North Carolina January 5- 8th. 1961 The Board of Medical Examiners of the State of North Carolina met January 5-8th. 1961, for the purpose of certifying the grades of the written examination for medical licensure given December 19-22nd. 1961, to interview applicants for licensure by endorsement and for special limited license and for other business. Thursda Jan ar 5th The Board convened for dinner at 7 P. M, Drs. Edwin A. Ras- berry, Jr. ~ President, J. B. Anderson, Thomas W. Baker. L. R. Doffer- myre, Thomas G. Thurston Carl V. Tyner and Mrs. Louise J. McNeill, Assistant Secretary-Treasurer were present. Dr. J. J. Combs. Sec- retary-Treasurer, was absent due to illness. Credentials for license by endorsement of credentials and spe- cial limited license were reviewed by the members of the Board. RE: Dr Robert Dean Philli s was granted special limited lic- ense to the University of North Carolina School of Medicine as a re- sident in plastic surgery and has applied for reinstatement of his special limited license. VERDICT: The Board ruled that the special limited license of Dr. Robert Dean Phillips be reinstated to cover him as a resident at the University of North Carolina School of Medidne, provided he fur- nish a letter of recommendation from his previous location and pay the fee of $10. 00 for the same. RE: W itten Examination December 1960 Certification - The Board canvassed the grades of the written examination given Decem- ber 19-22nd, 1960. All applicants made a passing average of 75% or more and the grades were certified. RE: Per Diem for S ecial Written Examination - Dr. Anderson moved that the members of the Board be paid a per diem of $50. 00 for this examination. This motion was duly seconded by Dr. Thomas W. Baker and passed unanimously. RE: Histor of the Board of Medical Examiners The Board was advised that the printing firm had held the type for this history for one year free of charge; that there are 240 copies on hand. VERDICT: Dr. Thomas W. Baker moved that the type of the History of the Board of Medical Examiners be destroyed. This motion was duly seconded by Dr. L. R. Doffermyre and passed unanimously. RE: D . Franklin B. Wilkins - (See previous Minutes) - Dr. L. R. Doffermyre reported that he had been advised by personal communi- cation that Dr. Wilkins is doing well in surgical pathology at Bowman' Gray School of Medicine. The copy of report required by Dr. Wilkins to the California Board of Medical Examiners was presented to the Board.

The Board convened for dinner at 7 P. M, Drs. Edwin A. Ras-berry, Jr. ~ President, J. B. Anderson, Thomas W. Baker. L. R. Doffer-myre, Thomas G. Thurston Carl V. Tyner and Mrs. Louise J. McNeill,Assistant Secretary-Treasurer were present. Dr. J. J. Combs. Sec-retary-Treasurer, was absent due to illness.

Credentials for license by endorsement of credentials and spe-cial limited license were reviewed by the members of the Board.

RE: Dr Robert Dean Philli s was granted special limited lic-ense to the University of North Carolina School of Medicine as a re-sident in plastic surgery and has applied for reinstatement of hisspecial limited license.

VERDICT: The Board ruled that the special limited license ofDr. Robert Dean Phillips be reinstated to cover him as a resident atthe University of North Carolina School of Medidne, provided he fur-nish a letter of recommendation from his previous location and pay thefee of $10.00 for the same.

RE: W itten Examination December 1960 — Certification - TheBoard canvassed the grades of the written examination given Decem-ber 19-22nd, 1960. All applicants made a passing average of 75% ormore and the grades were certified.

RE: Per Diem for S ecial Written Examination - Dr. Andersonmoved that the members of the Board be paid a per diem of $50. 00 forthis examination. This motion was duly seconded by Dr. Thomas W.Baker and passed unanimously.

RE: Histor of the Board of Medical Examiners — The Board wasadvised that the printing firm had held the type for this history forone year free of charge; that there are 240 copies on hand.

VERDICT: Dr. Thomas W. Baker moved that the type of the Historyof the Board of Medical Examiners be destroyed. This motion was dulyseconded by Dr. L. R. Doffermyre and passed unanimously.

RE: D . Franklin B. Wilkins - (See previous Minutes) - Dr.L. R. Doffermyre reported that he had been advised by personal communi-cation that Dr. Wilkins is doing well in surgical pathology at Bowman'Gray School of Medicine.

RE: Written Exami nat ion June 1961 - Letter from Dr. 'MansonMeads. Executive Dean of the Bowman Gray School of Medicine. was pre-sented to the Board. in which he requested consideration as to schedul-ing the annual written examination of the Board of Medical Examinersat an earlier date due to a change in the medical school curriculum.The Board was advised that the secretary had ascertained from the SirWalter Hotel that the ballroom in which the examinations are held wouldnot be available for another date.

