Every day I hear political pundits blathering on about how California is “ungovernable”. They cite our budget deficit which has topped $19 billion. They show how our state run schools are failing to educate. They lament the exodus of business, both big and small from our state and bemoan the accompanying rise in unemployment for our citizens. While the people and businesses of the state are yoked with these problems, our legislators appear to be in perpetual dead-lock and fail to take necessary action to bring revenue and spending into balance. California’s problems are not going away. They are growing! Our current position is unsustainable and there appears to be no solution in sight. These and other factors have led the pundits to their conclusion about California being ungovernable. They urge us to pass measures to limit our freedom and make it easier for the state to govern us. They advocate that we

pass heinous propositions like the "On-Time Budget Initiative" which will do away with the two thirds supermajority needed to pass a budget. Their argument is that with a simple majority needed to pass a budget,

deadlock will be eliminated and all will somehow be right with the world. What the pundits fail to realize is that the problems in California have not arisen because we are ungovernable. The prob-

lems we are facing are the result of being overgoverned!

Making it easier for the government to raise our taxes will not cause the budget crisis to end. Raising taxes has been shown to slow growth and actually cause state revenues to shrink. More businesses will leave the state or simply close down. We are currently the highest taxed state in America. This is the only solution our legislators and their cheerleaders can come up with?

What the pundits fail to realize is that the problems in California have not

arisen because we are ungovernable. The problems we are facing are the

result of being overgoverned!

That’s what they want you to believe.

How do we rein in California’s Dysfunctional Government? People are right to be suspicious of their public officers. They take oaths to defend the Constitution. They sign pledges not to raise taxes. Then when they get into office they run rough shod over the rights they swore to uphold and raise taxes to fund the programs that deprive us of our liberties! Deceit and contempt for their constituents seem to be requisites for becoming an elected official in California. That has been the case, at least when it comes to representatives from the currently entrenched, state sanctioned parties. The Libertarian Party has shown itself to be the only real alternative to government expansionism wrought by politicians from the two major parties. We are the only ones who consistently defend the principles of individual liberty and the free market economy that made this country great. NO Libertarian office holder has EVER voted to raise taxes. Can that be said for Democrats OR Republicans?

The Libertarian Party stands for the sacred liberties that this country’s founders sought to protect. Since its beginning in 1971, the Libertarian Party has stood for the principles on which this country was founded… minimal government with maximum individual liberty.

To quote from the Libertarian Party’s website, “The Libertarian way is a logically consistent approach to politics based on the moral principle of self-ownership. Each individual has the right to

control his or her own body, action, speech, and property. Government’s only role is to help individuals defend themselves from force and fraud.” Tony Tyler is the Libertarian Party’s Candidate for California’s 59th Assembly District. Good Intentions are not enough Not only are good intentions not enough, they are a major source of the problem! The problems facing the state were not brought about by people who desired to hurt us. We were brought to our current financial situation by politicians who wanted to be everything to everyone. As the saying goes, Democrats want to be your mommy and Republicans want to be your daddy. It is time that we grow up and take responsibility for ourselves. It is time to end this perpetual childhood. We must end the cycle of dependence. California has the highest number of people on public assistance in the nation. Instead of helping people out of poverty and into independence, welfare has been shown to perpetuate dependence. Prolonged welfare dependence has actually been demonstrated to reduce children's IQ levels. Other known effects are decreased earnings in future years. In fact the longer a child remains on AFDC in childhood the lower will be his earnings as an adult, the greater their likelihood of dropping out of school. Before you jump to the conclusion that these effects are caused by the fact that these individuals were poor and that is what caused the subsequent problems, let me point out that studies show that these effects are caused by welfare per se, not simply poverty. A poor child without welfare will do better, in general and upon reaching adulthood, than a similar poor child with welfare. Programs meant to give people a hand up have actually held them back. With our current welfare system social mobility has been decreased! In this case, and in several others, good intentions are shown to exacerbate the conditions that they are meant to alleviate. Moral and principled solutions are needed. Not touchy feely simplistic approaches. We need to take personal responsibility for ourselves and our families. Social programs in our past were voluntary and effective. People gave through their churches or other volunteer groups to care for others. We need to return to the values of self sufficiency and volunteerism that these programs fostered. This is not an advocacy of programs like those during the Bush administration that were simply public/private hybrids that consumed tax dollars while doing nothing to eliminate the underlying problems of dependence. This is a call for the total elimination of state welfare! If this seems strange or radical, ask yourself “Why should we continue to run a costly enterprise that actually produces the opposite results than we intended?” and remember, your good intentions do not elevate anyone out of poverty.

