IN THE MATTER OF,

ELOY P. HARA,

THIS MATTER came before the Committee on Ethics & Standards (Hereafter referred

to as "Committee") on January 14,2010 and the Committee issued a Subpoena requiring the

Guam Police Department (GPD) to produce any and all records concerning any arrest or

conviction of Respondent from any jurisdiction, including but not limited to Guam and the U.S.

state of California which GPD had in its possession, custody and control. On January 15,2010,

GPD complied with said subpoena. Committee's Legal Counsel also conducted a records search

for any criminal records concerning Respondent from the Superior Court of California, County

of Sacramento. A list of the relevant documents from the subpoena and the records search, and

copies of said documents are attached herein and are as follows:

1. Exhibit A: Declaration of Custodian of Records for California Department of Justice

dated December 1, 2009.

2. Exhibit B: California Department of Justice Disposition of Arrest and Court Action

indicating that on January 13, 1982, in Case No. 58611F before the Superior Court of California,

Sacramento County, Respondent Plead Guilty to violating Section 459 of the California Penal

Code (Burglary) as a misdemeanor and that Respondent was sentenced to serve twenty-four (24)

months of probation, and to perform sixty (60) hours of community service within six (6) months

3. Exhibit C: Transmittal Letter from the Sacramento Police Department Records

Division dated December 1,2009.

4. Exhibit D: Respondent's Arrest Report describing his arrest at 12:20 a.m., on

November 25, 1981 for allegedly burglarizing the Wienstocks Department Store located at 1701

Arden Way, Sacto, California.

5. Exhibit E: January 13,2010 Notice from Superior Court of California, County of

Sacramento, that Court Records for Criminal Case No. 58611F were destroyed.

6. Exhibit F: Respondent's November 16,2009 GPD Firearm Identification Card

Application.

7. Exhibit G: Respondent's July 3, 2009 Affidavit to the Guam Election Commission.