The Board directed that Dr. Manson Meads be advised that theschedule has been set for 1961, and that this requested be placedon the June. 1960 agenda with regard to the 1962 examination.

RE: Dr Geor e W Melchior - The Board was advised that Dr.Melchior had returned to Mississippi to practice medicine in Pascou-goula; that his license was in effect there.

RE: E enses D Edwin A Rasberr J - Meetin of the Ameri-can Medical Colle e Association — The Board approved payment of Dr.Rasberry's expenses in the sum $165.23.

RE: State Medical Societ - Resolution as to treatment of drugaddiction — Information received from Mr. James T. Barnes, executiveDirector, was received as information.

RE: Ma 5 - 10th 1961 Meetin - The Boai'd was advised that re-servations for this meeting had been made at the Battery Park Hotel.

RE: Oct ber 1961 Meetin — Dr. J. B. Anderson moved that theBoard hold its October 1961 meeting at the Sedgefield Inn; that thesame be arranged by the president and secretary, the dates to be attheir discretion. This motion was duly seconded and passed unanimously.

RE: Januar 1962 Meetin - Dr. J. B. Anderson moved that theBoard meet at Mid Pines Club, Southern Pines, January ll-14th. 1962.This motion was duly seconded and passed unanimously.

RE: Dr Willard W Gri s — The Board was advised that Dr.Griggs expired November 1st. 1960.

Dry Thomas W. B,"-ker reported that he wrote Mrs. Griggs afterDr. Griggs died; that she replied and stated he died of congestiveheart failure; that she was very grateful to the Board for what ithad done for Dr. Griggs.

The Minutes for the October. 1960 meeting were approved as read.

burg, clinical and me4ical director at Edgewood, in the Army.I transferred to the Navy as a psychiatrist. I then transferredto Charleston and was transferred on account of polio in 1955. Iwent to the Medical College of South Carolina and took a year ofresidency in Medicine. They did not have a residency in Psychia-try there. I then went to Michigan and took two years of resi-dency in Psychiatry, instructor there one year, then went tothe Medical College as assistant professor in Child Psychiatry.I am on a year's leave of absence. I am board eligible in regularPsychiatry, but lacked a year in Child Psychiatry.

Dr lton Lane Bullard — (See Minutes October. 1960) - Pur-suant to notice from the California Board of Medical Examiners thatDr. Bullard's license to practice medicine had been revoked in thatstate because of alcoholism and failure to comply with the terms ofa suspended )udgment he was requested to appear before the Board andwas advised that he would bd placed under the surveillance of theBoard for five years.

On November 11th 1960. the Board received reports from NewtonGrove alleging that Dr. Bullard had acted in a manner unbecoming aphysician. an investigation was made by the State Bureau of Investi-gation at the request of the Boards and the following charges werebrought:

"1. That before March 5th, 1958 you were addicted to the use ofalcoholic beverages, and you consumed intoxicating liquor to theextent and in such manner as to impair your ability to practice medi-cine and surgery with safety to the public.

"2. That on or about July 10th. 1959 you were intoxicated and underthe influence of intoxicating liquor in Grover City, County of SanLuis Obispo State of California. to the extent and in such manneras to be dangerous to yourself, to other persons and to the publicand to the extent that such use impaired your ability to practicemedicine and surgery with safety to the public.

That in April. 1960 you were intoxicated and under the influenceof intoxicating liquor in California at various times to such an ex-tent that you were dangerous to yourself, to other persons and tothe public and to the extent that such use impaired your ability topractice medicine and surgery with safety to the public and that dur-ing said month you were convicted of operating a motor vehicle underthe influence of intoxicant.

"7. That in September October and November 1960 at Newton GroveN. C. and vicinity you were intoxicated and were under the influenceof intoxicating liquor to the extent and in such manner as to bedangerous to yourself to other persons and to the public and to theextent that such use impaired your ability to practice medicine andsurgery with safety to the publica

"8. That on November 6th, 1960 while attempting and purporting tobe attending patients and holding yourself out for the practice ofmedicine, you were intoxicated and were under the influence of in-toxicdting liquor to the extent and in such manner as to be dangerousto yourself, to the other persons and to the public and to the ex-tent that such use impaired your ability to practice medic:ine andsurgery with safety to the public; that at said time and place ycudrew a gun on and threatened to shoot a patient you refused toattend a patient and to deliver a baby for a patient, namely Mrs.David Sport. you refused to leave your clinic or office to examinea patient who needed and required your attention you drew a gunupon and threatened to shoot one Robert Allen Barefoot, you engagedin an affray with one Sherrill Knowles ~ and that you refused totreat and pulled a gun on another pa tient at said time and place.