The most pressing issue for California is the state of our economy. At one time California was ranked as the third largest economy in the world. At the last evaluation we were eighth, and falling. If things continue as they are we will be comparing our economy to those of Greece or Zimbabwe.Many people choose not to address the reality of this crisis and look for scapegoats. It has become popular to blame all the problems facing the state on illegal immi-grants. While illegal immigrants may have a net negative effect on our economy (I say may because several studies suggest a positive effect) even the most inflammatory studies have shown them to have less than 2-4 percent net drain on the economy. In short, we need to look elsewhere for the causes of our economic problems. Don’t worry. Even without blaming everything on illegal immigrants, there is still plenty of blame to throw around.

Problem: The Cost of Regulation. The excessively burdensome cost of regula-tions has become so exorbitant that even the most economically ignorant candidates are speaking out against it. In fact, several have called to curtail increases in the number of regulations and their concurrent costs. The problem is that none of them have a solution or even a plan of action to accomplish this. None except for Tony Tyler of the Libertar-ian Party!

Before getting to the solution, let’s first look at the problem. According to a study conducted by the Small Business Administration’s Office of Advocacy:• The direct cost of the regulatory environ-ment in California is $176.966 billion in lost gross state output each year. The direct cost does not account for second order costs.• The total loss of gross state output for California each year due to direct, indirect, and induced impact of the regulatory cost is $492.994 billion.• In terms of employment this total output loss is equivalent to the loss of 3.8 million jobs for the state each year. A loss of 3.8 million jobs represents 10% of the total population of California. In terms of labor income, the total loss to the state from the regulatory cost is $210.471 billion. Finally the indirect business taxes that would have been generated due to the output lost arising from the regulatory cost is $16.024 billion.• The total regulatory cost of $492.994 billion is four to four and a half times the total budget for the state of California, and almost five to six times the general fund alone. Further, given the total gross state output of $1.6 trillion for California in 2007, the lost output from regulatory costs is almost a third of the gross state output.• The total cost of regulation was $134,122.48 per small business in California in 2007, labor income not created or lost was $57,260.15 per small business, indirect business taxes not generated or lost were

$4,359.55 per small business, and finally roughly one job lost per small business.• The total regulatory cost of $492.994 billion translates into a total cost of $38,446.76 per household, or $13,052.05 per resident. The total cost per household comes close to the median household income for California.California was 49th among all states ranked from the friendliest to the least friendly for entrepreneurship in the Small Business Survival Index for 2008. Given these extra costs of operation, it is a wonder that any businesses choose to remain in California.

We see that the regulatory environment in California is a major problem. In addition to costing small businesses millions upon millions of dollars per year, these regulations cost millions of jobs! Ironically, the state is costing itself with these regulations. The indirect business taxes that would have been generated due to the output lost arising from the regulatory cost is $16.024 billion. That is Eightyfour percent of our current deficit!

The Solution. In 1978 the legislature, seeking to curb "an unprecedented growth in the number of administrative regulations", passed the Administrative Procedure Act (APA). This law established the Office of Administrative

Law (OAL) to oversee the regulatory process. This measure was touted as placing controls on what had been perceived as an explosive and uncontrolled growth in the power of bureaucrats to make law. The failing of this legislation arises in how the checks in regulation were implemented. The Office of Administrative Law was put in the executive branch. The OAL began to simply "rubber stamp" regulations and when the governor signed off on them, the regulations gained the force of law. The rate of proliferation was not slowed and currently outpaces pre-APA rates. The so-called "checks" on unbridled regulation provided by the APA became simply a means to distance lawmakers from the taint of passing unpopu-lar laws themselves. So... What is the solution? If the legislature has the power to delegate regulatory author-ity in this way, they have the power to take it back. The Administrative Procedure Act must be revised to require legislative approval for any and all regulations passed in California. It is the task of the legislature to legislate and the executive branch to administer the law. This measure will bring regulation one step closer to the constituents that it impacts and will make legislators more accountable to the voters.

