Notice of Finding of No Significant Impact (FONSI)

The USDA, Rural Utilities Service has received an application for financial assistance from East Rio Hondo Water Supply Corporation. The proposal consists of relocating and increasing the size of an underground water transmission line adjacent to FM 2480 between FM 3069 and FM 510 in Cameron County, Texas. The proposed project is needed to comply with Texas Department of Transportation (TxDOT) regulations relating to a planned expansion of FM 2480, and to increase the water pressure for existing populations. An existing 6-inch waterline would be replaced with a 12-inch waterline along a new route.

As required by the National Environmental Policy Act and agency regulations, the Rural Utilities Ser-vice prepared an Environmental Assessment of the proposal that assessed the potential environmental effects of the proposal and the effect that the proposal may have on historic properties. The Environmen-tal Assessment was published on September 14, 2012 for a 30-day public comment period. No public comments were submitted to the Rural Utilities Service or the applicant during the 30-day comment period. Upon consideration of the applicant’s proposal, federal and state environmental regulatory and natural resource agencies, no effect determinations to historic properties and public input the agency has determined that the proposal will not have a significant effect on the human environment and for which an Environment Impact Statement will not be prepared. The basis of this determination is the review of all relevant environmental information pertaining to the proposed project area, and any comments from the public and regulatory agencies.

In order to avoid or minimize any adverse environmental impacts, the Rural Utilities Service will require the applicant to incorporate the following mitigation measures into the proposal’s design:

• The contractor shall work during normal weekday work hours from 7:00 am to 6:00 pm to reduce construction noise exposed to the adjacent properties. Work outside of this time schedule shall be limited to emergency repairs only.

• If cultural materials are encountered during construction, work shall immediately cease in the area of discovery. Work may continue in the project area where no cultural materials are present. The contractor shall immediately notify the consultant architect/engineer, the Texas Historical Commission (512) 463-6100, and the USDA Rural Development State Environmental Coordinator (254) 742-9789.

• The USFWS will be contacted immediately if a federally listed animal is seen in the project vicinity during construction activities. The USFWS can be contacted at 361-994-9005 (CCESFO) or 956-748-3607 (Laguna Atascosa National Wildlife Refuge) during normal business hours. After hours, 361-533-2797 Dr. Larisa Ford can be called.

• After completion of construction activities, a completion report will be provided to Dr. Larisa Ford at [email protected] , indicating if BMPs were employed properly by the contractor. A project comple-tion report will be submitted within 30 days after completion of work to Allan Strand, Field Supervisor, CCESFO, Texas A&M University at Corpus Christi, 6300 Ocean Drive, Unit 5837, Corpus Christi, Texas 78412-5837, summarizing all work completed.

• The contractor shall avoid locating horizontal boring entrance and exit pits outside of the line of vegetation bordering the resaca to avoid disturbance of vegetation that provides suitable cover, feeding and nesting sites for wildlife.

• If construction activities must occur during the bird nesting season of March through August, the contractor shall provide a survey for bird nests conducted by a qualified individual prior to commencing work. If nests are found, a no construction zone of a 75-ft radius will be marked and maintained around the nests until the birds have abandoned the site. The birds and nests are not to be disturbed.

EDINBURG – Hidalgo County Sheriff Lupe Treviño has arrested 36 Hidalgo County parents who violated court or-ders requiring them to pay child support. This week’s sweep was con-ducted in conjunction with the Texas Attorney General’s Child Support Division. This week’s sweep, which began Tuesday, targeted parents who are wanted for contempt of court because of their failure to pay child sup-

port. After holding a 5 a.m. briefing, Sher-iff Treviño dispatched teams of deputies to lo-cate and arrest the non-compliant parents be-fore they had a chance to leave their homes for the day. Child Support Division investigators aided the sheriff by pro-viding logistical assis-tance to locate missing parents.

Delinquent parents ar-rested on civil warrants face up to six months in jail. Cash bonds posted by delinquent parents seeking release from jail are paid to the cus-todial parents and chil-dren who are owed back child support.

To avoid the embar-rassment of arrest at

home or work, parents with child support war-rants should contact the Hidalgo County Sher-iff’s Office. Parents who have fallen behind on their child support payments – but are not subject to warrants for their arrest – should immediately contact the Attorney General’s Child Support Division at (800) 252-8014 to make payment arrange-ments.

Statewide, child sup-port collected by the Office of the Attorney General exceeded $3.4 billion for the state fiscal year that ended Aug. 31, 2012. Hidalgo County child support offices collected $113 million of that amount.