"9. That your present mental condition renders you incapable ofsafely practicing medicine and impairs your ability to 'practicemedicine and surgery with safety to the public.

"10. That in the foregoing respects you have been guilty of dis-honorable conduct unworthy of and affecting the practice of yourprofession and grounds exist for the revocation of your license topractice medicine issued by this Board.

After Dr. Bullard left Newton Grove he was greated for alcohol-ism at the John Umstead Hospital, Butner.

RE: Dr James Arthur Brown. Cleveland North CarolinaDr. Brown came in for a routine interview. He stated that he sees hispsychiatrist monthly; that he is doing well and practicing. Dr. ThomasG. Thurston stated that he was doing a good medical practice.

VBRDICT: The Board directed that Dr. James Arthur Brown be seenin one year.

RE: Dr. John Samuel Hooker, Carrboro, North Carolina.Dr. Hooker came in for a routine interview. He stated that he wasgetting along all right; that his psychiatrist discharged him a yearago. Dr. Thomas G. Thurston stated that from all reports he is doingwell and he recommended that Dr. Hooker be seen in one year.

VBRDICT: The Board directed that Dr. John Samuel Hooker beseen in one year.

RE: Dr. Ra. ford Lee Weinstein Fairmont, North Caroiina — TheBoard received copy of report of joint investigation made by the FederalNarcotic Bureau and the State Bureau of Investigation in October, 1960.This investigation was precipitated by a report that narcotic addictswere alleged to visit Dr. Weinstein.

It was found on the investigation tnat Dr. Weinstein did not haverecords of dispensation. He had a large amount of narcotic drugs onhand. which did not appear in his inventory of June 13th. 1960 and hehad made no purchases since thit time. Dr. Weinstein was unable toaccount for this discrepancy. He said that the morphine sulfate tabletswere purchased when he had the Weinstein Clinic in Fiirmont seven toeight years ago and that when he discontinued the clinic he had keptall of the narcotic drugs for office use and had purchased only a fewnarcotics during the past few years. chiefly demerol.

Upon receipt of this report Dr. Weinstein was requested to appearbefore the Board. He appeared (See file for interview) and statedthat he had kept the drugs when he closed the Fairmont Clinic; thathe used very little drugs; that he did not sell narcotic drugs; thathe did not personally use narcotic drugs. He admitted having writtenprescriptions for two women who claimed to have kidney colic. He saidhe dispensed drugs and wrote prescriptions. Dr. Weinstein gave veryvague answers with no explanation as to the discrepancy in his June.1960 inventory and the amount of drugs on hand when the investigationwas made.

RE: Dr Johm Gambill «To summarize, on January 9th, 1960,the license to practice medicine of Dr. Gambill was revoked, judgmentsuspende4 Conditions of the said suspension were violated by Dr.Gambill and his license was revoked May 16th, 1960. On July 23rd1960, Dr. Gambill appeared before the Board to ask for help and adviceand he was advised to report to a neuropsychiatrist and be admittedfor institutional treatment. Dr. Gambill was admitted to the VeteransAdministration Hospital in Salisbury on August 23rd, 1960, as a vol-untary patient.

Dr. Gambill appeared at this time, stated that he had been do-ing well at the Veterans Administration Hospital; that he had week-ends off for the past three months; that on the 15th day of this monthhe would go on leave of absence, which would terminate his stay there,He said that he had been working Dr. Thomas G. Thurston to obtain aposition at the State Hospital; that Dr. John S. McKee, Jr. , Superin-tendant of the Broughton Hospital at Morganton, had said he wouldgive him a position if he could get a permit, which would begin Jan-uary 15th, 1961. He said that he had not had any trouble on hisweek-ends off. Dr. Thurston reported that Dr. Gambill had apparentlydone well with his work at the Veterans Administration Hospital.

He stated that he did not want to dogeneral practice, but was interested in public health work.

RE: Dr Samuel A Po e, Beulaville North Carolina - (See pre-vious Minutes) - On January 8th, 1960, Dr. Pope's license to practicemedicine in the State of N orth Carolina, following conviction in theSuperior Court for criminal abortion, was revoked.

Dr. Pope has appeared at this time, w'1th his attorneys, E. WalkerStevens and Henry L. Stevens III, to petition the Board for reinstate-ment of his medical license. He presented representatives from hiscommunity, including two physicians, stating that his services wereneeded and desired. He said that he had been taking courses at theUniversity of North Carolina School of Medicine and attended a symposiumat Bowman Gray School of Medicine.

