Nuriootpa Landfill' dated 26 October 2010;

2. ensure that each groundwater bore is permanently marked (usually at the top of casing) to provide a consistent point from which groundwater depth is to be monitored;

3. ensure that the elevation of the permanent mark of every bore is established and recorded by a surveyor against the AHD or a local benchmark;

4. measure the depth to groundwater from the permanent mark on groundwater bores; GW1, GW2, GW3, GW4, N1, N2 and N3 on or about 1st of May and 1st November (note a four week buffer either side of these dates is considered acceptable);

5. ensure that groundwater samples are collected from the groundwater bores GW1, GW2, GW3, GW4 and N3 on or about 1st of May and 1st November (note a four week buffer either side of these dates is considered acceptable);

6. ensure that the collection of groundwater samples is undertaken in accordance with AS 5667.1:1998 Guidance on sampling groundwater, Standard Australia;

7. prior to each sampling event, measure the depth to standing water level at the bores;

8. analyse all of the groundwater samples for the parameters specified in 'Table 1 - Groundwater Monitoring Parameters' (attached);

9. during the collection of samples, measure and record pH, temperature, electrical conductivity, and either redox potential or dissolved oxygen;

10. during the purging of bore volumes ensure that:

10.1 between 4-6 times the internal volume of the bore is purged; and

10.2 the variations of field parameters (as listed in paragraph 9) are within those specified in Table 2 'Field Parameter Variation', (attached) prior to any groundwater samples being taken;

11. for each sampling event, record:

ensure that at least one duplicate sample, being two samples taken from the same bore, is collected annually, and that this duplicate sample is analysed at a laboratory not being the same laboratory at which the other samples are analysed;

ensure that the duplicate sample is analysed for the same range of analytes as the original sample;

where differences between the results of the duplicate groundwater samples are found to significantly vary (RPD > 20%) ensure that both samples be re-analysed.

GROUNDWATER REPORTING

The Licensee must submit a report to the Authority prior to the 30th of December each year on the implementation of monitoring required by licence condition 305-648, that sets out:

report identification;

EPA licence number and name of licence holder;

address of the licensees premises;

period covered by the report;

date of submission; and

details of the person responsible for preparing the report;

any deviations from the monitoring requirements of licence condition 305-648 together with a reason for those deviations;

5. an evaluation of all quality control information collected from the field during purging and sampling and analysis at the laboratory setting out:

5.1 data representativeness;

5.2 precision; and

5.3 accuracy;

6. a description on how the integrity of the groundwater samples were maintained;

7. a description of all analytical methods and the limits of reporting for each analyte reported;

8. a comparison against the results of the samples and the relevant water quality criteria in Schedule 2 of the Environment Protection (Water Quality) Policy 2003;

9. a conclusion which outlines whether any environmental harm has occurred to groundwater, and if so:

9.1 proposed actions to remedy this environmental harm,

10. any proposed changes to the monitoring requirements; and

11. if the Licensee considers that the variability between samples was trivial after being re-analysed and when compared against Schedule 2 of the Environment Protection (Water Quality) Policy 2003, provide a statement to that affect.

NOTE: Guidance on the preparation of monitoring reports is provided within the EPA Guideline titled 'Regulatory monitoring and testing -Reporting requirements' August 2007.

39. (67-1310) LEACHATE MANAGEMENT AND MONITORING

The Licensee must:

1. ensure that the head of leachate on the clay base liner in any parts of the landfill does not exceed 300 millimetres at any time;

2. monitor the head of leachate in leachate monitoring bores in all cells and stages and record:

2.1 weekly, when any contributing cells are operational;

2.2 monthly, when all contributing cells have an interim cover; and

2.3 quarterly, when all contributing cells have a final cap;

3. submit to the Authority as part of the annual reporting, required by condition 67-797 of this licence, for the previous 12 months:

3.1 all leachate level measurements (in metres AHD);

3.2 the corresponding height of the top of the clay liner at each measurement point in metres AHD; and

3.3 any remedial action undertaken to reduce the head of leachate including pumping records; and

4. if the maximum head of leachate in the sump of the liner exceeds the requirements of paragraph 1 of this condition, submit a report to the Authority covering paragraphs 3.1, 3.2 and 3.3 within 14 days of receiving the results.

40. (305-501) ACCREDITED LABORATORY FOR ANALYSIS

The Licensee must ensure that:

1. chain of custody documentation that details the movement of all samples from collection to analysis is completed;

2. all sampling of groundwater wells is undertaken by a person experienced in groundwater sampling and that all analysis is undertaken by a laboratory accredited by NATA for that analysis;

3. only containers approved by a NATA accredited laboratory are used for the collection and transport of samples; and

4. all samples to be analysed are to be done so within the holding period specified by the NATA accredited laboratory (refer to AS 5667.1:1998 Guidance on sampling groundwater).

NOTE. Guidance on the preparation of monitoring reports is provided within the EPA guideline titled 'Regulatory monitoring and testing -Groundwater sampling' June 2007.