Stop the insanity! Elect Tony Tyler.California is broken! Everyone knows that we are in a real mess and that we need real change (not B_S_ “Hope and Change”) to get out of it! Why aren’t our current elected officials offering sustainable solutions? There is an oft quoted aphorism that “The definition of insanity is doing the same thing over and over again and expecting different results.” Under this definition Californians would be downright certifiable. Our state looks like a Lewis Carroll nightmare! Why do we keep sending the same people with the same old tired ideas to the legislature to continue doing the same things that got us into the mess we’re in?It is time to stop hoping and start working to bring about the change that will keep this great state from plummet-ing over the precipice toward which our government has led us!

Neither the Republican nor Democrat parties have shown that they are up to the challenges that face us. The Democrat controlled

State Senate and Assembly have passed record breaking tax increases and overseen massive expansion in

regulations. We are subject to abuses from both state and federal governments. In the light of

our current suffering at the hands of Democrats, some people see the Republi-can party as the only force that stands between them and total state control of all aspects of their lives. They are wrong!Republicans have found themselves to be a minor party in California, but they have been given the power to check

government spending by the requirement of a 2/3’s majority to pass a tax increase.

Even with this powerful tool Republicans have shown that they are not up to the task.

Republicans in the state legislature have shown that they are more than willing to renege on

pledges and promises to their constituents and pass unpopular and government expanding tax increases. On top

of that, our Republican governor has signed off on these crippling taxes as well as excessively burdensome regulations.

Now things may get even worse! An initiative to lower the legislative vote threshold for passing a budget from two-thirds to a simple majority vote has qualified for the November ballot. This proposition goes by the misleading name "On-Time Budget Initiative" and would remove the miniscule safeguards set in place by the voters to curtail runaway tax increases. There is already a constitutional requirement to pass the budget on time, but legislators have failed to do so for 23 of the past 24 years. This initiative would simply make the legislature more likely to raise taxes and gives no incentive to cut spending.It makes it easier for them to do the easy thing and harder to do the right thing.

Unless the makeup of the legislature is radically changed, this initiative will deepen California’s financial crisis and will force even more jobs out of the state. We need a representative like Tony Tyler in the Assembly to stop (or at least slow) this outrageous government expansion.

Our state looks like a Lewis Carroll nightmare! Why do we keep sending the same people with the same old tired ideas to the legislature to continue doing the same things that got us into the mess we’re in?It is time to stop hoping and start working to bring about the change that will keep this great state from plummet-ing over the precipice toward which our government has led us!

Neither the Republican nor Democrat parties have shown that they are up to the challenges that face us. The Democrat controlled

State Senate and Assembly have passed record breaking tax increases and overseen massive expansion in

regulations. We are subject to abuses from both state and federal governments. In the light of

our current suffering at the hands of Democrats, some people see the Republi-can party as the only force that stands between them and total state control of all aspects of their lives. They are wrong!Republicans have found themselves to be a minor party in California, but they have been given the power to check

government spending by the requirement of a 2/3’s majority to pass a tax increase.

Even with this powerful tool Republicans have shown that they are not up to the task.

Republicans in the state legislature have shown that they are more than willing to renege on

pledges and promises to their constituents and pass unpopular and government expanding tax increases. On top

of that, our Republican governor has signed off on these crippling taxes as well as excessively burdensome regulations.

Now things may get even worse! An initiative to lower the legislative vote threshold for passing a budget from two-thirds to a simple majority vote has qualified for the November ballot. This proposition goes by the misleading name "On-Time Budget Initiative" and would remove the miniscule safeguards set in place by the voters to curtail runaway tax increases. There is already a constitutional requirement to pass the budget on time, but legislators have failed to do so for 23 of the past 24 years. This initiative would simply make the legislature more likely to raise taxes and gives no incentive to cut spending.It makes it easier for them to do the easy thing and harder to do the right thing.

Unless the makeup of the legislature is radically changed, this initiative will deepen California’s financial crisis and will force even more jobs out of the state. We need a representative like Tony Tyler in the Assembly to stop (or at least slow) this outrageous government expansion.