VERDICT: Dr. J. B. Anderson moved that we postpone /udgment of theBoard for a later session. This motion was duly seconded and passedunanimously ~ (See P. these Minutes)

RE: Dr Oliver Wa ne Williamson Waggner, South Carolina - Dr.Williamson's license to practice medicine in the State of North Carolinawas evoked on July 26th 1958, following conviction in the FederalCourt for conspiracy to violate the narcotic laws and revocation of hisSouth Carolina medical license to practice medicine on June 24th, 1958.

RE: Dr J lian L nn Harris, Winston-Salem, North Carolina - Dr.Harris was indicted for assault with intent to commit rape, which chargewas changed by the presiding judge of the Superior Court in ForsythCounty to assault on a female as the evidence was not suf f icient forthe original charge to go to a jury. Dr. Harris was acquitted in thiscourt for assault on a female.

Dr. Harris was asked by the Board to come in so that they mightdiscuss the matter with him. He stated that he was a victim of blackmail;that he was approached by a friend of the accusing family with regardto paying money to keep out of court; that he emphatically declined to doso; that he had a witness to testify, who was in his waiting room at thetime of the alleged assault; that he was guilty of poor judgment in see-ing the patient at night and not having a nurse in attendance, and wouldnever be put in that position again. Dr. George W. Paschal, Jr. Chief of Surgical Service at St. Agnes Hos-pital was presented to the Board supporting Dr. Dayao's appeal and stat-ing the need for his serv ices. Mr. Ralph, .C. Bartlett, Direction of St.Agnes Hospital, appeared with Dr. Dayao and stated that since the hos-pital will close about April 1st, 1961, when the new hospital is com-pleted, he is asking that Dr. Dayao be allowed to stay on until that time;that his services are greatly needed. Dr. Dayao stated that he planned totake the examination of the Educational Council for Foreign Medical Grad-uates again in April.

RE: Dr Otto Heinrich S erl graduate of the University ofErlangen, Germany, in 1957 and a resident in Psychiatry at Duke Univer-sity School of Medicine, appeared to petition the Board for the privilegeof taking the written examination in June. Dr. Spoerl has the permanentcertificate of the Educational Council for Foreign Medical Graduates andis an immigrant. He stated that he had two more years of training atDuke; that he desired to take the examination as it had been several yearssince graduation; that he would not practice until training was completed.

VERDICT: Dr. L. R. Doffermyre moved that Dr. Otto Heinrich Spoerlbe allowed to take the written examination in June, 1961, contingentupon recommendation from Duke University School of Medicine. This motionwas duly seconded by Dr. J. B. Anderson and passed unanimously.

RE: Dr Anthon P ter Slewka, graduate of the University ofWestern Ontario, Canada, 1954, and a resident in Pathology at Duke Uni-versity School of Medicine, appeared to petition the Board for the pri-vilege of taking the written examination in June. He is in the process ofobtaining an immigration visa, which he expects in the near future. Hestated that he is considering practicing in the State of Virginia, butwishes to take this examination and his plans are uncertain.

"At a regular meeting of the Board of Medical Examiners of the State ofNorth C~rolina, on January 6th 1961, at Mid Pines Club, Southern PinesNorth Carolina, pursuant to notice to Alton Lane Bulla rd, M. D. , a hearingwas held upon the charges and accusations presented against him.

"After full consideration of the evidence and the statements of Alton LaneBullard, M. D. concerning the charges and accusations made at the hear-ing as appear in the record, the Board of Medical Examiners of the Stateof North Carol ina f ound and concluded that the respondent, Alton LaneBullard, M. D. ~ was guilty of dishonorable conduct unworthy of and affect-ing the practice of his profession and that grounds existed for the re-vocation of his license to practice medicine in the State of North Carolina.

"WHEREUPON it was ordered and is hereby ordered that the license of AltonLane Bullard, MD D. to practice medicine in the State of North Carolina berevoked and that he surrender his certificate of licensure issued bythe Board of Medical Exam iners of the State of North Carolina to the sec-retary of this Board but that this order and revocation be suspended andnot be put into effect upon the following conditions and provided:

"1. That for a period of three years he refrain from practicing medicinein any respect except in employment in and by an institution operated bythe State of North Carolina or the Federal Government;

"2. That for a period of three years he be and remain of good behaviorand not violate any state or Federal laws;

"3~ That during said time he obtain psychiatric therapy for such periodor periods of time as may be advised by a psychiatrist and

"4. That for a period of three years he personally report to the Boardof Medial Examiners of the State of North Carolina or one of its membersevery six months to show his compliance with the conditions upon whichthe order of revocat ion has been suspended.