1. a summary of Complaints and actions arising;

2. a summary of the results and interpretation and actions arising from Groundwater monitoring including levels;

3. a summary of the results, an interpretation and actions arising from Landfill Gas monitoring;

4. a summary of all Waste Soil received, stored and/or disposed;

5. progress towards final height (mAHD in each cell and stage) and any updates to stage or cell planning;

6. a summary of all incidents, fires and emergencies;

7. a summary of results and interpretation and actions arising from Leachate monitoring and management including chemical analysis, Leachate levels and pumping records; and

8. an updated plan of the Premises that shows the locations of:

8.1 operational cells, proposed future cells, and closed cells,

8.2. Landfill Gas monitoring and/or extraction bore network;

8.3. Groundwater monitoring bores, Leachate sumps, pipework and ponds, stormwater ponds and diversion networks; and

8.4. materials storage areas, buildings access roads, Premises boundary, fencelines and nearest sensitive receptors.

ADMINISTRATION

42. (400-338) CHANGE OF LICENSEE DETAILS

If the Licensee's name or postal address (or both) changes, then the Licensee must inform the EPA within 28 days of the change occurring.

43. (400-339) DISPLAY LICENCE

The Licensee must display a copy of this licence on a notice board at the Premises.

44. (400-215) LICENCE INFORMATION TO EMPLOYEES/CONTRACTORS

responsible for carrying out any task controlled by this licence is properly advised as to the requirements of this licence and the general environmental duty under section 25 of the Act that relate to that person's tasks and responsibilities as employee, agent or contractor.

45. (400-201) IMPOSE OR VARY CONDITIONS

The EPA may during the term of this licence impose or vary conditions:

1. in relation to testing, monitoring and reporting referred to in section 52(1 )(a) of the Act;

2. which require the Licensee, in accordance with section 53 of the Act, to prepare a plan of action to be taken in the event of an emergency;

3. which require the Licensee to develop an EIP as set out in section 54 of the Act and to comply with the requirements of the EIP;

4. which relate to provision of information relating to the Licensee or any agent or contractor undertaking any activity on behalf of the Licensee pursuant to this licence; and

5. which relate to provision of information relating to the activity subject to the licence including the levels of inputs and outputs and the amounts of pollutants or waste generated by the activity.

46. (67-721) CHANGE to PROCESS EMISSIONS or WASTE

1. The Licensee must not undertake any changes at the Premises that:

1.1 has the potential to increase the emissions, or alter the nature, of pollutants or waste currently generated by or from the activity, or

1.2 has the potential to increase the risk of environmental harm, or

1.3 would relocate the point of discharge of pollution or waste at the Premises, or

1.4 result in the construction of a new waste disposal cell at the Premises, or

1.5 extends the current waste disposal area,

unless the Licensee has:

2. made application to the Authority to enable an assessment of the likely environmental impacts of the proposed change, and

2.1 received written approval from the Authority enabling the proposed change to proceed.

47. (400-348) ALTERATIONS to PLANT and EQUIPMENT

The Licensee must:

1. not construct or alter a building or structure, or, install or alter any plant or equipment at the Premises, without written approval from the EPA, where such changes:

1.1 have the potential to increase the emissions, or alter the nature of pollutants or waste currently generated by, or from the licensed activity, or

1.2 have the potential to increase the risk of environmental harm, or

1.3 would relocate the point of discharge of pollution or waste at the Premises;

2. ensure that written application is submitted to the EPA on the EPA form entitled 'Application for Alterations to Plant and Equipment' that details the proposed changes; and

3. pay the prescribed application fee indicated on the Application form.

NOTES.

A. The EPA may during the term of this licence impose or vary the conditions of this authorisation upon approval of an application made in accordance with this condition.

48. (400-78) ANNUAL RETURN PROCESS

The Licensee must:

1. submit an annual return at least 90 days before the authorisation fee payment date, if this licence is for a term of two years or more; and

2. pay the annual authorisation fee by the authorisation fee payment date.

• Waste Fill means waste consisting of clay, concrete, rock, sand, soil or other inert mineralogical matter in pieces not exceeding 100 millimetres in length and containing chemical substances in concentrations (calculated in a manner determined by the Authority) less than the concentrations for those substances set out in Table 2 overleaf (but does not include waste consisting of or containing asbestos or bitumen - as defined in Regulation 3-lnterpretation under Part 1 of the Environment Protection Regulations 2009.

• Not containing significant organic material such as timber, vegetable matter or other waste materials.

• Intermediate Soil means waste consisting of clay, concrete, rock, sand, soil or other mineralogical matter and containing chemical substances in concentrations (calculated in a manner determined by the Authority) that exceeds the Waste Fill criteria, but is less than the concentrations for those substances set out for Intermediate Soil (and does not include other waste including asbestos or bitumen, nor any significant organic matter).

Notes regarding Table 2: Waste Soil - Chemical Characteristics

1. The assessment of the chemical analysis carried out on samples of the waste soil in accordance with this condition may include scientifically valid statistical analysis to justify classification of the waste soil (for total concentrations mg/kg) in accordance with the values listed in this table. Such statistical analysis may include 95% Upper Confidence Limit (UCL)