Every day I hear political pundits blathering on about how California is “ungovernable”. They cite our budget deficit which has topped $19 billion. They show how our state run schools are failing to educate. They lament the exodus of business, both big and small from our state and bemoan the accompanying rise in unemployment for our citizens. While the people and businesses of the state are yoked with these problems, our legislators appear to be in perpetual dead-lock and fail to take necessary action to bring revenue and spending into balance. California’s problems are not going away. They are growing! Our current position is unsustainable and there appears to be no solution in sight. These and other factors have led the pundits to their conclusion about California being ungovernable. They urge us to pass measures to limit our freedom and make it easier for the state to govern us. They advocate that we

pass heinous propositions like the "On-Time Budget Initiative" which will do away with the two thirds supermajority needed to pass a budget. Their argument is that with a simple majority needed to pass a budget,

deadlock will be eliminated and all will somehow be right with the world. What the pundits fail to realize is that the problems in California have not arisen because we are ungovernable. The prob-

Good Intentions are not enough Not only are good intentions not enough, they are a major source of the problem! The problems facing the state were not brought about by people who desired to hurt us. We were brought to our current financial situation by politicians who wanted to be everything to everyone. As the saying goes, Democrats want to be your mommy and Republicans want to be your daddy. It is time that we grow up and take responsibility for ourselves. It is time to end this perpetual childhood. We must end the cycle of dependence. California has the highest number of people on public assistance in the nation. Instead of helping people out of poverty and into independence, welfare has been shown to perpetuate dependence. Prolonged welfare dependence has actually been demonstrated to reduce children's IQ levels. Other known effects are decreased earnings in future years. In fact the longer a child remains on AFDC in childhood the lower will be his earnings as an adult, the greater their likelihood of dropping out of school. Before you jump to the conclusion that these effects are caused by the fact that these individuals were poor and that is what caused the subsequent problems, let me point out that studies show that these effects are caused by welfare per se, not simply poverty. A poor child without welfare will do better, in general and upon reaching adulthood, than a similar poor child with welfare. Programs meant to give people a hand up have actually held them back. With our current welfare system social mobility has been decreased! In this case, and in several others, good intentions are shown to exacerbate the conditions that they are meant to alleviate. Moral and principled solutions are needed. Not touchy feely simplistic approaches. We need to take personal responsibility for ourselves and our families. Social programs in our past were voluntary and effective. People gave through their churches or other volunteer groups to care for others. We need to return to the values of self sufficiency and volunteerism that these programs fostered. This is not an advocacy of programs like those during the Bush administration that were simply public/private hybrids that consumed tax dollars while doing nothing to eliminate the underlying problems of dependence. This is a call for the total elimination of state welfare! If this seems strange or radical, ask yourself “Why should we continue to run a costly enterprise that actually produces the opposite results than we intended?” and remember, your good intentions do not elevate anyone out of poverty.

The most pressing issue for California is the state of our economy. At one time California was ranked as the third largest economy in the world. At the last evaluation we were eighth, and falling. If things continue as they are we will be comparing our economy to those of Greece or Zimbabwe.Many people choose not to address the reality of this crisis and look for scapegoats. It has become popular to blame all the problems facing the state on illegal immi-grants. While illegal immigrants may have a net negative effect on our economy (I say may because several studies suggest a positive effect) even the most inflammatory studies have shown them to have less than 2-4 percent net drain on the economy. In short, we need to look elsewhere for the causes of our economic problems. Don’t worry. Even without blaming everything on illegal immigrants, there is still plenty of blame to throw around.

Problem: The Cost of Regulation. The excessively burdensome cost of regula-tions has become so exorbitant that even the most economically ignorant candidates are speaking out against it. In fact, several have called to curtail increases in the number of regulations and their concurrent costs. The problem is that none of them have a solution or even a plan of action to accomplish this. None except for Tony Tyler of the Libertar-ian Party!

Before getting to the solution, let’s first look at the problem. According to a study conducted by the Small Business Administration’s Office of Advocacy:• The direct cost of the regulatory environ-ment in California is $176.966 billion in lost gross state output each year. The direct cost does not account for second order costs.• The total loss of gross state output for California each year due to direct, indirect, and induced impact of the regulatory cost is $492.994 billion.• In terms of employment this total output loss is equivalent to the loss of 3.8 million jobs for the state each year. A loss of 3.8 million jobs represents 10% of the total population of California. In terms of labor income, the total loss to the state from the regulatory cost is $210.471 billion. Finally the indirect business taxes that would have been generated due to the output lost arising from the regulatory cost is $16.024 billion.• The total regulatory cost of $492.994 billion is four to four and a half times the total budget for the state of California, and almost five to six times the general fund alone. Further, given the total gross state output of $1.6 trillion for California in 2007, the lost output from regulatory costs is almost a third of the gross state output.• The total cost of regulation was $134,122.48 per small business in California in 2007, labor income not created or lost was $57,260.15 per small business, indirect business taxes not generated or lost were

$4,359.55 per small business, and finally roughly one job lost per small business.• The total regulatory cost of $492.994 billion translates into a total cost of $38,446.76 per household, or $13,052.05 per resident. The total cost per household comes close to the median household income for California.California was 49th among all states ranked from the friendliest to the least friendly for entrepreneurship in the Small Business Survival Index for 2008. Given these extra costs of operation, it is a wonder that any businesses choose to remain in California.

Ironically, the state is costing itself with these regulations. The indirect business taxes that would have been generated due to the output lost arising from the regulatory cost is $16.024 billion. The Solution. In 1978 the legislature, seeking to curb "an unprecedented growth in the number of administrative regulations", passed the Administrative Procedure Act (APA). This law established the Office of Administrative

Law (OAL) to oversee the regulatory process. This measure was touted as placing controls on what had been perceived as an explosive and uncontrolled growth in the power of bureaucrats to make law. The failing of this legislation arises in how the checks in regulation were implemented. The Office of Administrative Law was put in the executive branch. The OAL began to simply "rubber stamp" regulations and when the governor signed off on them, the regulations gained the force of law. The rate of proliferation was not slowed and currently outpaces pre-APA rates. The so-called "checks" on unbridled regulation provided by the APA became simply a means to distance lawmakers from the taint of passing unpopu-lar laws themselves. So... What is the solution? If the legislature has the power to delegate regulatory author-ity in this way, they have the power to take it back. The Administrative Procedure Act must be revised to require legislative approval for any and all regulations passed in California. It is the task of the legislature to legislate and the executive branch to administer the law. The failing of this legislation arises in how the checks in regulation were implemented. The Office of Administrative Law was put in the executive branch. The OAL began to simply "rubber stamp" regulations and when the governor signed off on them, the regulations gained the force of law. The rate of proliferation was not slowed and currently outpaces pre-APA rates. The so-called "checks" on unbridled regulation provided by the APA became simply a means to distance lawmakers from the taint of passing unpopu-lar laws themselves. So... What is the solution? If the legislature has the power to delegate regulatory author-ity in this way, they have the power to take it back. The Administrative Procedure Act must be revised to require legislative approval for any and all regulations passed in California. It is the task of the legislature to legislate and the executive branch to administer the law. This measure will bring regulation one step closer to the constituents that it impacts and will make legislators more accountable to the voters.

Stop the insanity! Elect Tony Tyler.California is broken! Everyone knows that we are in a real mess and that we need real change (not B_S_ “Hope and Change”) to get out of it! Why aren’t our current elected officials offering sustainable solutions? There is an oft quoted aphorism that “The definition of insanity is doing the same thing over and over again and expecting different results.” Under this definition Californians would be downright certifiable. Our state looks like a Lewis Carroll nightmare! Why do we keep sending the same people with the same old tired ideas to the legislature to continue doing the same things that got us into the mess we’re in?It is time to stop hoping and start working to bring about the change that will keep this great state from plummet-ing over the precipice toward which our government has led us!

Neither the Republican nor Democrat parties have shown that they are up to the challenges that face us. The Democrat controlled

State Senate and Assembly have passed record breaking tax increases and overseen massive expansion in

regulations. We are subject to abuses from both state and federal governments. In the light of

our current suffering at the hands of Democrats, some people see the Republi-can party as the only force that stands between them and total state control of all aspects of their lives. They are wrong!Republicans have found themselves to be a minor party in California, but they have been given the power to check

government spending by the requirement of a 2/3’s majority to pass a tax increase.

Even with this powerful tool Republicans have shown that they are not up to the task.

Republicans in the state legislature have shown that they are more than willing to renege on

pledges and promises to their constituents and pass unpopular and government expanding tax increases. On top

of that, our Republican governor has signed off on these crippling taxes as well as excessively burdensome regulations.

Now things may get even worse! An initiative to lower the legislative vote threshold for passing a budget from two-thirds to a simple majority vote has qualified for the November ballot. This proposition goes by the misleading name "On-Time Budget Initiative" and would remove the miniscule safeguards set in place by the voters to curtail runaway tax increases. There is already a constitutional requirement to pass the budget on time, but legislators have failed to do so for 23 of the past 24 years. This initiative would simply make the legislature more likely to raise taxes and gives no incentive to cut spending.It makes it easier for them to do the easy thing and harder to do the right thing.

Unless the makeup of the legislature is radically changed, this initiative will deepen California’s financial crisis and will force even more jobs out of the state. We need a representative like Tony Tyler in the Assembly to stop (or at least slow) this outrageous government expansion.
